Please place the above-referenced item on the September 17, 1996 City Commission

DESCRIPTION: Will Sherrod of Anchor Awning and Sign, agent for Blockbuster
Entertainment, is requesting appeal from Section 10.F Exterior Lighting, 5 and 6, of the
Community Design Plan - Chapter 9 of the city's land development regulations to permit
the installation of back-lit awnings around the elevations of the proposed Blockbuster Video
outparcel building at Boynton Lakes Plaza shopping center. The Boynton Lakes Plaza
shopping center is located at the southeast corner of Congress Avenue and Hypoluxo
Road, zoned C-3. The Blockbuster Video building will be located on the last unbuilt,
outparcel at the center, between the Mobil service station (southeast corner of Congress
Avenue and Hypoluxo Road) and the Miami Sub building (northwest corner of Congress
Avenue and Plaza Lane). For further details pertaining to this request, please refer to
attached Planning and Zoning Department Memorandum No. 96-410.
RECOMMENDATION: The Planning and Development Board, with a 5-1 vote,
recommended approval subject to the staff comments in Exhibit "E" - Conditions of

Community Design Plan appeal - back-lit awnings
NATURE OF REQUEST
Will Sherrod of Anchor Awning and Sign, agent for Blockbuster Entertainment, is requesting to
appeal Section 10.F. Exterior Lighting, 5 and 6, of the Community Design Plan - Chapter 9 of the
city's land development regulations, which state the following:
5. Lighting shall not be used as a form of advertising in a manner that draws more
attention to the building or grounds at night than in the day.
6. Lighting attached to the form of the exterior of the building or part of the building
exterior or visible from the exterior of the building shall not be permitted if it is
contrary to the architectural style of the building.
Approval of the appeal would permit the installation of a back-lit awning around the elevations of
the proposed Blockbuster Video outparcel building at Boynton Lakes Plaza (see Exhibit "A" -
letter of request).
BACKGROUND
The Boynton Lakes Plaza shopping center is located at the southeast corner of Congress
Avenue and Hypoluxo Road. A significant level of architectural unity has been achieved within
this shopping center by using similar architectural features on the main shopping center building
and the outparcels as follows: (see Exhibit "B" - typical elevations of existing structures):
- gable or mansard roof (except for Cuco's restaurant)
- barrel roof tile of unified color (except for Cuco's restaurant but including the Mobil
service station)
- color compatible stucco elevations
- unified scale of structures
- signage of varying compatibility
- main building entrance features
The Blockbuster Video building will be located on the last unbuilt, outparcel at the center,
between the Mobil service station (southeast corner of Congress Avenue and Hypoluxo Road)
and the Miami Sub building (northwest corner of Congress Avenue and Plaza Lane); see Exhibit
"c" - location map. To date, no site plan for this outparcel has been submitted to the city for
approval. Therefore, the information regarding the design of the building is limited to the front
and side elevations of the building, submitted as a part of this request. These elevations do not
indicate exterior building materials or most colors to be used.
The proposed Blockbuster signature, blue, back-lit awnings are proposed on the north, west
(facing Congress Avenue) and east elevations of the building. The awnings would occupy one-
half of two sides of the building and more than two-thirds of the front, Congress Avenue facing

elevation (see Exhibit "D" - elevation view drawings of the proposed building facade). The side
elevation awnings would have an eighteen inch high copy of BLOCKBUSTER VIDEO on them.
The front elevation would contain two, non-copy awnings and a 72 square foot company logo ( a
torn movie theater ticket).
ANAL YSIS
Appeals to the referenced sections of the Community Design Plan can be approved if there are
significant similar elements between the overall design of a building and the surrounding
buildings, such that the element being appealed is not the predominant element(s). This makes
it necessary to evaluate the entire building design, rather than focusing on just a portion of it,
such as the use of lighting to emphasize the awning which in this case is basically the only
design element on the proposed building. The elevations submitted show a box building with
little articulation and a flat roof without roof tiles; unlike the majority of tenants at the center. For
example, Mobil service station to the north and Miami Subs to the south have roof tiles as
decorative elements. Therefore, if the extent of the awnings can be minimized, the backlighting
and awnings will be more compatible with the Mediterranean style of the center and will draw
less attention than other, more attractive, aspects of the building.
As far as signage is concerned, the December 21, 1993 approved sign program for Boynton
Lakes Plaza allow nationally registered tenants to erect their corporate signs with no color
limitations. Therefore, the part of the appeal stated in the letter of request that relates to the use
of sign color, is regulated by the sign program. However, the overall area of the wall signage
shall comply with the City's sign regulations (Land Development Regulations, Chapter 21).
RECOMMENDATIONS
In order to maintain compatibility of the proposed structures with the other buildings of the
Boynton Lakes Plaza, staff recommends the following:
. Incorporate a gable or mansard roof.
. Roof tiles compatible in design and color with the roof tiles displayed on other structures
within the shopping center shall be used.

This letter is an appeal by Anchor Awning & Sign, as agents for Blockbuster Entertainment, of the decision
by the directors not to allow the trademarked blue backlit awning for the proposed Blockbuster Video at the
above mentioned site. Further, it is a request to have it set before the City Commission for review.
Chapter 9- Sections 10F and 11 concerning exterior lighting and exterior building design are the parts of
the Boynton Beach Sign Code in question.
It has been brought to our attention that based on a Unity of Title, the Blockbuster backlit awning would be
required to be the aqua blue and pink colors of the existing Miami Subs awnings. The awnings at the
Miami Subs are very small and only cover the doorways to the business. The comparison of the two
awnings seems solely based on the fact that they are both awnings and does not take into consideration the
size and relative importance of the awning in the recognition of the individual business. Blockbuster's blue
backlit awning is an integral part of a nationally trademarked sign package and having to conform to
another businesses colors should not be required as it will only hinder in the recognition of the individual
business,
Blockbuster Entertainment has devoted a great deal oftime and money in developing a nationally
recognized sign plan. It is essential in the success and recognition of a Blockbuster Video store that it be
allowed adequate signage. The incorporation of all elements of Blockbuster's sign package will aid in this
success and the blue backlit awning is an essential element.
Please find attached all of the necessary drawings for the submittal of our appeal. If you have any
