DESCRIPTION: This request for relief from the wall accessory and
window type requirement of the Community Design Plan/ "Modern"
district, is submitted by Douglas McMillen, in connection with
approval to construct a Longhorn Steaks restaurant on a leased
outparcel at the future Boynton Festive Center (see separate item
on the october 18, 1994 agenda for major site plan modification
approval of the restaurant). The proposed restaurant,
predominantly a medium gray brick building with a concealed flat
roof deck, standing seam sloped roof embellishments, gray/beige
soldier courses of brick near the windows and base and top of the
building and limited wood siding, is short one wall accessory and
one window type. The main shopping center building has been
approved with a combination of stucco and split face masonry,
RECOMMENDATION: The planning and Development Board unanimously
recommends approval of this request, subject to the attached
staff comments (planning and Zoning Department Memorandum No. 94-
297), regarding an alternative window treatment to the multi-pane
windows proposed and to removing and closing-in various gable
roofs over windows and doors. At the Board meeting, the
applicant agreed to meet with staff, prior to the Commission
meeting, to discuss adding an additional window type (glass
block) to eliminate one of the appeals requested and to discuss
closing-in the open gables. staff will present a summary of this
meeting with the applicant at the City Commission meeting.

NATURE OF REQUEST
Mr. Douglas McMillen, of McMillen Development, Inc., agent for the
Great Western Bank properties, is requesting relief from the design
requirements of the Community Design Plan. The request is in
connection with the proposed development of a second leased
outparcel restaurant at the future Boynton Festive Center, located
at the northwest corner of Old Boynton Road and congress Avenue.
The site is located in the "Modern" design district, as identified
on the Community Design District map. Construction of the new
building requires the building to comply with the Community Design
Plan requirements. Attached is a letter from the applicant IS
agent, dated september 29,1994, (Exhibit "A"), which describes the
appeal and the justification for same.
BACKGROUND
The Boynton Festive Center project received site plan approval from
the City Commission on July 19, 1994. Construction has not started
on the two tenant, 88,489 square foot retail building or the 8,023
square foot leased outparcel restaurant building. Concurrent with
this appeal a major site plan modification is being processed to
establish a new 7,600 square foot leased outparcel restaurant
building at the project. The appeal is for relief from the wall
accessory and window type design requirements for the new
restaurant building.
The Community Design plan establishes criteria to use in designing
a development and offers alternate methods to achieve compliance
with the design requirements. The plan also identifies building
materials and design features that are associated with the three
architectural themes listed in the design plan (Exhibit "B11). As
previously stated, the subject site is located in the "Modern"
design district. The building is deficient in the following
architectural features and/or treatments of one wall accessory and
one window type. See Exhibit "C" which depicts the site plan of
this project and the design, shape and colors of the proposed
restaurant building.
ANALYSIS
The additional restaurant tenant proposed is Longhorn Steaks, Etc.
The architectural design of the proposed building has modern
characteristics and uses a blend of medium gray brick as the
predominant wall material with gray/beige soldier courses of brick
at the base, near the bottom of the windows and around the top of
the walls of the building. The walls of the previously approved
main building and the outparcel building are a combination of
stucco and split face masonry (refer to elevation view drawings and
sample boards for the building design, exterior materials and
colors of the approved and proposed buildings). The new restaurant
building has a concealed flat roof deck with metal standing seam
sloped roofs that embellish a portion of all sides of the building.
The previously approved buildings have a concealed flat roof deck,
however, they do not employ a standing seam roof material.

I'd l1ka to take this opportunity to bring you'up to date on
the history of our discussions with our prospective tenant.
Longhorn Steaks.
They or iginally wanted to use a 'wJood siding to try and
r~semble a Texas Roadhouse. Even thouoh the wood siding is
allowed in our ModeIn Design District, I thought there would
be better harmony between this outparcel and the ba.lance of
the shopping oenter buildings if we did the Long-horn in
brick, usi.ng similar color tonas as those found i.n the split
face block beinq u.od in tho Best Buy/Sports Authority
buildings. We're using brick on 't:ha Longhorn building f03: 2
raasons ~ first, to matoh the &oale of the building_ You
wouldn't use split faco .block on suoh a am~ll building
hecause it wouldn't be in ec~le1 second, I believe the brick

Regarding out' appeal for relieve from using two'window types
and two wall accessories, the !ol.lowing are our thouihts ~

well as destroy the look of a National Restaurant Chain.
I.ikewise for the wall accessories, presently the restaurant

or accent tile would not be compat.ible with the balance of
the restaurant. Please keep irl mind Longhorn is tly!n9 to
creat:e an image of a Taxas Roadhouse that matches the theme
of their menu.
