Jill Jarkesy, agent for the property owner of Boynton Festive Center, requested a waiver of the master plan process regarding the subdivision of the project. The subdivision is depicted on the attached master plan. The Planning and Zoning Director has granted the requested waiver of the master plan process. The waiver of the master plan process is subject to the attached master plan (SBMP 96-001), memorandum, dated November 4, 1996 from Michael J. Pawelczyk, Assistant City Attorney and recorded operation and easement agreement (recorded date January 29,1996). 2. Modify note 5 found on sheet 2 of 2 from ''The building setbacks shall be consistent with the building setbacks established on the approved master plan for the project" to liThe building setbacks shall be consistent with the building setbacks established in the City of Boynton Beach Code of Ordinances". Pawelczyk ~ Aesietant City Attorney /'~f Boynton Festive Center - Parking Space Regulations TO: RE: DATE: November 4, 1~~6 This is in response to Planning & Zoning Memorandum No. 96-541. The Operation and Easement Agreement dated December 6, 1995, of Agree Limited Partnership contains operable language indicating that the easement agreement is a perpetual easement for parking. Further I pursuant to Section 2.4. of the agreement, if the "shopping center" is subdivided, the parcels are subject to the benefits and burdens of the Operation and Easement Agreement. Accordingly, in this particular instance, the document is sufficient to permit the surplus parking of Tract A to cover the parking deficiency of Tract 8. Haag Current Planning Coordinator DA TE: October 14, 1996 SUBJECT: Boynton Festive Center - Parking space regulations The owners of the Boynton Festive Center are subdividing the center into two parcels. One parcel (Tract IIA") contains the Circuit City and Borders book store buildings with associated parking and the other parcel (Tract "8") contains Hops restaurant and Longhorn restaurant with associated parking. Tract "8" does not provided enough parking spaces to meet the parking space regulations specified in the code for restaurants. However, the adjacent site tract "A" contains surplus parking from the code regulations regarding retail stores. Will the surplus parking located on tract IIA" be able to be counted for required parking on tract "8" and meet the regulations specified in Chapter 2 - Zoning, Section 11. I. of the Code of Ordinances? Find attached a copy of an Operation and Easement Agreement submitted by the applicant which they believe is an alternative to having to provide the code required number of parking spaces on each tract. Please advise to the sufficiency of the document to meet the parking space regulations of the code.
