The Boynton Lakes Park plans do not provide for suitable off- street parking required by City of Boynton Beach, Florida Code of Ordinances, specifically Appendix "A", Zoning Regulations, Section IlH, IIprovision of Off Street Parking Spacesl', Subsection llH5, which states, "no fewer than four (4) parking spaces shall be provided for any nonresidential usen. (Page 1946). 2. Failure to provide suitable off street parking for the Boynton Lakes Park violates City of Boynton Beach, Florida Comprehensive Plan elements, specifically "Recreation and Open Space", Goal #5 which states "provide adequate open space and recreational facilities and programs to meet the needs of present and future residents, including seasonal visitors and special groups, such as the elderly and handicapped". Failure to provide off street parking infringes upon the rights of the aforementioned persons to utilize and access the park via adequate parking facility(s). 3. Failure to provide adequate off street parking for the Boynton Lakes Park violates Comprehensive Plan objective 5.1, which states "the City shall improve and increase access to parks and recreational facilities, where available space exists by providing adequate automobile parking, bike rack facilities, and handicap access to all existing and planned neighborhood and district parks operated by the City by the year 2000." 4. In the instant case, failure to provide adequate off street parking violates Comprehensive Plan policy 5.1.1 which states nthe City Technical Review Committee Comments/Boynton Lakes Park April 26, 1993 Page #2 shall provide adequate automobile parking" and bike facilities within all parks developed after the adoption of this plan". 5. Failure to construct adequate off street parking for the Boynton Lakes park, being in violation of Comprehensive Plan elements, would therefore potentially constitute a violation of Florida Statutes, Section l63.3l94, "Legal Status of Comprehensive Plan", which states "after a Comprehensive Plan, or element or portion thereof, has been adopted in conformity with this act, all develop- ment undertaken by, and all action taken in regard to development orders by governmental agencies in regard to land covered by such plan or elements shall be consistant with such plan or element as adopted n . Based upon the aforementioned local and state laws, this public project consisting of public lands to be improved by monetary resources entrusted to us by all of our taxpayers, denies most taxpayers the right to utilize a park their monies have funded and provides for the sole use of said park by the surrounding residents of Boynton Lakes, as the abutting public streets are posted "NO PARKING" and the abutting private street affords no suitable on street parking for this facility. The plans shall be revised to provide adequate parking facilities in conformance with the City's own zoning regulations & Comprehensive Plan elements in order to ensure that handicap persons and residents who do not reside in the immediate vicinity of this park will be provided safe and ready access necessary to enjoy the amenities contained therein. This is not desirable. The design consultant has been prov~ded the locations of our utilities. It is recommended he overlay the proposed and existing services on the plan to avoid conflicts before construction drawings are prepared. In a matter unrelated to utilities, the restroom design allows for viewing, f~om the parking lot, the restroom interiors when the doors are open. Exterior partitions should be considered to prevent this. It was our initial understanding that the City Engineering Department wanted us to perform an engineering review of the plans for paving, grading, drainage, and water and wastewater. Shortly after we made the comments Mr. Peter Mazella informed me that your Department would review the water and wastewater plan and specifications and I had no problem what- so-ever with this. - The comments it seems come back to haunt us. Therefore I recommend my water and wastewater comments be disregarded and I have no problem with the Utility Department reviewing and commenting on the utility plans (water and wastewater).
