Parking Lot Variance
Boynton Beach East Water Treatment Plant
The Utility Department of the City of Boynton Beach has requested
three parking lot variances in conjunction with the site plan
modification for the Boynton Beach East Water Treatment Plant.
The variances being requested are as follows:
1. Lighting. The applicant is requesting a variance for non-
public parking areas located in the center of the property.
2. Number of Driveways. The site is allowed to have two
driveways on each street. Three driveways presently exist
on each street.
3. Distance of driveway from corner. The northernmost driveway
on Seacrest Boulevard is 100 feet from the corner where 180
feet are required by code.
4. Driveway depth. The east driveway on Woolbright Road is
only 28 feet long whereas code requires 100 feet.
The subject parking is not available to the public and will only
be used between the hours of 7:00 a.m. and 6:00 p.m. Some
lighting is already provided on the buildings so that the parking
area will be lit, but not to the parking lot standards. In
addition, if this site was properly lighted it could have an
adverse impact on the preserve area and residential uses to the
south.
The driveways are all existing and there have been no problems
that we know of at the site from either a traffic congestion or
safety point of view.
The Technical Review Committee reviewed these variances and had
no comments and recommended approval of the variances.
The Planning and Development Board reviewed these variances at
its meeting of January 12, 1993 and forwarded this request to the
City commission with a recommendation for approval with the
condition that the north driveway on Seacrest Boulevard be one-
way out only.
This item has been scheduled for City Commission review and final
consideration on January 13, 1993.

Parking Lot Variance
Section 5-145(c)(4) of the Code of Ordinances requires that when a
variance to Section 5, Article X, Parking Lots is requested, the
Technical Review Committee must forward to the Planning and
Development Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
John Guidry, Director of utilities for the city of Boynton Beach,
is requesting a variance to Section 5-142 (a) and (h) (3), (5) and
( 7 ) of the Parking Lot Regulations. A description of these
sections is shown on the attached Notice of Public Hearing. The
applicant is requesting relief from these sections in connection
wi th the Phase I expansion improvements to the existing water
treatment plant. The attached copy of a reduced survey depicts the
existing conditions of the site and exhibit "A", a reduced site
plan drawing of the proposed improvements, illustrates the location
of the requested variances. For an explanation of the code
requirements, the nature of the variances requested and the
variance justification, please refer to the attached Notice of
Public Hearing and variance application.
On Tuesday, December 29, 1992, the Technical Review Committee (TRC)
met to review the plans and documents submitted and to formulate a
recommendation with regard to the variances requested. After
review and discussion the TRC recommended that the variance
requests be approved as submitted.

such a manner as to provide a safe
environment. Levels of illumination and
liminaire types shall comply with city
standards.
(h) Driveway.
(3) No parking lot driveway may be
constructed closer than thirty (30) feet
from the intersection of the right-of-
way lines along local streets and one
hundred eighty (180) feet along streets
of a higher classification as shown on
the city or county thoroughfare plans.
(5) The minimum distance from the street
right-of-way line at any major ingress
or egress driveway to any parking stall
or to any interior access aisle having
direct access to such driveway shall be
one hundred (100) feet.
(7) No more than two (2) driveways shall be
permitted from any property. Where
properties abut more than one (1) public
or private right-of-way, additional
driveways may be permitted depending
upon traffic volumes, but in no instance
shall the number of driveways exceed two
(2) on each street.

fixtures with appropriate levels of

of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of th~ City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated beiow:
section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Section 5-l42(a) - Lighting. East parking lot shall be lit in such a
manner as to provide a safe environment. Levels of illumination and
luminaire types shall comply with City standards.
Nature of Variance Requested: The Utilities Department requests that
current light levels be maintained, as they have proven adequate for safety
during night-time plant operations.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary) :
1). The parking lot is not utilized at night.
2) Current lighting is designed for purposes of operating the plant and
has proved to be satisfactory.
3) Meeting the lighting levels required by code will create an eye-sore and
not be desirable.
4) The site is completely fenced and not open to the public.

of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Section 5-l42(h)(3) - No par~ing lot driveway may be constructed closer than
thirty (30) feet from the intersection of the right-of-way lines along local
streets and one hundred eighty (180) feet along streets of a higher
classification as shown on the City or County thoroughfare plans.
Nature of Variance Requested: The existing driveway at the northwest
corner of the site does not meet the 180 foot criteria. The Utilities
Department requests that the driveway be allowed to remain.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary) :
1) Abandoning the driveway would impede traffic circulation through the site.
2) Abandoning the driveway would impede access to the northwest corner of the
Water Treatment Plant by large mobile equipment and also complicate fueling
of the two emergency generators.

of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Section S-142(h)(S) - The minimum distance from the street right-of-way line
at any major ingress or egress driveway to any parking stall or to any interior
access aisle having direct access to such driveway shall be one hundred (100)
feet.
Nature of Variance Requested: The Utilities Department requests approval
of driveway access via an interior access center as shown on the proposed site
plan in the northeast corner of the site. The distance from the access aisle to
the Woolbright Road right-of-way is approximately 30 feet.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary) :
1) The current distance from the right-of-way to the nearest parking stall is
approximately 25 feet.
2) The subject parking area will be utilitized primarily by City employees
on a repetitive basis, thereby reducing the possibility of an accident.
3) The proposed design will allow enhanced circulation. Deletion of the access
aisle will impede circulation.

The undersigned hereby petitions the Planning and Zoning Board to
grant to the petitioner a variance to Article X "Parking Lots",
of Chapter S, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Section 5-142 (h)(7) - No more than two (2) driveways shall be oermitted from
any property. Where properties abut more than one (1) public or private right-
of-way, additional driveways may be permitted depending upon traffic volumes.
but in no instance shall the number of driveways exceed two (2) on each street.
Nature of Variance Requested: The site current Iv has three (3) driveways
on Seacrest Boulevard, and three (3) driveways on Woolbright Road (one being a
driveway into the Administration Building). We request a variance to continue
using all of the existing driveways.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary):
The existing driveways have been in place for at least fourteen (14) yp~r~r nr
longer. They are necessary to maintain access to all buildin2s. In addition
the driveways on Seacrest Boulevard are all reQuired to allow e2ress from the
water treatment plant without having to back out onto Seacrest Boulevard. a
situation which would increase hazards to the vehicles, operators and public.

Description of Project: The Phase 1 expansion of the east water
treatment plant consists of site improvements that include new
parking and vehicle storage spaces, associated traffic aisles and
curbing, landscaping, drainage areas, water lagoon and sludge area,
and a one hundred seventy-five (175) foot high water tank. The
water tank is the only structure proposed for the Phase 1
expansion. A height exception for the water tank was approved by
the City Commission on November 4, 1992.
The following zoning district and uses border the subject property:
North: C-2, commercial buildings; East: FEC Railroad, C-3, Sunshine
Square shopping center and R-3 residential structures; south: PUD
planned residential development, Seaway Villas; West: R-3,
residential development, High Point West and PU, City cemetery.
The existing structures and appurtenances on the site will remain
in place with the exception of the existing water tank which will
be phased-out and removed when the new tank becomes operational.
The eXisting site contains approximately 7.26 acres. The
acquisition and incorporation of the vacant 7.47 acres directly
south of the existing site brings the total area of the site to
14.73 acres. New traffic aisles, parking and vehicle storage
areas, curbing and landscaping are the major improvements proposed
for the eXisting site. The xeriscape landscaping that presently
exists along Seacrest Boulevard and Woolbright Road was installed
as part of a previous site plan modification. The improvements
proposed for the new site include the water tank, sludge storage,
drainage detention areas, open storage, parking, and a .75 acre
preserve area where existing vegetation will be preserved. A six
(6) foot high slatted chain link fence installed along the north,
east and west property lines provides a perimeter enclosure for the
site. The south property line abutting Seaway Villas is open with
existing landscaping located on the Seaway Villas property. The
slatted fence along Seacrest Boulevard will be complemented with a
three (3) foot high berm that includes trees and hedge landscape
material incremental spaced along the south portion of the east
property line.

Review of Departmental Comments: Concurrent with the site plan the
applicant is requesting a variance to Sections 7.5-35 (e) and (j)
of the Landscape Code (Exhibit A). Section 7.5-35 (j) of the code
requires that a vegetative hedge material be installed around three
sides of a dumpster pad. Section 7.5-35 (e) of the code requires
that a continuous visual barrier be installed along the vehicle use
areas to screen the vehicle use area from view from abutting
properties. The specific areas of the site that are affected by
the variance are as follows: Eliminate the Code specified hedge
that forms the continuous visual barrier that would shield the
parking spaces and vehicle use aisles that are visible from the
east property line. The two and one-half (2!) foot wide sodded
landscape strip and six (6) foot high slatted chain link fence will
remain along the entire east property line. Eliminate the Code
specified vegetative screening that would screen the view of the
two dumpster pads, one located northeast of the existing wash
water recovery pond and the other south of the existing sludge
thickener basin.
The improvements proposed for the site, more specifically the
addition of more than twenty-five percent of the total number of
existing parking spaces, evokes the requirements of the Parking Lot
Code. Compliance with the Parking Lot Code requires the site to be
upgraded to the current parking lot standards. Comments number 1
and 2 identified within the Engineering Department Memorandum No.
92-313B from Richard staudinger dated November 25, 1992 describe
the sections of the Parking Lot Code that were not upgraded with
the proposed modification. Therefore, variances from the parking
lot code are required prior to initiating the proposed
modifications of the project. Due to the fact that the public
hearing and advertisement time period requirements for the parking
lot variance do not align with the site plan review schedule and
the critical path for bidding and construction of the water tank,
the a licant is re uesting that the site plan be approv ubject
to a rov 1 or denial of the par ing lot variances. The following
is a brief description of the par 1ng lot standards from which the
applicant is seeking relief: level of illumination of the parking
lot lighting, distance that the northwest driveway is located from
the Woolbright Road intersection and the length of the driveway
that leads to the first parking stall and/or interior access aisle
at the east entrance to the property. The parking lot variance is
scheduled for public hearing by the Planning and Development Board
on January 12, 1993. Construction of the improvements are
scheduled to begin late January, 1993. The City Forester has
indicated that he will rectify the tree preservation code related
issues when the applicant submits working drawings for permit
review to the BUilding Department. The utilities, Fire, Police,
Public Works, Building and Parks and Recreation Department
recommend the project proceed through the approval process.
Recommendation: Staff recommends approval of the project subject
to staff comments and approval of the referenced variances.
