The undersigned hereby petitions the Planning and Zoning Board to
grant to the petitioner a variance to Article X "Parking Lots",
of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
(h), (3): No parkin lot drivewa ma be constructed closer

Nature of Variance Requested: To reduce the 180 feet requirement cited
above to 165 feet (approximate) between center-lines of the new access drive
and S.E. 28th Avenue/South Driveway.

It is proposed to eliminate the existing north driveway which is considered to be
potentially dangerous because of its proximity to the southbound merge lane, and
the crest of the hill to the north on Seacrest Blvd. The new location will rovide
a onger turn deceleration lane, will avoid the existing conflict of the merge and
deceleration lanes, and will exceed the required sto in si ht distance from the

The undersigned hereby petitions the Planning and Zoning Board to
grant to the petitioner a variance to Article X "Parking Lots",
of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
SECTION 5-142, (h), (5): The minimum distance from the street right-of-way
line at any major ingress or egress driveway to any parking stall or to any
parking stall or to any interior access aisle having direct access to such
driveway shall be one hundred (100) feet.
Nature of Variance Requested: That the proposed and existing driveways
to this church parking lot not be considered "Major Driveways". By City Code
definition (Section 5-141 (f) ), the proposed new driveway is NOT a Maior
Driveway and therefore the 100' requirement is not applicable. Request
elimination of the 100' requirement and allow the 35' distance which now exists.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary) :
The 100 foot requirement to the first aisle or parking stall would render this
site unusable because of its depth. The proposed new ingress does not alter
the flow of traffic within the parking lot as it presently exists. The existing
driveways, access aisles, and parking lot layout were permitted by the City and
constructed in 1983-84. If this request is granted it will allow the parking
lot to function as it has since its construction, and will not be contrary to
public interest or welfare, and will not be injurious to the environment or
neighborhood.
