Dear Mike:
As you know I am the potential developer of the Boynton
Festive Center which will be located at the Northwest corner
of Congress Avenue and Old Boynton Road.
This parcel contains the Great Western Bank building and the
parking for that structure. As part of our site development
plan we will be improving the parking on the bank property
as well as our own.
The requirements of the Boynton Beach Landscaping code
requires us to provide a landscaping planter along the
property line between the properties which would be thru the
parking lot. As can be seen from our site plan the
requirement for the hedge would severely limit traffic flows
n the north side of the parking lot for no good reason and
orce traffic out onto local roads by limiting the access to
he eastern north-south access drive.
he first review of the site development plan has yielded a
omment from the Utilities Department that trees will not be
llowed to be planted in the utility easement along Congress
venue. To accommodate the removal of the ten trees from the
tility easement we have added five landscape islands with a
ree in each one outside the easement in the parking area
long Congress Avenue. The remaining five trees have been
hifted to non required landscape islands on the south side
f the development.

We would like to appeal the requirement for the landscaping
area between the properties and the requirement for the
planting of trees in the utility easement to the Planning
and Development Board.
We hope that you will agree with our analysis of the
requirements and recorrunend approval of our appeal to the
Board.

We request that Boynton Festive Center landscape appeal be
removed from the January, 1994, Planning and Zoning Board
Agenda and rescheduled for the February, 1994, meeting. This
will allow the site plan, parking lot variance and landscape
appeal to be reviewed by the board at the same meeting.

Dear Mike:
As you know I am the potential developer of the Boynton Festive
Center which will be located at the Northwest corner of Old
Boynton Road and Congress Avenue.
This parcel contains the Great Western Bank building and the
parking for the structure.
As part of our site development plan we will be improving the
parking on the bank property as well as our own.
Under the Boynton Beach landscaping code we are required to
provide a landscaping planter along the edge of our parking lot.
However, because the way the bank property has been developed,
meeting this requirement would have us installing landscaping
that would interfere with the flow of the parking areas. (See
dark lines on attached drawing).
We would like to appeal this requirement to the Planning and
Zoning Board. As can be seen from our site plan this requirement
would severely limit traffic flows on the north side of the
parking lot for no good reason and force traffic out onto local
roads by limiting access to the eastern north-south access drive.
More importantly, if we were required to put the landscaping in
place, no public good would be gained.
