please place the above-referenced request on the City Commission
agenda for May l7, 1994 under Development Plans, Consent Agenda.
DESCRIPTION: This is a request for a variance to Section 5 - 142
(h) (5), Article X, Parking Lots, which requires that there shall
be a minimum distance of 100 feet from the street right-of-way
line at any major ingress or egress driveway to any parking stall
or interior access aisle having direct access to such driveway.
This parking lot variance is requested in connection with site
plan approval, also scheduled for consideration by the City
commission on May 17, 1994, for the Boynton Festive Center, to be
located at the northwest corner of Congress Avenue and Old
Boynton Road. Specifically, relief is requested for the access
aisle distance to the driveway proposed on Old Boynton Road.
Although the distance to the first access aisle on the east side
of the Old Boynton Road driveway meets the requirement, the
distance to the first access aisle on the west side of this
driveway is substandard by 21 feet.
RECOMMENDATION: The Planning and Development Board unanimously
recommended approval of this variance, as submitted.

section 5-145 (c) (4) of the code of Ordinances requires that when
a variance to Section S, Article X, Parking Lots is requested, the
Technical Review Board (Technical Review Committee) must forward to
the Planning and Zoning Board (Planning and Development Board) a
recommendation that is to be part of the public hearing
proceedings. To that end, this memo is forwarded, consistent with
the requirements of Section 5-145 (c) (4).
Douglas McMillen, agent for McMillen Development, is requesting a
variance to Section 5-142 (h) (5) of the Parking Lot Regulations.
The variance is requested in connection with site plan approval for
a shopping center to be located at the northwest corner of Congress
Avenue and Old Boynton Road. The proposed use is a shopping
center. The name of the project is Boynton Festive Center. At
this time, the site is a vacant lot.
Section 5-142 (h) (5), in part, is described as follows: The
minimum distance from the street right-of-way line at any major
ingress or egress driveway to any stall or to any interior access
aisle having direct access to such driveway shall be one hundred
(100) feet. The purpose of this requirement is (a) to provide a
vehicle stacking area of approximately five (5) cars that is not
encumbered by turning vehicles from a side access aisle, (b) to
provide a transition area for vehicles coming off a right-of-way to
slow their speed to that of the parking lot traffic so as not to
stop suddenly or maneuver around vehicles either entering or
exiting parking spaces, and (c) to prevent bottlenecks near the
entrance off a thoroughfare.
The nature of the request revolves around the ingress/egress
driveway located on Old Boynton Road. The Old Boynton Road
driveway is the only driveway located on the Boynton Festive Center
site. The other three access driveways are located on the sites
that abut the subject property. The request under consideration is
the distance from the Old Boynton Road right-of-way line to the
intersection of the first access aisle. The distance is measured
from the right-of-way line along the major access aisle. The
distance to the intersection of the access aisle located on the
east side of the major aisle exceeds the required one hundred foot
minimum. The distance to the intersection of the access aisle
located on the west side of the major access aisle is seventy-nine
(79) feet. The access aisle leads to parking spaces located in
front of the main building.

Old Boynton Road, see the attached copy of a reduced site plan of
the Boynton Festive Center site. For an explanation of the code

On Tuesday April 26, 1994, the Technical Review Committee (TRC),
met to review the plans and documents submitted and to formulate a
recommendation with regard to the variance request. After review
and discussion, the TRC unanimously recommended that the variance

On Tuesday, January 25, 1994, the Technical Review Committee
(TRC) met to review the plans and documents submitted and to
formulate a recommendation with regard to the variance request.
After review and discussion, the TRC recommended that the
variance request be approved as submitted. Attached see
memorandum from Engineering Department (#94-019) regarding lack
of hardship. In addition, the Planning and Zoning Department is
in favor of the west interior access aisle distance (75 feet)
from the right-of-way. However, there is concern over the
twenty-four (24) foot distance to the east interior access aisle.
First, incoming vehicles making a right turn from the major
access aisle to approach the restaurant site would be confronted
by vehicles maneuvering to either enter or leave the parking
spaces located south and west of the restaurant building. The
other problem occurs when vehicles are leaving the restaurant
site and are attempting to enter the major access aisle to exit
the shopping center. These vehicles would have to cross in front
of incoming vehicles entering the shopping center site, creating
a bottleneck close to or possibly into the old Boynton Road
right-of-way. In both situatlons the stacking of one or two
vehicles at this lntersection located twenty-four (24) feet from
the right-of-way, creates a safety hazard. The hazard is
compounded by the concentrated traffic patterns created by a
restaurant use. Also, there is not a deceleration lane for west
bound traffic on Old Boynton Road to enter the site.
It is the Planning and Zoning Department's position that the east
interior access aisle be closed. Closing the access aisle would
allow the major ingress/egress access aisle to be of sufficient
length to allow vehicles to enter the interior parking area
traffic pattern while limiting the possibility of vehicles being
backed-up into the Old Boynton Road right-of-way. In addition,
it is believed the applicant's concern that closing the access
aisle prevents traffic flow around the restaurant outparcel can
be remedied by shifting the entrance west and redesigning the
parking lot in the area to provide traffic flow around the
outparcel.

Justifying the Requested Variance (attached additional sheets if
necessary):
This driveway has been located because it lines up with a driveway at the north
end of the property. Access must be kept open on the east side to allow for flow
around the restaurant. The west side is 11 feet short of 100 foot throat but
would allow flow into the second parking aisle creating better access to the main
structure on site. Allowing 100 root throat to be reduced would allow traffic
to disipate faster
