Commissioner Aguila stated that his intent in asking for further discussion is
that he wanted to make sure that everybody understood what his concerns were.
He expressed concern about what the neighbors to the south are going to see and
said they have the right to expect some protection from the City so that they
can enjoy their property without being infringed on. He stated that the design

views and that he could not support what was presented initially. He advised
that there are ways of making this work while protecting the residents from any
negative impact. He was concerned that there were no provisions shown on the
site plan for the required can wash, which is usually placed outside the site,
which is already jammed. He wondered where the applicant was going to put the
can wash. He noted that the landscaping on the south side to shield the view of
the building, which is not very aesthetically pleasing, is minimal.
Commissioner Aguila stated that he could be persuaded to support this project if
there was additional landscaping or preferably a buffer wall on the south side....'

JULY 19, 1994
Augy Vultaggio advised that he offered to put a wall in the back. However, the
Fire Department said they need access in case of a fire. Mr. Vultaggio was
willing to provide whatever the City wants. He said DOT will allow him to move
the entrance from the west side to the east side. He will move the dumpster
from the southeast corner to the northeast corner. He will provide a six foot
wall.
Commissioner Aguila asked Mr. Vultaggio to work out the details with staff. He
would like him to put the can wash close to the dumpster, somewhere away from
the residential.
Motion
Vice Mayor Matson moved to approve this, subject to the comments that were noted
here tonight and all the other staff comments.
City Manager Parker advised that the Santitation Department has not had a chance
to evaluate the change in the dumpster location. Therefore, they have not yet
approved it.
Commissioner Aguila would like the Sanitation Department to make an effOrt to
locate the dumpster as far a~ay from the residential~as possible.
City Manager Parker advised that another suggestion was made to use a compactor,

Mayor Pro Tem Bradley seconded the motion.
Commissioner Aguila stated that this project does not need to be held up or come
to a fonnal Commission meeting, but he would like to see the revised plans.

640 W. Boynton Beach Boulevard; south side of Boynton Beach
Boulevard across the street from the Texaco gas station at
Industrial Avenue and Boynton Beach Boulevard.
Concurrency: Concurrency certification is required as part of site
plan approval of the project. Commercial projects require
certification for traffic and drainage levels of service only.
a. Traffic - The Palm Beach County Traffic Division has
determined that the project meets the Traffic Performance
Standards of Palm Beach County.
b. Drainage The City of Boynton Beach Engineering
Department has indicated approval of drainage when
-drawings are revised to address their comments.

Driveways: Two, two-way drives are proposed. One of the two-way
drives (north side of property) provides access onto SR 804
(Boynton Beach Boulevard) and is restricted to right turn only,
into and out of the driveway. Due to an existing median within
Boynton Beach Boulevard, no access from, or to, eastbound lanes is
able to be made directly from this site. The second, two-way drive
provides access to and from N.W. 1st Avenue (south side of
property) .
Parking Facility: Fifty (50) parking spaces are provided (48
standard and two handicap). The city code requires 48 spaces, two
of which must be handicap.
Landscaping: The applicant is providing perimeter and parking site
landscaping per code. Please see landscape plan.
Building and Site Regulations: The site is located in the C-2,
Neighborhood Commercial, zoning district and conforms to the
district requirements. The "yet to be determinedll retail space
must be reviewed against code requirements at time of occupant
selection.
Community Design Plan: The site is located in the Mediterranean
Spanish Design District. The building meets the Mediterranean
District requirements.

The Engineering Department for the City of Boynton Beach, Florida
is in receipt of tt~e amended plans for the 2nd review of the above
referenced project.
The City Engineer has requested that I correspond with you and
notify you of the following:

1. Reference Engineering Department Memorandum No. 94-117, dated
April 20, 1994 with attached Lawson, Noble & Associates, Inc.
memo dated April 18, 1994, the applicant has not complied with
City Engineer's comment #1 and shall therefore depict upon
plans a break in curbing to allow drainage conflict in curbing
length between civil/architectural plans at the parking
facility's southeast corner.
2. Comment #2 of the City Engineer's memo regarding an inlet
located in conflict with a live oak tree on plan sheet A-2 has
not been resolved by the applicant.
Additionally, I herein forward to you a May 10, 1994 letter from
Mr. Dan Weisberg, P.E., Senior Registered Civil Engineer with Palm
Beach County Traffic Division indicating that the County has
several technical problems with the study. As a condition of
approval, the Engineering Department recommends that this issue be
resolved prior to this project moving forward to the reviewing
Boards.
The amended plans for 2nd review are herein returned pursuant to
City policy.

The Palm Beach County Traffic Division has reviewed the traffic statement for the

There are several technical problems with the study.
- The study does not consider pass-by traffic when calculating daily traffic.
- The study does not address all roadways within one mile of the project.
- There is no stated build-out date.

project meets the Traffic Performance Standards of Palm Beach County. If you

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the second review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Department for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. Two signed and sealed sets of drawings are still required.
2. Unity of title is still required and must be obtained prior to
building permit being issued.
3. Buffer wall still must be moved farther west or a variance
obtained.
4. Please delete from the drawing the compact car comments on the
first diagonal space from the buffer wall (south side).
5. Please indicate on the drawing the maximum spacing for trees.
6. Drawings need to be made consistent with each other,
particularly with respect to curbs around parking area. The
site plan must show all features.

II. RECOMMENDATION(S):
1. To reduce the impact of the blank wall facing the residences
located south of the project, add a decorative roof treatment
over the doors located on the south side of the building.
2. Consider an alternate location for the dumpster enclosure that
would be as far away from the residences as possible.
NOTE: If recommendations are approved, incorporate them into the
working drawings required for permits for the project.

As subject documents worked their way through the review process
Engineer Ron Last and Mr. Finizio both offered comments. Two of
those comments appear to remain unresolved. The first one appears
as #1 on Mr. Last's April 18, 1994 comment memo and related to a
requested curb break near the dumpster to permit stormwater from
the property to drain into a nearby inlet. The other comment
appeared as #3 on the same Last memo. '
Taken together, they represent overall concerns over the spillage
of stormwater onto NW 1st Avenue directly to the south of subject
property. One solution would be accomplished by berming along the
southern part of the property to direct water to inlet, plus
raising the south driveway sufficiently to prevent direct
discharge. Other methods accomplishing the same goals may be
available.
Whatever solution is proposed must be depicted on documents for
review by this office.

Please place the above-referenced item on the City commission
agenda for June 21, 1994 under Development Plans, Non-consent
Agenda.
DESCRIPTION: This is a request for site plan approval to
construct a 2,888 square foot restaurant and 3,775 square feet of
undesignated, commercial space on a .78 acre parcel of land at
640 W. Boynton Beach Boulevard, zoned C-2, Neighborhood
Commercial. Two, two-way driveways are proposed; one onto
Boynton Beach Boulevard and one onto N.W. 1st Avenue. The
proposed building meets the requirements of the Mediterranean
design district in which it is located. A buffer wall, required
between residential and commercial zoned properties, is to be
constructed alon~ the east property line.
RECOMMENDATION: The Planning and Development Board, with a vote
of 5 - 1, recommends denial of this site plan request. The Board
expressed concern over the lack of a buffer wall along the south
side of the property (adjacent to N.W. 1st street), the proposed
driveway entrance onto N.W. 1st street (a local, public right-of-
way primarily serving the residential neighborhood to the south),
the noise and odor impacts on the adjacent residential
neighborhood and the intensity of the use considering the size of
the property,

The Engineering Department for the City of Boynton Beach, Florida
is in receipt of the amended plans for the 2nd review of the above
referenced project.
The City Engineer has requested that I correspond with you and
notify you of the following:
1. Reference Engineering Department Memorandum No. 94-117, dated
April 20, 1994 with attached Lawson, Noble & Associates, Inc.
memo dated April 18, 1994, the applicant has not complied with
City Engineer's comment #1 and shall therefore depict upon
plans a break in curbing to allow drainage conflict in curbing
length between civil/architectural plans at the parking
facility's southeast corner.
2. Comment #2 of the City Engineer's memo regarding an inlet
located in conflict with a live oak tree on plan sheet A-2 has
not been resolved by the applicant.
Additionally, I herein forward to you a May 10, 1994 letter from
Mr. Dan Weisberg, P.E., Senior Registered Civil Engineer with Palm
Beach County Traffic Division indicating that the County has
several technical problems with the study. As a condition of
approval, the Engineering Department recommends that this issue be
resolved prior to this project moving forward to the reviewing
Boards.
The amended plans for 2nd review are herein returned pursuant to
City policy.

3. Please show proposed utility easements for fire hydrant
and relocation of existing 2" water main.
4. Show the existing utility easement on site, all of the
above and previous Utility Department requests on your

5. Proposed utility easements shall be a minimum of 10',

The following is a list of 1st review comments regarding the Site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compliance on the plans and/or documents submitted for second
(2nd) review in order for the project to continue through the
site plan review process. The second set of comment(s) are
recommendations t~.at the Planning and Zoning Department staff
believe will enhance the proposed development. The applicant
shall understand that all documents/plans submitted for site plan
and/or permit review are subject to additional comments. I
recommend that the applicant/ agent contact me regarding
questions related to the comments. If the applicant is not
intending to correct code deficiencies they should contact me
regarding the procedures, application forms, fees and submittal
deadline dates for seeking relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. Specify the height of the dumpster enclosure shown on the
Walter Cornnell plans.
2. Amend the striping detail drawing shown on the Walter
Cornnell plans to be consistent with the City standards.
[Find attached City Standard drawing B-90012.]
3. Setbacks are measured from the property line to the leading
edge of the structure. The east side setback required for
the subject property is thirty (30) feet. The drawings
indicate the proposed east side setback will be twenty-seven
point thirty three(27.33) feet. Amend the plans
accordingly. [Appendix A-Zoning section 6 B.3]
4. To unify all the lots described on the survey, obtain from
the Building Department, and complete and submit to the
Building Department, a unity of title form. Provide a copy
of the City accepted form to the Planning and Zoning
Department.
5. The required buffer wall located along the east property
line shall be adjusted so that it is setback, onto the
subject property, two (2) feet. Amend the section view
drawing and the site plan drawing to correctly identify the
location of the wall. Add to both drawings the required two
foot setback dimension. [Appendix A-Zoning section 4 L]

6. Amend the shape of the parking area between the buffer wall
and the first diagonal parking space located southeast of
the building. Diagonal parking spaces shall have a minimum
of eighteen (18) feet back-up distance measured back from
the drivers side ingress edge of the space. providing the
eighteen foot back-up space will require omitting one (1)
parking space. The required back-up space may be in front
of the dumpster enclosure considering the refuse pickup area
is a low use area. The total number of required spaces will
not be in jeopardy considering fifteen surplus spaces will
be remaining above what is required. [Chapter 5 Article x
section 5-142 (h) (4)]
7. The maximum spacing of trees required as part of the vehicle
use area screening along the public right-of-way is forty
(40) feet on center. Add to the landscape plan one (1)
native tree in both landscape strips located along the north
and south property lines. Provide a typical forty foot on
center dimension between trees along both rights-of-way.
[Landscape Code section 7.5-35 (d)]
8. Identify the color number and manufacture's name for the
following colors identified on the elevation view drawings:
a. Red - S-tile roof covering,
b. Mauve - stucco band (at the top of the parapet wall),
and
c. Oyster White - medium texture stucco wall finish
9. Specify the color, color number and manufacture's name for
the following exterior finish material:
a. Mansard fascia and soffit,
b. material proposed and shown directly below the window
units,
c. decorative handrails,
d. window and door frames, glass and solid doors located
at the rear of the building,
e. downspouts,
f. ceramic tile inserts,
g. decorative light fixtures (submit cut sheet for the
fixtures), and
h. arched stucco band

10. As indicated on the community design district map, the site
is located in the Mediterranean/Spanish design district.
Amend the elevation view drawings of the building to
incorporate into the design an additional architectural
feature and treatment using Appendix II. Boynton Beach
Community Design Plan Standards as guide. Find attached
Appendix II.
11. Amend the streetscape landscaping along both rights-of-way
to incorporate some landscape material identified in
Appendix III of the Community Design Plan. Find attached
Appendix III.

II. RECOMMENDATION'S):
1. Considering the project is a shopping center, I recommend
proposing the type and location of tenant wall (building)
signage. The following factors should be considered in
designing the sign package:
a. The sign should create visual harmony with the
architecture of the building and the surrounding
buildings.
b. The scale of the sign must be consistent with the scale
of the building and the surrounding buildings.
c. The overall effect of the configuration or coloring of
the sign shall be consistent with the appropriate
architectural theme as specified in the Community
Design Plan.
d. The colors of the signage shall be complementary with
other signs on the building and the adjacent
properties.
Proposing specifications for the following elements of
signage with consideration given to the above factors will
create a sign package:
* type of signage - ex. detached channel letters, cabinet
sign, etc.,
* letter style - ex. helvetic bold, script???,
* sign face material and color of same,
* color of returns and trim cap,
* color of the material that is located between the back
of the sign and the face of the building,
* display of logos and color of same,
* size - ~hall not exceed the Sign Code specifications,
and
* location of the wall signage on the building.

2. The above sign factors are applicable for the proposed free
standing sign. However, the location standards and other
requirements for installing a free standing sign are
specified in the Sign code. Free standing signs are mounted
to or incorporated into a structure placed on finish grade.
This structure shall also follow the above factors. There
are many types of signage that may be used to identify and
advertise the proposed businesses. All signage should be an
aesthetic form of communication. [Sign Code section 21-21]
3. Add a note to the elevation view drawing stating that the
height of all roof mounted mechanical equipment and/or other
appurtenances attached to the roof will no be above the
height of the parapet wall.

SUBJECT: Augy's Italian Restaurant - First Review
Staff has reviewed the above referenced project and offer the
following comments:
1. Two inch water main, currently in existing 5" utility
easement shown on your survey, should be properly
removed or abandoned in place and reconnected to an
existing water main on Boynton Beach Blvd. or NW 1st
Avenue to maintain the looped system.
2. Specify size of water meter. The Reservation Fee will
be required within 30 days of Commission approval based
on the size of the new water meter, Sec. 26-34(e).
3. An appropriate backflow preventor will be required on
domestic water service near proposed water meter
location (first connection after water meter, provide
installation detail), Sec. 26.107.
4. A fire hydrant shall be within 200' of all points on
every commercial building, Appendix C, Art.x, Sec.16.
5. unobstructed access to utility facilities must be
provided (see Sanitary Sewer Connection/Landscape
P I an), S e c. 2 6 . 33 ( a) .
It is our recommendation that the plan not proceed through the
review process until items 1, 2, & 4 are adequately addressed.

However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be ty~ed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project,
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.

Attached is the amended site plan submittal for the above referenced
development for your final review and recommendation.
We would ask that you review this amended site plan documents to determine if
the plans have been adjusted to satisfy comments made previously by your
department.
If the comments have been satisfied or if your comments can be met at time of
building permit, please advise the Planning and Zoning Department in writing.
If your comments have not been met or must be met by correcting the site plan
again, please advise the Planning and Zoning Department in writing.
Finally we would ask that you recommend to us if the plan should be forwarded
to the Planning and Development Board/Community Redevelopment Advisory Board
for review or held for further revisions by the applicant. All correspondence
shall be received by the Planning and Zoning Department per the following:
Please return your memo and the amended plans to the Planning and Zoning
Department by 5:00 P.M. on May 20, 1994,

SITE PLAN REVIEW
Section 7. Submission Require.ents.
Each applicant shall submit to the Planning and Zoning Department
the following plans and exhibits in the number of copies
specified by the Planning and Zoning Department, together with a
site plan Review application and a fee adopted by resolution by
the City Commission,
7.1. Existina site characteristics .aD: A recent certified
property survey showing all adjacent streets, alleys and
driveways, and also illustrating:

Existing natural features, including but not limited-
to lakes, trees and other vegetation and soils and
topography,
Existing buildings, building elevations, other
structures, including use, height, dimensions and
setbacks.
