Mr. Desiderio:
Please be advised that on Tuesday, February 11, 1992, the
Planning and Zoning Board conducted a public hearing at which
time they approved your request for a variance to Section 5-142
(h) (3) Driveways of Article X, Parking Lots, subject to staff
comments and with the following stipulations:
1. The driveway be constructed to allow one-way right turn
only into the site from Federal Highway
2. The city Engineer review the design.

VARIANCE REQUEST
At the January 28, 1992, TRC meeting a variance request for a driveway accessing
U.S. , for the Atrium Place project was discussed, The engineerIng department is not
opposed to the variance If the driveway access cranted is a right in only oH
southbound U.S.1 (ingress), with no egress from the development to southbound U.S.
1. The enginQaring department Is opposed to any outbound traffio to U.S. 1 at th!s
location because of the proximity to the median cut on U.S. 1 south of the driveway
(122 feet to 26th circle). Unsafe traffIc weave patterns Will result from exiting traffic
attempting U-Turns at this median cut.
Traffic wishing to proceed northbound on U.S. 1 may access this same intersection by
using the existing driveway on the south side of Atrium Place which accesses 26th
Clrcle west of U.S.1.

I have applied for a variance to have a driveway constructed
in order to have direct access to the Federal Highway for the
Atrium Place, 2755 So. U.S. Hwy 1, Boynton Beach.
If this variance is approved the second floor will
be rented or leased for office use only not to exceed
1:300 (1 parking space per 300 gross sq. ft.)
If graated this letter will be redrafted.

Dear Mr. Desiderio:
As a confirmation of our telephone conversation on Friday, you
should contact the planning department to apply for a variance
from the TRC at the January 1992 meeting. There is a fee the
variance request. The TRC will review the merits of the right
in, right out driveway onto Federal Highway once you submit
documentation similar to the plan I am returning to your with
this letter. Similar driveways appear to exist in the area north
of your development, so there appears to be a possibility the
variance might be granted. However, there is no guarantee the
TRC1 Planning and Zoning Board or the City Commission will
approve any variance for your site.
