Dear Mr. Haag:
Pursuant to our recent telephone conversation, I am providing the following
information regarding a proposed increase in the number of square feet above that
listed in the Previous Approval for the Boynton Lakes Plaza. This project was
determined to be a Previous Approval by the City and concurred by the County,
with an intensity of 137,833 square feet.
Rocky Goins provided an explanation of a proposal to increase the number of
square feet of Boynton Lakes Plaza. The explanation included breakdown of the
gross square feet and the leasable square feet. It is my understanding that the
Previous Approval was based on gross square feet. The proposal will increase the
project to 139,821 square feet. This will result in a net traffic increase of
45 daily trips. Based on an assumed build-out of 1995, the change meets the
Traffic Performance Standards of Palm Beach County.

Dear Rocky:
Thank you for your patience regarding your inquiry relative to the
allowable square footage remaining at the Boynton Lakes Plaza site.
The answer to your question is that a building not exceeding four
thousand five hundred twelve (4,512) square feet of gross floor
area/gross leasable floor area may be constructed on outparcel "B"
after receiving site plan review approval, without requiring
additional traffic review. This assumes construction of all 3,300
square feet allocated to outparcel "B". The following data,
obtained from the total square footages indicated on the approved
site plan, was used in arriving at this figure. The data includes
an analysis of the project as it relates to the other issues
identified in your letter:
a. Approved Site Plan - 132,732 maximum gross leasable floor
area; 133,438 maximum gross floor area
* (entire site including outparcel buildings)
b. Gross leasable floor area under construction - total
129,315 square feet, which includes the main shopping center
building of 123,432 square feet and cuco' s Restaurant of 5 I 883
square feet
c. Gross floor area under construction - total ~30,021 ~quare

footage for all buildings for the entire plat
f. Palm Beach County - 137,833 square feet, which equals the
vested gross floor area for the entire project
*Note: outparcel "A" which includes the site plan approved area of
three thousand three hundred (3,300) square feet of gross leasable
and/or gross floor area is included in the computations; however,
the site is vacant. Site plan review will be required to construct
a building on outparcel "A".
The area identified on the approved site plan establishes the area
the City will allow thus far for the entire site, subject to site
plan approval of outparcel "A". To determine the available area
remaining, the 3,300 square feet approved for outparcel nAn is
added to the area under construction (figures referenced above).
When this figure is then subtracted from the approved site plan
figure, the result indicates the project is within 117 square feet
of the area the City has approved to date and within 4,512 square
feet of the area vested by the County when subtracted from the
County vested figure. By adding six thousand five hundred (6,500)
square feet of floor area desired for outparcel "B" to this figure
(a total of 139,821), the vested gross floor area and/or gross
leasable floor area for the project of 137,833 square feet is
exceeded by 1,988 square feet. Further note that adding the new
gross floor area and/or adding the new gross leasable floor area to
the approved site plan totals would exceed the area figure
indicated on the plat.
To seek approval of the 6,500 square feet desired for outparcel
"BII, I recommend the following:
a. Amend the floor area figure identified on the plat
document (contact the Engineering Department for the procedures to
change the plat). I recommend omitting all reference to area from
the plat document.
b. Make a site plan review submittal for the new 6,500
square foot retail building. The submittal shall include a site
plan drawing of the entire project showing the new building. The
existing site data shall be amended to include the new area and new
required and provided parking count. The new building shall be
shown in compliance with the C-3: zoning provisions, building &
site regulations and all other applicable codes. With the site
plan review submittal, include a traffic impact statement that
recognizes the number of daily trips the new area is above the
trips the county has vested for the project. The City will forward

the statement to the County for their review. I recommend
establishing an appointment for a pre-application meeting with
Tambri Heyden, Acting Planning & Zoning Director, to discuss the
development of outparcel "B" and the other aspects of the site plan
review process.
The concern with increasing the gross floor area vested with the
County, was discussed with Allen Goins at a meeting held in our
office on November 1, 1993. During the discussion, Tambri Heyden
volunteered to contact Dan Weisberg regarding any potential traffic
issue. On November 4th, she contacted Dan Weisberg and relayed the
following to Allen on November 5th: Dan Weisberg indicated that the
proposed increase, since it was so small, would most likely have
little or no effect on the overall traffic of the area and that a
written request from the developer would be required to make a
formal determination. If you feel that you need preliminary
assurance from the County regarding the traffic concern, you may
want'to contact them; the formal request will be processed through
the Planning and Zoning Department. I believe following through
with the recommendations on Page 2 will enable you to modify the
City documents to successfully develop outparcel "B" to your
satisfaction.

lieu of glass. You stated that when you measure the sign, you
measure the lettering only, not spaces. Although, we believe your
interpretation of the frontage length is arbitrary, we will try to

Thank you for your patience regarding your inquiry relative to the
allowable square footage remaining at the Boynton Lakes Plaza site.
The answer to your question is that a building not exceeding four
thousand five hundred twelve (4,512) square feet of gross floor
area/gross leasable floor area may be constructed on outparcel "B"
after receiving site plan review approval, without requiring
additional traffic review. This assumes construction of all 3,300
square feet allocated to outparcel liB". The following data,
obtained from the total square footages indicated on the approved
site plan, was used in arriving at this figure. The data includes
an analys is of the proj ect as it relates to the other issues
identified in your letter:
a. Approved Site Plan - 132,732 maximum gross leasable floor
area; 133,438 maximum gross floor area
* (entire site including outparcel buildings)
b. Gross leasable floor area under construction - total
129,315 square feet, which includes the main shopping center
building of 123,432 square feet and cuco I s Restaurant of 5,883
square feet
c. Gross floor area under construction - total 130,021 square
feet, which includes the main shopping center building of 124,138
square feet and Cuco's Restaurant of 5,883 square feet
d. Board of Adjustment Case No. 190 - The City granted
approval of Case No. 190 allowing for a reduction of twenty-seven
(27) required parking spaces for the subject property

e. Plat - 135,975 square feet, which equals the total square
footage for all buildings for the entire plat
f. Palm Beach County - 137,833 square feet, which equals the
vested gross floor area for the entire project
*Note: outparcel "A" which includes the site plan approved area of
three thousand three hundred (3,300) square feet of gross leasable
and/or gross floor area is included in the computations; however,
the site is vacant. Site plan review will be required to construct
a building on outparcel "A".
The area identified on the approved site plan establishes the area
the City will allow thus far for the entire site, subject to site
plan approval of outparcel "A". To determine the available area
remaining, the 3,300 square feet approved for outparcel "A" is
added to the area under construction (figures referenced above).
When this figure is then subtracted from the approved site plan
figure, the result indicates the project is within 117 square feet
of the area the City has approved to date and within 4,512 square
feet of the area vested by the County when subtracted from the
County vested figure. By adding six thousand five hundred (6,500)
square feet of floor area desired for outparcel "B" to this figure
(a total of 139,821), the vested gross floor area and/or gross
leasable floor area for the proj ect of 137,833 square feet is
exceeded by 1,988 square feet. Further note that adding the new
gross floor area and/or adding the new gross leasable floor area to
the approved site plan totals would exceed the area figure
indicated on the plat.
To seek approval of the 6,500 square feet desired for outparcel
"B", I recommend the following:
a. Amend the floor area figure identified on the plat
document (contact the Engineering Department for the procedures to
change the plat). I recommend omitting all reference to area from
the plat document.
b. Make a site plan review submittal for the new 6,500
square foot retail building. The submittal shall include a site
plan drawing of the entire project showing the new building. The
existing site data shall be amended to include the new area and new
required and provided parking count. The new building shall be
shown in compliance with the C-3: zoning provisions, building &
site regulations and all other applicable codes. With the site
plan review submittal, include a traffic impact statement that
recognizes the number of daily trips the new area is above the
trips the County has vested for the project. The City will forward

the statement to the County for their review. I recommend
establishing an appointment for a pre-application meeting with
Tambri Heyden, Acting Planning & Zoning Director, to discuss the
development of outparcel "B" and the other aspects of the site plan
review process.
The concern with increasing the gross floor area vested with the
county, was discussed with Allen Goins at a meeting held in our
office on November 1, 1993. During the discussion, Tambri Heyden
volunteered to contact Dan Weisberg regarding any potential traffic
issue. On November 4th, she contacted Dan Weisberg and relayed the
following to Allen on November 5th: Dan Weisberg indicated that the
proposed increase, since it was so small, would most likely have
little or no effect on the overall traffic of the area and that a
wri tten request from the developer would be required to make a
formal determination. If you feel that you need preliminary
assurance from the County regarding the traffic concern, you may
want'to contact them; the formal request will be processed through
the Planning and Zoning Department. I believe following through
with the recommendations on Page 2 will enable you to modify the
City documents to successfully develop outparcel "B" to your
satisfaction.

On January 24, 1994, Don Johnson, Chief Building Inspector,
requested this office (Mike Haag and myself) to visit Boynton
Lakes Plaza, currently under construction at the southeast corner
of Hypoluxo Road and Congress Avenue. The purpose of the visit
was to view and discuss, with you and Stuart Wilson, the buffer
wall that was required by the City Commission to be constructed
six feet in height along the rear of the plaza; the south and
east property lines along Plaza Lane and Boynton Lakes Boulevard.
During this site visit, the height of the wall was measured from
the outside (street side) and found to be less than six feet in
height along that portion of the wall beginning at its northern-
most point to a southerly distance of approximately 225 feet. At
the northern-most point of the wall, the wall height was measured
to be three and one-half feet. It was noted that due to the
difference in the ground elevation at the street side of the wall
and at the shopping center parking lot side of the wall (inside),
the inside wall height at the northern-most point is five and
one-half feet.
The purpose of the six foot high buffer wall is to screen the
rear of the shopping center from the Boynton Lakes PUD residents
east of Boynton Lakes Boulevard and south of plaza Lane.
Therefore, it is important that the outside wall height, not just
the inside wall height, be six feet. In conclusion, it is my
administrative determination that the wall be reconstructed along
the 225 feet referenced so that all points along the outside of
the wall are no less than six feet in height.
If you feel that there is further justification for retaining the

information regarding the Previous Approval status for the Boynton lake$ Plaza.
This project was determined to be a Prevtous Approval by the City and concurred
by the County, with an intensity of 137,833 square feet. This is the intensity
officially on our records.
The Palm Beach County Traffic Division has rev1ewed two traffic studies Tor a
parcel of land on the immediate southeast corner of Hypoluxo Road and Congress
Avenuet ident;fied as Boynton lakes Commerc1al. The first traffic study was for
11. 000 square feet of commerciaL The second traffl c study was for a gas
station, car wash and 1,570 square foot convenience store. When two uses have
different traffic generating characteristics, any change from one use to another
would have to addre~s the traffic generation of the two uses. A reduct10n in
traffic due to an amendment to a site plan would be deducted from the project
traffic of the origina'l approval.
It is possible for approved intensity to be transferred within a project. The
projQct must be subject to a single development order for a single appl1cant.
In the case 10 question. these are two separate projects and intensity can not
b, transferred from one project to another.

Dear Mr. Morrill:
In reply to your letter dated September 7, 1993 I provide to you
the following responses to your inquiries/concerns; basically in
that same order as brought forth and outlined in said letter.
The swales along Boynton Lakes Boulevard fully comply with the
provisions of the City ordinances, specifically Appendix C
(subdivision and platting). The planting of trees for the sole
and explicit purpose .of providing an obstruction to vehicular
encroachment is prohibited. In accordance with the FDOT "Green
Book" trees may be planted within the swale area for beautifica-
tion purposes so long as they are planted a certain distance away
from the edge of pavement (so as not to become an absolute
obstruction to an errant vehicle), per the criteria in the Green
Book.
Reference your concern regarding the cost and restoration of the
swale areas and road pavement adjacent to the Boynton Lakes Plaza
Shopping Center, and the parameters of the designated road work
for said project, the developer will be held responsible to
repair any and all damage at his cost resulting from the
construction of this facility and the associated roadway work
immediately south of the location (road widening). Please be
advised that the developer does have a great deal of work to per-
form within the public rights-of-way of Boynton Lakes Boulevard,
including lane widening, pavement markings and drainage construc-
tion, all of which will certainly impact conditions that pre-
viously existed. The Engineering Department will remain on top
of this work to ensure that damage is repaired on an ongoing
basis and the road is constructed to plans and specs.

On the subject matter of the construction of the wall abutting
the Shopping Center on the south (plaza Lane) and the east
(Boynton Lakes Boulevard) sides, said wall is required to comply
with the 1990 site plan detail drawings for the wall. The wall
on the outside is to have a smooth finish, not painted block.
The Building Department will be alerted to the finish of the rear
wall so that it is in fact completed to be aesthetically pleasing
to the community.
Concerning traffic control devices (ie. additional stop signs,
road stop line stripes, etc.) erected/installed in the community,
the placement of multiple or multi-way stop signs must meet with
warrant criteria contained in the Federal Highway
Administration's Manual for Uniform Traffic Control Devices. To
date, the private roadways within Boynton Lakes do not qualify
nor satisfy the warrant requirements for the installation of
additional stop signs. Please see copy of Page 2 of Engineering
Department Memorandum No. 93-282 reference the requirements (copy
enclosed herewith).
As for the speeding on Paxford Lane, being a short "deadend"
street with primarily residents using said street, the use of
radar enforcement would not even apply in this situation.
Instead, if the residents who are complaining would in fact iden-
tify the alleged speeders, the Traffic Unit will speak to those
individuals and request that they slow down.
Regarding the use of posts and ropes on the corners, please be
advised that they are prohibited from being utilized on public
streets (Boynton Lakes Boulevard) since they could be construed
to be an "obstruction" to traffic as well as, and importantly,
they are not approved traffic regulated devices per the Uniform
Traffic Control Device Code.

Enclosed are the copies of the site plan that you requested for
Boynton Lakes Plaza. Please provide payment to cover $57.75
which you agreed to pay.
In addition, I have also reviewed the question of the finish at
the rear building and, based on the elevations, a smooth finish
must be applied to rear of the structure. This should not be
automatically construed as a stucco finish, but the finish should
be continuous and should cover the mortar joints on the
structure.
If you wish to challenge this interpretation, you need to write a
letter to the Planning and Zoning Director justifying the change.
This will then be taken before the Planning and Development Board
and the City Commission.
Finally, I have confirmed with Palm Beach County that the maximum
buildable floor area for the site is 137,833 square feet. You
will need to prepare a traffic study meeting the criteria of the
Palm Beach Traffic Performance Ordinance for the difference
between 137,833 square feet and proposed square footage on your
building plan. (The last time I checked it was just above
140,000 squre feet.) This study should be submitted to us for
review.

city Manager Miller pointed out there is a process in place
through the Bui~ding and Engineering Departments for building
permits. No one else can issue building permits.
Mr. Brown stated he was told this dock is an accessory, but
under hardship circumstances, the Commission could override it.
Attorney Cherof stated he knows of no provision of the Code which
would permit the Commission to waive the requirement of the
Building Code for permitting. Mr. Fetrow offered to provide the
Code provision but Attorney Cherof would need time to investigate
it.
Commissioner Matson was not comfortable with this situation.
Mayor Weiner felt the Commission could not help Mr. Brown at
this time.
DEVELOPMENT PLANS
A. Boynton Lakes Plaza Site Plan and Preliminary Plat
Extension

Mr. Cutro explained that representatives of Boynton Lakes Plaza
requested an extension for the concurrency, site plan review and
preliminary plat. The City Commission approved this on December
18, 1990 and it will expire shortly. The Planning and Zoning
Board approved the concurrency extension on December 10, 1991.
The preliminary plat extension is for the developer to complete
and finalize their plat.
In response to Commissioner Aguila's request for clarification,
Mr. Cutro explained that at the meeting of the Concurrency Review
Board, it was determined that a condition should be attached to
the concurrency that the driveway on Boynton Lakes Boulevard be
closed. It has nothing to do with concurrency and Attorney
Cherof determined no conditions could be attached to the con-
currency. There was further discussion about correspondence
crossing in the mail and the late receipt of correspondence per-
taining to this issue.
Mayor Weiner pointed out that she received the Engineering
memorandum at 5:00 p.m. today. She wondered how the Commission
is to deal with items received so late on the meeting day. She
questioned City Manager Miller about how this happened.
Mr. Miller received the memorandum on Monday and spoke with the
City Engineer and Mr. Cutro on Tuesday afternoon. Neither of
them were aware of the memorandum. It was not brought up at the
time it went before the Planning and Zoning Board. It contains
information the Commission needs to be aware of. Mr. Miller
intends to find out what prompted the memorandum.

Commissioner Matson suggested the Commission direct Mr. Cutro to
work with the County and the developer to get the canal culverted
as soon as possible.
Mayor Weiner was not sure how to handle this item and Vice Mayor
Harmening suggested if the Commission is interested in granting
the extension, then possibly it should be granted until the next
Commission meeting so that all the details could be worked out.
Commissio~er Aguila suggested granting the extension and disre-
garding the memorandum. Commissioner Matson agreed.
Allen Goins, representative for the owner, has worked on the pro-
ject for the past year. He stated they have been working to
accomplish their goals. They need financing and tenants to make
the project viable. There have been encouraging developments of
late with regard to financing. They have met with the homeowners
and Commissioner Matson and addressed the concerns with regard to
the Boynton Lakes entrance. They have looked at the area and
agree to close the entranceway. Regarding culverting, this will
be the first thing they will do before earth work is started. It
is difficult to agree to a time frame at this time. He agreed to
do this work as soon as possible. 90% of the shopping center is
committed to.
Mayor Weiner informed Mr. Goins of the conditions mentioned in
Mr. Walker's memorandum.
Richard Staudinger spoke with Mr. Walker about the details of his
memorandum. The time frame was discussed. He does not have a
need to have that time frame exactly adhered to. He wants the
improvements done. The culverting of the canal will permit the
widening of westbound Hypoluxo Road to put in a dual left-turn
lane. If the canal does not get culverted, the County would
have to scrap the plan and go to another plan to modify that
intersection design.
Commissioner Aguila again suggested ignoring this memorandum and
dealing only with the time extension.
Commissioner Matson confirmed that the developer would be
agreeable to closing the wall on Boynton Lakes Boulevard. She
asked if he was agreeable to a second winged wall for double buf-
fering the homes on Boynton Lakes Boulevard. The developer will
investigate this possibility. She asked that deed restrictions
remain in perpetuity as a condition to the site plan extension.
He agreed to deed restrictions discussed in the past.
Motion
Vice Mayor Harmening moved to grant the six-months extension as
requested for the Boynton Lakes Plaza site plan and preliminary
plat extension. Commissioner Aguila seconded the motion which
carried 5-0.

Motion
Commissioner Walshak moved to approve the request for extension of Knuth Road
PCD (West Boynton Boulevard at Knuth Road, southwest corner), Tara Oaks PUD
(East side of Knuth Road extended south between the LWOD L-25 and L-26 Canals,
and Boynton Beach Boulevard PCD (South si1e of West Boynton Beach Boulevard
between North Congress Avenue and Knuth RJad). Vice Mayor Matson seconded the
motion which carried 5-0.
3. Request for a six (6) month extension of the Boynton Lakes Plaza
site plan - (southeast corner of Hypoluxo Road and Congress
Avenue)
Mr. Cutro said this site plan was extended by the City Commission in December of
last year for six months. That was what was originally requested by the appli-
cant. Staff has now received a letter requesting an additional six month exten-
sion. The ordinance allows for an extension up to twelve months. It does not
specify whether or not it has to be done in a certain number of requests. This
request has been discussed with members of the Concurrency Review Board and no
objections to the extension have been raised. Mr. Cutro said Mr. Goins advised
him that he is about two to three weeks away from final financing on this proj-
ect. He has tied up the rest of the building and also the rentals of it and
believes construction will be started by August of this year.
Vice Mayor Matson pointed out a condition that went along with the original six
month extension and inquired if that same condition can be made if an additional
six month extension were granted. Mr. Cherof advised that the extension can be
conditioned upon other events occurring.
Motion
Vice Mayor Matson moved to approve a six month extension of the Boynton Lakes
Plaza site plan (southeast corner of Hypoluxo Road and Congress Avenue) with the
condition that was met in the December 1991 extension with regard to there being
no break in the buffer wall on Boynton Lakes Boulevard. Commissioner Hanmening
seconded the motion which carried 5-0.
4. Request for waiver of site plan review fees for neighborhood
Church (414 N. W. 10th Avenue) - James Bouie. Pastor. Community
Deliverance Church
Mr~ Cutro stated a request was received from Rev. James Bouie of the Community
Deliverance Church to waive the site plan review fees. This is a $500 site plan
because the site is less than two acres. The property is located at 414 N. W.
10th Avenue and is commonly known as the Cavalier Club.
J Mr. Cheraf advised that waiver of fees of this nature can be done administra-
tively but should be ratified by the Commission as opposed to the Commission

In response to requests of your department at the time of building permit revIew for Mobil, I
would appreciate clarification of the following.
In your staff review, a second vehicular access point was requested into the proposed shopping
center. That access was to be located at the North end of our East property line and be aligned with
the site plan approved by the shopping center. This posed no problem for the applicant since this
location for a connection coincided with their initial site plan submittal. Building permits were
issued, as I understand it, assuming plans would be revised and this additional connection made.
We were never, however, made aware of the fact that this connection was to be one-way,
eastbound only!
A one-way connection is unacceptable to everyone associated with the service station site and was
never discussed with either myself or any other representative of Mobil Oil or Lennar. I would
request your written clarification of this matter so that Mobil may proceed with development of
it's site.

The purpose of this letter is to correct the approvea nu~~a~ng square
footage that is recorded for Boynton Lakes Plaza. The proposed Boynton
Lakes Plaza project is located at the southeast corner of Congress Avenue
and Hypoluxo Road, within Traffic Analysis Zone #417.
Prior to being platted, the approved building area for the Boyn~on Lakes
Plaza included an outparcel, located at the northeast corner of the
project. A portion of the total building area was transferred to the
corner outparcel (4121 square feet), leaving 133,712 square feet for the
greater plaza. This figure of 133,712 square feet was used for comple~ing
the previous approval record.
On July 7, 1992 the city approved a site plan for the corner outparcel.
This approved plan, with 1,570 square feet, is considerably smaller than
what was originally planned and, was accounted for within the traffic stlldy
submitted by the developer and approved by your office. consequently, thE
owner of the shopping plaza has now requested that the city transfer hac}:
to the Boynton Lakes Plaza the unused building area, which amounts to thE
difference between what was originally transferred from the plaza and whc~
was subsequently approved.
The city's concurrency records con~~nue to indicate the original, combin~j
total of approximately 137,833 square feet (on December 10, 1991 the
planning and Development Board approved the extension of concurrency for
137,833 square feet). However, the City's previous approval list indicate3
the reduced building area resul~ing from the ex~raction for the outparcel.

The Owner, Boynton Lakes Plaza Partnership, is responding to your May 3, 1993 review
comment relative to the Buffer Wall associated with the above referenced project and
associated Building Permit Application.
Appendix A - Zoning of the Boynton Beach Code cleariy states that "buffer walls shall be
required only on interior lot lines". As you are aware, the Boynton Lakes Plaza site is a
freestanding corner lot without any abutting block adjacencies. The Code allows clear relief
from Buffer Wall requirements in these particular instances.
Although not required by Code, the Owner elected to provide a visual screen between the
Plaza and any residential areas. The sole purpose being a sincere desire to aesthetically
enhance the "neighborhood" within which the facility will exist. To that end, Boynton Lakes
Plaza Partnership requests that your agency act favorably upon approving the screen fence
as designed and previously submitted by Miller Associates (copy enclosed)RECEIVED

In a sincere attempt to secure the issuance of the pending Building Permit, the Owner will,
at this present time, remove the 6,097 Sq. Ft. associated with Outparcel "B" from the
tabulation of G .L.A. Actual. This will allow an avenue by which the present overage can
be offset by the utilization of a single entity of scope.
The Owner reserves the right to seek a formal variance, at a future date, for the
reinstatement of buildable commercial square footage on the Outparcel "B" site.
I would request that your agency act favorably upon the Owner's request so that the
Building Permit can be issued in an expeditious manner.

The Owner, Boynton Lakes Plaza Partnership, is responding to your :May 3, 1993 review
comment relative to the Buffer Wall associated with the above referenced project and
associated Building Permi.t Application,
Appendix A - Zoning of the Boynton Beach Code clearly states that ltbuffer walls shall be
required only on interior lot lines". As you are aware, the Boynton Lakes Plaza site is a
freestanding corner lot without any abutting block adjacencies. The Code allows clear relief
from Buffer Wall requirements in these particular instances.
Although not required by Code, the Owner elected to provide a visual screen between the
Plaza and any residential areas. The sole purpose being a sincere desire to aesthetically
enhance the "neighborhood" within which the facility will exist. To that end, Boynton Lakes
Plaza Partnership requests that your agency act favorably upon approving the screen fence
as designed and previously submitted by Miller Associates (copy enclosed).

Dear Alan,
I would like you to consider this as a suggestion to put some
flexibility into the Boynton Lakes Plaza site plan.
As you know, the number of parking spaces for this site is very
tight. Based on past experience in monitoring developments of this
size, and because of your need to be flexible in sizing outparcels,
I expect that providing the full number of required parking spaces
may become impossible.
I would suggest that you consider applying for a variance for the
number of parking spaces for the entire site. This would allow
some flexibility for the site and allow us to delete spaces if
construction problems occur.
As I stated, this is a suggestion, not a requirement. If you think
that this suggestion has some merit, please feel free to call me to
discuss it.

Dear Allen:
We have reviewed your request to revise the potential site of the
Outback Steak House to be located at Boynton Lakes Plaza and find
it to be acceptable.
We have no problem with the square footage reduction of the
structure. The 16 foot parking spaces are allowable because they
are adjacent to 5 foot wide greenbelts. City code only requires
a 2.5 foot wide greenbelt.
We would strongly recommend your moving the 3 parking spaces at
the east side of the structure to the northside of the structure.
This is based on the fact that in the proposed location, they
would be directly adjacent to a major accessway on the site.
Please submit a modified site drawing for the entire center to us
that reflects these modifications as soon as possible.
If you should have any questions regarding this matter, please

I appreciate your forwarding me a copy of the December 7, 1992 from Ed Preti, project
manager for AG Development Group on the Boynton Lakes Plaza project. As we
discussed, this proposal for a non-standard driveway was discussed at a meeting with
the shopping center developer. However, according to code, the developer or the
developer's engineer must write a specific letter to the City Engineer requesting approval
of any driveways with a width larger than 32 feet in accordance with the Code of
Ordinances 5-142(h)(1). I believe it is most appropriate if Mr. Preti directs his requests
to the engineering department with proper enclosures concerning the requested width of
the driveway and any other safety measures associated with his proposal.

Dear Sir,
This is to confirm that the City of Boynton Beach is supportive of
the proposed project, Boynton Lakes Plaza. The project is in
compliance with the C-3 zoning for the site. The site plan has
been reviewed and approved, subject to the minor modification
addressed at the site plan review meeting with A.G. Development
Group, Inc. on November 19, 1992.
The proposed development meets the parking requirements of the City
of Boynton Beach. The City does not involve itself with intra
agreements regarding parking between the main structure and out
parcels.
As long as the building design is in accordance with the approved
site plan and our building code, there is no political or technical
reasons to preclude any building permits required of this project.

Enclosed are two signed copies of the renewal application for the
Heal th Dept. permi ts on Boynton Lakes PI aza. PI ease note that
while we have no objection to renewal of these permits, and whereas
we do have sufficient capacity to service the entire project, only
the Mobil Station parcel has reserved firm capacity via payment of
a reservation fee. The remainder of the site does not have a firm
reservation of capacity as of this date.
It is our understanding that only the off-site sections of water
and sewer for the Mobil Station will be constructed now, and that
the remainder of the system is not scheduled for construction at
this time.
By copy of this letter to the Palm Beach County Health Unit, we are
requesting that the renewal of permit not exceed one year from the
date of their approval.

Dear Mr. Staudinger:
In regards to Boynton Lakes Plaza, we are pleased to announce that
we have obtained a commi tment for financing from an European
corporation. The condition for their investment, however, is that
upon closing we must begin construction immediately. As you may
know, the lands mortgage is currently owned by R.T.C. On November
17, 1992 our contract extensions expire, and the mortgage will go
to a national sales which would cause the property to sit for many
years.
We have recently reviewed our records to determine if we can close.
Presently the engineering drawings have been approved by the city.
The current site plans are in Mr. Cutro's possession. The plat
will be submitted for final approval November 17, 1992 at the city
commission. We recognize that we must provide a bond for the
cuI vert work to Lake Worth District Management and a bond to
Boynton Beach City for the water and sewer lines.
We request, knowing the above, permission to begin si te work
immediately after closing. This permission would enable us to close
with the lender. We would provide the appropriate bond to the city
be~ore construction. Although we anticipate plat approval, if the
plat is not approved for minor reasons, we would like to be able to
go forward with the construction.
Your prompt response to our request will be greatly appreciated.
We look forward to joining the Boynton Beach Community.

With reference to the attached request form Mr. Goins of A.G. Development Group, I
recommend they complete the platting process on this site. The developer has already
completed 95% of the effort by preparing a preliminary plat and related construction plans
for this site. I understand their concern with moving ahead rapidly on the culvert work,
however, the letter only addresses commencing construction on l'basic site work and
underground utilities".
Please advise if the developer wishes to further pursue efforts other than final platting.

It is important that Boynton Lakes Plaza is permitted to move
forward in anticipation of the review and approval of the revised
platting of the shopping center. It is my understanding that Palm
Beach County is in immediate need of my placing the culvert along
Hypoluxo Road in order that they can proceed with intersection
improvements. Accordingly, I request an approval to commence with
basic site work and underground utilities while the platting
review is underway. I will take full responsibility for any
possible changes that might derive from the pending plat review.
It is just that it is in both interests to get this project
started in order to eliminate this land as an unimproved property
that has been a nuisance to the public.

Dear Chris:
It is important that Boynton Lakes Plaza is permitted to move
forward in anticipation of the review and approval of the revised
platting of the shopping center. It is my understanding that Palm
Beach County is in immediate need of my placing the culvert along
Hypoluxo Road in order that they can proceed with intersection
improvements. Accordingly, I request an approval to commence with
basic site work and underground utilities while the platting
review is underway. I will take full responsibility for any
possible changes that might derive from the pending plat review.
It is just that it is in both interests to get this project
started in order to eliminate this land as an unimproved property
that has been a nuisance to the public.

In today's fin~ncin~ re~uirements. it is imperativA to include
credit tenants in our retail centers. It is my understan~ing that
the Palm Beach County has an inordinate number of unsuccesatul
~hoppir.g centers. Th@ primary reason for this problem is the
heovy reliance upon non-credit tenants who vacate 5hops overnight
after three months of negative cash flow. Because of this,
financing i~ not obtajn~hle unless sufficient credit tenant9 are
included in the finance packag@. I cannot afford to let Good Year
go and Buffer the risk uf l05ing my financing.

Our firm has been the Engineer of Record on the Boynton Lakes
P.U.D. since its inception some 10-12 years ago. Among other
civil engineering responsibilities on the over all project, we
proposed a Master Drainage Plan, supported by drainage
calculations,and obtained a surface water runoff permit from the
South Florida Water Management District for the 241 acre project.
That permit, which I understand you have found in your files,
included the commercial site, which now includes the service
station site. The outfall drainage system to serve the
commercial site is in place and includes two 30" pipe stubouts
along the north side of Plaza Lane that will transmit the
commercial drainage to retention ponds located in Plats 6 and 6-
A. The outfall was sized to accommodate drainage from the
commercial tract.
Our firm did not design the Mobile Oil service station drainage.
It is assumed that pretreatment of surface water runoff would
have been taken into consideration as part of the site
improvement engineering for that site.
I trust that this helps to clarify questions that were raised
concerning the use of the existing retention ponds. Should you
have any questions, please do not hesitate to contact our office.

As we discussed recently, we are requesting a six month extension
of the Preliminary Plat Approval, Site Plan Approval and
concurrency vesting which was previously extended on December 17,
1991. It is our understanding that the initial deadline for the
expiration of those approvals will be June 17, 1992. This
extension request is in order to allow us time to complete the
necessary loan commitments which are currently pending for this
project. I am sure that the City can appreciate the fact that
todays difficult economic climate has extended the time required
to secure construction financing.
For your information, we have a sale of the property pend~ to
Mr. Allan Goins, who has secured 90% pre-leas~ commitments as
well as preliminary commitments for construction and permanent
take-out loans. We need this additional time to finalize the
loan agreements and close the sale. Mr. Goins will proceed
immediately after closing with the proper applications for the
final Plat and for Build~ Permits. We would appreciate it if
this matter could be scheduled for an official decision by the
City Commission at their next regular meet~.
We appreciate your assistance in this matter. We look forward to
hearing from you soon as to the date we may expect a decision
from the City Commission.

In response to your letter of November 26, 1991, concerning
the above referenced project, please accept the following comments:
01. Construction plans have been requested and should be
forthcoming as soon as available.
02. As to the Surety Bond or Letter of Credit, I have requested
the p~oper wording and a sample L.O.C. from you approximately
two weeks ago. As of this date I have not received any of
this information. I have repeatedly tried to contact you to
secure this information but I have not had the courtesy of
return phone calls. As soon as you make this information
available, the L.O.C. will be issued.
03. The filing fee will be submitted at the same time as the
L.O.C.
For the record, I met with Mr. Chris cutro in November of
1990. At this time Mr. Cutro advised myself and Chuck Desanti of
Lennar Homes, Inc., that this commercial tract (includinq the
outparce!) was approved for 137,800 ftl of retail use. Boynton
Lakes Plaza had requested approval for 133,015 ft2, so therefore it
was determined that Boynton Lakes Commercial Plat would be limited
to 4,800 ft2. The Boynton Lakes Commercial Plat did not borrow any
square footage or concurrency from the shopping center. In a
spirit of cooperation with the city and at the advise of the city,

Lennar Homes, Inc., combined their outparcel with the plat of
Boynton Lakes Plaza being prepared by Keshavarz & Associates, Inc.,
so that one plat showing both parcels could be processed by the
city. The City requested that on the face of this plat the square
footage allocation shown to preclude any confusion as to what
parcel received what allocation. It wac; d~c.ided by all parties
concerned that Keshavarz would be the coordinating engineer, but
that Carnahan & Associates, Inc., would continue on in conjunction
with Keshavarz in order to protect Lennar1s interests.
I will contact you in the very near future to set up a meeting
with City staff in order to review our submittal.

permit is pulled for Boynton Lakes Plaza by 12/18/91 concurrency
for the project will expire.
Before a building permit can be pulled, however, your final plat
must be accepted, approved by the City Commission, and recorded.
If pulling a building permit is impossible, you can apply for an
extension of the time limit and the preliminary plat and the site
plan to the City. This request should be s~mitted to me no
later than 11/18/91.

The City of Boynton Beach understands that the developer of the
Boynton Lakes Plaza Shopping Center, a retail center approved for
133,015 sq.ft., intends to construct improvements for signage and
code required parking over the 80' drainage easement along their
north property line and that the existing drainage ditch will be
fully culverted according to your specifications. The City also
understands that the easement may, from time to time, need to be
maintained and/or repaired and that the improvements located
within this easement will be temporarily interrupted in that
regard. We also understand that the project's developer has
agreed to be responsible to promptly repair and/or replace any
improvements in the easement, including those which are damaged,

Dear Chris:
We are currently in the process of drafting letters requesting
sign off of all applicable utility agencies for the construction
of any of our improvements which happen to lie in the public
easements. In this regard, we have been requested to provide a
letter from the City to the Lake Worth Drainage District
confirming the City's understanding that the drainage easement
upon which we will be constructing certain improvements
(parking, signage, etc.) may need to be maintained and repaired,
from time to time, during which time those improvements will be
temporarily interrupted. We have further agreed to LWDD to be
responsible for the continuing maintenance of any of the
improvements in that easement as well as those which have to be
removed in order to facilitate that maintenance and repair. I
have enclosed a draft of an outline letter which I would
appreciate you reviewing. If the letter meets with your
approval, I would like to have the City issue it so that we may
submit it directly to Lake Worth Drainage District in order to
obtain our final approvals.

Dear Bill:
Reference is made to your meeting with Mr. Joel Wantman, P. E. ,
regarding culverting a portion of the above referenced canal
fronting Boynton Lakes Plaza.
Enclosed are documents which you required us to secure in order to
satisfy the Board of Supervisors and you in allowing the requested
culverting. These documents are:
Letter from the planning director of the City of Boynton Beach
acknowledging the operations involved.
Letter from the owner accepting any and all maintenance and
repair responsibilities.
Furthermore, on July 3, 1991, we had a meeting with Mr. Wheelihan
from your district, Mr. Andy Hertel from Palm Beach County Traffic
and the representative of Lennar Corporation (owners of the
outparcel in the northwest corner of our plaza). During this
meeting, we discussed the possibility of Palm Beach County
accepting the maintenance responsibility of the said culvert since
their roadway will be encroaching the 80' easement. Mr. Hertel
expressed willingness on the part of the county to do so, but said
that he will give us a final answer in writing soon.
On Wednesday, July 17, 1991 at 9:00 a.m., we are scheduled to
appear in front of your district's Board of supervisors. We trust
that by then we will be in receipt of Palm Beach County's final
written ~irection in regards to maintaining the canal upon
culverting. Even if Palm Beach County does not commit to maintain
this canal, as you can see on the attached letter, the owner is
unequivocally accepting that responsibility. However, I trust that
it is everyone's preference that Palm Beach County maintain this

client would convey the required land for an expanded intersection
(see attached survey sketches) to Palm Beach County while the land

Dear Mr. Glidden:
Please be advised that on Tuesday, December 18, 1990, the City
Commission approved the referenced site plan modification subject
to the "NO TRUCKS" sign on Plaza Lane being moved to a point just
east of the access drive on Plaza Lane. In addition, the issues
discussed within the attached me~orandums from Planning, Police
and'Bu~lding Departments must be addressed during final sign-off
prior to applying for a permit.
These plans were approved Subject to your compliance with the
attached stipulations and must now be modified to incorporate
same. To initiate your sign-off procedure, please submit three
(3) sets of modified plans to the Office of the Site Development
Division of the Building Departm~, which will record the
required identification markings on each set of the modified
plans.
After both sets of modified plans have the appropriate markings,
you should proceed with your sign-off on both sets of plans from
each Technical Review Board member who made comments. The
Planning Department is the next-to-last department to be
contacted to obtain their sign-off. The Zoning & Si te
Development Administrator will provide the Building Department
sign-Off and is the last Technical Review Board member to review
and sign-off the plans. If the Building Department did not have
comments that require sign-off, they are still the last
department to handle and process the plans. One (1) set of final
signed-off plans will remain with the Building Department and the
other set of plans will be returned to you to be retained at the
job site.

To help facilitate' the sign-off process, you should make an
appointment to meet with each Technical Review Board member (only
those members who made comments), to allow them sufficient time
to review and sign-off the modified plans. After securing all
the required Technical Review Board member signatures and
completing processing by the Site Development Division, you may
apply for building permits by submitting the appropriate
documents and fee to the Plan Review and Permitting Division of
the Building Department. The Building Department will advise you
as to any additional permits which may be required, such as Palm
Beach Health Department (water and sewer), clearing/grubbing,
excavation/fill, drainage, paving, site lighting, landscaping and
irrigation.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan will be
viewed procedurally as an as-built or record drawing. If you
have any questions concerning this matter, please do not hesitate
to contact me.

Site Plan Modification - parking/building change
Please be advised that the planning Department's comments, with
respect to the above-referenced request for a site plan
modification, have been addressed. The following is a list of
pOints of information:
1. A future site plan approval will be required for development
of the outparcels, changes in the parking lot layout and
design in the vicinity of the outparcels and the Winn Dixie
expansion.
2. The design of ingress/egress points for truck traffic was an
issue that was discussed in great detail by the Technical
Review Board (TRB) , particularly as it related to the
parking lot variance for the driveway onto Hypoluxo Road.
The positive recommendation from the TRB for the variance,
which has already been approved by the Planning and Zoning
Board at the December 11, 1990 meeting, assumed that truck
traffic would be allowed to enter the site from anyone of
the four driveways proposed and not restricted to Congress
Avenue and Hypoluxo Road, as is reflected on the revised
plans.
This access restriction has a significant impact on the
traffic circulation patterns (the Plaza Lane driveway and
the Hypoluxo Road driveway anticipated to be most heavily
used) and jeopardizes safety (forcing u-turns on Congress
Avenue and mixing truck traffic with vehicle and pedestrian
traffic within the internal parking areas). In addition, a
greater stacking problem is anticipated at the Hypoluxo Road
driveway if truck access is limited to Hypoluxo Road and
Congress Avenue. A possible consideration when revisiting
this issue may be to move the "No Trucksll sign east on Plaza
Lane, beyond the driveway onto Plaza Lane.

As per our discussions at the Technical Review Board meeting of
December 17, 1990, I am recommending the following:
1. With regard to the suggested elimination of the
ingress/egress points on Plaza Lane and Boynton Lakes Blvd., I
would not be in favor of such a proposal. These driveways should
remain available for public access so as to reduce traffic on
Congress Ave. and Hypoluxo Rd. Additionally, egress would permit
the use of a signal-controlled intersection at Hypoluxo and
Boynton Lakes Blvd. (Public Safety)
2. "No Trucks" Signage: My recommendation is that such signage,
if required, be placed south of the Boynton Lakes Blvd.
ingress/egress and east of the Plaza Lane ingress/egress. These
signs must be specific in the class/weight of vehicle(s) being
prohibited.
The placement of these signs as indicated would permit all trucks
to use these roadways for access to Boynton Lakes Plaza for
delivery/pickup purposes. This would avoid a u-turn situation
for southbound truckers at Plaza Lane and Congress Avenue and
allow for the same signal-controlled situation at Hypoluxo Rd.
and Boynton Lakes Blvd. (Public Safety)
3. Again, although not indicated on the set of plans provided
me, Mr. Glidden verbally confirmed that the corridor between the
stores will be secured with a lockable gate or eliminated
entirely.
4. All other recommendations listed in Lt. Hammack's memo of
November 6, 1990 have been satisfactorily addressed.

meeting due to the fact that Vince Finizio did not receive
