Review and Landscape Appeal
Max Developers has requested a major site plan review for the
Boynton Beach Promenade. The reason for the review is the
increase of the floor area from 75,130 to 79,318 square feet.
This increase is caused by the desire of the owners to keep the
second floor portion of the old structure and not remove it as
originally planned.
Since it was approved in June of 1992, the site plan has been
altered under a series of minor plan changes to shift the bulk of
the building to the Office Max structure, move that structure to
the south because of conflicts with an electrical transformer and
the height of the Office Max facade was increased by four feet.
The site meets the parking requirements and the design guidelines
of the modern district.
The applicant has also requested a landscape appeal to allow the
use of existing material instead of replacing with native species
both on the site and along the right of way.
The site plan and the landscape appeal were reviewed by the
Planning and Development Board and both were forwarded to the
City Commission with a recommendation of approval. A condition
was attached to the landscape appeal to plant additional palm
trees along the east elevation at the south end of the structure
which the applicant has agreed to do.
These requests have been scheduled for City Commission review and
final determination on May 18, 1993.

DESCRIPTION OF PROJECT:
In June of 1992, the City Commission approved a new site plan for
the Boynton Beach Promenade. Shortly after that approval,
demolition of the old structure began and the construction of the
Office Max structure now being built on site commenced.
In addition, early this year the owners received approval for a
conditional use for the site for a Motorola training facility. This
facility occupies the second floor of the old Promenade structure.
Finally, during the permitting process some changes were made to
the site plan that increased the height of the Office Max structure
and rearranged parking and landscaping at the rear of the main
building.
The original site plan called 75,130 square feet of floor space
with 396 parking spaces. However, the parking calculations were
computed based on separate uses.
The new site plan shows 79,318 square feet of floor area with 397
parking spaces calculated using the shopping center ratio of 1
space for 200 square feet.
The increase in square footage is because the second floor has been
left on the old structure and at the same the new structure has
been reduced in size.
As mentioned earlier, the structure has increased in height to 26
feet from 22 feet. This increase is acceptable and gives the
building better visibility from Congress Avenue. However, the
overall wall surface has been increased by removal of windows along
the first floor elevation. Some attempts to soften the surface have
been made by the addition of vertical elements around the entrance
to Office Max.
From a distance the east elevations will be softened by the
vegetation at the front of the site as well as the Red Lobster
outparcel.

The following comments are in response to the submittal of the site
plan for the above referenced project. The comments for the project
will be discussed at the April 27, 1993, Technical Review Committee
meeting. The site plan was reviewed for consistency with the review
standards specified in Section 8 of Chapter 4, site plan Review,
Part III, Land Development Regulations of the code of ordinances.
The applicant shall amend the drawings and documents to show
compliance with the following comments:
1. There are inconsistencies between the total gross square
footage as shown for the shopping center on the site plan
drawings, Sheet #1, and the project data table as shown on the
site plan.

feet. The 75,130 square feet figure should still be the total
existing building area. Please confirm and correct the
information shown on the project data sheet on the amended
plans.
4. There are inconsistencies between the site plan, sheet #1,
site layout plan, sheet #2A of 6, paving and drainage plan,
sheet #2 of 6 and the landscape plan, sheet #5. The parking
spaces and space count varies from sheet to sheet and do not
match. please provide on the amended plan information that
matches and is consistent throughout the plans.
5. The note on the landscape plan, sheet #5, "specific site code
requirements 11 indicates 205 interior parking spaces. upon
reviewing the plan the count shows 214 interior parking
spaces. Please correct any inconsistencies and provide the
correct number on the amended site plans.

We have reviewed the referenced project plans (Malar Site Plan Modification) and have
the following comments:
1. The parking lot striping doe~ not conform to the standard deta,lI tor striping (6-
90012) with regard to striping.
2. Parking lot landscape islands are not in accordance with City Standard Detail
(891003).
:;, All draInage structures require sumps and weepholes. Gate elevations in
Ia.ndscape islands should be raised to provide innitlal detention and water quality
treatment.
4. Frenoh drain detail does not conform to standard drawing 8..91007.
5. Caulfield and Wheeler plans still show the dumpster pad by the bank. This does
not agree with the site plan.
6. Parking lot typioal section does not reflect pavement CrO$5 slopes as noted on
paving plan.
7. No drainage calculations submitted.

Find attached for your review the plans and exhibits for the above
referenced project. Site Plan Review approval for this project
will be granted by the City Commission/Community Redevelopment
Agency. To ensure that the project stays on line with the review
time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on April 16. 1993. Do
not return plans and exhibits. Retain same for the review of the
amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 to review and formulate comments. (See Planning
& Zoning Department memo #92-020)
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards, additional data
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the code section and include the
language of the submittal requirements and review standards
that require the data to be submitted for review.
4. Technical Review Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Dotty Moore will be the Planning and Zoning Department
staff member coordinating the review of the project.
The Planning and Zoning Department will send to the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.

The amended plans for the above referenced project have been
submitted and reviewed. The following comments are either comments
from the original set of comments that were not satisfactorily
corrected on the amended plans or were generated as a result of the
review of amended plans. All comments shall be corrected. However,
it is acceptable to show compliance with the outstanding comments
on the plans that are required to be submitted to the BUilding
Department for permit review. The applicant must understand that
the following comments are comments generated for Site Plan Review
and that additional comments may be forth coming as a result of the
review of the working drawings and documents submitted to the
BUilding Department for permits. All permit documents are reviewed
for compliance with the requirements specified in the Boynton Beach
Code of Ordinances.
1. The note on the landscape plan, sheet #5, "specific site code
requirements" indicates 205 interior parking spaces. Upon
reviewing the plan the count shows 213 interior parking
spaces. Please correct any inconsistencies and provide the
correct number on the amended site plans.
2. The "Note" on the landscape plans, sheet #5, states "all
existing landscape planting and irrigation within this
designated area is to remain. Any code violation will be
brought into compliance. All new planting shall be irrigated
us ing current water supply wi th underground automatic system."
Further review revealed the "designated areaH as the full
perimeter of the property where the required landscaping shall
be provided for the on-site parking area. The landscaping that
presently exists there, as shown on the plans compiles of:
black olive trees and surinam cherry - four foot continuous
hedge. These are not native species. The code requires that a
minimum of 50% of all plant material shall be of a variety
that is native to Florida. Submit amended plan showing
compliance with this requirement and the requirements
specified within Appendix III of the Community Design Plan for
design district III or a landscape appeal may be applied for
requesting relief from this landscape code requirement.
3. Since there is not an active permit for the proposed
restaurant outparcel site, it is recommended that the site be
graded and covered with lawn grass that is irrigated with an
automatic water supply system if no permit is pUlled within
120 days of the approval of the site plan.

Upon my review of both the resubmitted plans and the comments
made on the original ones, I have discovered that the issues
raised in that memo were not addressed. Addi tionally, I
discovered that the memo itself contains a comment, #2, that
has the wrong compass direction. Therefore, please find below
the issues still in dispute.

I recommend that these plans move ahead and that the above

that my comments have been addressed and then to sign-off for
me.
