The owners of the Boynton Beach Promenade have requested a
conditional use to allow 7,011 square feet of space in the center
to be used for a teaching facility for Motorola. The teaching
facility will instruct people on the technology, assembly and
repair of Motorola beepers.
The Planning and Development Board, at its meeting of February 9,
1993, reviewed this conditional use and forwarded it to the City
Commission with a recommendation for approval.
This item has been scheduled for City Commission review and final
consideration on February 16, 1993.

SUBJECT: Boynton Beach Promenade Conditional Use Application
INTRODUCTION
The owners of the Promenade are requesting the approval of a
conditional use to allow an instructional facility for Motorola.
The Promenade is located on the west side of Congress Avenue,
north of Old Boynton Road.
Recently a site plan for the parcel was approved which included
75,130 square feet of commercial and office space and 396 parking
spaces on 6.5 acres of land. The site is zoned C-3 and the
proposed use is first allowed as a conditional use in the C-1
zoning district. The site meets all of the applicable codes and
is presently under construction.
The area to be used for the proposed use is located at the north
end of the main structure on the second floor and will occupy
approximately 7,111 square feet of floor space.
SURROUNDING LAND USES AND ZONING:
The properties to the north, south and west are all zoned C-3.
The property to the west is occupied by the Boynton Mall, the
south by commercial uses in the Herman's Plaza and to the north
by an office structure,
The parcel on the east side of Congress Avenue is zoned R-1AA and
is undeveloped. This site is presently being considered for a
high school to be built by the Palm Beach Board of Education.
PROPOSED USE:
The proposed use of the site is to instruct persons who service
Motorola beepers on the technology, assembly and repair of
beepers.
The use listed in the C-1 zoning district specifically does not
allow industrial teaching but the C-2 district allows repair or
service shops and, since the main function of the use is
training, staff believes the use is acceptable within the C-3
zoning district. In addition, the repair and assembly function
has often been classified as a "clean" use which is acceptable in
the C-3 zoning category.
STANDARDS FOR EVALUATING CONDITIONAL USES: The Planning and
Development Board and City Commission shall consider only such
conditional uses as are authorized under the terms of these
zoning regulations and, in connection therewith, may grant
conditional uses absolutely or conditioned upon the faithful
adherence to and fulfillment of such restrictions and conditions
including, but not limited to, the dedication of property for
streets, alleys, recreation space and sidewalks, as shall be
determined necessary for the protection of the surrounding area
and the citizens' general welfare, or deny conditional uses when
not in harmony with the intent and purpose of this section. In
evaluating an application for conditional use, the Board and
Commission shall consider the effect of the proposed use on the

general health, safety and welfare of the community and make
written findings certifying that satisfactory provision has been
made concerning the following standards, where applicable:
1. Ingress and egress to the subject property and proposed
structures thereon, with particular reference to automobile
and pedestrian safety and convenience, traffic flow and
control, and access in case of fire or catastrophe.
Access to the site is provided by two driveways located on
the north and south sides of the site. These accesses were
reviewed as part of the site and found to be acceptable
under the City codes.
2. Off-street parking and loading areas where required, with
particular attention to the items in subsection 1 above, and
the economic, glare, noise and odor effects the conditional
use will have on adjacent and nearby properties, and the
city as a whole.
The site contains sufficient off-street parking and loading
to service this use. Since the site is part of a larger
commercial area, no negative impacts are expected due to
glare, noise or odors.
3. Refuse and service areas, with particular reference to the
items in subsections 1 and 2 above.
This has been reviewed by the Public Works and found to have
the proper number of dumpsters with enough capacity on the
site,
4. utilities, with reference to locations, availability, and
compatibility.
The site is served by City water and sewer and is vested for
capacity for these utilities,
5. Screening, buffering and landscaping with reference to type,
dimensions, and character.
The site meets the landscaping and buffering criteria of the
City ordinances. The landscaping plan that was part of the
approved site plan contains the proper number and type of
species.
6. Signs, and proposed exterior lighting, with reference to
glare, traffic safety, economic effect, and compatibility
and harmony with adjacent and nearby properties.
The site and use are compatible with surrounding uses. The
site plan was reviewed and found to acceptable lighting,
traffic circulation and signage.
7. Required setbacks and other open spaces.
The structures on the site meet all of the required setbacks
and drainage criteria in the Code of Ordinances.
8. General compatibility with adjacent properties, and other
property in the zoning district.
The proposed use is compatible with the uses on the site as
well as adjacent to the site.
9. Height of buildings and structures, with reference to
compatibility and harmony to adjacent and nearby properties,
and the city as a whole.

The heights of structures within the development range from
one to three stories. These heights are consistent and
similar to structures around them and fall under the overall
height limit for the City.
10. Economic effects on adjacent and nearby properties, and the
city as a whole.
The use has a positive economic effect on the City, The
Motorola plant is the largest producer of pagers for
domestic and foreign use. Having an instructional facility
in the City generates travel to the City, hotel usage, and
meal consumption for local businesses.
11. Conformance to the standards and requirements which apply to
site plans of the City of Boynton Beach Code of Ordinances.
As previously mentioned, the site plan for this development
has been reviewed and approved by City staff, the P&D Board
and City Commission.
12. Compliance with, and abatement of nuisances and hazards in
accordance with the performance standards section 4 of the
zoning regulations; also, conformance to the City of Boynton
Beach Noise Control Ordinance.
No nuisances or hazards are expected to be generated by the
use nor is any unacceptable noise expected to be generated
by the use.
REVIEW OF COMMENTS:
This conditional use was reviewed by the technical review
committee at its meeting of January 14, 1993. The committee
had no comments on the proposed use.
RECOMMENDATION:
The Planning and Zoning Department recommend that this
conditional use be forwarded to the City Commission with a
recommendation for approval.
