Major Site Plan Modification: Request for site
plan approval of an amended site plan for a future
shopping center to omit one (1) leased outparcel
building and change the facade of the main
building. Approval includes elevations for the
leased restaurant outparcel and sign approval for
all buildings.
Ms. Heyden stated that this came before the City Commission on May 17, 1994 for
a new site plan approval. The applicant has returned with some major changes,
which include the deletion of one of the outparcel buildings, which reduces the
overall square footage of the shopping center by approximately 7,500 square
feet. The service area in the rear has been redesigned and shifted, and signif-

Commissioner Aguila referred to the locked gate on the first lot, closest to the
track. Mr. Frederick advised that there will be a Phase II of this project at
the far eastern end. This has been funded through Palm Beach County for
acquisition and development of 1.6 acres which takes effect October 1st. This
is a temporary gate system until Phase II of this project is developed and
completed.
Commissioner Aguila asked about security and lighting. Mr. Frederick advised
that there is no lighting on the park property. There is lighting in the
parking lot. The park will be closed at dark. The only options for security
are foot patrol by the police during the evening hours, or the hiring of night
park attendants. Commissioner Aguila asked if the Police Department is aware of
this burden that is being put upon them. Mr. Frederick advised that this went
to the Technical Review Board and the Police Department is represented on this
Board.
In response to-Commissioner Aguila, Mr. Frederick advised that when this goes
out to bid, everything will be unit priced.
Motion
Commissioner Aguila moved approval of this site plan. Commissioner Katz
seconded the motion.
Ms. Simmons, who resides at 239 N. E. 13th Avenue, objected to putting the
parking lot between two residential houses. . She stated that there are already
problems with people stealing the residents' hubcaps and tags from their cars.
She did not think gates willkprotect the residents.
Mayor Harmening pointed out that the residents are in walking distance to the
park and you do not need a lot of parking at a neighborhood park.
Mr. Frederick said the reason parking was considered at the far western end was
that if acce.ss is not provided near the dock area, people,would.par..k on Seacrest
Boulevard and the side streets. He stated that Phase II will have a ~arking .
lot. He advised that we could look at eliminating the parking lot or reducing
the size of it.
Vice Mayor Matson pointed out that Boynton Lakes Park was only required to have
four parking spaces because of the Americans With Disabilities Act.
Commissioner Aguila suggested confinming if parking is needed. If ADA or any
other code requires parking, provide only what is required. He asked if we can
postpone it until Phase II and put it down at that end.
Mr. Frederick advised that the restrooms in this park have been eliminated in
Phase I with the Building Department's penmission, with the proviso that they be
built in Phase II. If parking is required, perhaps it can be put in in Phase
II.

icant changes (color scheme and design of the bUilding) to the elevations of the
main shopping center are proposed. The new elevations and the previously
approved elevations were displayed on the easel. The new elevations do not meet
the Community Design Plan.
A condition of approval was that more landscaping be providedt as long as
parking spaces are not deleted. The applicant has considered this; however it
would result in the loss of an entire bay of parking. Thereforet there will be
no additional landscaping. The Planning and Development Board unanimously
recommended approval of this major site plan modification.
Commissioner Katz asked how many spaces comprise an entire bay. Ms. Heyden
advised that an entire bay would be approximately twenty plus parking spaces.
Jill Jarkesy represented McMillen Development Corporation. She stated that the
applicant's architect and site planner did some recalculating and the only way
additional landscaping could be added in front of the main building would be to
lose an entire double row of parking. The national tenants in front of the main
building require a certain amount of parking. She pointed out that 7tOOO or
8tOOO square feet of restaurant space was deleted to increase the parking spaces
(the forty bays). Additional landscape medians have been provided in that areat
as well as adjacent to the restaurant towards the main shopping center.
Commissioner Aguila had no problem with the site plan. He did feel that the
signage is too big and overpowering; howevert it is in compliance with the
Codes.
Motion
Commissioner Aguila moved to approve this site plan, subject to staff comments.
Mayor Pro Tern Bradley seconded the motiont which carried 4-1. Mayor Hanmening
cast the dissenting vote.
Ms. Heyden stated that one of staff's comments regarded the sign program. The
Planning and Zoning Department recommended that the signage be revised because
it is not compatible. She asked if the City Commission wants staff to work this
out with the applicant and make the detenmination as to what is hanmonious.
Mayor Hanmening answered affinmatively.

Ms. Heyden stated that this site plan approval request is for the Barnett Bank
at Boynton Plaza, located at the southwest corner of Boynton Beach Boulevard and
Congress Avenue. They are planning to add an addition which requires upgrading
of the parking lot. In addition, the sand lot is included as part of this
approval to expand the parking lot being purchased by Barnett Bank. The
Planning and Development Board expressed concern about the existing "no right
turnll sign and it was left up to staff to work out a solution with the appli-
cant. With the use of an overhead projector, she displayed and reviewed three
solutions and advised that the applicant did not like any of these solutions.
The applicant was concerned about modifying the driveways because Barnett Bank
currently has a cross access agreement with the shopping center and they feel
any modification would be risking the future modifications of the cross access
agreement and also purchasing of the property.
Commissioner Aguila liked what Barnett Bank is doing and felt it is an improve-
ment to the building. He felt the turn was a minor issue. However, he would
like gates on the dumpster enclosure.
George Hohmann, Architect and Project Manager with Scharf Associates, and Don
Zyto, Vice President of Barnett Bank, were present. Mr. Hohmann explained why
the three solutions would not work. He expressed concern about closing off the
access. He said Barnett Bank had put the sign there four or five years ago
because during school hours, parents line up on the bottom of the road along the
fence along the school property to pick up their children. The children jump
over the fence and the parents drive away. In order to get a prime parking spot
there, they come in and make a right turn into the bank property, back out and
come back and pull around, which is hazardous. He said the other two solutions
described by Ms. Heyden would not prevent a person from making a right turn if
they wanted to. One of the solutions restricts the egress out of the parking
area on the right-hand side. You would be cutting the roadway less than twenty-
four feet wide, which is against the Zoning Code. He advised that if people
cannot make a left turn out of the bank property onto Congress Avenue, traffic
would be turned back into the shopping center, which is going to make it more
congested than it already is. One of the solutions makes it harder for someone
to make a right turn, but it would not prohibit it. Mr. Hohmann stated that
people tend to disobey the "no right turn" sign. He agreed to put gates on the
dumpster.
Motion
Commissioner Aguila moved to approve this site plan as submitted, subject to
staff comments and the addition of the dumpster gates. Mayor Pro Tem Bradley
seconded the motion.
Mayor Pro Tern Bradley asked if the Police Department is aware of the traffic
problem at the school. Mr. Zyto advised that the police are there frequently.
He suggested posting "no parking" signs along the side the road. He stated that
there is a long wait to get into the school grounds to pick up the children and
the parents park allover and block traffic.
The motion carried 5-0.

Existing Site Characteristics: Vacant, wooded land with City
approval granted May 17, 1994 to construct a 104,018 square foot
shopping center (see attached Exhibit "A")
Proposed Development: The proposed modifications to the existing,
approved and undeveloped 104,018 square foot shopping center are
comprised of developer changes to accommodate tenant requests. The
changes require re-approval by the Planning and Development Board
and City Commission.
The changes consist of:
* The deletion of the southeast leased outparcel restaurant
building which deletes building square footage and increases
parking spaces. The deletion of the restaurant building reduces
the total restaurant area from 15,200 square feet to 8,235 square
feet. The total number of parking spaces increased from 595 to
637, a total of 42 spaces. The total square footage of the
shopping center decreased from 104,018 to 96,512; a total of 7,506
square feet.
* A relocation of the compactor and loading area from the west
side of the main building to the south side of the main building.
The new location of the service area required the parking spaces
located south of the building to be moved to the west side of the
building. The relocation of parking spaces resulted in a net
increase of two spaces.

* A reconfiguration in the parking area west of the proposed
leased outparcel restaurant building,
* A change in the colors and texture of the exterior finish
material.
* A change in the shape of the facade of the main building.
* The submittal of a sign package which includes wall and free-
standing signs.
* The submittal of elevation view drawings for the leased
outparcel restaurant building.
Concurrency: Concurrency certification is required as part of site
plan approval of the project. Commercial projects require
certification for traffic and drainage levels of service only.
a. Traffic - The proposed modifications reduce the total
square footage of the project, therefore, the project
remains in compliance with the Palm Beach County Traffic
Performance Standards.
b. Drainage The City of Boynton Beach Engineering
Department has indicated approval of drainage when
drawings are revised to address their comments.
Driveways: A total of four two-way driveways lead to the site,
only one driveway, located on Old Boynton Road, allows direct
access to the site. The other three driveways allow access to the
site through adjacent sites. the Congress Avenue and northeast
access are located on the Great Western Bank site. The northwest
access is through a Boynton Mall access easement.
The northeast access drive located on the neighboring property,
nearest to the Red Robin, shall be relocated westward to line up
with the north/south access aisle.
The drive behind and south of "Best Buy" shall be one way in a
clockwise direction to accommodate Public Works Department
vehicles. The appropriate traffic control signs shall be posted to
properly direct traffic.
Parking Facility: A total of 637 spaces are proposed which is an
increase of 42 spaces from the previously approved project. The
project requires 483 parking spaces,
A parking lot variance was approved by the City Commission (May 17,
1994) regarding relief from Article X-Parking Lots, for the
distance from the right-of-way line to an intersection of an
interior access aisle for the two-way driveway entrance located on
Old Boynton Road.
Landscaping: Due to the relocation of the loading area to the
south end of the main building the landscaping along the south end
of the building has been changed, with the omission of the south
outparcel building, the number of interior landscape islands has
increased, The amount of interior parking landscaping area exceeds
the area required by the code. The remainder of the landscaping
is consistent with the previously approved plans.
A landscape code variance was approved by the City commission (May
17, 1994) regarding relief from Article II-Landscape Code for
interior lot line landscaping between the shopping center and the
abutting, three story bank building and right-of-way landscaping
along Congress Avenue.

Building and site Regulations: The proposed changes do not affect
the code required regulations.
Community Design Plan: The site is located in the Modern design
district. The previous approved plans and proposed plans are
lacking one additional wall accessory and one additional window
treatment. Considerable changes are being proposed to the facade
and color of the main building. (see colored elevation view
drawings)
Signage: Following compliance with staff comments, the sign
package will comply with the code.

The Public Works, utilities, Engineering and Planning and Zoning
Departments' comments may be addressed on permit application set of
drawings. With regard to Public Works Memorandum #94-170,
clockwise, one-way traffic behind and south of "Best Buy" tenant
space was agreed to by the applicant at the June 28, 1994 TRC
meeting. The remaining departments did not have comments
regarding their review of the amended plans.
RECOMMENDATION:
The Planning and Zoning Department recommends approval of this site
plan request, subject to the permit plans for the project being
amended to show compliance with staff comments and the applicable
City of Boynton Beach Code of Ordinance.

Major Site Plan Modification
Staff has reviewed the above referenced project and offer the
following comments:
1. A reservation fee of $6,320.16 is due within 30 days of
Commission approval or upon request for my signature on
the HRS/DEP permit applications, Sec. 26-34[E).
2. Palm Beach Health Department permits will be required,
Sec. 26.12.
3. Backflow preventors for buildings A and B are not
required for the proposed uses, Sec, 26.107.
4. Unobstructed access to utility facilities must be
provided, several trees near proposed fire hydrant and
water meters need to be relocated, Sec. 7.5-18.1.
5. Other Utility Department concerns will be addressed at
time of HRS/DEP permit application.
6. City water will not be supplied for irrigation, City
Compo Plan, Policy 3C.3.4.
It is our recommendation that the plan pr~ceed through the review
process.

PROJECT SUMMARY: The proposed modifications to the existing,
approved and undeveloped 104,018 square foot shopping center are
comprised of developer changes to accommodate tenant requests.
The changes require re-approval by the Planning and Development
Board and City Commission and were reviewed by the City on a cost
recovery, basis rather than an up-front fee. The fees will be
billed and payment received prior to issuing building permits.
The changes consist of:
The deletion of the southeast leased outparcel
restaurant building which reduces building square
footage and increases parking spaces. The deletion of
the restaurant building reduces the total restaurant
area from 15,200 square feet to 8,235 square feet. The
total number of parking spaces increased from 595 to
637, a total of 42 spaces. The total square footage of
the shopping center decreased from 104,018 to 96,512; a
total of 7,506 square feet.
An addition of a trash compactor and relocation of the
loading area to the south side of the main building.
The new location of the service area required the
parking spaces located south of the building to be
moved to the west side of the main building. The
relocation of parking spaces resulted in a net increase
of two spaces.
A reconfiguration in the parking area west of the
proposed leased outparcel building.
A change in the colors and texture of the exterior
finish material.
A change in the shape of the facade of the main
building.
The submittal of a sign package which includes wall and
free-standing signs.
The submittal of elevation view drawings for the leased
outparcel restaurant building.
The developer has indicated that a future subdivision of property
may take place. We have informed him that re-review would be
required as code requirements for parking, signage, building
construction, landscape, etc. will change considerably if the
site is not considered a shopping center.

Concurrency: Concurrency certification is required as part of site
plan approval of the project. Commercial projects require
certification for traffic and drainage levels of service only.
a. Traffic - The proposed modifications reduce the total
square footage of the project, therefore, the project
remains in compliance with the Palm Beach County Traffic
Performance Standards.
b. Drainage The City of Boynton Beach Engineering
Department has indicated approval of drainage when
drawings are revised to address their comments.
Driveways: A total of four two-way driveways lead to the site.
only one driveway I located on Old Boynton Road, allows direct
access to the site. The other three driveways allow access to the
site through adjacent sites. the Congress Avenue and northeast
access are located on the Great Western Bank site. The northwest
access is through a Boynton Mall access easement.
The northeast access drive located on the neighboring property,
nearest to the Red Robin, shall be relocated westward to line up
with the north/south access aisle.
The drive behind and south of "Best Buy" shall be one way in a
clockwise direction to accommodate Public Works Department
vehicles. The appropriate traffic control signs shall be posted to
properly direct traffic.
Parking Facility: A total of 637 spaces are proposed which is an
increase of 42 spaces from the previously approved project. The
project requires 483 parking spaces.
A parking lot variance was approved by the City Commission (May 17,
1994) regarding relief from Article X-Parking Lots, for the
distance from the right-of-way line to an intersection of an
interior access aisle for the two-way driveway entrance located on
Old Boynton Road.
Landscaping: Due to the relocation of the loading area to the
south end of the main building the landscaping along the south end
of the building has been changed. With the omission of the south
outparcel building, the number of interior landscape islands has
increased. The amount of interior parking landscaping area exceeds
the area required by the code. The remainder of the landscaping
is consistent with the previously approved plans.
A landscape code variance was approved by the City Commission (May
17, 1994) regarding relief from Article II-Landscape Code for
interior lot line landscaping between the shopping center and the
abutting, three story bank building and right-of-way landscaping
along congress Avenue.

PROJECT SUMMARY: The proposed modifications to the existing,
approved and undeveloped 104,018 square foot shopping center are
comprised of developer changes to accommodate tenant requests.
The changes require re-approval by the Planning and Development
Board and City Commission and were reviewed by the City on a cost
recovery, basis rather than an up-front fee. The fees will be
billed and payment received prior to issuing building permits.
The changes consist of:
The deletion of the southeast leased outparcel
restaurant building which reduces building square
footage and increases parking spaces. The deletion of
the restaurant building reduces the total restaurant
area from 15,200 square feet to 8,235 square feet. The
total number of parking spaces increased from 595 to
637, a total of 42 spaces. The total square footage of
the shopping center decreased from 104,018 to 96,512; a
total of 7,506 square feet.
An addition of a trash compactor and relocation of the
loading area to the south side of the main building.
The new location of the service area required the
parking spaces located south of the building to be
moved to the west side of the main building. The
relocation of parking spaces resulted in a net increase
of two spaces.
A reconfiguration in the parking area west of the
proposed leased outparcel building.
A change in the colors and texture of the exterior
finish material.
A change in the shape of the facade of the main
building.
The submittal of a sign package which includes wall and
free-standing signs.
The submittal of elevation view drawings for the leased
outparcel restaurant building.
The developer has indicated that a future subdivision of property
may take place. We have informed him that re-review would be
required as code requirements for parking, signage, building
construction, landscape, etc. will change considerably if the
site is not considered a shopping center.

The following is a list of comments regarding the review of the
above-referenced project. It should be noted that the comments
are divided into two (2) categories:
The first category is a list of comments that identify unresolved
problems. To show compliance with these comments will not
substantially alter the configuration of the site and the design
of the building.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting considering that the request for site plan
review is approved. The applicant must understand that
additional comments may be generated upon review of the documents
and working drawings submitted to the Building Department for
permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. The northeast, two-way access driveway entrance from the
neighboring property northwest of the Red Robin building
shall be moved westward to line up with the north-south
access aisle.
2. The code required width of all access drives shall be
indicated on drawings.
3. All light poles, drainage structures, fire hydrants and
similar structures need to be shown on the landscape
drawings. The landscape material should not interfere with
any-fixed structure (above). Landscape material should be
relocated (not deleted) on the drawing to avoid obvious
interferences. A note should be added to the drawing that
indicates landscape material must be relocated (not deleted)
when interference occurs in field. Substitutions may be
allowed by Planning and Zoning Department approval, except a
substitution of shrubs for trees.
4. Amend the landscape drawings to indicate the proper tree
species to be located near or under the overhead utility
lines located along Congress Ave. The Tamarind trees are
not acceptable within 20 feet of the overhead utility lines.
5. The size of the line-of-sight triangle shown on the
landscape drawing at the corner of Congress Avenue and old
Boynton Road shall be changed from 30 feet to 35 feet.
6. The restaurant site (pad area) final landscaping may be
submitted with the restaurant building permit plans.
However, any modification must be of equal value to the
landscaping shown for the pad area on the landscape plan
approved with this site plan.
7. On the landscape plan indicate the maximum tree spacing of
40 feet on center for the required trees located along Old
Boynton Road.
8. A city approved cross access easement agreement between the
subject property and the abutting 3 story bank property must
be implemented and finalized prior to the issuance of
building permits for the project.

acceptable. Please review the agreement for legal sufficiency.

Also on January 27/ 1994, the draft, cross access agreement
between the Boynton Festive Center and Great Western Bank was

We have reviewed subject drawing 8 of 12 for drainage. The
distance water must travel over impervious areas north of the
retail building marked 15 is several hundred feet which does not
comply with LDR Chapter 6, Article IV, Section 5B, page 6-8. In
addition, we see no evidence that storm water is discharged to
percolation areas prior to conveyance into receiving waters as
described in the second paragraph of the same section.
Based on your limited request, we did not review for any other
changes than drainage, and assume none were made.
