Dear Mr. Winter:
The District offers the following in response to your request for a
jurisdictional determination of the subject property.
A site i~spection was conducted by Anita Bain, Staff Environmental Analyst, of
the Natural Resources Management Division on March 10,1993. The aerial
photographs and project boundaries you provided were reviewed and no connection
with waters of the state to the property were found. Based on this information,
none of the project area is considered waters of the state as defined by Chapter
403 F.S., and Sections 17-301 and 17-312 F.A.C. Dredging or filling activities
within this project will not require a Wetland Resource Permit form this agency.
This correspondence is an informational preapplicati6n jurisdictional
determination pursuant to Section 403.914(2), F.S. It does not bind the
District, its agents or employees, nor does it convey any legal rights, expressed
or implied. Persons obtaining this informal preapplication jurisdictional
determination are not entitled to rely upon it for purposes of compliance with
provision of law or District rules. A binding jurisdictional determination may
be obtained by petitioning the Florida Department of Environmental Regulation
(FDER) for a jurisdictional declaratory statement pursuant to F.A.C. Rule 17-
312.040 or by applying for a Wetland Resource Permit.

Dear Mr. Cutro:
On May 13, 1993, the Palm Beach County Traffic Division issued a finding on the
traffic study for the Boynton Festival Center. There are two errors in that
letter. The traffic study is identified as Boynton Beach Plaza. The approved
square footage of 216,000 should actually be 115,000. Pleas note these
corrections.

Dear Mr. McMillen:
This letter is confirm that I have visited the above referenced
site on Nov. 6, 1993 to determine if any significant trees or
vegetation existed. I observed no significant trees except
Melaleuca and Brazilian Pepper and the vegetative ground cover
was normal lowland and upland weeds. Some invasive Earleaf
Acacia were also present. Since these three tree species are
normally considered "noxious" and invasive and are not protected
under any code, I do not think a tree survey is needed.
As the proposed site plan for the Center does require renovation
and realignment of part of the existing parking lot on the N.W.
corner of the site, the trees that exist as part of this facility
should be transplanted and preserved. The shrubs and ground
covers in this same area are not cost effective in preservation
or transplanting. The Landscape Planting Plan I have prepared
however does not address the transplanting of the trees in this
quadrant of the site.

3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of exist ing buildings that are

minimum size is 511 by 711. Each photograph shall be labeled to identify the
location of the existing structures with respect to the location of the
proposed project.
4. Submit colored elevation view drawings - a colored duplicate copy of all
drawlngs of the elevation views of each side of all buildings and signage
associated with the project. The colored elevation views shall match the
elevations shown in the documents that were submitted for Slte plan
review. The appl icable exterior surfaces as identif ied above shall be

identlfied. The type of exterior surface material shall be identified neXL
to the associated color. The colored elevation drawings shall have compass

The following is a list of 1st review comments regarding the site
plan review of the plans for the above-referenced project. It
should be noted that the comments are divided into three (3)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compliance on the plans submitted for second (2nd) review in
order for the project to continue through the site plan review
process. The second set of comment(s) are recommendations that
the Planning and Zoning Department staff believe will enhance the
proposed development. The third set of comments is a list of
deficiencies that are shown on the plans regarding technical
compliance and shall be corrected and shown in compliance on the
permit set of plans prior to issuance of permits for the
development of the project. The applicant shall understand that
all documents/plans submitted for site plan and/or permit review
are subject to additional comments. I recommend that the
applicant/agent contact me regarding questions related to the
comments. If the applicant is not intending to correct code
deficiencies they should contact me regarding the proceduresl
application forms 1 fees and submittal deadline dates for seeking
relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:

1. Realign the northwestern ingress/egress to the site so that
the entrance provides clear traffic flow into and throughout
the site or rearrange the building configuration to provide
same.

aisles and width of the access aisles throughout the entire
sitel including areas affected on the west and south sides

The number of spaces identified on a row of parking spaces
to the east of retail building A is incorrectly numbered.
Correct the number accordingly and ensure that the number of
parking spaces identified in the parking data is correct and
matches the number of spaces shown on the site plan.
On the site plan show and label a distinguishable symbol
that identifies the location of the required City standard
curbing. [Article X Parking lots section 5-142 (e)]

On the site plan identify the symbol that represents the
property line of the suLject site and the 3 story office
building site.

Show on the site plan a dimension of no less than one
hundred (100) feet from the property line to the first
interior access aisle on both sides of the congress Avenue
and western Old Boynton Road ingress/egress driveway
entrance to the site. [Article X section 5-142 (h)(5)]
9.
Identify on the site plan within the area labeled "remove
existing parking" the total number of parking spaces being
removed. This information is needed to verify that the new
parking spaces are not decreasing the number of parking
spaces existing at the site for the three (3) story
building.
Specify the height of the dumpster enclosure depicted on the
dumpster enclosure detail drawing.
Place a note on the site plan that states lISite plan review
is required for the two outparcel buildings - 6,000 square
foot retail building and 9,000 square foot restaurant
building".
Dimension the narrowest width of the landscape strip along
Congress Avenue and the west property line. [Minimum width
Congress Avenue 6 feet/minimum width west property line 2.5
feet. [Landscape code section 7.5-35 9 (d) & (e)]
Show on the plan a continuous 2.5 foot wide landscape strip
required to separate the Boynton Festive Center site from
the existing and separate three story office building
property. An approval of an appeal to the landscape code
would be in the best interest for the proposed development.
However, a cross access and cross parking agreement would be
a condition of approval of the appeal to omit the 2.5 foot
wIde .~.c pe strip. [Landscape Code 7.5-35 (e)]
There is a contI, t "nth ;-egard to the 17 foot deep parking
spaces and the location of the r~q~lced or proposed hedge
landscaping being placed adjacent to the end of the parking
space. Ti!e hedge material is located in the remaining 1
foot of the requirel 18 foot deep parking space. Correct
the plans accordingly.
To ensure that note number 12 found on the landscape plan
can be enforced, identify on the plan view drawing the total
lineal footage of each plant/specie that is proposed to form
the continuous visual barrier required to screen the vehicle
use area. The total number of plants provided for the west
property line is less than the number required to comply
with the code specified two (2) foot on center spacing.
Amend the plans accordingly. [Landscape 7.5-35 (c) (3)]
16. Remove the dash dot symbol shown on the landscape plan near
and around the outparcel buildings. Identify the symbol
that represents the property line.

17. To verify that the spacing of the trees along Old Boynton
Road and Congress Avenue are located no further apart (trunk
to trunk) than the code specified distance of forty (40)
feet on center. The space between some of the trees along
the south property line exceed the maximum spacing allowed
by the code. Amend the plans accordingly. [Landscape Code
7.5-35 (d)J
18. To ensure that fifty (50) percent of required landscape
material is native identify the native specie by placing a
distinguishable symbol on the plant list next to the native
specie. [Comprehensive Plan policy 4.4.6J

19. Show and dimension on the landscape plan the required line-
of-sight triangles required at the intersection of Old
Boynton Road and Congress Avenue and on both sides of all
ingress/egresses to the site. Place a note on the plan at
the line-of-sight triangles that states the landscape
material located within the line-of-sight triangle will be
installed and maintained to form an unobstructed cross
visibility between the distance of thirty (30) inches and
six' (6) feet above the adjacent pavement surface. Amend the
plan view drawing and plant list accordingly. [Landscape

Extend the required continuous, unbroken, solid perimeter
visual screen hedge material to within three (3) feet of
each ingress/egress driveway. Dimension the three (3) foot

number and manufacturers name of all exterior finish
material shown and identified on the drawings.

The project is located in the Modern Design District and is
not in compliance with the window and extra features
requirements of the architectural features and/or treatments
part of the Community Design Plan, Appendix II (a). Show
and label on the plan no less than two (2) of the following
types of windows: Spandrel glass, Fixed glass or Reflective
glass. To be in compliance with the extra features show and
label on the plan exterior lighting. Site lighting
poles/fixtures are not considered exterior lighting.

proposed and/or required to be planted under overhead power
lines to a species that is identified on the FPL plant list
for planting trees near power lines.

has reviewed the above referenced plan and offer the following
staff comments:
City Engineer's Comments

1. Revise Sheet A to depict standard handicap parking symbol
and/or provide for in plan legend (Chapter 5, Section 5-142(k)).
2. Revise Plan Sheet A to depict required stop signs at all ingress/
egress approaches (Section 5-142(c)) and depict 24" wide white
stop bars which shall include attached double yellow continuous
center lines at all ingress/egress approaches and where aisles
intersect other major aisles (Section 5-142(c)).
3. Revise Drainage Plan Sheet 1 to depict invert elevations for all
structures and pipe slopes (Section 5-142(f)).
4. Revise Drainage Plan Sheet 1 to depict existing and proposed
elevations at minimum 100' grid, including all transition points
(highs & lows) within parking area and site (Section 5-l42(f)).
5. Clarify Drainage Plan Sheet 1 and define pipe specifications
and provide details and other technical information for all
structures (Section 5-142(f)).
6. Revise Drainage Plan Sheet 1 to provide some exfiltration trench
or similar treatment of stormwater outflow to treat pollutants
retained by the skimmer in structure S-ll (Section 5-142(f)).
Deputy City Engineer's Comments
1. The existing paved walk along Old Boynton Road shall be
inspected by the applicant's Engineer of Record in conjunction
with the City Engineer's Office in order to determine the
condition of said walk and should the walk require resurfacing,

As the City's Code of Ordinances, specifically Chapter 5,
Appendix, requires that all walkways within the public
rights-of-way transition thru all driveway approaches, the
applicant shall delineate the required walkway by providing
pedestrian striping thru the two ingress/egress approaches
situated on Old Boynton Road.
2. The Engineer of Record shall provide a statement on the face
of the plan indicating the site contains large quantities of
decaying fibrous peat and muck requiring extension excavation
and fill operations, requiring the applicant to successfully
obtain authorization from the City Commission during the
conceptual site plan review process to excavate and fill the
subject parcel. In conjunction with the conceptual site plan
review process, the applicant shall submit the required permit
submission data specified within Chapter 8, "Excavation & Fill
Regulations", specifically Section 8-7, entitled "Permit
Required.", Subsection A(l), (2) ,(3) and (B).
3. Revise plans to depict an appropriate fire lane which conforms
to the specifications provided in Chapter 5, Appendix, entitled
"Fire Lane" specifications and standards (Section 5-142(m)).
4. Internal directional arrows shall be provided at all ingress/
egress approaches (Section 5-142(c), Traffic Control).
5. The Developer's Engineer shall provide a plan depicting the
pavement marking striping patterns along Old Boynton Road
necessary for staff to determine whether storage lanes for
eastbound traffic along Old Boynton Road are necessary.
6. In reviewing the landscape plan it appears that the tree
locations at all ingress/egress approach areas and locations
where aisles intersect other aisles may conflict and obscure
with the positioning of required stop signs and other regulatory
devices. Revise plans to ensure that landscaping does not
obsure regulatory signage.
7. The depicted parking lot lighting standard locations, reference
Drawing Sheet Al indicates that the poles and their associated
foundation(s) are situated within the required 2' overhang area.
The parking lot lighting standards shall be relocated into nearby
grassed islands, etc., so as not to cause irregular parking
patterns and/or damage to frontal sections of motor vehicles, etc.
Revise plans accordingly. Note: From a preliminary review of the
lighting standards as depicted, levels of illumination within this
facility will, in all liklihood, not comply with minimum City
standards.

This memorandum shall serve to supplement the original staff comments
for the above referenced project.
This office has determined that the applicant shall install F.P.L.
street lights along Old Boynton Road (North Rights-of-Way) for the
entire length of the property boundary line (south line).
This condition of approval is rendered pursuant to City Code of
. Ordinances, Appendix "C", Subdivision and Platting Regulations,
Article VI. entitled "Application of Ordinance", subsection 4.
entitled "Requirements in lieu of platting" which states:
"If, pursuant to this article, platting is not necessary, in
lieu of platting a certified survey shall be submitted to the
City Engineer's Office and the City Engineer shall reserve
the right to require...improvements required in connection
with platting under this ordinance..."
The installation of F.P.L. street lights by the developer is in
sympathy with F.P.L. street light installations funded by Motorola
along their frontage on Congress Ave., Catalina Center along their
frontage on Congress Ave. and Boynton Lakes North along Congress Ave.

SUBJECT: Boynton Festive Center - 1st Review
Staff has reviewed the above referenced project and offers the
following comments:
1. All water and sewer utilities shall be constructed to
the City of Boynton Beach Standards (see attached)
(Sec. 26-32).
2. Show all proposed on-site utility easements. Easements
shall encompass the entire water system including
meters and main line sewers (Sec. 26-33).
3. Show all proposed fire hydrant locations, water mains
and water services, including meter sizes.
4. Department of HRSjDEP permits will be required for the
water and sewer systems prior to building permit
issuance.
5. A capacity reservation fee will be required within
thirty (30) days of City Commission approval, or upon
request for my signature on the HRSIDEP permit
applications. The fee amount will be determined based
upon meter sizes or expected demand (Sec. 26-34[E]).
6. Large trees are not permitted in existing or proposed
utility easements. There would be apparent confl~cts
between trees and existing underground utilities along
the east and south property lines (Sec. 7.5-18.1).
7. Provide calculations certifying appropriate fire flows
of at least 1500 gpm with a 20 psi residual pressure at
the hydrant.
Items 2, 3 and 6 above must be satisfactorily addressed before
this project proceeds to the City Commission. All other items
may be addressed at time of building permit review.
It is our recommendation that the plan proceed through the review
process.

Comment #6-utilities Director-
On the south and east perimeters of the Center, the Land-
scape Plan has been revised to use native trees that comply with
the Florida Power & Light document 1993 "Plant the Right Tree in
the Right Place". Silver Buttonwood, Wax Myrtle and Sabal Palms
are used within the 20' distance to the pole lines and Sabicu
(classified as a "medium" tree) are used in the parking islands
back 20' from the rlw line where the poles are located. The
Sabal Palms may be used to within 7' plus 2' of the power poles.
All Sabals are further away than 10' and a note has been added to
the drawing for field adjustment of these trees. Since there are
only overhead power lines along these two easements, the roots of
these trees will not interfere with underground utilities.
Addtionally all other underground utilities on the site miss
(as much as possible) any of the proposed planting areas.
Comment #3-Planninq-
The dimensions of the Landscape buffer strip along Congress
and along the west pIL, are to be indicated on the site plan.
This is the dimension that these areas will be built from; not
the Landscape Plan.
Comment #4-Planninq-
This strip is provided on the south side of the adjacent
office building. See the site plan by the Architect for pro-
visions provided on the west common P/L with this same office
building.
Comment #5-Planninq-
Note that the Architect's Site Plan shows that all parking
spaces utilize tire stops set 2' back of the pavement edge as
shown to allow for car overhang. Also the hedges are placed 2'
into the landscape space from the edge of the pavement. Because
of the code requirement of the small scale of the Landscape Plan,
this 2' is not apparent but is provided for on the computer plan.
Comment #10-Planninq-
An additional quantity of plant material (hedge) has been
added to the west property line to form a continuous hedge. The
maximum spacing is 24" o.c.(Wax Myrtle) but the Surinam Cherry
hedge is 18" o.c. The Surinam Cherry hedge stops at the angle of
the P/L N.W. of Retail "A" and directly west of the S.W. corner
of Retail "D". It should be noted that part of this common P/L
with the Boynton Beach Mall is screened on its property with a

existing hedge to screen its parking and therefore the hedge on
the Boynton festive Center is not required in these locations.
Comment #1l-Planninq-
The property line symbol for the out parcels #1 & #2 are not
shown on the Landscape Plan. See the Site Plan of the Architect
for the definitive property line locations for these parcels. The
lines that are shown as a long dash and short dash are standard
"centerline" symbols.
Comment #13-Planninq-
The spacing of the trees along Congress Ave. and Old Boynton
Road does not exceed the 40' spacing. Nothing in the code re-
quires the these trees to be evenly spaced. Therefore because of
light standards, sight distances and allowances for plant growth
the spacing is not identical for every section. On the Congress
Ave. frontage of 200', 10 trees are required and 10 Silver
Buttonwood, 2 Sabicu and 6 Sabal Palms are provided. The code
allows Sabal Palms to count 1:1 and the buffer strip requirements
allows a minimum of "at least" 5' therefore since the Sabicu and
Sabals are not needed for other requirements they can be counted
for the perimeter requirements.
In like manner on the Old Boynton Road frontage, the Sabal
Palms can also count for the perimeter requirements. The total
length of this frontage is 800' (or 280', 300', 220' respectively
from east to west). Therefore 20 trees are required. The 13
Silver Buttonwood (now), 2 Sabicu, and 12 Sabal Palms are pro-
vided. A total of 29 trees which are not counted towards other
requirements.
Interior parking spaces (excluding perimeter parking and
spaces serviced from a driving isle servicing perimeter parking)
number 540. At 20 s.f. of required landscape per space and 1
tree per 500 s.f. of landscape space, 22 trees are required. Ex-
cluding the perimeter trees (above plus 23 for the north P/L), &
17 for the west PIL, & 11 for the west and south of the build-
ings; a net of 85 trees (195-110) count towards this interior re-
quirement of 22 trees. This is still a 4:1 margin even if some
trees can't be planted due to internal sight distance for traffic
signs etc. Also the excess trees for the perimeter would add to
this total.
Comment #14-Planninq-
Why is it necessary to "ensure" that 50% of the required
plant material is native when the note under the plant list on
the drawing states the percentages of all materials are over the
50% native requirement. It is assumed that all reviewers and
landscape contractors know which species are native and which are
not. Ground covers are not required under the code and only
approximately 50% of the trees shown are required, then it
follows that the "50% native requirement is met.

Comment #6-Enqineerinq-
Any conflicts with the Landscape and the regulatory signage
or ingress/egress approach areas will by necessity have to have
the Landscape adjusted out of the conflict areas in the field
as part of supervision of the Landscape construction. Since the
actual locations for regulatory signage and all utilities, paving
and drainage plans are not a construction level at this stage of
approval, it is not feasible or practical to move or eliminate
landscape material for undetermined locations of these engineer-
ing structures.
Comment-Urban Forester
It is questioned whether the Wax Myrtle (Myrica cerifera)
and the Coastal Plain Willow (Salix caroliniana) that exist on
this site should be classified as "trees" under any definition
for protection or mitigation. However a count and assessment
by the Landscape Architect is provided on the drawing and the
extra 60 plus trees above the code requirements on the drawing
should be sufficient for mitigation for loss of these existing
materials (8 Myrtles and 22 Willow). Note that due to the wet
growing conditions that the existing Myrtles and willows are in
presently, it is deemed not feasible that they would transplant
successfully to a urban "high and dry" environment. Addition-
ally the willow are not single trunk and have trunks that have
grown laterally parallel to the ground. These would not allow
for transplanting. The Wax Myrtles are also multi-trunked and
of lesser value as trees.

PUBLIC WORKS
1. We have responded to this comment by amending our drawing
to show the dumpsters on the west property line.
URBAN FORESTER
1. The Landscape Architect will meet with Kevin Hallanhan to
identify the trees that Kevin is concerned about. We will
prepare a tree management program for review prior to or at
the time of building permit.
RECREATION AND PARKS
1. No comments were made by the Department.
FIRE
1. We are in the process of preparing a conceptual water and
sewer plan that will be delivered to Mr. Cavanaugh under
separate cover.
POLICE
1. We have responded to this comment by amending our drawing
to show stop signs/bars at entrances/exits.
UTILITIES
1. Items 1, 4, 5 and 7 will be addressed at the time of
building permit.
2. Items 2 and 3 will be addressed by the conceptual water

BUILDING DEPARTMENT
1. We are not in a position to submit a sign program at this
time. We are now negotiating leases with possible tenants
but to design a program around these potential tenants would
be premature. We realize a separate review may be required
but designing a full sign program would not be cost
effective at this time. In addition a sign program was not
mentioned as being required on your submission handout.
2. We do not feel that a handicap access walkway from
Congress Avenue to the main structure is needed. There is a
sidewalk along Congress Avenue and Old Boynton Road that is
handicap accessible and if used would take people to the
rear building.
ENGINEERING DEPARTMENT
City Engineer's Comments (Dated November 22, 1993)
1. Items 1 through 6 will be addressed by amending the
appropriate plans.
Deputy City Engineer's Comments
1. We have asked Palm Beach County to inspect this sidewalk
and provide us with a letter that it is acceptable to leave
in place or recommend repairs if warranted. We will provide
this letter to you as soon as we have it. We have amended
our drawing to address the second part of the comment.
2. We are not in a position to file an excavation and fill
permit at this time. We understand that a separate
application must be filed and reviewed and we will do this
in conjunction with the building permit application.
3. For items 3, 4, 5, 6 & 7 the plans have been revised to
reflect these comments.
Engineering Comments (dated 12/10/93)
1. At this point in time we are not willing to comply with
this comment. This site is not required to plat and is not
seeking a waiver of plat. The requirement for street lights
comes out of Appendix C. , Subdivision and Platting
Regulations, which are not applicable to this development.

Engineering Comments (Parking Lot Variance)
1. Plans have been adjusted to reflect this comment.
2. Decleration lanes are not being required by the County
for the engress/egress on Old Boynton Road (please note, my
representative only agreed to abide by the decision of the
County Engineer in this matter not to provide the
decleration lane.)
PLANNING AND ZONING DEPARTMENT
1. Based on the survey we have moved the driveway 10 feet to
the east. We have tried to the best extent possible to re-
configure the ingress/egress and our drawings reflect our
efforts. Quite frankly, we are at the mercy of the DeBartolo
Corp. on this item because they will not allow us to move
the driveway. We do not have the ability to reduce the
Retail A building because our potential tenant has demanded
a building of the size indicated on the plan.
2. For items 2 through 12 the plans have been adjusted to
reflect these comments.
3. For item 13, we will submit a landscaping appeal to omit
this requirement. A cross access agreement was supplied in
our first submission in anticipation of this comment.
4. For items 14 through 22 the plans have been adjusted to
reflect these comments.
As you can see, we have adjusted the plans to address most
of the comments made by staff. We hope that you and the
staff will look favorable on these changes and allow this
plan to go forward to the Planning and Zoning board and City
Commission in January, 1994.

Dear Mr. Finizio:
I am writing in response to your memorandum of December 1, 1993 to Tambri Heyden,
a copy of which was sent to me.
In a meeting with the developer of this project, I indicated that the County
would not permit two driveways onto Old Boynton Road for this project. It is our
position that the western most entrance would be too close to Winchester
Boulevard to be properly served by a left turn lane. This entrance should be
deleted.
We feel that this site will be very well served by its remaining access
driveways. We will not be reQuiring a westbound right turn lane to serve the
single driveway onto Old Boynton Road.
At such time as the developer seeks the necessary driveway permit from the
County. we will address our engineering design concerns with his consultant. The
developer is aware of our position on this matter.

Today I reviewed the above-referenced request, more particularly
spelled out on the attached facsimile received from you on December
20, 1993.
In light of time, I polled those TRC members who were not on
vacation for the holidays regarding your request. If I had edited,
retyped and distributed your memorandum, the TRC members would not
have received your memorandum until December 22, 1993 and as you
know, December 23rd and December 24th are City holidays and
comments on the amended site plans are due December 28th.
Concerns were expressed by the various TRC members regarding the
requested procedure - processing the site plan prior to a parking
lot variance application being made and, at minimum, being
discussed at a TRC. Also, concerns were expressed regarding
problems with the proposed throat/driveway design. Therefore, I
cannot accept your expedited processing proposal, and application
should be made by December 27, 1993 for the necessary parking lot
variance.

We recently sent out for second review the site plan for the Boynton Festive
Center. The applicant has requested chat we also review the plan for a 100
foot throat variance for the single driveway on Old BoyntGn Road.
You will recall that the TRC reviewed a similar variance and recommended
approval for a driveway that was proposed just to the south of the main
structure. This driveway was removed from the plan . because the County
would not allow chat driveway.
The applicant would like to go forward to the Planning and Zoning Board
and City Cou~~ission in January, but in order to do so some review o.B
tJ8 variance must take place now so that we can structure a recommendation
taat will include the variance.
Since the applicant has tried to comply or respond to all comments co date
we would ask that: you take the extra few minutes to review the proposed
driveway on the site plan at this juncture. Comments on the variance should
be sent to us at the same time as the site plan in a seperate memo.

Dear Mr. McMillen:
Your site plan review submittal regarding Boynton Festive Center
has been placed on hold and will not be forwarded to the January
11, 1994 Planning & Development Board Meeting. The recent
submittal of a parking lot variance for the project created a
conflict with regards to Board review of a site plan that
requires a variance determination. The parking lot variance is
scheduled for public hearing before the Planning & Development
Board on February 8, 1994. The site plan will be placed on the
February 8, 1994 Planning & Development Board agenda which will
enable both requests to be reviewed concurrently. With regards
to the landscape appeal for the project, I recommend that it also
wait until the February 8, 1994 meeting. However, it is
scheduled for review by the Planning & Development Board on
January 11, 1994 and the appeal will remain on schedule unless
written confirmation from you to hold the request, until the
February 8, 1994 meeting, is received. If you do not want the
item on the January 11, 1994 agenda please forward your
determination to Ms. Tambri Heyden, Acting Director of Planning &
Zoning (407 375-6260) as soon as possible.
Attached find comments that were generated as a result of the
review of the amended plans, submitted on December 16, 1993, for
the Boynton Festive Center project. You have an opportunity to
rectify the unresolved comments and address the comments that
staff request be resolved prior to the project moving forward.
Note: January 12, 1994 is the deadline date for submitting
amended plans that will be processed for review by the planning &
Development Board Meeting of February 8, 1994. Find below a copy
of the standards for services and fees for site plan review of
your project. The fee for the third review will be assessed
following the review.

The following is a list of comments regarding the 2nd review of
the above-referenced project. It should be noted that the
comments are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the 2nd review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building except for the following comments, Numbers
1, 2 and 6.
In addressing comment No.1, the applicant enlarged the east on
site radius at the driveway opening to allow for a better
transition into the site. However, the access to the site still
does not create a fluid alignment with the traffic aisle located
in front of the building. The building configuration has not
been adjusted. In my opinion the applicant needs to attempt
reconfiguring the building to allow the formation of two large
radii in the parking area to develop a traffic aisle that creates
a longer transition from the offset driveway to the
aforementioned traffic aisle in front of the building. The
longer transition will allow a safer traffic flow with ease in
movement.
There has been a formal submittal to seek relief from the code
requirements for comments Nos. 2 and 6. However, the submittal
to seek relief from comment No.2, Parking Lot Variance, will not
be scheduled for review by the Planning & Development Board or
City Commission at the same time as the Site Plan. The Parking
Lot Variance is scheduled for a February 8, 1994 public hearing
before the Planning & Development Board with final action by the
City Commission on February 15, 1994. The Landscape Appeal and
Site Plan are on schedule for review by the Planning &
Development Board on January 11, 1994 and final review by the
City Commission on January 18, 1994. Following general procedure
the site plan review and landscape appeal will be held in
abeyance until February 8, 1994, at which time all items may
proceed concurrently for review by the Planning and Development
Board with their recommendation forwarded to the City Commission
meeting of February 15, 1994. My recommendation is to follow the
general practice. At your direction, I will forward that
determination and these comments to the applicant. I will also
forward the outstanding comments from the other reviewing
departments so that the applicant has the opportunity to correct
issues that the reviewing departments want rectified prior to the
project being forwarded to the reviewing Boards. In following
the Site Plan Review schedule, the applicant shall submit amended
plans no later than 5:00 p.m. on January 12, 1994 to meet the

deadline for submittal of amended plans that are being forwarded
for February 8, 1994 review.
The second categ0ry is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments, with the exception of Nos. 1, 2 and 6, can be
rectified on the plans at time of permitting with consideration
given to the final determination of the request for Site Plan
Review, Parking Lot Variance, and Landscape Appeal. The
applicant must understand that additional comments may be
generated upon review of the documents and working drawings
submitted to the Building Department for permits for the proposed
project.
I. Site Plan Review Comments:
1. Based on the letter from Stephen E. Platz, of the Edward J.
DeBartolo Corporation, dated November 15, 1993, it appears that
they cannot move the northwestern ingress/egress so that the
entrance aligns with the traffic aisle in front of the main
building. Therefore, as discussed with your representative, a
rearrangement or reconfiguration of the building would allow for
a better access to the traffic aisle in front of the main
building. There has been no request, by Staff, to reduce the
size of the building.
2. Show and diwension on the site plan a distance along both
sides of the Old Boynton Road ingress/egress access aisle to the
site, of no less than one hundred (100) feet from the property
line to the first access aisle that leads to on-site parking
and/or the first parking stall or be granted approval of a
Parking Lot Variance for said code requirement.
3. Revise the second legend note to reflect a thirty-five (35)
foot long loading zone. The plans state forty-five (45) feet.
The loading zones drawn on the plan are dimensioned 35 feet long.
4. The location and number of parking spaces shown on the
landscape plan do not match the spaces identified on the site
plan. Correct the plans accordingly.
5. Remove the text following the last symbol identified on the
legend notes and replace with the following: "Site plan r~view
is required for the two (2) outparcel buildings - 6,000 square
foot retail building and 9,000 square foot restaurant building".
6. Show on the landscape plan a continuous two point five (2.5)
foot wide landscape strip required to separate the Boynton
Festive Center site from the existing three (3) story office
building site or be granted approval of an appeal to said
landscape code requirement.
7. Add to the typical detail drawing of the 17'0" long parking
space, the location of the adjacent hedge landscape material.
Include on the drawing the 18'0" dimension which is the minimum
length of a parking space.
8. Extend the required vehicle use area screening to form a
continuous, unbroken, solid perimeter visual screen hedge to
within three (3) feet of each side of each on-site ingress/egress
entrance driveway access aisle. Dimension the three (3) foot

distance at each driveway or provide a typical note on the
landscape plan. Note: Amend the plant count shown on the plan
view drawing accordingly. New material shall not exceed the code
required spacing of two (2) feet on center.
9. To verify that the spacing of the required trees along Old
Boynton Road are located no further apart (trunk to trunk) than
the code specified forty (40) feet on center, place a typical
note "maximum spacing forty (40) feet on center'l between
extension lines that were placed between the trunks of two of the
required trees located along Old Boynton Road. The spacing of
the trees just west of the Old Boynton Road driveway exceed the
forty (40) foot on center spacing.
10. To ensure that fifty (50) percent of the required landscape
material is native, identify the native specie by placing a
distinguishable symbol on the plant list next to the native
specie.
11. The project is located in the modern design district as
specified in the Community Design Plan. The project is not in
compliance with the window aspect of the architectural features
and/or treatments part of the modern design district. The
Community Design plan offers an alternative method of providing
the required window type. Amend the elevation view drawing to
show and label no less than two (2) of the appropriate type of
window or seek approval of an appeal to the Community Design
Plan. The plans identify one (1) type of allowed window--fixed
glass store front.
12. Amend the site plan and floor plan drawing to accurately
depict the true configuration of the front of the main building.
Include showing and dimensioning overhangs, canopies, columns and
prefab steel geometries. Note: Adjust the overall building
setback from the property line to the leading edge of the main
building on the east and south sides.
13. On the elevation view drawing label the location of the base
trim that is specified in the exterior color schedule. Also,
specify the color of the downspouts, metal scuppers and exterior
doors located on the west elevation of the main building.
14. Submit a revised site plan review application that reilects
the changes that were made on the plans that affect the
percentage of pervious and impervious area as previously
identified on the original application.
II. RECOMMENDATION(S):
1. Recommend changing the species of some of the trees located
in the perimeter landscape strip along Congress Avenue and Old
Boynton Road to a species that is different than the hedge
material located in the same landscape strip. The new specie
should be acceptable to be placed under overhead power lines.
Example: Yellow Elder, which is a native evergreen flowering
tree.
NOTE: If recommendations are approved, incorporate them into the
working drawings required for permits for the project.

Dear Ms. Heyden:
As you requested I am writing to you regarding possible scenarios
regarding the outparcels at the Boynton Festive Center. This is
to clarify if it will be necessary for the outparcels to undergo
major site plan review, when we submit building plans for the
structures.
Scenario One:
Building Plans for either one or both of the outparcels are
submitted for permits. The structure is the same as the structure
proposed on the site plan and the square footage is equal to that
proposed on ~ne site plan. No changes have been made to parking,
Idndscaping, loading zones, dumpster locations etc. The building
meets the criteria of the community design plan and the signage
meets code. Would these plans be subject to major 8i te plan
review or would they fall under the waiver of site plan/minor
site plan review provisions of the code?
Scenario Two:
Building Plans for either one, or both of the outparcels are
submitted for permit. The structure is smaller that the original
foot print but about the same similar shape and does not go
outside the original footprint on the site plan. There is
increased landscaping, but loading zones, dumpster locations,
parking, etc. are the same as the approved site plan. The
building meets the criteria of the community design plan and the
signage meets code. Would these plans be subject to major site
plan review or would they fall under the waiver of site
plan/minor site plan review provisions of the code?
Please note that in both of the scenarios;
1. There is no increase of square footage above 5% of the
allowed square footage of the site plan.
2. There is no significant change to the shape 0
structure.

I have reviewed your letters dated January II, 1994; each
separately addressing the above-referenced topics. Statt's
position regarding both issues remains as discussed with your
representative, Chris Cutro, and the previously written site plan
review staff comments. The staff comments will become part of
the package that is forwarded with the project for review by the
Planning and Development Board and City Commission. Therefore,
the final determination regarding both issues will be resolved by

This letter is to address two comments on the Boynton Festive
Center that we discussed earlier in the week. I have taken the
liberty of writing to you because Doug McMillen is out of town
until Monday.
First, regarding the comments by the Building Department on the
glass on the north side of the retail outparcel we are in the
process of applying for a variance to allow the design to stay in
place.
Second, regarding the landscaping on Congress Avenue, the
landscape architect is working on alternatives that will be
presented to you next week. We will be prepared to make a full
presentation on them at the Planning and Development Board
meeting.
I would ask that this information be distributed to the Board
members at the meeting on Tuesday. We will make the drawings
available to you if we get them early on Monday.

This letter is to summarize the meeting that took place
between you, Ted Majdiak, Chris Cutro and myself on the 23rd
of March at your office.
At that meeting I reviewed with you the new site plan that
we are planning to submit to the City on April 7, 1994. We
also gave you three alternative landscaping plans that were
based on the old site plan for your review, with the hope
that we would receive from you, some indication as to a plan
that you preferred and would support, as part of our
landscaping appeal.

In reviewing the new site plan, you suggested that the rear
driveways behind the outparcels be made one way, so that the
loading zones would not interfere with two way traffic. We
agreed to either do this or to increase the size of the
driveways so that the loading space as well as the two way
traffic could be accommodated.
We agreed to review the planting islands, fronting on
Congress Avenue, and if possible reduce the widths and add
another island or two, to accommodate the trees that need to
be relocated from the Congress Avenue City Utility Easement.

We also discussed the possibilit~/'Of shifting the approval
for one outparcel to the other putparcel. The example that
we gave was that we would submit elevations and details for
the South outparcel but if it was decided to remove this
outparcel we would have the ability to move the approved
elevations and details to the North outparcel with no review
by the TRC, Planning and Development Board and the City
Commission. This was agreed to so long as the building was
not expanded and the elevations remained the same.

Regarding the variance for the driveway throat it was agreed
that you would discuss the need for readvertisement with Jim
Cheroff and get back to us on the procedure to follow. Chris
Cutro has since indicated to me that he received a phone
call from Mike Haag and that we need to submit an amended
application and a check for $134.00, when we submit the site
plan to you.
As explained at the meeting, the deadline date for submittal
is April 7, 1994 to turn in the plans, amended application
and amended variance application. It was agreed that we
would try to submit the entire plan package, but if the
landscaping plan was not completed that we could submit that
plan by the 11th of April, 1994.
I would ask that you review this letter and enter it into
the Boynton Festive Center' file. If you have any problems
with this summarization, please contact me inunediately so
that we can work out any differences.

Dear Mr. McMillen:
On April 11, 1994 your submittal for Site Plan Review of the above
referenced project was reviewed for completeness. It has been
determined that the submittal is substantially complete and
accepted for further processing. A Planning and Zoning department
staff member will be responsible for the review and coordination of
your site plan through the remainder of the Site Plan process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, Section 8, and all applicable sections
of the Boynton Beach Code of Ordinances. Due to the fact that the
subject submittal will require staff work beyond standard site plan
review the following shall apply: Resolution #92-211, Exhibit "A"
states that any additional staff work over the established
standards will be billed to the applicant based on hourly salary of
employees involved, plus 35% for fringe benefits and indirect
costs. Please be advised these costs should be available to you by
May 1, 1994 and should be paid for between May 1, 1994 and May 10,
1994. At the present time your project will be reviewed by the
Planning and Development Board of May 10, 1994, and final
determination by the City Commission on May 17, 1994.

This is to confirm that we will add a note to the face of
the landscaping plan that if a conflict is discovered
between the landscaping plan and the traffic control
signage, the landscaping plan will be adjusted to remove the
conflicts.
Regarding the street lights on Old Boynton Road, we will
arrange with FPL to install between 3 and 4 lights and pay
the necessary fees to the City of Boynton Beach before we
pull a building permit for this project.

This letter is provided at your request to identify the elements of
the building elevation of the proposed Borders tenant space that
staff recommends to be changed in order for the changes from the
original approved plans to be processed as a minor site plan
modification. The elevation view drawings shown on the plans
prepared by Bignell Watkins Hasser Architects P.A. dated 4/11/95
with revision nO.2 dated 5/16/95, project no. 95045.00 were the
drawings used to make the following recommended changes:
1. Remove all neon.
2. Narrow the upper sign band of the Borders tenant facade

recommendations are a condition of staff accepting the radius shape
