Request
for
surety
Please be advised that this Department requests the $8,000 surety
now being held by the City be retained until the one year warranty
period is completed. This surety is, in part, for the utilities
improvements on the west side of the subject parcel, and also
serving the adjacent parcel (Mobil station). We had previously
recei ved all necessary documents regarding that portion of the
water and sewer utilities.
Regarding the utilities on the eastern portion of the site (i.e.
that portion certified by Simmons & White, Inc.), we have yet to
receive the necessary bill of sale on the utilities, and therefore
request that the reduction not occur until the developer furnishes
a completed document. A copy of the bill of sale form is attached
for transmittal to the developer.
It is our understanding that neither of the above sureties cover
the utilities on the Mobil station site. If this understanding is
incorrect, please inform us immediately, referring any information
on this matter to Peter Mazzella of this office.

Engineer) as well as a request from Simmons & White, Inc.
(Developer's Engineer) for partial surety reduction for Boynton
Lakes Plaza, Parcel "B" (Shopping Center site).
I ask that wi thin ten days from receipt of this memo, your
departments reply in writing, to my attention, as to whether or not
you obj ect to or approve the requests received from the two
Engineers.
Please set forth within your memo any conditions which must be met
in order to satisfactorily process the release and/or reduction of
surety.
Please perform the appropriate final or interim inspections and

As a registered professional engineer in the State of Florida, to
the best of my knowledge, information and belief, it is my
professional opinion that the required improvements for Boynton
Lakes Plaza, based on field review under my responsible charge,
have been constructed in substantial accordance with the approved
construction plans. These required improvements include water,
sewer, paving, drainage and off-site road improvements. Test
reports and record drawings have been provided to your office and
in addition a reproducible mylar is included with this letter.
Since all of the bondable items (required improvements) have been
completed, it is requested that a reduction in the amount of
surety be granted. Although the work is essentially complete, it
is suggested that 3urety in the amount of 10% of the original be
retained. This new surety amount would be $19,472.58 (.10 x
$194,725.75).
It is requested that this matter be placed before the City
Commission at the earliest possible time.

Status of Capacity Reservation
As you may recall, we gave a favorabl e recommendation to this
project with the notation that water and sewer reservation fees
were past due and must be paid before the plat was signed off by
the City and recorded.
Members of my staff met today with Gregory "Rocky" Goins and Terry
Harms, who were representing the developers of Boynton Lakes Plaza.
These two gentlemen indicated that their firms wish to fast-track
this project and begin construction as soon as possible after
approval of the Final PI at by the ci ty. Due to thei r imminent
construction, they are considering paying the capital facilities
charges for retai I use at thL PI aza in I ieu of the necessary
reservation fee. This option is allowed by the City Code, and we
would have no objection to it.
It will take several days, however, to arrange payment of whichever
fee the developers decide to pay. The project can therefore either
go forward for Commission action, with the plat not being signed
until payment is received, or the project can be withheld from the
agenda until payment is received. Either option is workable from
an administrative standpoint, and we would have no objection to
either alternative as long as a time limit is placed upon the grace
period for making payment.
Please advise me if you require any additional information on this
matter.

Please be advised that the Engineering Department for the City of
Boynton Beach, Florida is in receipt of the attached August 14, 1992
letter from Charles R. Walker, Jr., P.E., Acting Assistant County
Engineer, where in paragraph #3 of the subject letter, the County
indicates they have no objections to the City allowing the plat of
Lennar's outparcel to be recorded.
The Boynton Lakes Commercial plat was previously approved by City
Commission Resolution R92-l00 (attached) and therefore I respectfully
request that the Honorable Mayor, City Clerk and the City Engineer
who effectuated the approval of the plat, that being Mike E. Kazunas,
execute the provided original mylar plat document as soon as possible.
Once executed, the plat document should be returned to my attention
so that I may make a photocopy of same in order to ensure that no
changes are made to the plat document, prior to recording by the
applicant. Once the applicant has provided a recorded mylar repro-
ducible document to this office, I will prepare a Land Development
Order for the signature of the City Engineer in order to authorize
construction of the required improvements pursuant to City Code of
Ordinances, Appendix "C", Subdivision & Platting Regulations.
Thank you for your assistance during the processing of this final
plat.

As we discussed recently, we are requesting a six month extension
of the Preliminary Plat Approval, Site Plan Approval and
concurrency vesting which was previously extended on December 17,
1991. It is our understanding that the initial deadline for the
expiration of those approvals will be June 17, 1992. This
extension request is in order to allow us time to complete the
necessary loan commitments which are currently pending for this
project. I am sure that the City can appreciate the fact that
todays difficult economic climate has extended the time required
to secure construction financing.
For your information, we have a sale of the property pending to
Mr. Allan Goins, who has secured 90% pre-leasing commitments as
well as preliminary commitments for construction and permanent
take-out loans. We need this additional time to finalize the
loan agreements and close the sale. Mr. Goins will proceed
immediately after closing with the proper applications for the
final Plat and for Building Permits. We would appreciate it if
this matter could be scheduled for an official decision by the
City Commission at their next regular meeting.
We appreciate your assistance in this matter. We look forward to
hearing from you soon as to the date we may expect a decision
from the City Commission.

approval of a time extension upon the land owners agreeing to dedicate the
required land areas needed for the Counties roadway improvement project as detailed
within Hr. Walker's letter. Additionally, the County requests that as a con-
dition of approval, the land owners shall install the necessary culvert pipe
and backfill within the affected future roadway area (LWDD) within the time
frame contained in Hr. Walker's letter.

Dear Mayor Wiener:
It has come to our attention that the developer of the subject project 1$
seeking an extension from the City on his obligation to record a plat and site
plan. This extension, 1f granted, would have a substantial detrimental effect
on the p1anned expansion of the Hypoluxo Road/Congress Avenue intersection by
American Development (Target Center) and Palm Beach County.
As you are proba,ly aware. the City. American Development, and the County have
entered into a Tri-Pa~ty Agreement to accomplish this intersection improvement.
A substantial portior of this work is American Development's obiigation under
the development order issued by the City,
The County has directed the consultant preparing the plans for this intersection
to changQ thQ plans to incorporate ths right-of-way to be dedicated by Boynton
Lakes Pla21. This change results in t~erQ being no need to condemn property on
the north side of Hypoluxo Road to accomplish the construction.
Over the last several months, there nave baan sQve~al meetings and discussions
involving rQprQsenht1vu of Boynton Lakes PhZi, the Lake Worth DrainagQ
District, ths consultant preparing the plans, and County for the purpose of
working out the details of Boynton LaKes Plaz~'$ piping of the L,W.D.D. canal
and conveying r;ght.oT-WiY to :ne County.
In keeping with thlilsQ discussions, the County has phdgsd t.o enhr into an
agree~er.t with L.W.D.O. for the maintenance or the pifed canal, in exchange for
the deve1oper's dedication of right-of-way for :.-iypo Uxo Road. Tho developer
stands to receive a substant4al benefit from this arrangement because a
substantial amount of his required parking would be placed on top of this pipQC

I understand that the City his the opportunity to impo5e conditions on this
requested extension. In order to avoid further delays to th1 s 1ntersect 1 on
expans10n and to remove the element of un~ertainty, I am reQuest1ng that any
time extension granted by the City be conditioned upon tne developer Of Boynton
Lakes Plaza piping the canal by April 15, 1992. We est1mate the cost for this
piping work to be $165,000.00+1-. The right-of-way for Hypoluxo Road and
Congress Avenue should be conveyed in the same time frame.
If the developer is not w1111ng to commit to th1st the county will have no choice
but to withdraw its comm1tment to ma1nta1n the p1ped canal. At present, the Lake
Worth Drainage District requires that a governmental ent1ty have responsibility
to ma1nta1n such piped cana1s as a condition of their permit to use their
easement for parking. It should be noted that if the County withdraws its offer,
the developer will not be able to sat1sfy his minimum parking requirements for
the center.

and Preliminary Plat Extension
The representatives of Boynton Lakes Plaza have requested an
extension of the concurrency, site plan and preliminary plat for
this development for six months.
On December 10, 1991, the Planning and Zoning Board, based
on an affirmative recommendation from the Concurrency Review
Board, unanimously approved the extension of the concurrency for
Boynton Lakes Plaza for 137,833 square feet of construction for
six months, subject to approval of a site plan extension by the
City Commission. This determination is final at the Planning and
Zoning Board unless appealed to the City Commission.
If the site plan is extended by the City Commission, the new
expiration date for the site plan and submission of the final
plat will be June 18, 1992.
We have attached the Planning and Zoning Board backup and
other memos on this item.
This item has been scheduled for City Commission review on
December 17, 1991.

Please be advised that the Planning and Zoning Board met on
Tuesday, December 10, 1991 and took the following action:
1. Continued the public hearing for the Cross Creek Centre
parking lot variance to the January 14, 1992 meeting at
7:00 p.m., as per the applicant's final request for another
30 day postponement.
2. Tabled the determination of consistency with the
Comprehensive Plan for the proposed amendment to Appendix
A-Zoning to amend the regulations governing service stations
and convenience stores until the amendment is presented to
the Board in ordinance form. In addition, the Board
directed staff to formulate language to include specific
landscape buffer criteria, a 6 foot rather than a 5 foot
concrete wall and to change "larger" to "wider" under the
locational standards. The Board reiterated their desire to
exclude T-intersections as an allowable location for such
uses.
3. After conducting a public hearing recommended approval of
Ray F. Flow's request for conditional use approval of an
existing day care center, subject to proviso. Motion was
made by Mrs. Huckle and seconded by Mr. Howard. The vote
was 5-1 with Mr. Rosenstock dissenting. (PM91-324)
4. After conducting a public hearing, unanimously recommended
approval of Kilday and Associates' Mall South request to
show annexed land as Local Retail Commercial, to rezone from
AR in Palm Beach County to C-3 and AG and to amend the
Traffic Circulation Element Support Document of the
Comprehensive Plan to include Winchester Boulevard as a city
collector on the Future Functional Classification Map and as
a 4-lane divided road on the 2010 Roadway Design Map,
subject to proviso. The motion was made by Mrs. Huckle and
seconded by Mr. Cwynar. (PM91-325)
5. After conducting a pUblic hearing, recommended approval of
the City's water treatment plant expansion request to amend
the Future Land Use Element of the Comprehensive Plan from
Medium Density Residential to Public and Private
Governmental/Institutional, amend Area 4.e of the Future
Land Use Element Support Document to remove obsolete text
and rezone from R-2 to PU, Public Usage. The motion was
made by Mr. Howard and seconded by Mrs. Huckle. The vote
was 5-1 with Mr. Hinson dissenting. (PM91-326)
6. After conducting a public hearing, unanimously recommended
denial of the City's North Federal Highway request to amend
Area 1.i of the Future Land Use Element Support Document, to
remove text that is inconsistent with the proposed rezoning
and to rezone from C-4 to C-3. The motion was made by Mr.
Cwynar and seconded by Mr. Hinson.
In addition a motion was made by Mr. Howard and seconded by
Mrs. Stevens recommending that the City Commission, an
alternative to rezoning from C-4 to C-3, investigate an
aesthetic/landscape overlay district for the C-4 zoned area

Pursuant to Chapter 19, Article VI, concurrency Requirements,
James Williams has submitted a request to extend the concurrency
for the Boynton Lakes Plaza Site Plan.
The Concurrency Review Board met on November 25, 1991, and
unanimously recommended that the concurrency of Boynton Lakes
Plaza be extended for six (6) months to June 18, 1992.
The Engineering Department recommended the concurrency be
extended subject to a condition that an access driveway on

As you are aware. the City's codes requires the subdivision and platting submission
be administered by one (1) Engineer and not two (2) Engineers. Additionally, the

SUBJECT: Boynton Lakes Plaza Site Plan Modification
As requested by the Planning and Zoning Board at its meeting of
Tuesday, December 11, 1990, the applicant has resubmitted a fully
revised site plan for this development.
The Planning Department received these plans on Thursday,
December 13, 1990 and they were distributed to members of the
Technical Review Board on that day.
A special meeting of the Technical Review Board was held on
December 17, 1990 and the plan was found to be in compliance with
the comments that were made by the Technical Review Board on this
plan at its meeting of November 5, 1990.
It should be pointed out that a problem has arisen regarding the
placement of "NO TRUCK" signs at the intersection of Boynton
Lakes Boulevard and Hypoluxo Road and Plaza Lane and Congress
Avenue.
The applicant is opposed to the placement of these signs because
it forces all trucks to enter the development by either Hypoluxo
Road or Congress Avenue. When truck traffic was discussed at the
Technical Review Board meeting on November 5, 1990, the Technical
Review Board members made comments based on the concept that
trucks would enter the site by way of an access opening on Plaza
Lane.
Mr. Finizio, Administrative Coordinator of Engineering, is
adamant regarding the placement of these signs. The Police
Department is opposed to the signage placement. The Planning
Department feels that the sign on Plaza Lane should be moved to
a point just east of the access drive on Plaza Lane. We expect
that the applicant will wish to discuss this item with the Board
during the meeting.

Site Plan Modification - parking/building change
Please be advised that the planning Department's comments, with
respect to the above-referenced request for a site plan
modification, have been addressed. The following is a list of
points of information:
1. A future site plan approval will be required for development
of the outparcels, changes in the parking lot layout and
design in the vicinity of the outparcels and the Winn Dixie
expansion.
2. The design of ingress/egress points for truck traffic was an
issue that was discussed in great detail by the Technical
Review Board (TRB), particularly as it related to the
parking lot variance for the driveway onto Hypoluxo Road.
The positive recommendation from the TRB for the variance,
which has already been approved by the Planning and Zoning
Board at the December 11, 1990 meeting, assumed that truck
traffic would be allowed to enter the site from anyone of
the four driveways proposed and not restricted to Congress
Avenue and Hypoluxo Road, as is reflected on the revised
plans.
This access restriction has a significant impact on the
traffic circulation patterns (the Plaza Lane driveway and
the Hypoluxo Road driveway anticipated to be most heavily
used) and jeopardizes safety (forcing U-turns on Congress
Avenue and mixing truck traffic with vehicle and pedestrian
traffic within the internal parking areas). In addition, a
greater stacking problem is anticipated at the Hypoluxo Road
driveway if truck access is limited to Hypoluxo Road and
Congress Avenue. A possible consideration when revisiting
this issue may be to move the fiNo Trucks" sign east on Plaza
Lane, beyond the driveway onto Plaza Lane.

remain available for public access so as to reduce traffic on

Boynton Lakes Blvd. (Public Safety)
2. "No Trucks" Signage: My recommendation is that such signage,
if required, be placed south of the Boynton Lakes Blvd.
ingress/egress and east of the Plaza Lane ingress/egress. These
signs must be specific in the class/weight of vehicle(s) being
prohibited.
The placement of these signs as indicated would permit all trucks
to use these roadways for access to Boynton Lakes Plaza for
delivery/pickup purposes. This would avoid a u-turn situation
for southbound truckers at Plaza Lane and Congress Avenue and
allow for the same signal-controlled situation at Hypoluxo Rd.
and Boynton Lakes Blvd. (Public Safety)
3. Again, although not indicated on the set of plans provided
me, Mr. Glidden verbally confirmed that the corridor between the
stores will be secured with a lockable gate or eliminated
entirely.
4. All other recommendations listed in Lt. Hammack's memo of
November 6, 1990 have been satisfactorily addressed.

In accordance with the City of Boynton Beach, Code of Ordinances, Chapter 19,
Section 19-7. "Plan Required" and 19-17.1. "Fee to Accompany Plan", inc:'uding
Chapter 5, Article X, "Boynton Beach Parking Lot Regulations", Section 5-142.
"Required Improvements" (inclusive), the applicant for the above referenced
project, shall submit the following plan revisions, technical data, info~ation
and requested engineering details ~s follows:
SITE PLAN AND PRELlHINARY!FINAL PLAT
1. The construction details for the widening of Boynton Lakes Boulevard shall
be revised to indicate an asphaltic concrete surface of one and three quarter
inches ( 1-3/4" ) in thickness, as Boynton Lakes Boulevard is a collector road.
Reference-Code of Ordinances, page 2139, Appendix "C", Article X, Section 10.
"Streets", Subsection F. "Materials" which requires type II, asphaltic concrete.
Additionally, revise the Florida Bearing Value (F.B.V.) of fifty (50) to read
seventy-five (75) in accordance with the aforementioned code.
2. Page 6 of 13 indicates a shoulder restoration procedure by which disturbed
shoulder areas are to be restabilized to fifty (50) p.s.i. (F.B.V.). Revise this
note to read seventy-five (75) p.s.i. (F.B.V.) in accordance with Section 10.
"Streets", Subsection H. "Stabilized Shoulders".
3. A quantity of three (3) stormwater inlet grates are located within paved areas
and constitute a state of non-compliance with Chapter 5, Article X, Section, 5-142
(g) "Drainage Standards". The provisions within this section allow this Depart-
ment to grant administrative relief in those instances where design demands that
placement of said grates be located within paved surfaces, as the code requires
all stormwater inlet structures are to be located within grassed areas. The Eng-
ineering Department in accordance with this provision is required to provide a
written statement granting relief, and in accordance with this provision herein
grants the applicant relief for the three (3) stormwater inlet grates condition-
ed upon the applicant placing bicycle/pedestrian-proof grates at these locations.
4. Pedestrian sidewalks along Boynton Lakes Boulevard and Plaza Lane shall be
constructed in conjunction with the development of this site. The sidewalks
shall continue through ingress/egress approach areas and be a total thickness
of six (6) inches through these areas. The sidewalks shall be transitioned to
provide proper access for handicap persons. Chapter 5, Article X, Section 5-142
(g), "Sidewalk Standards" inclusive.
5. Should the Developer's Engineer desire to diminish costs relative to construct-
ion of the parking facility, the stabilized subgrade note on page 8 of 13 could be
revised to delete the thirty-five (35) p.s.i. (F.B.V.) if the Engineer deems this
action appropriate, as our City Codes do not require stabilization of subgrade
soils within parking facilities.
6. Plaza Lane and Boynton Lakes Boulevard are dedicated rights-at-way and there-
fore sidewalks constructed at intersections (including Congress Ave.) shall comply
with City of Boynton Beach Engineering Department Standard Drawing #A-83065, in
order to provide handicap accessibility at each intersection. Chapter 22. "Streets

of the stormwater drainage system that ties into the stormwater drainage system
situated within the public rights-of-way(s) of Boynton Lakes Boulevard and Plaza
Lane. The stormwater drainage system inlet structures located in proximity to
the "dumpsters", shall be relocated north of the proposed location to eliminate
the possibility of toxic discharges into a system that ties directly into the
drainage system located within the public rights-of-way(s) of Boynton Lakes Blvd.

istered engineer, for technical review for both the storrnwater system(s) and the
roadway widening project(s). In accordance with Chapter 22. "Streets", Section
22-20 (b). the applicant shall reimburse the City of Boynton Beach for those
services rendered by the registered engineer. The text of Section 22-20 is as
follows: "In the event it should be necessary to have the services of a registered
engineer for any inspection. or technical approvals are deemed necessary by the
City Engineer, such expenses shall be borne by the owner or person interested".
(page 1560 of Chapter 22. "Streets")
8. The pavement markings for the expansion and/or modification of the publicly
owned streets (Boynton Lakes Blvd. and Plaza Lane, shall be thermoplastic pavement
markings. (Chapter 22. "Streets". Section 22-23. "Standards" page 1561)
9. As a prerequisite of approvals precedent to Final Plat, the applicant shall
obtain formal permits from requisite governmental agencies having jurisdiction
over the subject lands. Palm Beach County Traffic, Lake Worth Drainage District
Palm Beach County Health Department and South Florida Water Management District.
10. In accordance with the T.R.B. comments of the City's Consulting Engineers
Gee & Jenson, One Harvard Circle, P.O. Box 24600, West Palm Beach. Florida 33416-
4600, telephone number (407) 683-3301 - Richard Staudinger, P.E., the stormwater
inlet structure grates proposed to remain within a newly constructed traffic lane
shall be convereted to a man-hole cover (two instances) and newly placed inlet
structures shall be located within the available grassed swale areas of Boynton
Lakes Boulevard to facilitate the pre-treatment of stormwater runoff.
Appendix "C". "Subdivision and Platting", Article X, Section 5. "Drainage and Storm-
water Treatment", including Section 5A (inclusive) and 5B. "Stormwater Treatment"
(inclusive).
11. Provide striping details for "Handicap" parking stalls including details for
the associated signage. Striping of "Handicap" parking stall, signage and ramps,
shall comply with the latest edition of the Department of Community Affairs Manual
and Accessibility Requirements. Chapter 5. "Boynton Beach Parking Lot Regulations",
Section 5-142 (k), "Handicap Requirements". Additionally, provide a striping detai]
for standard parking stall in accordance with the requirements set forth within
Section 5-142 (L), "Parking Lot Striping". Reference Section 5-142 (g), "Striping
Standards" which can be found within the Engineering Construction Specifications
made a part of the Parking Lot Ordinance by a Commission adopted resolution.
A copy of the Boynton Beach Parking Lot Regulations and attached standards can be
obtained from the Building Department at a nominal cost to the Developer.
12. Provide "Fire-Lane" striping and signage in accordance with Chapter 5, Section
5-142 (m), "Required Fire Lanes" and Section 5-142 (g), "Fire Lane Construction
Standards".
Please note that Item #11 is properly depicted on the Architectural drawings, but
is not shown. on the Civil Engineer's Development Plan. Permits for parking lot
construction are usually issued by utilizing the Engineer's plan which does not
compliment the Architects plan in this regard. Additionally, the decorative paving
blocks shown on the Architects plan should also be placed on the Engineer's plan
(a notation would be acceptable) as the Engineer's plan indicates painted "Stop Bars
at these locations. The required painted "Stop Bars" and associated painted turn-
ing (directional) arrows, may adversely alter the appearance of these areas.
Revise plans accordingly.
13. Provide a parking facility lighting plan that complies with the requirements
of Chapter 5, Article X. "Boynton Beach Parking Lot Regulations". Section 5-142 (a)
"Required Lighting" and Section 5...;142 (g), "Lighting Standards". An illumination
(photometric) plan shall be submitted by the applicant. Said plan shall accuratel)
depict illumination levels within this parking facility. Chapter 19, "Plan Require(

adequate to review possible hazards and disturbances to the public and adjacent
properties. It should be noted that the proposed location of approximately four (
light poles (standards) will adversely affect and negate the required two (2) foo~
vehicle overhang areas, as these poles are placed within the paved parking areas.
The two (2) foot overhang is a code requirement of Chapter 5, Article X, Section
5-142 (g) "Construction Standards and Associated Layout Appendix". Reference Sectie
5-142. "Required Improvements", subsection 5-142 (i), (1), which states: "Parking Ie
shall be designed to meet or exceed the dimensional requirements for stalls, drive-
ways,. and access aisles as provided for in City standards". Relocate the lightini
standards (poles) into appropriate areas that will not adversely impact the t~o (2)
foot over-hang layout requirement. Revise plans accordingly.
14. In accordance with Appendix "C"-Subdivision and Platting Regulations, the appL
cant shall submit (reference Section 7. Submission of Final Plat) to the City. a
surety or performance bond obtained from a company having Best's rating of AAA, and
authorized to do business in the State of Florida.......(pages 2113 & 2114, City of
Boynton Beach, Code of Ordinances. Should the applicant desire to submit an altel
nate form of surety, the surety shall be approved by the City Commission in conjunct
ion with this office, the City Attorney's office and the City Xanager's office.
The surety posted in whatever form shall remain in full force and effect until City
final approval. The applicant is herein directed to contact the City Attorney,
~r. James Cherof, Esquire for guidance and direction in matters pertaining to said
alternate surety. (City Attorney's telephone number is .40n 738-7405 or (407) 276-
9400) Surety shall be in an amount equal to 110% of the Engineer's Opinion of Costc
15. The Developer shall formally execute the "Developer's Agreement" contained
within the site plan submittal application in accordance with the Ordinance adopted
by City Commission, relative to executing the rider to the site plan application.
By copy of these comments to the City Attorney's office, the applicant is hereby
directed to contact the City Attorney, relative to whether or not this "Rider"
shall be notarized including the execution of the witness signature line not yet
signed.
16. Comply with the City of Boynton Beach, Florida, Consulting Engineer's T.R.B.
comments, attached and made a part herein.
17. Provide written verification from Palm Beach County Traffic, Charles Cantrell,
P.E., Signalization Specialist, that the $18,000.00 line item listed'within the
"Engineer's Opinion of Costs" published by Keshavarz & Associates is adequate to
ensure the installation (Developer's fair share) of the three (3) traffic signals
indicated under the heading "Street Lighting: Congress Avenue & Hypoluxo Road".
18. The Developer has requested that his submission be considered both a prelim-
inary and final plat submission in conjunction with site plan approval. When the
submission complies with the requirements set forth within our City's Code of
Ordinances, a quantity of six (6) sets of construction plans having Health Depart-
ment approval and time stable mylar plat document(s) formally executed, shall be
delivered to this Department in order to facilitate and expedite the platting
process. Reference: Appendix "C", Article VIII, Section 7. "Submission of Final
Plat". Technical compliance with the provisions of the subdivision and platting
process must occur prior to review by the Planning and Zoning Board as the appli-
cant desires to receive simultaneous approval of preliminary and final plat, there-
for immediately after the T.R.B. has provided comments to the applicant, the appli-
cant must reconcile the plans with staff comments (platting) and as quickly as
possible, re-submit the corrected plans to my office. I will promptly schedule a
staff review of the plans. Should the plans comply with all staff comments, this
Department will promptly write a letter of technical compliance and request that tr
Director of Planning, place this matter before the P & Z Board. Additionally, I
will create an agenda item for City Commission review and acceptance of the pre-
linary plat, including a resolution accepting the formal final plat submission,
to be ruled upon by the City Commission during the same meeting.
19. Indicate the point(s) of ingress/egress for Delivery Trucks. Delivery truck:
will be prohibited from utilizing City owned and operated roadways that are a part
of the roadway circulation system for the residential P.D.D. Delivery trucks in
the form of "Tractor/Trailer" trucks should enter this site from Hypoluxo Road or
Congress Avenue. Provide signage directing trucks to the appropriate ingress/egr
approach areas. This shall be a condition of City permit(s) to alter and constru
within the public rights-of-way, in accordance. with Chapter 22. "Streets" includin

Site Plan Modification - parking/building change
Please be advised of the following Planning Department comments
with respect to the above-referenced request for a site plan
modification:
1. A graphic scale needs to be added to all sheets submitted.
Site plan application, page 5, item 42.
2. Indicate any existing driveways that are within 100 feet of
the site, such as the driveway onto Plaza Lane which serves
Boynton Lakes PUD and the driveway onto Boynton Lakes
Boulevard which also serves Boynton Lakes PUD. Site plan
application, page 5, item #4.
3. Add a note to the elevations that all rooftop and
ground-mounted mechanical equipment shall be screened and
baffled. Comprehensive Plan, Future Land Use Element,
Policy 1.17.7.
4. A future site plan approval will be required for development
of the outparcels, changes in the parking lot layout and
design in the vicinity of the outparcels and the Winn Dixie
expansion.
5. As per the previous site plan approval, it is recommended
that the developer post a bond for future traffic signals at
the following intersections:
a) Congress Avenue and Plaza Lane
b} Hypoluxo Road and Boynton Lakes Boulevard
6. It is recommended that the eastbound, left turn lane on
Plaza Lane into the shopping center and the westbound, left
turn lane on Plaza Lane, be constructed as shown on the
previously approved site plan (see Exhibit "A").
7. As a point of information, the number of outparcels proposed
as part of the requested site plan modification is greater
than the number of outparcels proposed on the previously
approved site plan.
8. A sidewalk shall be required along the property's Hypoluxo
Road frontage. Comprehensive Plan, Future Land Use Element,
Policy 1.11.9.
9. Add a note to the plans that parking lot lighting along the
east and south property lines will be shielded from the
adjacent residences. Comprehensive Plan, Future Land Use
Element, Policy 1.17.7.
10. The driveway proposed onto Boynton Lakes Boulevard does not
meet the requirement of Article X - Parking Lots, Section
5-142(h)(3}. It must be relocated north, a minimum of 180
feet from the intersecting rights-of-way lines of Boynton
Lakes Boulevard and Plaza Lane, or the applicant must apply
for a parking lot variance.

No fire lane has been provided along the 6 retail bays on
the north side of the shopping center. The parking spaces
in this area must be removed or the applicant must apply for
a parking lot variance. Since no surplus of parking spaces
exists, any parking spaces deleted must be prOVided
somewhere else on site. Article X - Parking Lots, Section
5-142(m).
The design of ingress/egress points for truck traffic is a
problem which needs to be addressed, particularly at the
driveway onto Hypoluxo Road and access to the rear of the
shopping center. Several solutions were discussed at the
TRB meeting for the applicant to conslder. They are as
follows:
a) add an additional egress-only driveway onto Boynton
Lakes Boulevard, so that trucks may enter the rear of the
center from the driveway onto Boynton Lakes Boulevard and
exit at the additional driveway located further north,
b) shift the Winn Dixie building south to open
up access to the loading zones in the rear,
c) move the Winn Dixie building along the south property
line rather than the east property line so that lt faces
Hypoluxo Road to improve rear access, and
d) enlarge the turning radius at the driveway onto
Hypoluxo Road as shown on the sketch included in the
parking lot variance submitted to prevent trucks from
running over the Hypoluxo Road median when exiting at this
driveway.
An internal circulation problem exists east of the congress
Avenue driveway where five access aisles merge, but don't
align safely. It is recommended that this area be
redesigned to form proper intersections. Comprehensive
Plan, Future Land Use Element, Objective 1.18.

BOYNTON LAKES PLAZA
SITE PLAN MODIFICATION
John Glidden, agent for Boynton Lakes Development Corporation, is
requesting approval of an amended site plan to allow changes in
building and parking layout and design. The latest approved site
plan allows a maximum of 137,833 square feet of gross floor area.
The proposed site plan reflects 133,015 square feet, a decrease
of 4,818 square feet. As a result of significant changes in
tenants, all of which exhibit similar peak parking demands, the
previously approved shared parking study has been eliminated and
all parking required by code is to be provided. Three leased
outparcels are proposed, as well as a 54,234 square foot
supermarket, a 13,500 square foot drugstore, and 65,281 square
feet of retail/office space. Since this parcel is bound on all
four sides by public rights-of-way, one driveway is proposed onto
each of the four frontages. Landscaped buffers are proposed on
the south and east frontages which abut residential zoning,
Boynton Lakes PUD. The Technical Review Board recommends
approval of this request subject to the attached staff comments.

In accordance with the City of Boynton Beach, Code of Ordinances, Chapter 19,
Section 19-7. "Plan Required" and 19-17.1. "Fee to Accompany Plan", including
Chapter 5, Article X, "Boynton Beach Parking Lot Regulations", Section 5-142.
"Required Improvements" (inclusive), the applicant for the above referenced
project, shall submit the following plan revisions, technical data, information
and requested engineering details as follows:
SITE PLAN AND PRELIMINARY/FINAL PLAT
1. The construction details for the widening of Boynton Lakes Boulevard shall
be revised to indicate an asphaltic concrete surface of one and three quarter
inches ( 1-3/4" ) in thickness, as Boynton Lakes Boulevard is a collector road.
Reference-Code of Ordinances, page 2139, Appendix "C", Article X, Section 10.
"Streets", Subsection F. "Materials" which requires type II, asphaltic concrete.
Additionally, revise the Florida Bearing Value (F.B.V.) of fifty (50) to read
seventy-five (75) in accordance with the aforementioned code.
2. Page 6 of 13 indicates a shoulder restoration procedure by which disturbed
shoulder areas are to be restabilized to fifty (50) p.s.i. (F.B.V.). Revise this
note to read seventy-five (75) p.s.i. (F.B.V.) in accordance with Section 10.
"Streets", Subsection H. "Stabilized Shouldersll.
3. A quantity of three (3) stormwater inlet grates are located within paved areas
and constitute a state of non-compliance with Chapter 5, Article X, Section, 5-142
(g) "Drainage Standardsll. The provisions within this section allow this Depart-
ment to grant administrative relief in those instances where design demands that
placement of said grates be located within paved surfaces, as the code requires
all stormwater inlet structures are to be located within grassed areas. The Eng-
ineering Department in accordance with this provision is required to provide a
written statement granting relief, and in accordance with this provision herein
grants the applicant relief for the three (3) stormwater inlet grates condition-
ed upon the applicant placing bicycle/pedestrian-proof grates at these locations.
4. Pedestrian sidewalks along Boynton Lakes Boulevard and Plaza Lane shall be
constructed in conjunction with the development of this site. The sidewalks
shall continue through ingress/egress approach areas and be a total thickness
of six (6) inches through these areas. The sidewalks shall be transitioned to
provide proper access for handicap persons. Chapter 5, Article X, Section 5-142
(g), "Sidewalk Standards" inclusive.
5. Should the Developer's Engineer desire to diminish costs relative to construct-
ion of the parking facility, the stabilized subgrade note on page 8 of 13 could be
revised to delete the thirty-five (35) p.s.i. (F.B.V.) if the Engineer deems this
action appropriate, as our City Codes do not require stabilization of subgrade
soils within parking facilities.
6. Plaza Lane and Boynton Lakes Boulevard are dedicated rights-of-way and there-
fore sidewalks constructed at intersections (including Congress Ave.) shall comply
with City of Boynton Beach Engineering Department Standard Drawing #A-83065, in
order to provide handicap accessibility at each intersection. Chapter 22. "Streetsll

7. The applicant shall provide an affadavit agreeing to the perpetual maintenance
of the stormwater drainage system that ties into the stormwater drainage system
situated within the public rights-of-way(s) of Boynton Lakes Boulevard and Plaza
Lane. The stormwater drainage system inlet structures located in proximity to
the "dumpsters", shall be relocated north of the proposed location to eliminate
the possibility of toxic discharges into a system that ties directly into the
drainage system located within the public rights-of-way(s) of Boynton Lakes Blvd.
and Plaza Lane. As this environmental issue affects City owned streets and the
associated drainage systems, the plan has been forwarded for the review of a reg-
istered engineer, for technical review for both the stormwater system(s) and the
roadway widening project(s). In accordance with Chapter 22. "Streets", Section
22-20 (b), the applicant shall reimburse the City of Boynton Beach for those
services rendered by the registered engineer. The text of Section 22-20 is as
follows: "In the event it should be necessary to have the services of a registered
engineer for any inspection, or technical approvals are deemed necessary by the
City Engineer, such expenses shall be borne by the owner or person interested".
(page 1560 of Chapter 22. "Streets")
8. The pavement markings for the expansion and/or modification of the publicly
owned streets (Boynton Lakes Blvd. and Plaza Lane, shall be thermoplastic pavement
markings. (Chapter 22. "Streets", Section 22-23. "Standards" page 1561)
9. As a prerequisite of approvals precedent to Final Plat, the applicant shall
obtain formal permits from requisite governmental agencies having jurisdiction
over the subject lands. Palm Beach County Traffic, Lake Worth Drainage District
Palm Beach County Health Department and South Florida Water Management District.
10. In accordance with the T.R.B. comments of the City's Consulting Engineers
Gee & Jenson, One Harvard Circle, P.O. Box 24600, West Palm Beach, Florida 33416-
4600, telephone number (407) 683-3301 - Richard Staudinger, P.E., the stormwater
inlet structure grates proposed to remain within a newly constructed traffic lane
shall be convereted to a man-hole cover (two instances) and newly placed inlet
structures shall be located within the available grassed swale areas of Boynton
Lakes Boulevard to facilitate the pre-treatment of stormwater runoff.
Appendix "C". "Subdivision and Platting", Article X, Section 5. "Drainage and Storm-
water Treatment", including Section 5A (inclusive) and 5B. "Stormwater Treatment"
(inclusive).
11. Provide striping details for "Handicap" parking stalls including details for
the associated signage. Striping of "Handicap" parking stall, signage and ramps,
shall comply with the latest edition of the Department of Community Affairs Manual
and Accessibility Requirements. Chapter 5. "Boynton Beach Parking Lot Regulations",
Section 5-142 (k), "Handicap Requirements". Additionally, provide a striping detail
for standard parking stall in accordance with the requirements set forth within
Section 5-142 (L), "Parking Lot Striping". Reference Section 5-142 (g), "Striping
Standards" which can be found within the Engineering Construction Specifications
made a part of the Parking Lot Ordinance by a Commission adopted resolution.
A copy of the Boynton Beach Parking Lot Regulations and attached standards can be
obtained from the Building Department at a nominal cost to the Developer.
12. Provide "Fire-Lane" striping and signage in accordance with Chapter 5, Section
5-142 (m), "Required Fire Lanes" and Section 5-142 (g), "Fire Lane Construction
Standards".
Please note that Item #11 is properly depicted on the Architectural drawings, but
is not shown, on the Civil Engineer's Development Plan. Permits for parking lot
construction are usually issued by utilizing the Engineer's plan which does not
compliment the Architects plan in this regard. Additionally, the decorative paving
blocks shown on the Architects plan should also be placed on the Engineer's plan
(a notation would be acceptable) as the Engineer's plan indicates painted "Stop Bars"
at these locations. The required painted "Stop Bars" and associated painted turn-
ing (directional) arrows, may adversely alter the appearance of these areas.
Revise plans accordingly.
13. Provide a parking facility lighting plan that complies with the requirements
of Chapter 5, Article X. "Boynton Beach Parking Lot Regulations", Section 5-142 (a)
"Required Lighting" and Section 5-142 (g), "Lighting Standards". An illumination
(photometric) plan shall be submitted by the applicant. Said plan shall accurately
depict illumination levels within this parking facility. Chapter 19, "Plan Required"
Section 19-17 (k), "Technical and Engineering Data", including Section 19-17 (g),

13. ......which states: "Indication of exterior lighting standards and devices
adequate to review possible hazards and disturbances to the public and adjacent
properties. It should be noted that the proposed location of approximately four (4)
light poles (standards) will adversely affect and negate the required two (2) foot
vehicle overhang areas, as these poles are placed within the paved parking areas.
The two (2) foot overhang is a code requirement of Chapter 5, Article X, Section
5-142 (g) "Construction Standards and Associated Layout Appendix". Reference Section
5-142. "Required Improvements", subsection 5-142 (i), (1), which states: "Parking lots
shall be designed to meet or exceed the dimensional requirements for stalls, drive-
ways, and access aisles as provided for in City standards". Relocate the lighting
standards (poles) into appropriate areas that will not adversely impact the two (2)
foot over-hang layout requirement. Revise plans accordingly.
14. In accordance with Appendix "C"-Subdivision and Platting Regulations, the appli-
cant shall submit (reference Section 7. Submission of Final Plat) to the City. a
surety or performance bond obtained from a company having Best's rating of AAA, and
authorized to do business in the State of Florida.......(pages 2113 & 2114, City of
Boynton Beach, Code of Ordinances. Should the applicant desire to submit an alter-
nate form of surety, the surety shall be approved by the City Commission in conjunct-
ion with this office, the City Attorney's office and the City Manager's office.
The surety posted in whatever form shall remain in full force and effect until City
final approval. The applicant is herein directed to contact the City Attorney,
Mr. James Cherof, Esquire for guidance and direction in matters pertaining to said
alternate surety. (City Attorney's telephone number is (407) 738-7405 or (407) 276-
9400) Surety shall be in an amount equal to 110% of the Engineer's Opinion of Costs.
15. The Developer shall formally execute the "Developer's Agreement" contained
within the site plan submittal application in accordance with the Ordinance adopted
by City Commission, relative to executing the rider to the site plan application.
By copy of these comments to the City Attorney's office, the applicant is hereby
directed to contact the City Attorney, relative to whether or not this "Rider"
shall be notarized including the execution of the witness signature line not yet
signed.
16. Comply with the City of Boynton Beach, Florida, Consulting Engineer's T.R.B.
comments, attached and made a part herein.
17. Provide written verification from Palm Beach County Traffic, Charles Cantrell,
P.E., Signalization Specialist, that the $18,000.00 line item listed within the
"Engineer's Opinion of Costs" published by Keshavarz & Associates is adequate to
ensure the installation (Developer's fair share) of the three (3) traffic signals
indicated under the heading "Street Lighting: Congress Avenue & Hypoluxo Road".
18. The Developer has requested that his submission be considered both a prelim-
inary and final plat submission in conjunction with site plan approval. When the
submission complies with the requirements set forth within our City's Code of
Ordinances, a quantity of six (6) sets of construction plans having Health Depart-
ment approval and time stable mylar plat document(s) formally executed, shall be
delivered to this Department in order to facilitate and expedite the platting
process. Reference: Appendix "C", Article VIII, Section 7. "Submission of Final
Plat". Technical compliance with the provisions of the subdivision and platting
process must occur prior to review by the Planning and Zoning Board as the appli-
cant desires to receive simultaneous approval of preliminary and final plat, there-
for immediately after the T.R.B. has provided comments to the applicant, the appli-
cant must reconcile the plans with staff comments (platting) and as quickly as
possible, re-submit the corrected plans to my office. I will promptly schedule a
staff review of the plans. Should the plans comply with all staff comments, this
Department will promptly write a letter of technical compliance and request that the
Director of Planning, place this matter before the P & Z Board. Additionally, I
will create an agenda item for City Commission review and acceptance of the pre-
linary plat, including a resolution accepting the formal final plat submission,
to be ruled upon by the City Commission during the same meeting.
19. Indicate the point(s) of ingress/egress for Delivery Trucks. Delivery trucks
will be prohibited from utilizing City owned and operated roadways that are a part
of the roadway circulation system for the residential P.U.D. Delivery trucks in
the form of "Tractor/Trailer" trucks should enter this site from Hypoluxo Road or
Congress Avenue. Provide signage directing trucks to the appropriate ingress/egress
approach areas. This shall be a condition of City permit(s) to alter and construct
within the public rights-of-way, in accordance with Chapter 22. "Streets" including the
submission of a one year quarantee for pavement alterations. Sec. 22-26 (i).

Site Plan Modification - parking/building change
Please be advised of the following Planning Department comments
with respect to the above-referenced request for a site plan
modification:
1. A graphic scale needs to be added to all sheets submitted.
Site plan application, page 5, item #2.
2. Indicate any existing driveways that are within 100 feet of
the site, such as the driveway onto Plaza Lane which serves
Boynton Lakes PUD and the driveway onto Boynton Lakes
Boulevard which also serves Boynton Lakes PUD. Site plan
application, page 5, item #4.
3. Add a note to the elevations that all rooftop and
ground-mounted mechanical equipment shall be screened and
baffled. Comprehensive Plan, Future Land Use Element,
Policy 1.17.7,
4. A future site plan approval will be required for development
of the outparcels, changes in the parking lot layout and
design in the vicinity of the outparcels and the Winn Dixie
expansion.
5. As per the previous site plan approval, it is recommended
that the developer post a bond for future traffic signals at
the following intersections:
a) congress Avenue and Plaza Lane
b) Hypoluxo Road and Boynton Lakes Boulevard
6. It is recommended that the eastbound, left turn lane on
Plaza Lane into the shopping center and the westbound, left
turn lane on Plaza Lane, be constructed as shown on the
previously approved site plan (see Exhibit "A").
7. As a point of information, the number of outparcels proposed
as part of the requested site plan modification is greater
than the number of outparcels proposed on the previously
approved site plan.
8. A sidewalk shall be required along the property's Hypoluxo
Road frontage. Comprehensive Plan, Future Land Use Element,
Policy 1.11.9.
9. Add a note to the plans that parking lot lighting along the
east and south property lines will be shielded from the
adjacent residences. Comprehensive Plan, Future Land Use
Element, Policy 1.17.7.
10. The driveway proposed onto Boynton Lakes Boulevard does not
meet the requirement of Article X - Parking Lots, section
5-142(h)(3). It must be relocated north, a minimum of 180
feet from the intersecting rights-of-way lines of Boynton
Lakes Boulevard and Plaza Lane, or the applicant must apply
for a parking lot variance.

No fire lane has been provided along the 6 retail bays on
the north side of the shopping center. The parking spaces
in this area must be removed or the applicant must apply for
a parking lot variance. Since no surplus of parking spaces
exists, any parking spaces deleted must be provided
somewhere else on site. Article X - Parking Lots, Section
5-142(m) .
The design of ingress/egress points for truck traffic is a
problem which needs to be addressed, particularly at the
driveway onto Hypoluxo Road and access to the rear of the
shopping center. Several solutions were discussed at the
TRB meeting for the applicant to consider. They are as
follows:
a) add an additional egress-only driveway onto Boynton
Lakes Boulevard, so that trucks may enter the rear of the
center from the driveway onto Boynton Lakes Boulevard and
exit at the additional driveway located further north,
b) shift the Winn Dixie building south to open
up access to the loading zones in the rear,
c) move the Winn Dixie building along the south property
line rather than the east property line so that it faces
Hypoluxo Road to improve rear access, and
d) enlarge the turning radius at the driveway onto
Hypoluxo Road as shown on the sketch included in the
parking lot variance submitted to prevent trucks from
running over the Hypoluxo Road median when exiting at this
driveway.
An internal circulation problem exists east of the Congress
Avenue driveway where five access aisles merge, but don't
align safely. It is recommended that this area be
redesigned to form proper intersections. Comprehensive
plan, Future Land Use Element, Objective 1.18.

In accordance with the City of Boynton Beach, Code of Ordinances, Chapter 19,
Section 19-7. "Plan Required" and 19-17.1. "Fee to Accompany Plan", including
Chapter 5, Article X, "Boynton Beach Parking Lot Regulations", Section 5-142.
"Required Improvements" (inclusive), the applicant for the above referenced
project, shall submit the following plan revisions, technical data, information
and requested engineering details ~s follows:
SITE PLAN AND PRELIHlNARY/FINAL PLAT
1. The construction details for the widening of Boynton Lakes Boulevard shall
be revised to indicate an asphaltic concrete surface of one and three quarter
inches ( 1-3/4" ) in thickness, as Boynton Lakes Boulevard is a collector road.
Reference-Code of Ordinances, page 2139, Appendix "C", Article X, Section 10.
"Streets", Subsection F. "Materials" which requires type II, asphaltic concrete.
Additionally, revise the Florida Bearing Value (F.B.V.) of fifty (50) to read
seventy-five (75) in accordance with the aforementioned code.
2. Page 6 of 13 indicates a shoulder restoration procedure by which disturbed
shoulder areas are to be restabilized to fifty (50) p.s.i. (F.B.V.). Revise this
note to read seventy-five (75) p.s.i. (F.B.V.) in accordance with Section 10.
"Streets", Subsection H. "Stabilized Shoulders".
3. A quantity of three (3) stormwater inlet grates are located within paved areas
and constitute a state of non-compliance with Chapter 5, Article X, Section, 5-142
(g) "Drainage Standards". The provisions within this section allow this Depart-
ment to grant administrative relief in those instances where design demands that
placement of said grates be located within paved surfaces, as the code requires
all stormwater inlet structures are to be located within grassed areas. The Eng-
ineering Department in accordance with this provision is required to provide a
written statement granting relief, and in accordance with this provision herein
grants the applicant relief for the three (3) stormwater inlet grates condition-
ed upon the applicant placing bicycle/pedestrian-proof grates at these locations.
4. Pedestrian sidewalks along Boynton Lakes Boulevard and Plaza Lane shall be
constructed in conjunction with the development of this site. The sidewalks
shall continue through ingress/egress approach areas and be a total thickness
of six (6) inches through these areas. The sidewalks shall be transitioned to
provide proper access for handicap persons. Chapter 5, Article X, Section 5-142
(g), "Sidewalk Standards" inclusive.
5. Should the Developer's Engineer desire to diminish costs relative to construct-
ion of the parking facility, the stabilized subgrade note on page 8 of 13 could be
revised to delete the thirty-five (35) p.s.i. (F.B.V.) if the Engineer deems this
action appropriate, as our City Codes do not require stabilization of subgrade
soils within parking facilities.
6. Plaza Lane and Boynton Lakes Boulevard are dedicated rights-of-way and there-
fore sidewalks constructed at intersections (including Congress Ave.) shall comply
with City of Boynton Beach Engineering Department Standard Drawing #A-83065, in
order to provide handicap accessibility at each intersection. Chapter 22. "Streets"

7. The applicant sha:l provide an affadavit agreeing to the perpetual maintenance
of the stormwater drainage system that ties into the stormwater drainage system
situated within the public rights-of-way(s) of Boynton Lakes Boulevard and Plaza
Lane. The stormwater drainage system inlet structures located in proximity to
the "dumpsters", shall be relocated north of the proposed location to eliminate
the possibility of toxic discharges into a system that ties directly into the
drainage system located within the public rights-of-way(s) of Boynton Lakes Blvd.
and Plaza Lane. As this environmental issue affects City owned streets and the
associated drainage systems, the plan has been forwarded for the review of a reg-
istered engineer, for technical review for both the stormwater system(s) and the
roadway widening project(s). In accordance with Chapter 22. "Streets", Section
22-20 (b), the applicant shall reimburse the City of Boynton Beach for those
services rendered by the registered engineer. The text of Section 22-20 is as
follows: "In the event it should be necessary to have the services of a registered
engineer for any inspection, or technical approvals are deemed necessary by the
City Engineer, such expenses shall be borne by the owner or person interested".
(page 1560 of Chapter 22. "Streets")
8. The pavement markings for the expansion and/or modification of the publicly
owned streets (Boynton Lakes Blvd. and Plaza Lane, shall be thermoplastic pavement
markings. (Chapter 22. "Streets", Section 22-23. "Standards" page 1561)
9. As a prerequisite of approvals precedent to Final Plat, the applicant shall
obtain formal permits from requisite governmental agencies having jurisdiction
over the subject lands. Palm Beach County Traffic, Lake Worth Drainage District
Palm Beach County Health Department and South Florida Water Management District.
10. In accordance with the T.R.B. comments of the City's Consulting Engineers
Gee & Jenson, One Harvard Circle, P.O. Box 24600, West Palm Beach, Florida 33416-
4600, telephone number (407) 683-3301 - Richard Staudinger, P.E., the stormwater
inlet structure grates proposed to remain within a newly constructed traffic lane
shall be convereted to a man-hole cover (two instances) and newly placed inlet
structures shall be located within the available grassed swale areas of Boynton
Lakes Boulevard to facilitate the pre-treatment of stormwater runoff.
Appendix "C". "Subdivision and Platting", Article X, Section 5. "Drainage and Storm-
water Treatment", including Section 5A (inclusive) and 5B. "Stormwater Treatment"
(inclusive).

11. Provide striping details for "Handicap" parking stalls including details for
the associated signage. Striping of "Handicap" parking stall, signage and ramps,
shall comply with the latest edition of the Department of Community Affairs Manual
and Accessibility Requirements. Chapter 5. "Boynton Beach Parking Lot Regulations",
Section 5-142 (k), "Handicap Requirements". Additionally, provide a striping detail
for standard parking stall in accordance with the requirements set forth within
Section 5-142 (L), "Parking Lot Striping". Reference Section 5-142 (g), "Striping
Standards" which can be found within the Engineering Construction Specifications
made a part of the Parking Lot Ordinance by a Commission adopted resolution.
A copy of the Boynton Beach Parking Lot Regulations and attached standards can be
obtained from the Building Department at a nominal cost to the Developer.
12. Provide "Fire-Lane" striping and signage in accordance with Chapter 5, Section
5-142 (m), "Required Fire Lanes" and Section 5-142 (g), "Fire Lane Construction
Standards".
Please note that Item #11 is properly depicted on the Architectural drawings, but
is not shown, on the Civil Engineer's Development Plan. Permits for parking lot
construction are usually issued by utilizing the Engineer's plan which does not
compliment the Architects plan in this regard. Additionally, the decorative paving
blocks shown on the Architects plan should also be placed on the Engineer's plan
(a notation would be acceptable) as the Engineer's plan indicates painted "Stop Bars"
at these locations. The required painted "Stop Bars" and associated painted turn-
ing (directional) arrows, may adversely alter the appearance of these areas.
Revise plans accordingly.
13. Provide a parking facility lighting plan that complies with the requirements
of Chapter 5, Article X. "Boynton Beach Parking Lot Regulations", Section 5-142 (a)
"Required Lighting" and Section 5~142 (g), "Lighting Standards". An illumination
(photometric) plan shall be submitted by the applicant. Said plan shall accurately
depict illumination levels within this parking facility. Chapter 19, "Plan Required"
Section 19-17 (k), "Technical and Engineering Data", including Section 19-17 (g),

13. ......which states: "Indication of exterior lightin~ standards and devices
adequate to review possible hazards and disturbances to the public and adjacent
properties. It should be noted that the proposed location of approximately four (4)
light poles (standards) will adversely affect and negate the required two (2) foo:
vehicle overhang areas, as these poles are placed within the paved parking areas.
The two (2) foot overhang is a code requirement of Chapter 5, Article X, Section
5-142 (g) "Construction Standards and Associated Layout Appendix". Reference Section
5-142. "Required Improvements", subsection 5-142 (i), (1), which states: "Parking lot:
shall be designed to meet or exceed the dimensional requirements for stalls, drive-
ways, and access aisles as provided for in City standards". Relocate the lighting
standards (poles) into appropriate areas that will not adversely impact the t~o (2)
foot over-hang layout requirement. Revise plans accordingly.
14. In accordance with Appendix "C"-Subdivision and Platting Regulations, the appli-
cant shall submit (reference Section 7. Submission of Final Plat) to the City. a
surety or performance bond obtained from a company having Best's rating of AAA, and
authorized to do business in the State of Florida.......(pages 2113 & 2114, City of
Boynton Beach, Code of Ordinances. Should the applicant desire to submit an alter-
nate form of surety, the surety shall be approved by the City Commission in conjunct-
ion with this office, the City Attorney's office and the City Manager's office.
The surety posted in whatever form shall remain in full force and effect until City
final approval. The applicant is herein directed to contact the City Attorney,
~r. James Cherof, Esquire for guidance and direction in matters pertaining to said
alternate surety. (City Attorney's telephone number is (407) 738-7405 or (407) 276-
9400) Surety shall be in an amount equal to 110% of the Engineer's Opinion of Cost3.
15. The Developer shall formally execute the "Developer's Agreement" contained
within the site plan submittal application in accordance with the Ordinance adopted
by City Commission, relative to executing the rider to the site plan application.
By copy of these comments to the City Attorney's office, the applicant is hereby
directed to contact the City Attorney, relative to whether or not this "Rider"
shall be notarized including the execution of the witness signature line not yet
signed.
16. Comply with the City of Boynton Beach, Florida, Consulting Engineer's T.R.B.
comments, attached and made a part herein.
17. Provide written verification from Palm Beach County Traffic, Charles Cantrell,

P.E., Signalization Specialist, that the $18,000.00 line item listed within the
"Engineer's Opinion of Costs" published by Keshavarz & Associates is adequate to
ensure the installation (Developer's fair share) of the three (3) traffic signals
indicated under the heading "Street Lighting: Congress Avenue & Hypoluxo Road".
18. The Developer has requested that his submission be considered both a prelim-
inary and final plat submission in conjunction with site plan approval. When the
submission complies with the requirements set forth within our City's Code of
Ordinances, a quantity of six (6) sets of construction plans having Health Depart-
ment approval and time stable mylar plat document(s) formally executed, shall be
delivered to this Department in order to facilitate and expedite the platting
process. Reference: Appendix "C", Article VIII, Section 7. "Submission of Final
Plat". Technical compliance with the provisions of the subdivision and platting
process must occur prior to review by the Planning and Zoning Board as the appli-
cant desires to receive simultaneous approval of preliminary and final plat, there-
for immediately after the T.R.B. has provided comments to the applicant, the appli-
cant must reconcile the plans with staff comments (platting) and as quickly as
possible, re-submit the corrected plans to my office. I will promptly schedule a
staff review of the plans. Should the plans comply with all staff comments, this
Department will promptly write a letter of technical compliance and request that the
Director of Planning, place this matter before the P & Z Board. Additionally, I
will create an agenda item for City Commission review and acceptance of the pre-
linary plat, including a resolution accepting the formal final plat submission,
to be ruled upon by the City Commission during the same meeting.
19. Indicate the point(s) of ingress/egress for Delivery Trucks. Delivery trucks
will be prohibited from utilizing City owned and operated roadways that are a part
of the roadway circulation system for the residential P.U.D. Delivery trucks in
the form of "Tractor/Trailer" trucks should enter this site from Hypoluxo Road or
Congress Avenue. Provide signage directing trucks to the appropriate ingress/egresl
approach areas. This shall be a condition of City permit(s) to alter and construct
within the public rights-of-way, in accordance. with Chapter 22. "Streets" including 1
submission of a one year quarantee for pavement alterations. Sec. 22-26 (i).

We can approve this project, subject to the following conditions:
Add a second valve on all hydrant lines whenovcr the hydrant is
greater than 20 feet from the main line south most hydrants.
Provide fire flow calculations.
Dumpsters and enclosures are not permitted in utility easements.
Relocate sewers and/or provide Hold Harmless Agreement and use
ductile iron pipe at all conflict points.
Reduced pressure backflow preventers will be required. We
recommend dual units in parallel so service is not interrupted
during testing.
Double check valve assembly will be required on the fire service
line. Detector not required.
Connection of the 12" water main act"oss Congress Avenue is

Site Plan Modification - parking/building change
Please be advised of the following Planning Department comments
with respect to the above-referenced request for a site plan
modification:
1. A graphic scale needs to be added to all sheets submitted.
Site plan application, page 5, item #2.
2. Indicate any existing driveways that are within 100 feet of
the site, such as the driveway onto Plaza Lane which serves
Boynton Lakes PUD and the driveway onto Boynton Lakes
Boulevard which also serves Boynton Lakes PUD. Site plan
application, page 5, item #4.
3. Add a note to the elevations that all rooftop and
ground-mounted mechanical equipment shall be screened and
baffled. Comprehensive Plan, Future Land Use Element,
Policy 1.17.7.
4. A future site plan approval will be required for development
of the outparcels, changes in the parking lot layout and
design in the Vicinity of the outparcels and the Winn Dixie
expansion.
5. As per the previous site plan approval, it is recommended
that the developer post a bond for future traffic signals at
the following intersections:
a) Congress Avenue and Plaza Lane
b) Hypoluxo Road and Boynton Lakes Boulevard
6. It is recommended that the eastbound, left turn lane on
Plaza Lane into the shopping center and the westbound, left
turn lane on Plaza Lane, be constructed as shown on the
previously approved site plan (see Exhibit "A").
7. As a point of information, the number of outparcels proposed
as part of the requested site plan modification is greater
than the number of outparcels proposed on the previously
approved site plan.
8. A sidewalk shall be required along the property's Hypoluxo
Road frontage. Comprehensive Plan, Future Land Use Element,
Policy 1.11.9.
9. Add a note to the plans that parking lot lighting along the
east and south property lines will be shielded from the
adjacent residences. Comprehensive Plan, Future Land Use
Element, Policy 1.17.7.
10. The driveway proposed onto Boynton Lakes Boulevard does not
meet the requirement of Article X - Parking Lots, Section
5-142(h)(3). It must be relocated north, a minimum of 180
feet from the intersecting rights-of-way lines of Boynton
Lakes Boulevard and Plaza Lane, or the applicant must apply
for a parking lot variance.

No fire lane has been provided along the 6 retail bays on
the north side of the shopping center. The parking spaces
in this area must be removed or the applicant must apply for
a parking lot variance. Since no surplus of parking spaces
exists, any parking spaces deleted must be provided
somewhere else on site. Article X - Parking Lots, Section
5-142(m).
The design of ingress/egress points for truck traffic is a
problem which needs to be addressed, particularly at the
driveway onto Hypoluxo Road and access to the rear of the
shopping center. Several solutions were discussed at the
TRB meeting for the applicant to consider. They are as
follows:
a) add an additional egress-only driveway onto Boynton
Lakes Boulevard, so that trucks may enter the rear of the
center from the driveway onto Boynton Lakes Boulevard and
exit at the additional driveway located further north,
b) shift the Winn Dixie building south to open
up access to the loading zones in the rear,
c) move the Winn Dixie bUilding along the south property
line rather than the east property line so that it faces
Hypoluxo Road to improve rear access, and
d) enlarge the turning radius at the driveway onto
Hypoluxo Road as shown on the sketch included in the
parking lot variance submitted to prevent trucks from
running over the Hypoluxo Road median when exiting at this
driveway.
An internal circulation problem exists east of the Congress
Avenue driveway where five access aisles merge, but don't
align safely. It is recommended that this area be
redesigned to form proper intersections. Comprehensive
Plan, Future Land Use Element, Objective 1.18.

Preliminary Plat and Site Plan for Boynton Lakes Plaza
During the June 5, 1990 Regular City Commission Meeting, the Honorable Mayor and
City Commission granted the above referenced agent, a six (6) month time extension
for the above referenced project. The Commission also granted the real property
own('r~, nn npprovn] to fUl thl~ prnJl'ct to n blllldnble grade as the originnl Rite
contained massive amounts of fibrous peat and silty sands. The developer has in
good faith continued with the filling operation and has obtained the appropriate
permits for the scope of work, including the posting of surety to protect the City
and adjoining property owners from the negative impact of unconfined emissions
(blowing sand) and roadway damage usually associated with this type of filling
operation.
Attorney Raymond W. Royce has submitted to this office the attached request for
a six (6) month time extension for the preliminary plat and the preliminary site
plan. Additionally, Attorney Royce requests that if the City Commission rules
favorably in this matter, that an additional six (6) month extension be afforded
his client in increments of one (1) month, as determined by the City Manager,
Director of Planning and this Department with a total time extension not to exceed
one (l) year.
ENGINEERING DEPARTMENT RECOMMENDATION:
The Engineering Department for the City of Boynton Beach, respectfully requests
that Attorney Raymond W. Royce's extension be ruled upon favorably by the City
Commission, as his client has submitted plat documents & development plans including
cost estimates and monies made payable to the City of Boynton Beach for the req-
uired improvements administration fees and one-hundred and twenty-five perceny (125%) ,
of the cost for funding F.P.L. street lighting. The origrnaIexiens[on--expTres in
just a few days. Attorney Royce's client has formally entered the site plan
process and the platting process and therefore this Department favorably recommends
the granting of his request.

We represent Boynton Lakes Plaza.
You will recall that I previously requested administrative
approval of an eJtteneion. We have been advised th8t the Commission
would have to approve any extension and accordingly please consider
this 19tter as that request.
Our cliQnt hag been working very hard to prepare all required
plan. and construction drawings for the revised site plan and plat
approval. Purguant to inatructions by the City, representatives
of my client mot with represontatives of th. Palm Beach County
Bngineerinq Department. The Palm Beach County Engineerinq
Department has advieed of new roquirements. Th. County Rngineerinq
Department indicatee that additional right-af-way will be neCeSl!~Ary
on Congress Avenue and right-of-way for deceleration lane8 on both
Congress Avenue And Hypoluxo Road entrances will be required.
These new requirements affect the parking lot configuration
and affect the number ot parking placee. While we eincerely hope
and believe that these requirements can be met, a number of chanqeo
have been made in the plans and draw1nqs in order to ~eapond to the
impact of the re~uced parking capacity. Engineering changes are
also necessitated and our engineer, M8~iBr ~eBhavarz, has had to
revise much of the work that was previously done.

We have done everything poss1ble to expedite this matt~r but
in view of these new requirements, additional t~. may be requir9d
to fully address the impact ot the parkinq ~pace8 within our site.
As you know, our plans have, in tact, been filed but these ne~ and
additional requirements of the County Engineering Department could
mean that amendments, changes, or adjustments are necessary. Even
thouQh this may be able to be resolved within a very short period,
other problems stemming from these changes could emerge.
Accordinoly, a six month extension is requested. If possible we
would ~lso request that the staff be given additional authority to
grant successive one month extensions if necessary from time to
time for an additional period not exceeding six months. Hopefully
tha.A administrative extension would not be necessary but in view
of the additional requirements and changing rules and regulationB
it is difficult for u8 to be certain.
In summary, our archi teet and enoineer and other
repreeentativee of th9 olient have been working very diliqently on
this matter. A great deal of tima, energy, and money hag hgen
expended to develop the plan, prepare appropriate drawinC)8 and
submit theee documents to the City for its rAview. Our client ie
ready and anxious to move lorward and va believe that this shoppinq
center will be an ceeet to the City of Boynton Beaoh.
For all of the reasons Bet forth in thi. letter. we
respectfully request the cooperation and assistance of thG City in
this regard.

Dear Mr. Finizio:
A meeting was held in the Traffic Division on October 16 with representatives
of the subject shopping center project in attendance.
The primary focus of our discussion was the matter of additional right of way
from this parcel which would be required to accommodate the ultimate expansion
of th is intersect ion. Th is ri ght of way is depi cted with_ red Jines and
dimensions on the attached site plan. The probable need for right turn lanes
to serve the project's entrances was also discussed. Additional right of way,
outside of the expanded intersection right of way has been shown with black lines
on the same plan. This total area, which we are requesting to be-dedicated by
the developeW-is shown shaded in red.
While no traffic study indicating the necessity for the suggested right turn
lanes was available at our meeting, the need for such improvements for a
commercial site such as this is quite likely.
We will be glad to review the traffic study for this project for possible
reconsideration of the turn lane requirement at such time as the study becomes
available.
The requested right of way dedications obviously will have an impact on this
site. I would like to discuss this with you as soon as ,you have had a chance

I. INTRODUCTION
1.1 Boynton Lakes Plaza is a proposed 11.6 acre shopping
plaza located at the southeast corner of Hypoluxo Road
and Congress Avenue in the City of Boynton Beach,
Florida.
1.2 This project was originally approved by the City of
Boynton Beach in 1987 for the same usage. The approved
volume of generated traffic was 9,172 trips per day as
reflected in a Traffic Impact Analysis prepared by
"Reikenis & Associates, Inc." (Rev. Date October 1986).
1.3 The purpose of this report is to compare the traffic
volume generated by the new establishment with the
approved traffic volume for this project.
1.4 This report is based on a site plan prepared by "Oliver,
Glidden & Partners", dated October 23, 1990.
II. TRAFFIC GENERATION RATES AND VOLUMES
2.1 The proposed plaza contains 133,015 square feet of
building which reflect Phase I, Phase II and all
outparcels.
2.2 "Institute of Transportation Engineers, Trip Generation,
september 1987" Handbook offers the following traffic
generation rate for a shopping plaza:
Average Weekday: 4(T) = 0.65 4(X) + 5.92
P.M. Peak Hour: 4(T) = 0.52 4(X) + 4.04
(Weekday)
Where T = Total Trip Ends, X = Area in 1,000 S.F.
Thus, the volume of the generated traffic is:
Average Weekday:
Ln ( T ) = O. 65 Ln ( 133 . 015) + 5. 92
T = 8945 Trips/Day
P.M. Peak Hour:
(Weekday)
4(T) = 0.52 4(133.015) + 4.04
T = 723 Trips/Hour
III. CONCLUSION
The comparison of the generated traffic volumes for the
approved site plan and the revised site plan decidedly suggest
a net reduction of 227 Trips/Day. It is therefore concluded
that the revised site plan be approved due to the fact that
it generates less traffic than the originally approved site
plan.
