Ms. Heyden distributed colored elevations which were revised to reflect the -
introduction of glass block. Because staff was uncomfortable with the exposed
rafters and the gables, the applicant has now included black grill work with
mesh screen behind which will hide the rafters. Grill work is a material
allowed in the "Modern" design district. Glass block is not; however, glass
block has been used in other "Modern" districts.
In response to Vice Mayor Matson's question, Ms. Heyden advised that the colors
of the main shopping center buildings are beige and gray.

Commissioner Aguila does not mind the building. He feels the gables are a bit
too busy, but he likes the metal Qrill work. He does not have a problem with
this project.
Commissioner Aguila questioned the signage.
Jill Jarkesy, representing the applicant, said there are two (2) signs proposed
for the entire site; one on the corner and one on the building. The applicant
has agreed to come back with the sign program for the entire site.
Motion
Commissioner Aguila moved to approve the request for the Conmunity Design
appeal. Vice Mayor Matson seconded the motion, which carried 5-0.

Tambri Heyden made the presentation. There are minor changes in the landscaping
and circulation.
Ms. Heyden referred to Engineering Comments dated 9/30/94, wherein one comment
requires providing a landscape break every ten parking spaces. When this came
before the Commission in July, the approval asked that the applicant add addi-
tional interior landscaping provided no parking spaces are lost. This comment
will eliminate parking spaces. This comment came from engineering standards
which are not approved by Ordinance. This is in conflict with the Landscape
Code since the requirement is not contained therein.
In response to Commissioner Katz' question, Ms. Jarkesy said there are no plans
for the space Buy Wise was originally intended to occupy. Commissioner Katz
questioned whether or not additional landscaping could now be added since the
need for a certain number of parking spaces for Buy Wise no longer exists. Ms.
Jarkesy said significant additional landscaping has already been added. Eight
foot median landscape buffers have been added in front of the two outparcels.
Sports Authority still has the same problem regarding parking, and she feels any
national tenant would also have the same requirement.

Commissioner Aguila said he has dealt with major national chains and the 500
number seems to be a common concern. Although he is always in favor of more
green. he realizes that we will wind up with more vacant shopping centers if we
insist on this. He feels Boynton Festive Center has done good perimeter and
buffer jobs.
Ms. Jarkesy said parking spaces have been deleted since the original approval
with two outparcels.
Commissioner Aguila referred to the roof-mounted kitchen equipment. He does not
want to see any rooftop equipment for a distance of 600 feet. If it can be seen
at 601 feet, that is okay. He pointed out that the requirement to shield the
equipment is not definitive enough. He wants all rooftop equipment screened so
that nothing but screening can be seen for a distance of 600 feet in any direc-
tion.
Motton
Commissioner Aguila moved to approve the major site plan modification for
Boynton Festive Center to allow for an amended site plan to add an additional
7,600 square foot leased outparcel building for a restaurant, subject to staff
comments and discussion here this evening. Vice Mayor Matson seconded the
motion, which carried 5-0.

Michael Rumpf, Senior Planner, pointed out that at this point, there are very
few alternatives in the annexation program given the limited number of proper-
ties with water service agreements with the annexation clause. There have been
very few voluntary annexations without the agreement.
The first group in the proposal is in the enclaves. The City is seeking the
interlocal agreement process which is provided by State Statutes. State -
Statutes provide for the annexation of eligible enclaves. These are properties
of ten acres or less in size, developed or improved, through an interlocal
agreement with Palm Beach County.
Infonmation contained in the back-up packet summarizes the properties, provides
the enclave number, the number of acres, the size, predominant use, estimated
units, potential tax revenue, and other infonmation. It has always been the
assumption that the City could service these properties with Fire. Police. EMS
services, Solid Waste collection, etc.
Mr. Rumpf confinmed that if the City Commission approves this proposal tonight.
staff will return with an interlocal agreement. The public will have oppor-
tunities to voice their opinions here and at the County level.
Mr. Rumpf explained that Carriage Gate Condominiums became contiguous with the
annexation of Heartland Healthcare Center. With the annexation of Sausalito
Groves, continuity is gained with Royal Manor Mobile Home Park and the Windward
project. Further to the north is the Lawrence Oaks project, which will become
contiguous with the Knollwood Groves annexation.

Existing Site Characteristics: Vacant, wooded (primarily exotics)

96,512 square foot shopping center.
Proposed Development: The proposed modification consists of adding
a 7,600 square feet leased outparcel restaurant site. This is a
reinstatement of the restaurant site approved by the Commission on
May 17, 1994 and deleted, at the request of the applicant, by the
Commission on July 19, 1994 (See Exhibit "A"). The request is to
build a 5,320 square foot restaurant for Longhorn Steaks with a
future expansion of 2,280 square feet. The elevation view drawings
depict the 5,300 square foot building (see attached Planning and
Zoning Department comment No.2).
Concurrency: Concurrency certification is required as part of site
plan approval. Commercial projects require certification for
traffic and drainage levels of service only.
a. Traffic - The project remains in compliance with the Palm
Beach County Traffic Performance Standards.
b. Drainage The City of Boynton Beach Engineering
Department has indicated approval of drainage when
drawings are revised to address their comments.

Driveways: A total of four, two-way driveways lead to the site.
Only one driveway, located on Old Boynton Road, allows direct
access to the site. The other three driveways allow access to the
site through adjacent sites. The Congress Avenue and northeast
access are located on the Great Western Bank site. The northwest
access is through a Boynton Beach Mall access easement.
Parking Facility: A total of 575 spaces are provided which is
above the 521 parking spaces required. The 575 spaces are a
decrease of 54 spaces from the previously approved proposal and are
20 spaces below that originally approved in May. A condition of
the July approval was to make the drive behind and south of "Best
Buy" one-way, in a clockwise direction, to accommodate delivery and
Public Works Department vehicles. The appropriate traffic control
signs shall be posted to properly direct traffic.
Landscaping: The landscape plan remains unchanged except in the
immediate area of the proposed restaurant site.
Building and Site Regulations: The newly proposed restaurant does
not conflict with code regulations and the remainder of the site is
in compliance with the code regulations.
Community Design Plan: The site is located in the Modern Design
District. The Longhorn Steaks Restaurant is appealing requirements
of the Community Design ordinance and these are addressed under
separate cover (refer to elevation view drawings and color chart
for building design and colors).
Si~ge: The building signage for the new restaurant is shown on
the design plans and will comply with the sign code at time of
permit. The wall sign consists of channel letters mounted on a
raceway. The letters are black and white with a red neon border
(see Sheet A-I for sign details).

SUBJECT: Boynton Festive Center - Major Site Plan Modification
New Site Plan, Conditional Use - First Review
Staff has reviewed the above referenced project and offers the following comments:
1. A reservation fee of $8,426.88 is due within 30 days of
Commission approval or upon request for my signature on the
HRS/DEP permit applications, Sec. 26-34 (E).
2. Palm Beach Health Department permits will re required, Sec.
26.12.
3. Backflow preventors for buildings A and B are not required for the
proposed uses, Sec. 26.107.
4. Unobstructed access to utility facilities must be provided, several
trees near proposed fire hydrant and water meters need to be
relocated, Sec. 7.5-18.1.
5. Other Utility Department concerns will be addressed at time of
HRS/DEP permit application. All construction must meet Utility
Department criteria.
6. City water will not be supplied for irrigation, City Compo Plan,
Policy 3C.3.4.

3. All curbing shall be 8"X13.5" per std dwg. 8-90012.
4. Typical "90 degree parking stall" should locate wheel stop two feet from edge ofpvt.-B-90012
5. Hie pavement symbol and accessway striping shall be white per dwg. B-90012 and DOT stds.
DRAINAGE:
1. Revise exfiltration trench detail to agree with city std dwg. 8-91007.
2. Place all inlets in grassed areas for pretreatment of storm water per pg. 2 of park. lot specs.
3. Provide a set of satisfactory drainage calculations by a registered Fla. engineer if not
previously submitted. - SeG. 5-142( f).
LANDSCAPING:
1. Provide typical detail(s: of sight distances (including vertical clearance) required at each
driveway. Sec. 7.5-35(h).
2. Provide a landscape break (island) every ten parking spaces. Pg. 3 of park. lot specs.
OTHER STIPULATIONS:
I. Driveway permits from other governing agencies must be obtained prior to obtaining
required building permits. See 5-142(h)(6).
RECOMMENDATIONS:
I. Relocate trees adjacent to stop signs to assure permanent visability of signs. This will also
eliminate landscape maintenance to keep signs free of branches/palm fronds.
2. Fire Lanes: Place wore markings facing traffic and in readable order (the word "fire" first
and "lane" above it). Offs,~t pvt markings and post signs so they are 25 feet from each other.

We have reviewed the Site Plans for the proposed second
restaurant and have the following comments:
1. There is a discrepancy in the footprints of the building
which, at the time of permit application submittal, plans
should be consistent.
2. At the time of permitting, documentation showing proof that
the entire shopping center is considered one parcel and one
owner, without which the signs would not be in compliance
with the Code. The two pylon signs for Building A and
Building B might be considered off-premise signs, if NOT
bound together as one parcel.
3. The pylon signs sheet references the details shown on Sheet
A-3. Sheet A-3 is not included for this review.
4. If the sign on Sheet A-7 is intended for installation on two
sides of the building, it will exceed square footage allowed
by the Sign Code.
5. Handicap accessibility routes must be shown on the plans
from the public street or sidewalks to the entrance of each
building to meet requirements of State of Florida
Accessibility Code Section 4.3.2.

Project Summary: The proposed modification to the existing,
approved and undeveloped 96,512 square foot shopping center
consists of reinstating the second leased outparcel restaurant site
previously approved in May and then deleted on the last site plan
modification which was approved in July.
The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories: '
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the second review. To show compliance with these comments will

d. Both restaurant site (pad area) final landscaping may be
submitted with the respective restaurant building permit
plans. However, any modification to the outparcel #2
landscaping must be of equal value and quantity of
material to the landscaping shown for the pad area on the
landscape plan approved with this site plan.
e. On the landscape plan indicate the maximum tree spacing
of 40 feet on center for the required trees located along
Old Boynton Road.
f. A City approved cross access easement agreement between
the subject property and the abutting three-story bank
property must be implemented and finalized prior to the
issuance of building permits for the project.
g. All parking lot striping, curbing and wheel stops shall
meet city codes.
h. At the June 28, 1994 TRC meeting, the applicant agreed to
modify the direction of traffic at the access aisle
located to the rear and south of the "Best Buy" tenant
space to one-way clockwise. The change was to promote
safe traffic flow for the delivery and sanitation
vehicles use of the service area. Revise the plans
accordingly.
2. Site plan review will be required at the time of the
restaurant expansion. Place a note on the site plan drawing
indicating same.
3. The new restaurant building is deficient one modern wall
accessory and one window type for compliance with the "Modern"
Community Design District Code. Drawings must be modified to
show the' appropriate window type and wall accessory or a
Community Design Plan appeal must be granted.
4. All drawings of the permit set shall reflect the same
buildings and dimensions. Ci viI and landscape drawings
submitted with the request do not reflect the approved plans
of record. The site plan, elevation view drawings,
engineering plans and landscape plans that are included with
the July 19, 1994, site plan approval documents are the plans
of record for the project. Incorporate into the approved
plans the changes proposed with this request. Use a
distinguishable symbol and notes to identify the proposed
changes.
5. Amend the site plan review application to be consistent with
the proposed construction data.
6. As agreed to by the applicant, at the July 19, 1994 City
Commission meeting, a sign program for the entire proj ect will
be submitted for review by the Planning and Development Board
and City Commission. The release of sign permits for the
proj ect will be contingent on the approval of the sign
program.
7. The complete site plan review fee shall be submitted to the
Planning and Zoning Department prior to the October 18, 1994,
City Commission review of the subject request.

II. RECOMMENDATION:
Place the following text on the site plan drawing and the elevation
view drawings of both restaurant buildings:
"Roof mounted equipment located on the restaurant
building should be screened, full height, with a material
color matching the color of the building."
NOTE: If the recommendation is approved, it shall be incorporated
into the working drawings required for permits for the project.
