Dear Mr. Johnson:
Installation of a permanent type curb at this time is not
recommended because it, as well as the adjacent asphalt, will
likely be damaged or removed during construction of the second
restaurant. In order to provide a temporary barrier for
motorists and pedestrians, we are proposing the installation of
a row of wheel stops around the perimeter of the outparcel.
This row of wheel stops will serve as a visual and physical
barrier to preclude unauthorized access to the parcel.
The permanent curb will be constructed as part of the building
construction. If phase two of this project is completed prior to
construction of the second restaurant, the wheel stops will be
removed and the permanent curb will be install around the second
outparce1. Installation of the curb will complete the
obligations of the site plan approval ~ .'

Dear Mr. Garmizo:
As a courtesy to you, we have briefly reviewed the documents you
submitted late last week. Please consider the following
comments:
1. Revise documents to reflect all comments.
2. Applicant's attention is directed to Appendix C, Article
VIII, Section 7 regarding surety requirements.
3. Provide engineer's cost estimate.
4. Verify that existing exfiltration system is adequate.
5. Provide certification by developer's engineer that drainage
plan complies with all City codes and standards (see Chapter
5, Article X and Appendix C).
6. Inlets must be in grassy areas unless adequate documentation
is presented to support something different.
7. Provide dumpster location and details, including drainage.
8. Provide stop signs in accordance with the "Manual on Uniform
Traffic Control Devices".
9. Parking lot dimensions, striping, aisles, stalls, radii,
signs, landscaping, etc. must conform with City codes and
standards (see Chapter 5, Article X).

Tambri Heyden made the presentation. There are minor changes in the landscaping
and circulation.
Ms. Heyden referred to Engineering Comments dated 9/30/94, wherein one comment
requires providing a landscape break every ten parking spaces. When this came
before the Caa.1ssion in July, the approval asked that the applicant add addi-
tional interior landscaping provided no parking spaces are lost. This comment
will eliminate parking spaces. This comment came from engineering standards
which are not approved by Ordinance. This is in conflict with the Landscape
Code since the requirement is not contained therein.
In response to Commissioner Katz' question, Ms. Jarkesy said there are no plans
for the space Buy Wise was originally intended to occupy. Commissioner Katz
questioned whether or not additional landscaping could now be added since the
need for a certain number of parking spaces for Buy Wise no longer exists. Ms.
Jarkesy said significant additional landscaping has already been added. Eight
foot median landscape buffers have been added in front of the two outparcels.
Sports Authority still has the same problem regarding parking, and she feels any
national tenant would also have the same requirement.

OCTOBER 18. 1994
Mr. Rumpf explained that this is a slight deviation in the direction of the
annexation program. The City has maintained a close, tight movement along
Lawrence Road. One of the goals of the annexation program has been to maintain
efficient delivery of services. At this point, we will only annex those proper-
ties which are accessible from existing corridors. Since the properties along
Gateway are accessible from the corridor, we are allowed to expand the direc-
tion.
At the end of this corridor is the Windward project. This project, when
completed, will consist of approximatelj 416-418 dwelling units, 2.3 acres of
commerical property which are currently undeveloped, and a private day care
center which is developed. There are approximately 200 units developed at this
point and they are in the final stages of developing the last 196 units.
Staff met with service providers to detennine if delivery of service would be
burdened or if additional expenditures would be required. The Department of
Public Works can provide and maintain service to all of the properties with the
existing capital and personnel. Police would require one additional staff per-
son for this zone if Windward and Royal Manor are annexed. The Fire Department
will require the maximum amount of expenditures.
Mr. Rumpf spoke with the association representatives at Royal Manor and met with
representatives of the Windward project. They shared infonmation with him which
was helpful in his analysis. The expected revenues dropped only by about $2,000
to account for a more accurate representation of the anticipated property values
of the future homes and to incorporate the 2.38 .acres of commercial property
which had not originally been included.
Staff is requesting direction regarding the annexation of enclaves. Staff would
like to go forward with the interlocal agreements with the County. With regard
to Phase II, staff would like to explore further the annexation of these prop-
erties indicated.
City Manager Parker advised that staff quickly prepared an additional table to
address the millage concerns. The estimate was based on a $100,000 valued home
with a $25,000 exemption. The estimate is a comparison of City millages and
County millages. (A copy of this estimate is attached to the original set of
these minutes on file in the City Clerk's Office.) There is a difference of
$362.01 between a City resident and County resident assuming a $100,000 home.
Commissioner Aguila said he finds it very easy to go along with enclave annexa-
tions because they are in the service area. However, the Windward annexation
bothers him somewhat. He knows why it is good for the City to annex these prop-
erties, but asked that the publiC be advised of the reasons why this annexation
is good for them.
City Manager Parker explained that some of the benefits are tangible and others
are intangible. Traditionally, cities offered better protection in tenns of
Fire and Police. Counties were more rural and spread out with a different
atmosphere. Palm Beach County is an urban county, and some of the traditional
differences between city and county do not apply.

Dear Burl:
As requested by Mr. Richard Agree of Agree Realty Partnership, and pursuant to recent
correspondence and telephone conversations, this letter shall state the position of this
office with respect to the retail pylon sign located on the Boynton Festive Center
property. Conveyance by Agree Realty Partnership of the parcel holding the two
restaurants (Longhorn and Hops) will not result in any adverse affect on existing pylon
signage. The Operation and Easement Agreement, dated December 6, 1995,
effectively treats the entire shopping center as a "parcel" for purposes of interpreting
applicable City code sections related to signage. It should be clear that this office is
not commenting on future condemnation actions which may affect the Boynton Festive
Center, and more specifically, the existing pylon sign.

Existing Site Characteristics: Vacant, wooded (primarily exotics)
land with City approval granted July 19, 1994, to construct a
96,512 square foot shopping center.
Proposed Development: The proposed modification consists of adding
a 7,600 square feet leased outparcel restaurant site. This is a
reinstatement of the restaurant site approved by the Commission on
May 17, 1994 and deleted, at the request of the applicant, by the
Commission on July 19, 1994 (See Exhibit "A"). The request is to
build a 5,320 square foot restaurant for Longhorn Steaks with a
future expansion of 2,280 square-feet. The elevation view drawings
depict the 5,300 square foot building (see attached Planning and
Zoning Department comment No.2).
Concurrency: Concurrency certification is required as part of site
plan approval. Commercial projects require certification for
traffic and drainage levels of service only.
a. Traffic - The project remains in compliance with the Palm
Beach County Traffic Performance Standards.
b. Drainage The City of Boynton Beach Engineering
Department has indicated approval of drainage when
drawings are revised to address their comments.

26.12.
3. Backflow preventors for buildings A and B are not required for the
proposed uses, Sec. 26.107.
4. Unobstructed access to utility facilities must be provided, several
trees near proposed fire hydrant and water meters need to be
relocated, Sec. 7.5-18.1.
5. Other Utility Department concerns will be addressed at time of
HRSIDEP permit application. All construction must meet Utility
Department criteria.

Project Summary: The proposed modification to the existing,
approved and undeveloped 96,512 square foot shopping center
consists of reinstating the second leased outparcel restaurant site
previously approved in May and then deleted on the last site plan
modification which was approved in July.
The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the second review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Department for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. Drawings for the building permit must incorporate comments
approved at the time of the July 19, 1994 Commission approval.
The pertinent comments are as follows:
a. All light poles, drainage structures, fire hydrants,
traffic control signs, and similar structures need to be
shown on the landscape drawings. The landscape material
should not interfere with these fixed structures.
Landscape material should be relocated (not deleted) on
the drawing to avoid obvious interferences. A note
should be added to the drawing that indicates landscape
material must be relocated (not deleted) when
interference occurs in field.
b. Amend the landscape drawings to indicate the proper tree
species to be located near or under the overhead utility
lines located along Congress Avenue.
c. The size of the line-of-sight triangle shown on the
landscape drawing at the corner of Congress Avenue and
Old Boynton Road shall be changed from 30 feet to 35
feet. Specify on the landscape plan the clear un-
obstructed vertical clearance required within the line-
of-sight triangles.

d. Both restaurant site (pad area) final landscaping may be
submitted with the respective restaurant building permit
plans. However, any modification to the outparcel #2
landscaping must be of equal value and quantity of
material to the landscaping shown for the pad area on the
landscape plan approved with this site plan.
e. On the landscape plan indicate the maximum tree spacing
of 40 feet on center for the required trees located along
Old Boynton Road.
f. A City approved cross access easement agreement between
the subject property and the abutting three-story bank
property must be implemented and finalized prior to the
issuance of building permits for the project.
g. All parking lot striping, curbing and wheel stops shall
meet city codes.
h. At the June 28, 1994 TRC meeting, the applicant agreed to
modify the direction of traffic at the access aisle
located to the rear and south of the "Best Buy" tenant
space to one-way clockwise. The change was to promote
safe traffic flow for the delivery and sanitation
vehicles use of the service area. Revise the plans
accordingly.
2. Site plan review will be required at the time of the
restaurant expansion. Place a note on the site plan drawing
indicating same.
3. The new restaurant building is deficient one modern wall
accessory and one window type for compliance with the "Modern"
Community Design District Code. Drawings must be modified to
show the' appropriate window type and wall accessory or a
Community Design Plan appeal must be granted.
4. All drawings of the permit set shall reflect the same
buildings and dimensions. Civil and landscape drawings
submitted with the request do not reflect the approved plans
of record. The site plan, elevation view drawings,
engineering plans and landscape plans that are included with
the July 19, 1994, site plan approval documents are the plans
of record for the project. Incorporate into the approved
plans the changes proposed with this request. Use a
distinguishable symbol and notes to identify the proposed
changes.
5. Amend the site plan review application to be consistent with
the proposed construction data.
6. As agreed to by the applicant, at the July 19, 1994 City
Commission meeting, a sign program for the entire project will
be submitted for review by the Planning and Development Board
and City Commission. The release of sign permits for the
proj ect will be contingent on the approval of the sign
program.
7. The complete site plan review fee shall be submitted to the
Planning and Zoning Department prior to the October 18, 1994,
City Commission review of the subject request.

We have reviewed the Site Plans for the proposed second
restaurant and have the following comments:
1. There is a discrepancy in the footprints of the building
which, at the time of permit application submittal, plans
should be consistent.
2. At the time of permitting, documentation showing proof that
the entire shopping center is considered one parcel and one
owner, without which the signs would not be in compliance
with the Code. The two pylon signs for Building A and
Building B might be considered off-premise signs, if NOT
bound together as one parcel.
3. The pylon signs sheet references the details shown on Sheet
A-3. Sheet A-3 is not included for this review.
4. If the sign on Sheet A-7 is intended for installation on two
sides of the building, it will exceed square footage allowed
by the Sign Code.
5. Handicap accessibility routes must be shown on the plans
from the public street or sidewalks to the entrance of each
building to meet requirements of State of Florida
Accessibility Code Section 4.3.2.

and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.

Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of

submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
~~~ identify the location of the existing structures with respect to the
~ ~ocation of the proposed project.
~ Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of any kind.
~ Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.

Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

RE: Two appeals to the Community Design Standards
for Longhorn Steaks at the Boynton Festive Center
Dear Tambri:
I'd like to take this opportunity to bring you up to date on
the history of our discussions with our prospective tenant,
Longhorn Steaks.
They originally wanted to use a wood siding to try and
resemble a Texas Roadhouse. Even though the wood siding is
allowed in our Modern Design District, I thought there would
be better harmony between this outparcel and the balance of
the shopping center buildings if we did the Longhorn in
brick, using similar color tones as those found in the split
face block being used in the Best Buy/Sports Authority
buildings. We're using brick on the Longhorn building for 2
reasons; first, to match the scale of the building. You
wouldn't use split face block on such a small building
because it wouldn't be in scale; second, I believe the brick
gives Longhorn a distinctive look, without being
ostentatious.
Regarding our appeal for relieve from using two window types
and two wall accessories, the fOllowirig are our thoughts:
Presently the restaurant has fixed glass. To add either
spandrel glass or reflective glass would look ridiculous as
well as destroy the look of a National Restaurant Chain.
Likewise for the wall accessories, presently the restaurant
has decorative moldings, to add aluminum or steel grill work
or accent tile would not be compatible with the balance of
the restaurant. Please keep in mind Longhorn is trying to
create an image of a Texas Roadhouse that matches the theme
of their menu.

On September 20, 1994, your submittal for Site Plan Review of the
above-referenced project was reviewed for completeness. It has been
determined that the submittal is substantially complete and accepted
for further processing. A planning & Zoning Department staff member
will be responsible for the review and coordination of your site
plan through the remainder of the site Plan Review process.
The next step in the review process is for the Technical Review
committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, section 8 and all applicable sections
of the Boynton Beach Code of Ordinances. The results of the review
will be available to you on October 7, 1994.

II. RECOMMENDATION:
Place the following text on the site plan drawing and the elevation
view drawings of both restaurant buildings:
"Roof mounted equipment located on the restaurant
building should be screened, full height, with a material
color matching the color of the building."
NOTE: If the recommendation is approved, it shall be incorporated
into the working drawings required for permits for the project.
