Vice Mayor Matson feels the same and thought it was clear that the Commission

Commissioner Aguila moved to approve Boynton Nurseries PUD as referenced in
Michael Haag's memo of September 29th, with the deletion of items 2, 3, 16a, 15,
and 17. On Item 14. we added, "if warranted". He would like to include that
the driveways should be 16', and to reaffinm that there will be one right-turn
lane at each entry off of Lawrence Road into the development.
Vice Mayor Matson pointed out that Commissioner Aguila's previous motion is
stated on Page 18 of the last City Commission minutes.
Mayor Pro Tem Bradley seconded the motion. Mayor Hanmening clarified that the
motion is to approve the request of G.L. Homes as set forth in the minutes of
the meeting of October 3, 1994, on Page 18, plus clarifications with regard to
the driveway size of 16', and two right-turn lanes on Lawrence Road into the
development.
The motion carried 4-1. (Commissioner Katz cast the dissenting vote.)
Attorney Cherof advised that this item came back to the City Commission because
of an inconsistency in the Code. He requested pennission to work with Planning
staff to deal with the inconsistency so that an applicant does not have to
re~urn to the Commission a second time. Mayor Hannening had no problem with
this request.

NATURE OF REQUEST
Mr. Douglas MCMillen, of McMillen Development, Inc., agent for the
Great Western Bank properties, is requesting relief from the design
requirements of the Community Design Plan. The request is in
connection with the proposed development of a second leased
outparcel restaurant at the future Boynton Festive Center, located
at the northwest corner of Old Boynton Road and Congress Avenue.
The site is located in the "Modern" design district, as identified
on the Community Design District map. Construction of the new
building requires the building to comply with the Community Design
Plan requirements. Attached is a letter from the applicant IS
agent, dated september 29,1994, (Exhibit "A"), which describes the
appeal and the justification for same.
BACKGROUND
The Boynton Festive Center project received site plan approval from
the City Commission on July 19, 1994. Construction has not started
on the two tenant, 88,489 square foot retail building or the 8,023
square foot leased outparcel restaurant building. Concurrent with
this appeal a major site plan modification is being processed to
establish a new 7,600 square foot leased outparcel restaurant
building at the project. The appeal is for relief from the wall
accessory and window type design requirements for the new
restaurant building.
The Community Design Plan establishes criteria to use in designing
a development and offers alternate methods to achieve compliance
with the design requirements. The plan also identifies building
materials and design features that are associated with the three
architectural themes listed in the design plan (Exhibit "B"). As
previously stated, the subject site is located in the "Modern"
design district. The building is deficient in the following
architectural features and/or treatments of one wall accessory and
one window type. See Exhibit "c" which depicts the site plan of
this proj ect and the design, shape and colors of the proposed
restaurant building.
ANALYSIS
The additional restaurant tenant proposed is Longhorn steaks, Etc.
The architectural design of the proposed building has modern
characteristics and uses a blend of medium gray brick as the
predominant wall material with gray/beige soldier courses of brick
at the base, near the bottom of the windows and around the top of
the walls of the building. The walls of the previously approved
main building and the outparcel building are a combination of
stucco and split face masonry (refer to elevation view drawings and
sample boards for the building design, exterior materials and
colors of the approved and proposed buildings). The new restaurant
building has a concealed flat roof deck with metal standing seam
sloped roofs that embellish a portion of all sides of the building.
The previously approved buildings have a concealed flat roof deck,
however, they do not employ a standing seam roof material.

Regarding our appeal for relieve trom using two window types
and two wall accessor les, the tollowlnq are our thoughts:
Presently the reSl:aurant has fixed glass. To add oi ther
spandrel 91ass or reflectlvG glass would look ridiculous as
well as destroy the look of a National Restaurant Chain.
Likewise tor the wall accessories, presently the restaurant
bas decorative moldings, to add aluminum or steel grill work
or accent tile would not be compatible with the balanc~ of
t.he restaurant. Please keep in mind Longhorn is tr:yinq to
create an. image of a Texas Roadhouse that matches tbe theme
of their menu.

Ms. Heyden distributed colored elevations which were revised to reflect the
introduction of glass block. Because staff was uncomfortable with the exposed
rafters and the gables, the applicant has now included black grill work with
mesh screen behind which will hide the rafters. Grill work is a material
allowed in the "Modern" design district.. Glass block is not; however, glass
block has been used in other "Modern" distr~cts.
In response to Vice Mayor Matson's question, Ms. Heyden advised that the colors
of the main shopping center buildings are beige and gray.
Commissioner Aguila does not mind the building. He feels the gables are a bit
too busy, but he likes the metal grill work. He does not have a problem with
this project.
Commissioner Aguila questioned the signage.
Jill Jarkesy, representing the applicant, said there are two (2) signs proposed
for the entire site; one on the corner and one on the building. The applicant
has agreed to come back with the sign program for the entire site.
Motion
Commissioner Aguila moved to approve the request for the Community Design
appeal. Vice Mayor Matson seconded the motion, which carried 5-0.

MAJOR SITE PLAN MODIFICATION: Request for
approval of an amended site plan to add an addi-
tional 7,600 square foot leased outbuilding for
a restaurant, including surrounding parking lot
design changes.
Tambri Heyden made the presentation. There are minor changes in the landscaping
and circulation.
Ms. Heyden referred to Engineering Comments dated 9/30/94, wherein one comment
requires providing a landscape break every ten parking spaces. When this came
before the Commission in July, the approval asked that the applicant add addi-
tional interior landscaping provided no parking spaces are lost. This comment
will eliminate parking spaces. This comment came from engineering standards
which are not approved by Ordinance. This is in conflict with the landscape
Code since the requirement is not contained therein.
In response to Commissioner Katz' question, Ms. Jarkesy said there are no plans
for the space Buy Wise was originally intended to occupy. Commissioner Katz
questioned whether or not additional landscaping could now be added since the
need for a certain number of parking spaces for Buy Wise no longer exists. Ms.
Jarkesy said significant additional landscaping has already been added. Eight
foot median landscape buffers have been added in front of the two outparcels.
Sports Authority still has the same problem regarding parking, and she feels any
national tenant would also have the same requirement.
