Dear Mr. Miller:
As per our meeting on this same date. White-spunner
Construction will modify the buffer wall on Boynton Lakes
Boulevard to achieve a 6'-0" height from outside finish grade
elevation if the city commission does not accept the plan
modification to accept the buffer wall "as is". If we are
required to make modifications to the buffer wall, all
landscaping affected will be repaired or replaced.
Additionally, the buffer wall issue will not be a condition
for a final certificate of occupancy, We also ask that the
related landscaping be treated in the same manner.
Thank you for your help in resolving this matter.

Dear Ms. Tambri:
Please find enclosed five (5) copies of the site compliance
drawing for Boynton Lakes Plaza. The buffer wall height has been
noted to show the wall varying from six feet plus to three feet
eight inches. This height variance starts at 232 (two-hundred
thirty-two) lineal feet from the hypoluxo end of the wall.
We understand that the Boynton Lakes Homeowner's association
is acceptable to the buffer wall "as is".
Thank you for your help in resolving this matter.

Dear Mr. Carrico:
On January 24, 1994, Don Johnson, Chief Building Inspector,
requested this office (Mike Haag and myself) to visit Boynton
Lakes Plaza, currently under construction at the southeast corner
of Hypoluxo Road and Congress Avenue. The purpose of the visit
was to view and discuss, with you and stuart Wilson, the buffer
wall that was required by the City commission to be constructed
six feet in height along the rear of the plaza; the south and
east property lines along Plaza Lane and Boynton Lakes Boulevard.
During this site visit, the height of the wall was measured from
the outside (street side) and found to be less than six feet in
height along that portion of the wall beginning at its northern-
most point to a southerly distance of approximately 225 feet. At
the northern-most point of the wall, the wall height was measured
to be three and one-half feet. It was noted that due to the
difference in the ground elevation at the street side of the wall
and at the shopping center parking lot side of the wall (inside),
the inside wall height at the northern-most point is five and
one-half feet.
The purpose of the six foot high buffer wall is to screen the
rear of the shopping center from the Boynton Lakes PUD residents
east of Boynton Lakes Boulevard and south of Plaza Lane.
Therefore, it is important that the outside wall height, not just
the inside wall height, be six feet. In conclusion, it is my
administrative determination that the wall be reconstructed along
the 225 feet referenced so that all points along the outside of
the wall are no less than six feet in height.
If you feel that there is further justification for retaining the

wall at its existing height and wish to file an administrative
appeal, a letter of request must be submitted to the City
Manager's office. Your letter of request should reference my
