The application for the subject request has been modified. The
modification necessitates a readvertisement of the variance request.
Find attached a copy of the revised request for a variance to Section
5-142 (h) (5) "Driveways" of Article X-Parking Lots. A check in the
amount of $134.00 to cover the advertisement of the modified request
has been forwarded to the Finance Department.
A legal advertisement will be prepared and forwarded to your
office after review by the City Attorney and the City Manager's
office. The variance is scheduled for public hearing by the
Planning and Development Board on May 10, 1994.

Boynton Festive Center, Old Boynton Road at Congress Avenue
Request for Parking Lot Variance
The Engineering Department for the City of Boynton Beach, Florida
has reviewed the above referenced application for variance and
herein renders a favorable recommendation on the applicant's
request for relief to City Code of Ordinance, Chapter 5, Article X,
Section 5-l42(h) (5), which requires a minimum distance from the
street right-of-way line at any major ingress/egress driveway to
any parking stall or any interior access aisle having direct access
to such driveway shall be 100'.
This favorable recommendation is conditioned upon the following:
1. The extreme southwest ingress/egress approach shall be modified
along the westernmost radii where the aisle along the souths ide of
the proposed structure intersects with the major aisle fronting
this shopping center. This action will allow for sanitation
trucks and other large delivery trucks to exit this location
without impacting landscaped areas, etc.
2. It is recommended that the applicant construct deceleration lanes
for the two ingress/egress approaches along Old Boynton Road and
this office shall require that the developer address this matter
with PBC Traffic Engineering and forward to the City Engineer's
attention, the County's decision in this matter (agreed to by
applicant's representative during TRC meeting).
