BOYNTON FESTIVE CENTER
NEW SITE PLAN
PLANNING AND ZONING DEPARTMENT MEMORANDUM #94-035
SITE PLAN REVIEW
STAFF REPORT
FOR
PLANNING AND DEVELOPMENT BOARD AND CITY COMMISSION
January 31, 1994
DESCRIPTION OF PROJECT:
Project Name:
Boynton Festive Center
Applicant:
McMillen Development, Inc.
Agent:
Douglas McMillen
Location:
Northwest corner of Congress Avenue
and Old Boynton Road
Land Use Plan Designation:
Local Retail
Zoning Designation:
C-3 Community Commercial District
Type of Use:
Retail center with a restaurant and
retail outparcel building
Number of Units:
N/A
Square Footage:
Building(s): 115,000
Site: 10.1 acres
Proposed Development: The proposed site will be developed
into a retail center that contains a main building with
100,000 square feet and two (2) outparcel buildings; a retail
building with 6,000 square feet, and a restaurant building
with 9,000 square feet. The restaurant building is shown in
location and size on the site plan. There are no elevation
view drawings of the proposed restaurant building. The main
building is planned for tenant occupancy and is located
approximately 600 feet west of Congress Avenue with the front
of the building facing Congress Avenue.
The two outparcel buildings are approximately 150 feet west of
Congress Avenue and both buildings face Congress Avenue. The
remainder of the site contains parking spaces, loading zones,
dumpster enclosures and landscaped areas. Ninety two point
seven (92.7) percent of the site is impervious. The
impervious area includes building gross floor area, vehicle
use area and all other impervious area depicted on the plans.
Site Characteristics: The existing site consists of one lot
which is vacant of structures. The City Forester is working
with the applicant regarding the preparation of a tree and
vegetative survey of the property. The northwest portion of
the site contains viable plant life. There are existing
recorded easements located on the frontage of the property
along Old Boynton Road and Congress Avenue.
Traffic: A project that generates more than 1,000 net trips per
day is required to be reviewed by the Palm Beach County
Traffic Division. The Traffic Division reviewed the traffic
impact study submitted by the applicant and determined that
the 2,578 net trips per day generated by the project at a 1995
build-out are within the threshold to maintain the project in
compliance with the Traffic Performance Standards. Traffic is
determined on an individual basis per development. The county
did not indicate what the total count of remaining trips are
available for the area of influence of the proposed
development.
'Boynton Festive Center - Staff Report
Page 2
Driveways: A total of four (4) two-way driveways lead to the
site. Only one driveway, located on Old Boynton Road, allows
direct access to the site. The other three driveways allow
access to the site through adjacent sites. The Congress
Avenue and northeast access are located on the Great Western
Bank site. The northwest access is through a Boynton Mall
access easement.
Parking Facility: Based on the shopping center use and the
floor area identified on the plans for all structures, a
total of 575 parking spaces are required to support the
shopping center use. There are 606 parking spaces provided.
Two percent of the total parking spaces provided shall be
built and designed for the handicapped. Thirteen (13)
handicapped spaces are required and the plans indicate
seventeen (17) handicapped spaces provided. The handicapped
spaces are evenly distributed throughout the site. A fire
lane fronts the east side of the main building. Six loading
spaces and seven dumpster enclosures are provided to service
all structures proposed for the site.
Landscaping: Seven point three (7.3) percent of the site is
pervious and dedicated to landscape areas. The parking area
contains 1nterior landscape islands and there are landscape
strips around the perimeter of the entire project. Minimal
landscaping is shown adjacent to the buildings. The site
contains landscaping that will meet the requirements of the
code upon compliance with the technical aspects of the
Landscape Code. Supplemental landscape material is shown on
the landscape plan. A wide variety of material is proposed
with many plants being a native specie.
Building and Site Regulations: The three structures as depicted
on the site plan are in compliance with the C-3 Building and
Site Regulations specified in Appendix A-Zoning for lot area,
lot frontage, maximum floor area coverage, and all setbacks.
The height of all three structures, as noted on the plan, are
in compliance with the City height limitations. Each
structure is identified as a one story building.
Community Design Plan: The site is located in the Modern Design
District and upon compliance with staff comments will be in
compliance with the architectural theme requirements of the
modern district for building elements and streetscape
landscaping. The main building and the retail outparcel
building have a rectangular shape. The north end of the main
building has a prefabricated geometric shaped steel fixture
located above the building entrance and attached to the roof.
The walls of the front and north sides of the main building
have split face block along the bottom with a grooved stucco
pattern above. The south face of the building has the grooved
stucco pattern and the rear of the building is stuccoed. The
color of the grooved stucco is peach and the color of the
split face block and stucco is medium grey. See the exterior
color schedule for the location of same and the other colors
and materials proposed for the other elements of the main
building and the retail outparcel building. The location and
size of the restaurant building is shown on the site plan,
however, no elevation view drawings were submitted for review.

File No:
The following is a list of comments regarding the 2nd review of
the above-referenced project. It should be noted that the
comments are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the 2nd review. To show compliance with comment number 1 will
require substantial modifications to be made to the site. The
remaining comments can be rectified on the plans at time of
permitting with consideration given to the final determination of
the request for site plan review, parking lot variance (reference
comment #2), and landscape appeal (reference comment #6).
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
The applicant must understand that additional comments may be
generated upon City review of the documents and working drawings
submitted to the Building Department for permits for the proposed
project.
I. Site Plan Review Comments:
1. Based on the letter from Stephen E. Platz, of the Edward J.
DeBartolo Corporation, dated November 15, 1993, it appears that
they cannot move the northwestern ingress/egress so that the
entrance aligns with the traffic aisle in front of the main
building. Therefore, as discussed with their representative, a
rearrangement or reconfiguration of the building would allow for
a better access to the traffic aisle in front of the main
building. There has been no request, by Staff, to reduce the
size of the building.
2. Show and dimension on the site plan a distance along both
sides of the Old Boynton Road ingress/egress access aisle to the
site, of no less than one hundred (100) feet from the propertv
line to the first access aisle that leads to on-site parking
and/or the f~rst parking stall or be granted approval of a
Parking Lot Variance for said code requirement.
3. Revise the second legend note to reflect a thirty-five (35)
foot long loading zone. The plans state forty-five (45) feet.
The loading zones drawn on the plan are dimensioned 35 feet long.
Boynton Festive Center - 2nd Review
Page 2
4. The location and number of parking spaces shown on the
landscape plan do not match the spaces ident~fied on the site
plan. Correct the plans accordingly.
5. Remove the text following the last symbol identified on the
legend notes, sheet A-I, and replace with the following: "Site
plan review is requ1red for the 9,000 square foot restaurant
building".
6. Show on the landscape plan a continuous two point five (2.5)
foot wide landscape strip with the appropriate landscape material
that is required to separate the Boynton Festive Center site from
the existing three (3) story office building site or be granted
approval of an appeal to said landscape code requirement.
7. Add to the typical detail drawing of the 17'0" long parking
space, the location of the adjacent hedge landscape material.
Include on the drawing the 18'0" dimension which is the minimum
length of a parking space.
8. Extend the required vehicle use area screening to form a
continuous, unbroken, solid perimeter visual screen hedge to
within three (3) feet of each side of each on-site ingress/egress
entrance driveway access aisle. Dimension the three (3) foot
distance at each driveway or provide a typical note on the
landscape plan. Note: Amend the plant count shown on the plan
view drawing accordingly. New material shall not exceed the code
required spacing of two (2) feet on center.
9. To verify that the spacing of the required trees along Old
Boynton Road are located no further apart (trunk to trunk) than
the code specified forty (40) feet on center, place a typical
note "maximum spacing forty (40) feet on center". The spacing of
the trees just west of the Old Boynton Road driveway exceed the
forty (40) foot on center spacing.
10. To ensure that fifty (50) percent of the required landscape
material is native, identify the native specie by placing a
distinguishable symbol on the plant list next to the native
specie.
11. The project is located in the modern design district as
specified in the Community Design Plan. The project is not in
compliance with the window aspect of the architectural features
and/or treatments part of the modern design district. The
Community Design plan offers an alternative method of providing
the required window type. Amend the elevation view drawings of
both buildings to show and label no less than two (2) of the
appropriate w~ndow types or seek approval of an appeal to the
Community Design Plan. The plans identify one (1) type of
allowed window--fixed glass store front.
12. Amend the site plan and floor plan drawing to accurately
depict the true configuration of the front of the main building.
Include showing and dimensioning overhangs, canopies, columns and
prefab steel geometrics. Note: Adjust the overall building
setback from the property line to the leading edge of the main
building on the east and south sides.
13. On the elevation view drawing of the main building label the
location of the base trim that is spec1fied in the exterior color
schedule. Also, specify the color of the downspouts, metal
scuppers and exterior doors located on the west elevation of the
main building.
. Boynton Festive Center - 2nd Review
Page 3
14. Subm1t a revised site plan review application that reflects
the changes that were made on the plans that affect the
percentage of pervious and impervious area as previously
identified on the original application.
15. On the site plan, show the location of the overhang for the
retail building. Specify the width of the overhang and dimension
the distance to the east and north property lines from the
leading edge of overhang. The setback distances shall be in
compliance with the C-3 zoning requirements. Also, identify the
width and length of the building.
16. Correct elevation note #2 on sheet A-2 to represent that
elevation view drawings shall be submitted at the time of site
plan review of the restaurant building outparcel #1.
17. Identify in the statistics the total gross leasable floor
area and the total gross floor area for the main building and
each outparcel.
18. Correct the inconsistency regarding the overall height of
the buildings identified in the statistics found on sheet A-I and
the overall height of the buildings identified on the elevation
view drawings.
II. RECOMMENDATION(S):
1. Recommend changing the species of some of the trees located
in the perimeter landscape strip along Congress Avenue and old
Boynton Road to a species that is different than the hedge
material located in the same landscape strip. The new specie
should be acceptable to be placed under overhead power lines.
Example: Yellow Elder, which is a native evergreen flowering
tree.
NOTE: If recommendations are approved, incorporate them into the
working drawings required for permits for the project.

Re: Boynton Beach Center, NWC of Congress Avenue &
Old Boynton Road, Boynton Beach, Florida
Dear Tambri:
We have received the second set of comments from the technical
review committee on the Boynton Festive Center. As far as we can
tell, there are five comments that must be addressed so that the
site plan can go forward. Three comments came from your
department and the other two from the Utilities Department.
We have applied for a parking lot variance and a landscaping
appeal which responds to two of your comments. In addition, we
have contracted John Guidry and have addressed his comments in
writing. This leaves the comments your department has made on the
north driveway, the only comment that is unaddressed at this
time.
By way of this letter we would request that you allow the site
plan for the Boynton Festive Center to go forward as it is
presently drawn. Please do not take this as us throwing down the
gauntlet and asking to do battle. There are circumstances that we
believe are out of our control and have led us to this impasse.
As we explained in our meeting with you, we are now negotiating
to rent a portion of the main structure to national retail
tenants, who, whether we like it or not, have their own standards
in terms of floor area and store dimensions. In designing this
site, we have taken these standards into consideration. In short,
our ability to keep our anchor tenant on this site, could be
greatly affected if forced to redesign their store at this time.
A second circumstance is the control that is exercised over this
property by the DeBartolo Company. We both agree that the easiest
way to solve the driveway problem is to move the driveway to the
east and reconfigure the median at the driveway. We are willing
to do this however, . the DeBartolo Company will not allow us to
do so (a letter stating this has been provided in previous
submittals).

Unfortunately, at this juncture what is needed is flexibility by
all the parties involved, but to date, we have been unable to
move our potential tenant or the former owner of the property.
We recognize that you are not supporting this driveway
configuration and it is your right not to do so, based on
standards in your codes. However, because of our time constraints
regarding closing on this property, we would ask that you allow
the site plan to go forward as it is drawn. This will allow you
and us to make presentations to the Planning and Zoning Board and
the City Commission and have them decide the issue.
I hope that you will look favorable on this request. If you
should have any questions please feel free to call me.
Very truly yours,

RE: Boynton Festive Center, NWC of Congress Avenue &
Old Boynton Road, Boynton Beach, Florida
Dear Ms. Heyden:
As you requested I am writing to you regarding possible scenarios
regarding the outparcels at the Boynton Festive Center. This is
to clarify if it will be necessary for the outparcels to undergo
major site plan review, when we submit building plans for the
structures.
Scenario One:
Building Plans for either one or both of the outparcels are
submitted for permits. The structure is the same as the structure
proposed on the site plan and the square footage is equal to that
proposed on tne site plan. No changes have been made to parking,
landscaping, loading zones, dumpster locations etc. The building
meets the criteria of the community design plan and the signage
meets code. Would these plans be subject to major site plan
review or would they fall under the waiver of site plan/minor
site plan review provisions of the code?
Scenario Two:
Building Plans for either one, or both of the outparcels are
submitted for permit. The structure is smaller that the original
foot print but about the same similar shape and does not go
outside the original footprint on the site plan. There is
increased landscaping, but loading zones, dumpster locations,
parking, etc. are the same as the approved site plan. The
building meets the criteria of the community design plan and the
signage meets code. Would these plans be subj ect to maj or site
plan review or would they fall under the waiver of site
plan/minor site plan review provisions of the code?
Please note that in both of the scenarios;
1. There is no increase of square footage above 5% of the
allowed square footage of the site plan.
2. There is n0 significant change to the shape 0
structure.
P.O. Box 772530. Coral Springs. Florida 33077-2530. 305/345-7000. FAX 05/
3. There is no dec.cease in r-arking, landscaping or other
development si:.andard.
4. That the proposed structures will comply with the
modern design guidelines.
We would appreciate if you would review these scenarios as soon
as possible and respond in writing, regarding what procedure
would need to be followed.
If you should hav~ any questions regarding this request, please
feel free to call me.
Very truly yours,

Re:
TRC COMMENTS - SITE PLAN REVIEW
BOYNTON FESTIVE CENTER
Northwest Corner of Congress Avenue & Old Boynton Road
Thank you for forwarding the building floor plans and elevations for
outparcel Building *2 of Boynton Festive Center for our comments.
On our first and second set of comments for this project, we did not
include the outparcel building elevations because of a note on Sheet
A-2 stating that the outparcels would be submitted at the time of
permitting for the outparcel buildings. We understood that to mean it
would have to go back for site review for each of these parcels.
After reviewing the drawings dated January 24, 1994, for outparcel
Building *2, the Building Department cannot approve this plan, however
our original comment to go forward still stands and Table 600 must be
met at permit time.
We would suggest that you advise the applicant that if his building
setback is 2.5' from the property line, it cannot comply with Table
600 with any openings, even if it were constructed as a Type I
Building.
We have not received any written notice from your department, but it
is our understanding that the applicant intends to tie the first
structure originally approved by this department to the outparcel
buildings.
These comments supersede comments made on the original set of plans.
In order for us to support this for variance, the existing access road
would have to be permanently dedicated as public space because between
zero to 3' from property lines, openings are not allowed.

The Building Department has reviewed the amended plans for the
above referenced project and offers the following:
1. The applicant's comments regarding the sign program are
acceptable.
2. There must be painted markings on the walkway from the road
right-of-way to the front entrance of each building. The
sidewalk that you have shown around the building to the rear
structure does not meet the intent of the code for the two
buildings facing Congress Avenue.
We recommend that the plans be forwarded to the Planning and
Development Board since our comment #2 can be met at time of
permit.

of this site has applied for a variance from the landscaping code
to reduce the number of trees required along the east side of the
property. As this signifies the developer's intent to not place
trees within the utility easement, we have no objection to this
si te pI an and variance proceeding to the P&D Board and Ci ty
Commission for action.
Please refer any questions on this matter to Peter Mazzella of this
office.

L.N. & A. Project No. 94-174
PROJECT: BOYNTON FESTIVE CENTER
APPLICANT: McMillen Development, Inc. and Cutro & Associates.
Your File No. 792
The Engineering Department for the City of Boynton Beach, Florida has reviewed the
above referenced plan, as well as a previous Engineering Department Memorandum
(E.M.D) 93-390 concerning this project. The following comments correspond to
E.D.M. 93-390 (copy attached):
1. Plans package includes landscape plans. Therefore, Item 1 of previous memo
considered resolved.
2. The orientation of the words "fire lane" does not c:;ppear to be corrected.
Orientation shall be corrected before permit is issued.
3. Engineering department reiterates previous concern that applicant pay
appropriate street lighting fee prior to Board approval.
1 00' THROAT VARIANCE - It appears no corrective measured have been taken to
satisfy the 100' throat requirement. Therefore, our stance is the same as stated in
E.D.M. 93-390 and defer to the Planning Department.
ENGINEERING DEPARTMENT RECOMMENDATIONS - Items 2 and 3 above can be
resolved at time of permit application and are for the developer consideration at this
point in time. We feel the above concerns should not deter the project. We
recommend forwarding the plans to the Planning and Development Board.

The following is a list of comments regarding the 2nd review of
the above-referenced project. It should be noted that the
comments are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the 2nd review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building except for the following comments, Numbers
1, 2 and 6.
In addressing comment No. I, the applicant enlarged the east on
site radius at the driveway opening to allow for a better
transition into the site. However, the access to the site still
does not create a fluid alignment with the traffic aisle located
in front of the building. The building configuration has not
been adjusted. In my opinion the applicant needs to attempt
reconfiguring the building to allow the formation of two large
radii in the parking area to develop a traffic aisle that creates
a longer transition from the offset driveway to the
aforementioned traffic aisle in front of the building. The
longer transition will allow a safer traffic flow with ease in
movement.
There has been a formal submittal to seek relief from the code
requirements for comments Nos. 2 and 6. However, the submittal
to seek relief from comment No.2, Parking Lot Variance, will not
be scheduled for review by the planning & Development Board or
city Commission at the same time as the Site Plan. The Parking
Lot Variance is scheduled for a February 8, 1994 public hearing
before the Planning & Development Board with final action by the
City Commission on February 15, 1994. The Landscape Appeal and
Site Plan are on schedule for review by the Planning &
Development Board on January II, 1994 and final review by the
City Commission on January 18, 1994. Following general procedure
the site plan review and landscape appeal will be held in
abeyance until February 8, 1994, at which time all items may
proceed concurrently for review by the Planning and Development
Board with their recommendation forwarded to the City Commission
meeting of February 15, 1994. My recommendation is to follow the
general practice. At your direction, I will forward that
determination and these comments to the applicant. I will also
forward the outstanding comments from the other reviewing
departments so that the applicant has the opportunity to correct
issues that the reviewing departments want rectified prior to the
project being forwarded to the reviewing Boards. In following
the Site Plan Review schedule, the applicant shall submit amended

BOYTON FESTIVE CENTER
DRAINAGE SUMMARY
General site Information / Existing Conditions
The project site is approximately 11 acres in size and is located
on the northwest corner of Old Boynton Road and Congress Avenue
in the City of Boynton Beach, Florida (See Figures 1 & 2). The
si te is an out parcel to the Boynton Beach Mall and is in the
City limits of Boy ton Beach.
Storm Water Management
The site is considered an out parcel to the original Boynton Mall
development. The property was accounted for in the mall drainage
and storm water retention system. No on site retention was
anticipated in the original drainage plan and all retention for
the property is included in the mall system. A 54" diameter
concrete culvert has been provided at the northwest corner of the
site to accommodate the property drainage with an allowance for
55 cfs of flow. The culvert connects to the existing mall
retention pond system.
The mall system consist of inlets and pipes which discharge to a
series of on site retention ponds, which in turn discharge to
ei ther the Boynton Canal of the north of the mall or the Lake
Worth Drainage District Canal L-23 at the northwest corner of the
mall. Control structures for discharge to the canals are in
place. The property is covered by master drainage permits from
the Lake Worth Drainage District and the South Florida Water
Management District. The property is included in these existing
permits. However, plan submittal and request for permit
modification will be required to construct the site.
Flood criteria for the property has been determined by the master
drainage permitting process. Buildings and other site features
will have to meet the pre-established permitted flood criteria
The conceptual design of the on site positive drainage consist of
a system of pipes and inlets connected to the existing 54"
outfall. Pollution retardant structures will be included in the
system to prevent floating oils and debris from entering the mall
retention ponds.
Attached are copies of the conceptual drainage system design
computations, a copy of the mall master drainage permit, an
excerpt from the mall master drainage plan showing the
relationship of the out parcel drainage to the mall system and
a copy of the original mall drainage calculations showing the
inclusion of the site in the system calculations.

Re: Boynton Beach Mdll Permits
Dear Chuck:
Pursuant to your request in regard to necessary permit approval~ from the
Florida Department of Environmental Regulation (OER) for the Boynton Beach
Mall, we have detennined that the best way to obtain a "stonThoJater dischargelf
approval is by modifying your existing SFWMD permit. This approval can now
be obtained from SFWMO because OER has delegated this respons1b111ty to them
effective February 1, 1982. This permit modification can be obtained by' letter
submittal and possibly staff approval.
The only other possible DER approval would be for a Dredge/Fill Permit. Based
on letters (rom Mr. Herb Zebuth (see enclosed copies) dated August 3~ 1981 and
August 26~ 1981, and my letter dated August 19, 1981, a Dredge/Fill Permit is
not required if the stormwater d1scharge approval is obtained. Although your
stormwater discharge approval Hill not be obtained from OER, we feel that the
enclosed 1 etters obviates the need for a Dredge/Fill Pennit if SFWMO stonrwater
discharge approval is obtained.
Because of the abovE: stated approach to DER perm; t requi rements, I am returning
your check (enclosea) that you had previously sent to me for a DER Dredge/Fill
Pennit application fee. Please let me know as soon as possible when to proceed
with the SFWMO permit modification.
In addition to the above, permits from DER will have to be obtained for the lift
stat10n and the on-site sanitary sewer system. If you have any Questions on the
above, please give me a call.
Very truly yours,
GEE & JENSON
