SUBJECT: DESCRIPTION: This is a request for appeals to two sections of the landscape code in connection with the site plan approval for Boynton Festive Center, to be located at the northwest corner of congress Avenue and old Boynton Road, also scheduled for consideration by the City Commission on May 17, 1994. The two appeals are as follows: a) section 7.5 - 35 (d) - There is an existing, 20 foot wide utility easement, parallel to the west side of the congress Avenue right-of-way. This easement conflicts (because of damage from tree root systems) with the requirement to plant trees, 40 feet on center, between an abutting right-of-way and a parking area. Therefore, relief from planting ten trees in this area is requested. In exchange, the applicant is proposing to construct seven landscaped islands, each planted with a tree, within the parking area along Congress Avenue. b) Section 7.5 - 35 (e) - Cross access between the retail center and the existing bank outparcel (a subdivided lot) conflicts with the requirement to plant a continuous hedge along an interior property line where a vehicular use area is visible from a property line. Therefore, relief from creating a 2 1/2 foot perimeter landscape strip with a hedge is requested. In exchange, the applicant is proposing to install two trees per landscaped island located along the . interior property line and trees within the landscaped area along the bank driveway off of Congress Avenue. RECOMMENDATION: The Planning and Development Board unanimously recommends approval of this appeal, subject to staffls recommendation of the applicant revising his draft, cross access agreement to exclude cross parking (Planning and Zoning Department Memorandum No. 94-032). There was discussion regarding the Utilities Department's policy of allowing only shallow-rooted palm trees and shrubs in utility easements. Heyden Planning and Zoning Director FROM: Michael Haag Site and Zoning Development Administrator DATE: May 2, 1994 RE: Appeal to the Landscape code section 7.5-35 (d) & (e) Boynton Festive Center - File No. 802 NATURE OF REQUEST: Mr. Douglas McMillen, of McMillen Development, Inc., agent for the Great Western Bank properties, is requesting City approval to appeal the above-referenced sections of the Landscape code in connection with proposed development of the Boynton Festive Center site. The proposed Boynton Festive Center project is located on the northwest corner of Congress Avenue and Old Boynton Road. The site abuts the south and west property lines of the existing Great Western Bank site. Find attached Exhibit "A" which is the appeal request from the applicant. BACKGROUND: The proposed shopping center site is vacant property. McMillen Development, Inc. is under contract to purchase the property to build the center. Mr. McMillen is presently processing a site plan for the property through the site plan review process. The site plan consists of developing the 10.1 acre site into a 104,018 square foot shopping center titled Boynton Festive Center. The Great Western Bank site is an existing 2.195 acre site that is adjacent to the northeast corner of the subject site and contains an existing three story building and associated parking facility. The first section of the Landscape Code, which the applicant is requesting to appeal, is section 7.5-35 (e). This section requires the installation of hedge landscape material along interior property lines where a vehicle use area is visible from the property line. The objective of the code requirement is to provide a continuous visual barrier to screen the vehicle use area from the view of the abutting property. The parking area depicted on the plan has been designed to allow traffic to flow efficiently across the property lines of both si t.es. As indicated on the plans, the existing parking area located on the west side of the bank site is being removed and the new parking spaces as shown, are being constructed. Consistent with section 7.5-35 (e) of the Landscape Code, one of the sites is required to install a minimum two point five (2.5) foot wide landscape strip, that contains continuous hedges planted two (2) feet on center. The hedge plants shall be eighteen (18) inches in height at planting and fifty (50) percent of the total number required shall be native. It has been interpreted that the landscape strip and hedge material are not required where a vehicle use area access aisle crosses the common property line, where said access points are described as an access easement. The landscape strip and material are not required when a building is located between a vehicle use area and the interior property line. The applicant is requesting to appeal the requirement of installing the continuous landscape hedge screen and, in one location, omit the two point five (2.5) foot wide landscape strip. These areas are identified on the attached copy of a reduced landscape plan of the project. BOYNTON FESTIVE CENTER - File 802 Landscape Appeal Memo 94-032 Page 2 of 3 The second section of the Landscape Code which the applicant is requesting to appeal is section 7.5-35 (d). This section requires the installation of trees and hedges where the vehicle use area is visible along the property line that borders a right-of-way. The second request is for the Congress Avenue frontage of the Boynton Festive Center site only. Consistent with section 7.5-35 (d) of the Landscape Code, each property line of a site that borders a right-of-way is required to install a minimum five (5) foot wide landscape strip. Wi thin the landscape strip there shall be installed a continuous hedge, as required by Section 7.5-35 (e) and eight (8) foot tall trees spaced a minimum of forty (40) feet on center. The fifty (50) percent native requirement is also applicable for the total count of required trees. The combination of hedge and tree material form the visual barrier to screen the vehicle use area. The landscape strip and landscape material is not required where a driveway is located along the R.O.W. property line or where a building is located between the vehicle use area and the property line. The applicant is requesting to appeal the requirement of installing trees in the landscape strip along the Congress Avenue frontage of the project. The landscape strip and the continuous hedge shown on the plans will be installed. The request to omit the trees is a result of the location of a twenty (20) foot wide utility easement that begins at the property line and extends twenty (20) feet into the site. The easement runs along the entire length of the east frontage of the Boynton Festive Center property. The city utility Department requires that all of the trees proposed within the easement be deleted because of city water and sewer utility lines located in the easement. The overall length of the frontage where the vehicle use area is visible from the right-of-way (R.O.W.) is approximately 382 lineal feet. The 382 feet of vehicle use area requires the installation of ten (10) trees. ANALYSIS: FIRST REOUEST: (Landscaping along an interior lot line.) The landscape plan proposed for the shopping center and the new parking area located on the west side of the bank property is shown developed as a large parking area. The location of the property line that separates both properties is shown on the attached drawing. For the most part, the areas where the perimeter landscape area is broken is where an access aisle is located with the exception of one area where the property line cuts across parking spaces. with the exception of the property line cutting across the parking spaces, the location and width of the required landscape strip is acceptable. The other code deficiency is the required hedge material. Starting on the south property line of the bank site at the west side of the access aisle leading into the shopping center to where the property line abuts the Boynton Mall access road, the required hedge material has been omitted. The applicant is proposing to plant two (2) trees in each landscape island located on the property line. Trees are not required in a landscape area along an abutting property. The extra trees placed along the property line as well as the extra trees planted in the interior landscape islands, exceed the required interior parking area landscaping. A total of seventeen (17) trees are required to be planted in the landscape islands located within the shopping center parking area and two (2) trees are required for the interior parking area for the bank property. The request is for the area along the Congress Avenue frontage of the shopping center. The landscape strip along Congress Avenue is eleven (11) feet wide. The required width is five (5) feet (one (1) foot of the eleven (11) foot wide landscape strip is part of the required eighteen (18) foot long parking space). The required continuous hedge material is shown. The code deficiency is the ten (10) trees required to be in the landscape strip and spaced a maximum of forty (40) feet on center. The applicant is proposing seven (7) landscape islands along the Congress Avenue frontage and has placed a tree in each island. The trees are spaced approximately forty-five (45) feet on center with the exception of the distance between the first and last tree along the right-of-way which exceeds sixty (60) feet. The total number of trees required, along the frontage, is ten (10). The total number provided is nine (9). The nine trees are located in landscape islands, outside of the existing easement, and outside of the perimeter landscape strip. RECOMHENDATION(S): The Planning and Zoning Department recommends approval of the request to appeal section 7.5-35 (d) of the Landscape Code. The Department also recommends approval of the request to appeal section 7.5-35 (e) of the Landscape Code subject to the applicant modifying the previously submitted cross access and parking agreement to a cross access easement, thereby omitting the text regarding cross parking and specifically describing the areas of cross access as easements and showing same with exhibits. The document requested by the City is a cross access easement, not a cross parking agreement. Both properties have the required parking spaces located on their sites respectively. It is the property owner t s choice to allow cross parking between both properties. Documentation of cross parking is not required by the City. The easements shall include the code required access aisle where the property line diagonally cuts across an access aisle between parking spaces on both properties. The cross access easement document shall be prepared by the applicant and submitted to the Planning and Zoning Department for review by the City Engineering, Planning and Zoning Department and the City's legal staff. Following review approval by the City, the applicant shall record same with Palm Beach County and provide copies to the Engineering and Planning and Zoning Department. It is recommended that the 10cument be accepted by the city prior to being signed by the appropriate parties. The cross access easement document is required prior to a bUilding permit being issued for the construction of either the shopping center or the bank parking area. This parcel contains the Great Western Bank building and the parking for that structure. As part of our site development plan we will be improving the parking on the bank property as well as our own. The requirements of the Boynton Beach Landscaping code requires us to provide a landscaping planter along the property line between the properties which would be thru the parking lot. As can be seen from our site plan the requirement for the hedge would severely limit traffic flows n the north side of the parking lot for no good reason and orce traffic out onto local roads by limiting the access to he eastern north-south access drive. The proposed Boynton Festive Center project is located on the northwest corner of Congress Avenue and Old Boynton Road. The slte abuts the south and west property lines of the existing Great Western Bank site. BACKGROUND: The proposed site is vacant property. McMillen Development, Inc. is under contract to purchase the property to build the center. Mr. McMillen is presently processing a site plan for the property through the site plan review process. The site plan consists of developing the 10.1 acre site into a 115,000 square foot shopping center titled Boynton Festive Center. The Great Western Bank site is an eXisting 2.195 acre site that contains an existing three story building and associated parking facility. The first section of the Landscape Code, which the applicant is requesting to appeal, is section 7.5-35 (e). This section requires the installation of hedge landscape material along interior property lines where a vehicle use area is visible from the property line. The parking area depicted on the plan has been designed to allow traffic to flow efficiently across the property lines of both sites. The existing parking area located on the west side of the bank site is being removed and new parking spaces are being constructed. Consistent with section 7.5-35 (e) of the Landscape Code, one of the sites is required to install a minimum two point five (2.5) foot wide landscape strip, that contains continuous hedges planted two (2) feet on center. The hedge plants shall be eighteen (18) inches in height at planting and fifty (50) percent of the total number required shall be native. The continuous hedge forms the visual barrier to screen the vehicle use area. The landscape strip and hedge is required where a vehicle use area is visible from a common property line. It has been interpreted that the landscape strip and hedge material are not required where a vehicle use area access aisle crosses the common property line. The landscape strip and material is not required when a building is located between a vehicle use area and the interior property line. The applicant is requesting to appeal the requirement of installing the continuous landscape hedge screen and, in some cases, omit the two point five (2.5) foot wide landscape strip. These areas are identified on the attached copy of a reduced landscape plan of the project. BOYNTON FESTIVE CENTER - File 802 Page 2 The second section of the Landscape Code which the applicant is requesting to appeal is section 7.5-35 (d). This section requires the installation of tree and hedge and landscape material where the vehicle use area is visible along the property line that borders a right-of-way. The second request is for the Congress Avenue frontage of the Boynton Festive Center site only. Consistent with section 7.5-35 (d) of the Landscape Code, each property line of a site that borders a right-of-way is required to install a minimum five (5) foot wide landscape strip, along the right-of-way, where the vehicle use area is visible from the right-of-way. within the landscape strip there shall be installed a continuous hedge, as required by Section 7.5-35 (e) and eight (8) foot tall trees spaced a minimum of forty (40) feet on center and fifty (50) percent of the trees shall be native. The combination of hedge and tree material form the visual barrier to screen the vehicle use area. The landscape strip and landscape material trees/hedges are not required where a driveway is located along the R.O.W. property line or where a building is located between the vehicle use area and the property line. The applicant is requesting to appeal the requirement of installing trees in the landscape strip along the congress Avenue frontage of the project. The landscape strip and the continuous hedge shown on the plans will be installed. The request to omit the trees is a result of the location of a twenty (20) foot wide utility easement that begins at the property line and extends twenty (20) feet into the site. The easement runs along the entire length of the east frontage of the Boynton Festive Center property. The City Utility Department requires that all of the trees proposed within the easement be deleted because of City water and sewer utility lines located in the easement, The overall length of the frontage where the vehicle use area is visible from the right-of-way (R.O.W.) is approximately 382 lineal feet. The 382 feet of vehicle use area requires the installation of ten (10) trees. ANALYSIS: FIRST REOUEST: (Landscaping along an interior lot line.) The landscape plan for the project depicts interior parking area landscape islands for the existing and new site. The islands are shown without a hedge. However, the plans indicate each interior landscape island, including the islands that are located along the common interior lot line, will have two (2) trees per landscape island. The trees proposed for the islands clearly exceed the interior parking area tree requirement specified in the Code, At one point along the common property line, the property line cuts across parking spaces. For the most part, the common property line is located where there is a vehicle use area access aisle or landscape area, SECOND REOUEST: (Landscaping for the perimeter of the project where the property line abuts the right-of-way.) The landscape plans for the project depict the landscaping along Congress Avenue in compliance with the Landscape Code, however, with regard to Utilities Department memorandum No. 94-026 all of the tree landscape material shall be removed. This requirement is based on an easement, as previously described, which is located along the Congress Avenue frontage of the Boynton Festive Center project. RECOMMENDATION(S) : The Planning and Zoning Department recommends approval of the request to appeal section 7.5-35 (e) of the Landscape Code subject to comments number 1, 2 and 3 of attached Planning and Zoning Department memorandum, dated February I, 1994. The appeal is in connection with the proposed development of the Boynton Festive Center. The project is proposed for the northwest corner of Congress Avenue and Old Boynton Road. Comments regarding landscape appeal section 7.5-35 (e): 1. On the landscape permit plans for the Boynton Festive Center project, identify the total number of eXisting hedge plants that will be disturbed by the new construction proposed for the bank site. Show on the plans where the existlng hedge plants will be relocated on the bank site. 2. Identify where 4 new live oak trees [minimum height eight (8) feet] will be located to replace the four (4) dying live oak trees identified on the landscape plan. 3. Since the common property line cuts across 3 parking spaces, either move the common property line to a location where the line will not cut across parking spaces or change the area into a landscape island and amend the parking space count. Recommendations regarding landscape appeal section 7.5-35 (d): 1. Considering there is a surplus of thirty-one (31) parking spaces for the entire project the recommendation is to omit the trees shown in the easement and create no less than a total of seven (7), nine (9) foot wide by eighteen (18) foot deep landscape islands in the parking area along Congress Avenue. The new islands would be spaced at an interval of every four (4) regular parking spaces. Since the east end of the new landscape islands are located in the utility easement, the recommendation is to plant a twelve (12) foot tall tree in each island. The trees shall be installed five (5) feet from the west end of the island, and in the middle of the width of the island. This location will not be in the easement. The tree specie shall be a specie identified in the small tree or medium tree category of the FP&L brochure titled Plant the Riqht Tree in the Riqht Place. Also, incorporate within the total tree count, tree species from the modern district category of the Community Design Plan. The recommendation includes at least one tree, as identified above, planted in the landscape area located at the north and south corners of the property. In conclusion, the recommendation will have the following effect on the site along the Congress Avenue frontage: The omission of five (5) surplus parking spaces to install five (5) new landscape islands that will be added to the two (2) existing islands (of which one will be relocated). The end result will be the installation of nine (9), twelve (12) foot tall trees spaced no more than forty-five (45) feet on center and located approximately twenty-five (25) feet into the site from the east property line. The following is a comparison of the recommended landscaping to the code required landscaping and the landscaping shown on the plans: The recommendation is one (1) tree less than required by the code and nine (9) trees less than what is shown on the existing plans. The size specification recommended is four (4) feet taller than required by the code and three (3) feet taller than the trees shown on the plans, Note the code required continuous hedge landscaping will remain in the landscape strip that is shown on the plans.
