Dear Ms. Cottrell:
The City of Boynton Beach has completed its first revieVl of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during thelr initlal
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date 0 f tins letter. ( I f amended pI ans are not
submitted in 90 days, a new application tel:! will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi tted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for a second review and
the reviewers will recommend if the site plan will be placed on a
board meeting agenda for approval (see attached meeting schedule).
If there are major comments not addressed by new plans or the
reviewers recommend that the plan not be forwarded through the
approval schedule, this office will notify you of your alternatives
regarding the site plan as soon as possible.

CHECKLIST
The following list and information is provi.ded as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
planning and Zoning Department.

Submit an amended site plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in wlth the amended submittal.
Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3 .

Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.

Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of any kind.

shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.
Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to

The following is a list of 1st review comments regarding the Site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compliance on the plans submitted for second (2nd) review in
order for the project to continue through the site plan review
process. The second set of comment(s) are recommendations that
the planning and Zoning Department staff believe will enhance the
proposed development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant is not intending to correct code deficiencies they
should contact me regarding the procedures, application forms,
fees and submittal deadline dates for seeking relief from the
code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. The survey indicates the property is being subdivided from
the Catalina Shopping Centre. This subdivision will require a
determination by the City Engineer if the site will require
rep1atting. Contact the City Engineer regard1ng the correct
procedure. The outcome of the platting issue shall be determIned
prior to site plan review approval. [Appendix C Subdivision and
PlattIng RegulatIons]
2. The overall site plan for the entire shopping center is not
legible. Resubmit legible plans. The subject site is shown as
part of the shopping center, but the survey ind1cates it is a
separate property. City records show the McDonalds Restaurant is
a separate property. Correct the plans accordingly. The parking
space data shown on the plan is inaccurate based on the proposed
property ownership and property ownership on record. The parking
ratios required for the separate properties shall be in
compliance with the princIpal use ratios specified in the code.
Correct the plans accordingly. To simplify showing the parking
space requirements, specify on the overall site plan the code
required parkIng count for each use shown on the plan. Also show
the proposed shared parking data. Include the same information
on the Boston Chicken site plan Sheet 52. I understood that the
Boston Chicken site was going to be a leased outparcel, not
separately owned. I previously dIscussed with the applicant that
a survey for the proposed leased outparcel site would satisfy the
survey subm1ttal requirements as long as the survey indicating
the lines represented lease lines, not property lines. The
applicant shall clarify the discrepancy. [Appendix A-Zoning

3. The following comment is regarding the Boston Chicken site
as separately owned: Show on the landscape plan, the required
landscape strip and associated continuous hedge landscape
material along the north and west property lines of the Boston
Chicken site, or obtain approval of an appeal to the landscape
code for the required landscaping. The landscape appeal shall be
determined prior to the site plan review approval. [Landscape
code section 7.5-35 (e)]
4. Add to the site data sheet S2, the number of seats proposed
for the restaurant. Number the proposed seats on the floor plan
drawing. [Appendix A-Zoning Section 11 H. 16. d. (1)]
5. Show on each plan view drawing, a loading zone for delivery
of provisions to the restaurant. Th~ loading shall not encroach
a required landscape area, parking space or access aisle. The
minimum size is 12 feet wide, 35 feet long with a clear height of
14 feet. [Appendix A-Zoning Sectlon 11 J.]
6. Add to the drawing the size, letter style and color of the
proposed site and building signage. Also, include the color and
size of the associated sign framework and supports. Showlng the
signage at this time may eliminate possible delays for Board
approval for the subject signage in the future.
7. Add to the landscape plan, the south property line of the
subject property. Also, show the required landscaping material
along the south and east property lines. Indicate the location
and length of the areas to be filled-in with new material. Note
new material shall comply with the landscape code for size
spacing and native speCle count. [Landscape Code Section 7.5-35
( d) and (e)]
8. On the site plan, specify the width of the one-way driveway
proposed for the new parking area. Also, specify the angle of
the diagonal spaces. Show and identlfy the control dimensions
for the diagonal spaces. All dimensions shall be consistent with
the requirements specified in the Engineering Department standard
drawing B90013.
9. On each plan view drawing, show an eighteen (18) foot clear
back-up space in the access alsle for the new diagonal parking
spaces proposed for the north side of the building. [Article X
Section 5-142 (h)]
10. Add to the site plan and landscape drawing, the location and
width of the proposed awnings. Note the setback distances are
measured from the property line to the awning. Add to the site
plan, the setback dimension for the north and east sides of the
building. Amend the existing dimensions on the west and south
sides of the building to identify the distance from the property
line to the closest edge of each awning. Note that each setback
shall comply with the district setback requlrements. The awnings
shown on the overall site plan are not consistent with the
awnings shown on the floor plan drawing. Add the width of the
awnings to the floor plan drawing and correct the plans
accordingly. The new electrical closet and door located on the
north elevation of the floor plan is not shown on the site plan
or landscape plan. It, also, appears that there is an eXisting
and proposed new sidewalk located on the north side of the
bUilding that is leading to a block wall. There is also a door
shown on the floor plan located on the east side of the south
elevation of the buildlng that does not have a sidewalk stoop
shown on the site plan or landscape plan. Correct the plans
accordingly. [Appendix A-Zoning Section 4 J. 3.]

following comments:
1. In order to better facilitate the movement of handicapped
individuals from the public rights-of-way of Congress Ave.
into this site, the developer shall construct a sidewalk
connection from the in-place Congress Ave. sidewalk system to
an internal point in the parking facility.
2. No lighting plans were submitted during this site review
process and therefore this memo shall serve to notify the
applicant that compliance with required levels of illumination
for both the parking facility and pedestrian circulation
systems (sidewalks) shall be required prior to issuance of a
building permit.

Per your request, the Building Department has reviewed the plans
for the above project and offers the following comments:
1. The curb and landscape on the north side of the
building obstructs the kitchen door.
2. The sidewalk on the north side should be removed since
it leads to a door that is to be closed.
3. The south side should have a continuation of the
handicap access from Congress Avenue to the front
entrance.
4. The signage for Boston Chicken should comply with
Catalina criteria, unless detailed signage plans are
submitted for approval during site plan review.
5. All signs should be in compliance with the Sign Code.
6. The proposed directional sign on Sheet S-2 should be
not more than 4 Sq. Ft. and a maximum of 5 Ft. in
height, and should be located at points of parking lot
ingress and egress.

Major Site Plan Modification (restaurant conversion of
bank)
Please place the above-referenced request on the city commission
agenda for April 19, 1994 under Development plans, Non-Consent
Agenda.
DESCRIPTION: This is a request for approval of an amended site
plan to convert the existing, vacant, former Flagler Federal bank
building on a leased outparce1 at the catalina Centre shopping
center located at 1755 N. congress Avenue. This adaptive reuse of
the bank building includes demolition of the drive-through lanes
and canopy, installation of three additional parking spaces and
traffic circulation modifications, specifically widening of the
one-way access aisle northeast of the building, to two-way.
Also, significant changes are proposed to the building exterior,
such as change in building color to grey and substitution of
awnings with striped awnings, which staff believes are not
compatible with the Catalina Centre color scheme, as well as window
and door revisions, emphasizing t~e south-facing building front.
Lastly, the approved, shared parking study that applies to the
shopping center, outparce1s, hotel and vacant, commercial parcel is
being revised to reflect the new parking spaces, using the same
methodology as was used to verify sufficient parking for the
original bank approval.
RECOMMENDATION: The Planning and Development Board unanimously
recommended approval of the requested, amended site plan, subject
to staff comments (Building Department Memorandum No. 94-065,
Utilities Department Memorandum No. 94-088, Police Department
memorandum, dated March 22, 1994 and Planning and Zoning Department
memorandum, dated April 8, 1994). There was much discussion
regarding the proposed building color and striped awnings, as well
as traffic circulation east of the building. The applicant agreed
to reduce the width of the one-way access aisle that is not wide
enough for two-way traffic, but is wider than the minimum width
required for one-way traffic which otherwise would encourage two-
way traffic flow in this area. The Planning and Development Board
endorsed staff's comments regarding the building color and awnings
recommending that the colors of both be changed to shades
complementary to those used at the shopping center.

1. The curb and landscape on the north side of the
building obstructs the kitchen door.
2. The sidewalk on the north side should be removed since

3. The south side should have a continuation of the
handicap access from Congress Avenue to the front
entrance.
4. The si~nage for Boston Chicken should comply with
Catalina criteria, unless detailed signage plans are
submitted for approval during site plan review.
5. All signs should be in compliance with the Sign Code.
6. The proposed directional sign on Sheet S-2 should be

4. Technical Review Committee member (s) shall identify in their

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be 1ncluded in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the appl1cant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When

Proposed Development: The Boston Chicken building is an existing
leased outparce1 building located on the southeast corner of
the Catalina Centre commercial shopping center (see attached
location map). The previous use that occupied the one-story
building was a bank with drive-up tellers. The modifications
proposed, including changing the use from a bank to a
restaurant, are as follows: omit the drive-up teller area and
install three (3) new parking spaces, widen the one-way access
aisle to the northeast of the building to two-way, remove and
block-in window and door openings, add new windows and doors,
remove the semi-circular decorative awnings and install new
multi-color awnings, and change the color of the building (see
attached drawing and color elevation view drawings) .
Existing Site Characteristics: The site is an existing occupied
shopping center.
Traffic: Palm Beach County Traffic Division reviewed the traffic
impact study submitted by the applicant, and forwarded to the
city Engineer a determination that the request was not subject
to the traffic performance standards providing the following
are true:
no increase in the size of the building;
City zoning does not require the proposed use to obtain a
special exception;
the bank was in operation within the last five years.
All of the above conditions are true for the subject request.

Driveways: As previously stated, the Boston chicken building is a
leased outparce1 to the Catalina Centre. The shopping center
has direct access to congress Avenue by way of a two-way
ingress/egress driveway located directly north of the existing
McDonald's site. Another access to congress Avenue is a two-
way driveway located on the abutting site to the south. This
driveway is located directly south of the proposed Boston
Chicken building. The parking spaces adj acent to the building
are linked to both driveways by the common parking lot.
parking Facility: The catalina Centre and the abutting projects to
the south share common parking facilities. The approved
shared parking study has been revised to reflect the
conversion of the former bank to a restaurant and the addition
of three new parking spaces. The approved study includes all
existing uses in the vicinity (the Holiday Inn, the former
Marie Ca11endar's restaurant, the Catalina Centre shopping
center and its outparce1s - McDonald I s restaurant and the
former bank requested for conversion to a restaurant) and a
future use planned for the vacant parcel lying between the
Holiday Inn and the savannah Lakes Apartments properties. A
1988 site plan approval of a health club/office building on
the vacant parcel has expired. This site plan approval would
have provided 93 parking spaces to share among the various
uses covered under the shared parking study.
The shared parking study was last revised in 1989 as part of
the bank approval and at that time the 1988 site plan of the
health club/office building had not expired. Since no new
square footage was being added to the bank/restaurant
conversion and since the retail parking ratio is applied to
uses on leased outparcels part of a shopping center,
regardless of the type of use, the revised shared parking
study incorporates the future 93 parking spaces yet to be
constructed. Based on this assumption and using the same
methodology as was used when the bank was added to the shared
parking study, i.e. - retail peak parking demand for leased
outparce1s, rather than restaurant peak parking demand,
quanti tative evidence / consistent with Section 11-H (13) of the
Zoning Code, has been provided that at the peak hour parking
demand, 8: 00 p. m. weekdays, the shared parking allocation
allows for sufficient parking to meet the zoning code
requirement and the required 10% buffer. In addition to the
buffer, a surplus of one parking space will be provided.
Another proposed change to the parking facility is the
modification to the relief access aisle located northeast of
the building. The existing aisle allows vehicles to exit the
drive-up area without approaching a teller window. This one-
way out lane is being widened to form a two-way traffic aisle
to serve the new parking spaces. The shape, traffic flow and
the parking spaces for the balance of the parking facility
will remain unchanged. Following compliance with staff
comments and approval of the updated parking study, the
proposed parking space count will accommodate the uses
proposed and existing at the shopping centre.
Landscaping: Minor changes to the landscaping are proposed.
Foundation landscaping is being added to the perimeter of the
building, new material is being added where the new parking
spaces and access aisles are proposed. New hedge material is
being added to the east and south perimeter of the shopping
center site where existing material is missing. The
landscaping is in compliance with requirements of the
Landscape Code.

Building and site Regulations: The building is existing and in
compliance with C-3 zoning district regulations.
Community Design Plan: The site is located in the Modern Design
District. However, the existing buildings located on the site
support a Spanish/Mediterranean architectural des ign. The
color of the existing buildings provide a common element and
relationship that creates an aesthetic unity though there are
several buildings. The architecture of the subject building
is not being changed, however, multi-color awnings are being
added to the perimeter of the building and the color of the
building is being changed. See color elevation view drawings
and photographs of the adjacent buildings.
signage: The proposed building signage is an extension of the
business logo which includes specific shapes and colors. The
site signage consists of directional signage which also,
displays the logo colors. See color elevation view drawings.
The proposed wall signage like the previous bank signage is
different from the signage on the main shopping center
building. The main building signage is basically single color
signs with different letter styles and types of sign face.

REVIEW OF DEPARTMENTAL COMMENTS:
Please find attached the comments from all reviewing departments:
staff has determined that compliance with the outstanding comments
identified in their memoranda will not substantially alter the
configuration of the site and/or buildings. The only exception is
the Planning and Zoning Department comment Number 2 regarding the
loading zone. Considering all comments, the proj ect has been
forwarded for Planning and Development Board and City Commission
review. The applicant must understand that the permit plans shall
be amended to comply with the attached staff comments and that
additional comments may be generated by staff following their
review for technical compliance of permit documents that are
required to be submitted for the development of the project.
RECOMMENDATION(S) :
The planning and zoning Department recommends approval of the
request for site plan review subject to the permit plans for the
project being amended to show compliance with staff comments and
the applicable City of Boynton Beach Code of Ordinances.

The following is a list of comments regarding the 2nd review of
the above-referenced project. It should be noted that the
comments are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the 2nd review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building with exception of comment Number 2
regarding the loading zone. The installation of a loading zone
will alter the shape of the parking area, however, there is ample
room to include the loading zone with minor changes being
required.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting considering that the request for Site Plan
Review is approved. The applicant must understand that
additional comments may be generated upon review of the documents
and working drawings submitted to the BUilding Department for
permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. The number of parking spaces required for the shopping
center is based on a shared parking study. The study allowed
reduction in number of code required parking spaces based on the
parking demand for the different uses proposed for the entire
project. The shopping center is one of the sites used in
creating the shared parking study for the project. The total
number of parking spaces shown on the shopping center site plan
drawing, match the number of spaces that the shared parking study
specify for the shopping center site, however, the number of
parking spaces listed in the site data found on the shopping
center site plan drawing does not match and shall be revised to
match the study and count shown on the site plan. The firm that
prepared the parking study and the date the final approved study
is accepted by the city shall be documented on the shopping
center site plan and the Boston Chicken site plan drawing.

2. The applicant shall show on each plan view drawing of the
subject site, a loading zone. The loading zone is for delivery
of provisions to the restaurant. The loading zone shall not
encroach a required landscape area, parking space or access
aisle. The minimum size of a loading zone is 12 feet wide, 35
feet long with a clear height of 14 feet. Anna Cottrell, the
applicant's agent, submitted a letter, dated March 29, 1994 (see
attached), regarding omitting the loading zone and the
justification for same. The staff's position remains the same,
that the loading zone is required and the Board of Adjustment is
the Board that may grant relief from the code requirement for a
loading zone.
3. The shared parking study dated February 4, 1994 shall be
revised to reflect the correct number of parking spaces for the
southern parcel (580) and the total number of parking spaces to
be provided (1262).
II. RECOMMENDATION(S):
1. To maintain harmony between the Catalina Centre buildings
and the subject leased outparcel building, regarding color, the
color of the building, recessed band and awning should be changed
to colors that blend closer with the colors of the main shopping
center building.

Thanks for taking the time to meet with me yesterday regarding the Boston Chicken
Restaurant site plan application.
Pursuant to our discussion, we are requesting a waiver of the requirement for a loading zone
at the site. We would appreciate your adding this request to our application for site plan
approval scheduled to be presented to the Planning and Development Board and the City
Commission next month. It is our understanding that the requested waiver is reviewed and
approved by the City Commission, and that no other variance is required.
We feel the waiver is justified since loading can take place within the restaurant's parking
area prior to daily business operation, without any disruption to the Boston Chicken's
operation or to any other business or user at the Catalina Center. The delineation of an
exclusive loading zone can be accomplished only with a conversion of some of the existing
parking spaces, or with the conversion of some of the hmdscaped area at the site. We don't
feel either of these alternatives is desirable since the loading operation can occur without the
need for an exclusive loading zone.

recommendations on our site plan application. If you need any further information or
