Further, pursuant to Section 2.4 of the agreement, if the "shopping centertl is subdivided, the parcels are subject to the benefits and burdens of the Operation and Basement Agreement. Accordingly, in this particular instance, the document is sufficient to pe~it the surplus parking of Tract A to cover the parking deficiency of Tract B. One parcel (Tract "A") contains the Circuit City and Borders book store buildings with associated parking and the other parcel (Tract "8") contains Hops restaurant and Longhorn restaurant with associated parking. Tract "B" does not provided enough parking spaces to meet the parking space regulations specified in the code for restaurants. However, the adjacent site tract "A" contains surplus parking from the code regulations regarding retail stores. Will the surplus parking located on tract "A" be able to be counted for required parking on tract "B" and meet the regulations specified in Chapter 2 - Zoning, Section 11. I. of the Code of Ordinances? Find attached a copy of an Operation and Easement Agreement submitted by the applicant which they believe is an alternative to having to provide the code required number of parking spaces on each tract. Please advise to the sufficiency of the document to meet the parking space regulations of the code. Modify the plan and parking data for parcel"B" to show and specify no less than one (1) parking space per each two point five (2.5) seats for each restaurant. City records show that the Hops restaurant has 212 seats and the Longhorn restaurant has 191 seats, therefore a total of 162 parking spaces are required to be located on Parcel "B". Amend the documents accordingly, or provide verification of an alternative acceptable to the city attorney. If an alternative method of complying with the parking space requirements is approved by the city attorney a reference to the method and or document shall be placed on the master plan. 2. Add a note to the plan that identifies the previous landscape appeal LAAP 94- 001 regarding the right-of-way landscaping along Congress Avenue and the interior property line landscaping where the bank property abuts the north property of the site. Identify the date the City Commission approved the appeal, May 17, 1994. Also, add a note that identifies the parking lot variance regarding the length of the driveway access aisle at the Old Boynton driveway by file number PKLV 94- 001 and the date the City Commission approved the variance, May 17, 1994. 3. Add a note to the plan that references the results of the current landscape appeal request LAAP 96-002 regarding the interior property line landscaping at the new parcel line. Also, identify the date the City Commission made their final determination. If the commission approves landscape appeal LAAP 96-002 as recommended in the Planning and Zoning Department Memorandum No. 96-503, permit plans for the recommended landscaping shall be submitted to the Building Division of the Development Department prior to plat approval for the proposed subdivision. 4. Clarify the designations of the new property. The statistics on sheet 1 of 1 identify the new areas as Parcel "A" and Parcel"B" whereas the plan view drawing on sheet 1 of 1 identify the areas as Tract "A" and Tract "B". Amend the plans accordingly. 5. Sign-off from the Development Department regarding the issue related to the signs that was described in a letter to Jill Jarkesey dated September 3, 1996 from Bill Hukill, City Engineer (see attached letter). Appendix A, Zoning, Section 1, page 1888, read as follows: "SHOPPING CENTER. A group of retail commercial and/or service establishments planned, developed, managed and operated as a unit." That is exactly the same language as the current LDR, Chapter 1, Article II (Definitions) pg. 1-30. The confusion is caused by a separate definition which formerly appeared in the Code of Ordinances, Chapter 21, Section 21-3, page 1485, which was worded differently. Please recall that one of the goals in modifying the Code was to eliminate conflicts like this. The rule I used was to use the definition in Appendix A when a conflict existed, and that is what occurred with this definition. If you think the definition is defective, please let me know so that I can insert it into upcoming LDR changes. If a TRC member finds the plans acceptable, he/she shall forward a memo, within the time frame stated above, to the Planning and Zoning Director stating that the plans are approved and they do not have any comments on the plans submitted for review and recommend the project be forwarded through the approval process. All comments shall be typed, addressed and transmitted to the Director of the Planning and Zoning Department for distribution to the applicant. Please include the name and phone number of the reviewer on this memo. Michael Haag will be the Planning and Zoning Department staff member coordinating the 1st review of the project.
