Dear Mr. Scharf:
The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of' the date of this letter. (If amended plans are not
submi tted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the proj ect or \'1ill be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
In order to meet the July 12th Planning and Development Board
meeting schedule, you may mark the twelve (12) copies of the
submitted drawings following the June 14th TRC meetingsr otherwise,
the following sequence must be followed.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi tted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for a second review and
the reviewers will recommend if the site plan will be placed on a
board meeting agenda for approval (see attached meeting schedule) ,
If there are major comments not addressed by new plans or the
reviewers recommend that the plan n':>t be forwarded through the
ap~roval scheduler this office will notify you of your alternatives
regarding the site plan as soon as possible.

The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete fJr
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted ty the
Planning and Zoning Department.

Submit an amended Site Plan Review/Conditional Use application form th~t
reflects the changes that were made as a result of amending the pLans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with ~
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from thE
applicant stating same must be turned in with the amended submittal.

Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title ~f
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 ~f

Submit color photographs of the buildings on the site that are to remai~
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property,
The minimum size is 5" by 7". Each photograph shall be labeled t::~
identify the location of the existing structures with respect to the
location of the proposed project.
Submit colored elevation view drawings - a colored duplicate copy of 311
d::.:-awings of the elevation views of each side of all bUildings ar,d
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference nurnbe~
identified. The type of exterior surface material shall be identifi?d
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of any kind.
Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name:.lld
numerical/letter code from an established color chart.

On May 27, 1994, your submittal for Site Plan Review of the above
referenced project was reviewed for completeness. It has been
determined that the submittal is substantially complete and accepted
for further processing. A Planning & Zoning Department staff member
will be responsible for the review and coordination of your site
plan through the remainder of the Site Plan Review process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, section 8 and all applicable sections
of the Boynton Beach Code of Ordinances. The results of the review
will be available to you on Monday, June 13, 1994. The submittal of

In regard to our conversation earlier today, we are resubmitting twelve (12) sets of drawings for
the Site Plan Review Process. These plans are the same as previously submitted on April 29,
1994, except for a minor revision to the exterior elevation on Sheet A-3.
We have also included the review fee of $750, a revised colored elevation, a sample of the
accent tile for the sample board and two copies each of review letters from the Lake Worth
Drainage District and the South Florida Water Management District.
The Cross Access Agreement and Unity of Title are being generated by the Owner and will be
provided for the next submittal date.
It is our understanding that you will attempt to expedite the review process so that we fit into

This Declaration o~ Easements, Covenants and Restrictions,
made and executed this /'~ day of November, 1991 by BOYNTON PLAZA
SHOPPING CENTER, INC., a Florida corporation (hereinafter referred
to as "GRANTOR") end BARNETT BANK OF PALM BEACH COUNTY, a Florida
corporation (hereinafter referred to as "GRANTEE")

WHEREAS, GRANTOR is the owner of the real property
(hereinafter referred to as "the Shopping Center") more particularly
described on Exhibit A, annexed to and forming a part hereof; and
WHEREAS, GRANTEE is about to acquire the real property
(hereinafter referred to as "the Outparcel") more particularly
described on Exhibit B, annexed to and forming a part hereof; and
WHEREAS, in order to provide a coordinated and integrated
development of the Shopping Center and GRANTEE's improvement of the
Outparcel, the parties hereto desire to create perpetual,
non-exclusi ve ingress, egress and access easements for both
vehicular and pedestrian traffic and a non-exclusive parking
easement for ten (10) contiguous parking spaces on the parking and
common areas located within the Shopping Center; 'and to provide for
certain covenants and restrictions respecting such easements.
NOW THEREFORE, for and in consideration of the premises, the
easements, covenants, conditions and restrictions herein created,
and other good ar,d valuable considerations in hand paid by each of
the parties hereto to the other, GRANTOR and GRANTEE do hereby
declare that the Shopping Center and the Outparcel are and shall be
held, transferred, sold, conveyed, used and occupied subject to the
easements, covenants and restrictions hereinafter set forth.
1. Grant of Easements.
A. GRANTOR does hereby grant unto GRANTEE and to the
successors and assigns of GRANTEE, a perpetual non-exclusive
easement for ingress and egress and access and a non-exclusive
parking easement for ten (10) contiguous parking spaces as shown on
Exhibit "C" attached hereto for the use and benefit of GRANTEE, its
customers, invi tees, licensees, lessees, employees, successors and
assigns, for vehicular parking, vehicular and pedestrian ingress and
egress, over, upon and across those portions of the parking areas
and common areas of the Shopping Center.
B. GRANTOR shall have the right to redesignate "thf!\
location of such ten (10) parking spaces at any time and -' in
GRANTOR's sole discret,iollo provided, however, that any ,of ~ such

in the event that GRANTEE, its successors or assigns shall use the
Barnett Parcel (as described on Exhibit "0" annexed hereto and made
a part hereof) for any other purpose than as a banking facility or
for general office uses.
2. Prohibition Against Barriers.
A. GRANTOR and GRANTEE, for themselves and for their
respecti ve grantees, successors and assigns do hereby covenant and
ag ree, one wi th the other, that no curb, barrier, fence or hedge
shall be located on the common boundary between the Shopping Center
and the Outparcel or elsewhere in the Shopping Center so as to
unreasonably interfere with or obstruct (i) pedestrian or vehicular
ingress and egress between the Shopping Center and the Outparcel, or
(ii) the visibility of the Outparcel and GRANTEE's improvement
thereto from the Shopping Center or the rights-of-way existing at or
about the Outparcel or the Shopping Center.
B. GRANTOR and GRANTEE acknowledge and agree that the
barriers contemplated on GRANTEE's site plan annexed hereto as
Exhibit "E" and forming a part hereof do not violate the
prohibitions against barriers set forth in Paragraph 2.A. hereof.
3. Restriction on Use of Outparcel. GRANTEE
and agrees that the Outparcel being conveyed to
conditioned upon the restriction that the Outparcel may
as a surface level parking lot.

4. General Provisions.
A. The invalidation of any of the provisions of this
Declaration by judgment or court order shall in no way affect any of
the other provisions hereof and such remaining provisions shall
continue in full force and effect.
B. The easements, covenants, restr ictions, benef i tS
and Obligations established hereunder shall run with the land and
shall bind and inure to the benefit of the parties hereto, their
respective heirs, personal representatives, lessees, successors,
grantees and assigns, except to the extent the same may be
terminated pursuant to the terms and conditions contained herein.
C. This Declaration shall be construed and enforced
in accordance with the laws of the State of Florida.
D. In the event of any litigation between the
parties hereto ar1s1ng out of this Declaration of Easements,
Covenants and Restrictions, the prevailing party shall be entitled
to recover its reasonable attorneys fees and costs through all
levels of proceedings from the other party.
E. This Declaration may be exectued in one or more
counterpart signatures.

an indefinite hold and do wish to proceed with the process in order to save the City from any
exercise in futility.
We are unsure if there is any credit, relating to the $750 fee which we submitted with the
drawings. If any consideration could be given to a refund, either partial or full, we would

This Declaration o~ Easements, Covenants and Restrictions,
made and executed this I-./' day of November, 1991 by BOYNTON PLAZA
SHOPPING CENTER, INC., a Florida corporation (hereinafter referred
to as "GRANTOR") and BARNETT BANK OF PALM BEACH COUNTY, a Florida
corporation (hereinafter referred to as "GRANTEE")

WHEREAS, GRANTOR is the owner of the real property
(hereinafter referred to as "the Shopping Center") more particularly
described on Exhibit A, annexed to and forming a part hereof; and
WHEREAS, GRANTEE is about to acquire the real property
(hereinafter referred to as "the Outparcel") more particularly
described on Exhibit a, annexed to and forming a part hereof; and
WHEREAS, in order to provide a coordinated and integrated
development of the Shopping Center and GRANTEE's improvement of the
outparcel, the parties hereto desire to create perpetual,
non-exclusive ingress, egress and access easements for both
vehicular and pedestrian traffic and a non-exclusive parking
easement for ten (lO) contiguous parking spaces on the parking and
common areas located within the Shopping Center; 'and to provide for
certain covenants and restrictions respecting such easements.
NOW THEREFORE, for and in consideration of the premises, the
easements, covenants, conditions and restrictions herein created,
and other good and valuable considerations in hand paid by each of
the parties hereto to the other, GRANTOR and GRANTEE do hereby
declare that the Shopping Center and the Outparcel are and shall be
held, transferred, sold, conveyed, used and occupied subject to the
easements, covenants and restrictions hereinafter set forth.
1. Grant of Easements.
A. GRANTOR does hereby grant 0 GRANTEE and to the
successors and assigns of GRANTEE, perpetual non-exclusive
easement for ingress and egress and a non-exclu .
parking easement for ten (10) contiguous parking spaces as shown on
Exhibit "C" attached hereto for the use and benefit of GRANTEE, its
customers, invi tees, licensees, lessees, employees, successors and
assigns, for vehicular parking, vehicular and pedestrian ingress and
egress, over, upon and across those portions of the parking areas
and common areas of the Shopping Center.
B. GRANTOR shall have the right to redesignate "tba\
location of such ten (10) parking spaces at any time and 'in
GRANTOR' s sole discretiof" provided, however, that any "of. such
parking spaces so redesigna~e\i shall be contiguous to each O~IU:h. iUad
shall be in the area marked by cross-hatching on Exhibit,- ~C" 'annexed
hereto and forming a part hereof. No other alteration~' modification
or change shall be made to the foregoing ingress, egtessj access and

Barnett Parcel (as described on Exhibit MO" annexed hereto and made
a part hereof) for any other purpose than as a banking facility or
for general office uses.
2. Prohibition Against Barriers.
A. GRANTOR and GRANTEE, for themselves and for their
respective grantees, successors and assigns do hereby covenant and
agree, one with the other, that no curb, barrier, fence or hedge
shall be located on the common boundary between the Shopping Center
and the Outparcel or elsewhere in the Shopping Center so as to
unreasonably interfere with or obstruct (i) pedestrian or vehicular
ingress and egress between the Shopping Center and the Outparcel, or
(ii) the visibility of the Outparcel and GRANTEE's improvement
thereto from the Shopping Center or the rights-of-way existing at or
about the Outparcel or the Shopping Center.
B. GRANTOR and GRANTEE acknowledge and agree that the
barriers contemplated on GRANTEE's site plan annexed hereto as
Exhibit "E" and forming a part hereof do not violate the
prohibitions against barriers set forth in Paragraph 2.A. hereof.
3. Restriction on Use of outparcel. GRANTEE
and agrees that the Outparcel being conveyed to
conditioned upon the restriction that the Outparcel may
as a surface level parking lot.

4. General Provisions.
A. The invalidation of any of the provisions of this
Declaration by judgment or court order shall in no way affect any of
the other provlslons hereof and such remaining provisions shall
continue in full force and effect.
B. The easements, covenants, restrictions, benefi ts
and Obligations established hereunder shall run with the land and
shall bind and inure to the benefit of the parties hereto, their
respective heirs, personal representatives, lessees, successors,
grantees and assigns, except to the extent the same may be
terminated pursuant to the terms and conditions contained herein.
C. This Declaration shall be construed and enforced
in accordance with the laws of the State of Florida.
O. In the event of any litigation between the
parties hereto arlslng out of this Declaration of Easements,
Covenants and Restrictions, the prevailing party shall be entitled
to recover its reasonable attorneys fees and costs through all
levels of proceedings from the other party.
E. This Declaration may be exectued in one or more
counterpart signatures.

I was called over to planning to give my recommendations on three
possible changes that might occur to the south access of the Barnett Bank
drive through area.
The first scenerio is what I originally approved on the plans and I
still see no need to change it. This would allow traffic to flow
from the access road as well as the front (west) parking area,
The second plan is to widen the concrete median so as to allow
vehicles to exit the bank parking area onto the access road but
would restrict vehicles from entering onto the bank property from
the access road. This idea has merit also and I am not opposed to
this type of configuration.
The third scenerio would block off the access road completely and
by doing so would prohibit travel from either direction. It is this
solution that I have a great deal of trouble with and would recommend
, strongly that it not be implemented. This plan would restrict traffic
