Reinstatement of outparcel for Longhorn Steaks, Etc,
Please place the above-referenced request on the October 18, 1994
City Commission agenda under Development plans, Non-consent
Agenda.
DESCRIPTION: This is a request submitted by Douglas McMillen, to
amend a previously approved site plan for the Boynton Festive
Center, to be located at the northwest corner of Congress Avenue
and Old Boynton Road, zoned C-3, Community Commercial. The
amendments include the addition of a 7,600 square foot, leased
outbuilding for Longhorn Steaks, Etc., at the southeast corner of
the site and changes to the parking lot design surrounding the
outbuilding, An outbuilding was previously approved by the
Commission, and subsequently deleted by the applicant through a
commission approved, site plan modification for the subject
outparcel location,
RECOMMENDATION: The planning and Development Board unanimously
recommends approval of this request, subject to the attached
staff comments (Public Works Department Memorandum No, 94-240,
Utilities Department Memorandum No. 94-309, police Department
memorandum dated September 26, 1994, Engineering Department
memorandum dated september 30, 1994, Building Department
Memorandum No. 94-223 and Planning and Zoning Department
memorandum dated october 6, 1994) and that a mulch type, other
than Cypress, be used, The Board further stated that they would
like to point out to the Commission that landscaping comment #2
of the Engineering Department's memorandum, requiring additional
landscaped islands to be added (one every ten parking spaces),
conflicts with the previous Commission approval to require
additional interior landscaping, provided no parking spaces are
lost.

We have reviewed the Site Plans for the proposed second
restaurant and have the following comments:
1. There is a discrepancy in the footprints of the building
which, at the time of permit application submittal, plans
should be consistent.
2. At the time of permitting, documentation showing proof that
the entire shopping center is considered one parcel and one
owner, without which the signs would not be in compliance
with the Code. The two pylon signs for Building A and
Building B might be considered off-premise signs, if NOT
bound together as one parcel.
3. The pylon signs sheet references the details shown on Sheet
A-3. Sheet A-3 is not included for this review.
4. If the sign on Sheet A-7 is intended for installation on two
sides of the building, it will exceed square footage allowed
by the Sign Code.
5. Handicap accessibility routes must be shown on the plans
from the public street or sidewalks to the entrance of each
building to meet requirements of State of Florida
Accessibility Code Section 4.3.2.

1. Driveway permits from other governing agencies must be obtained prior to obtaining

RECOMMENDATIONS:
I. Relocate trees adjacent to stop signs to assure permanent visability of signs. This will also
eliminate landscape maintenance to keep signs free of branche sip aim fronds.

Staff has reviewed the above referenced project and offers the following comments:
1. A reservation fee of $8,426.88 is due within 30 days of
Commission approval or upon request for my signature on the
HRS/DEP permit applications, Sec, 26-34 (E).
2, Palm Beach Health Department permits will re required, Sec.
26.12.
3. Backflow preventors for buildings A and B are not required for the
proposed uses, Sec. 26.107.
4. Unobstructed access to utility facilities must be provided, several
trees near proposed fire hydrant and water meters need to be
relocated, Sec, 7,5-18.1.
5. Other Utility Department concerns will be addressed at time of
HRS/DEP permit application, All construction must meet Utility
Department criteria.
6. City water will not be supplied for irrigation, City Compo Plan,
Policy 3C.3.4.
It is our recommendation that the request proceed through the review process.

Find attached for your review the plans and exhibits for the above-
referenced proj ect. Site Plan Review approval for this proj ect
will be granted by the city Commission. To ensure that the project
stays on line with the review time frame, I request that the plans
and exhibits be reviewed and formal written comments transmitted to
the Director of the Planning and Zoning Department no later than
5:00 P.M. on September 30. 1994. It is anticipated only a single
review will be required. Consequently, please return plans with
your comments.
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, chapter 4, Site Plan Review, Section
8 of the Code of ordinances to review and formulate comments,
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in section 7 of the Site Plan Review Ordinance,
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.

3, Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4, Technical Revievl Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo, Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project,
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s} and directions to amend the plans
to comply with the comments and the procedures for resubmission, When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval,

in 1984. In 1987 he was named Vice President and Regional Manager with
responsibility for 60 restaurants in the Southeast, Northeast and Midwest.
During his tenure with the company, Underwood garnered many awards and
much recognition, In 1992 his successful company operation led to his being
named President of Steak and Ale Restaurants. He notably increased
company sales in 1992 and 1993 while overseeing 156 Steak and Ale
Restaurants, In 1993 he assumed additional responsibility for the 223
Bennigan's Restaurants, Under his leadership, the 379 restaurants generated
over $665-million in annual revenues.
. Underwood left Steak and Ale Restaurant in 1994 to pursue independent
interests, He has since signed a partnership agreement with Longhorn Steaks,
I~c. and will introduce and expand the Longhorn concept in So. Florida,
Underwood received a B. S. in Hotel Administration from Cornell University
in 1973, He currently resides in Boca Raton, .

SUBJECT: Boynton Festive Center - Major Site Plan Modification
New Site Plan, Conditional Use - First Review
Staff has reviewed the above referenced project and offers the following comments:
1. A reservation fee of $8,426.88 is due within 30 days of
Commission approval or upon request for my signature on the
HRSIDEP permit applications, Sec. 26-34 (E).
2. Palm Beach Health Department permits will re required, Sec.
26.12.
3. Backflow preventors for buildings A and B are not required for the
proposed uses, Sec. 26.107.
4. Unobstructed access to utility facilities must be provided, several
trees near proposed fire hydrant and water meters need to be
relocated, Sec. 7.5-18.1.
5. Other Utility Department concerns will be addressed at time of
HRSIDEP permit application. All construction must meet Utility
Department criteria.
6. City water will not be supplied for irrigation, City Compo Plan,
Policy 3C.3.4.
It is our recommendation that the request proceed through the review process.
