Engineering Department Request for an Expedited Review
Accompanying this memorandum please find one full set of construction
plans and one complete final plat document for your review.
Christopher Cutro, the City's Planning Director, would like to place
this matter on the next available City Commission agenda and therefore
I respectfully request that your department place a top priority on
this project and perform an expedited review as soon as possible.
This project's preliminary plat received a Statement of Technical
Compliance and therefore it is necessary to compare the final plat
document to both the preliminary plat and the master plan.
Comments should be addressed to my attention and be received by this
office no later than February 9, 1993 at which time I will coordinate
the final plat process with W. Richard Staudinger, City Engineer.
Additionally, I have attached a copy of the Engineer of Record's
certified Opinion of Cost for both on-site and off-site required
improvements.

SUBJECT: Boynton Lakes Plaza
The Planning and Zoning Department has reviewed the plat for
Boynton Lakes Plaza and found that it complies with our original
comments from December of 1990.
We realize that the approved site plan has changed since the
original approval but, since you are familiar with these changes
and have participated in our discussion on these changes, we feel
a full review of the site plan is unwarranted at this time.
While we have no comments on the plat document itself, we would
ask that the following items be noted in the record.
1)
The rear setback of the main structure is shown on the
approved site plan as 28 feet and your construction plans at
29.48 feet. This must be corrected to 30 feet.
2}
There are discrepancies between the parking layout on the
approved site plan and the construction plans. These
discrepancies exist mostly around Parcel B and the north
side of the main bUilding;
3 )
Dumpster locations are not consistent between the
construction plans and the approved site plans;
The plat shows a cross access location on the south property
line of the gas station, this is not reflected on the site
plan.
The width of the driveway on Plaza Lane varies between
construction plans and the approved site plan;
Building square footage on the plat is 135,975 square feet,
the square footage on the approved site plan is 135,872;
The individual parcel A,B,C, require full site plan review
if the footprints on the plat change when building permits
are filed to determine consistency with the overall plan.
Elevation review is required if there are no changes in the
footprint of the structures.

All of these comments can be handled at the time that site plan
modifications and building permits are filed. If you feel the
plat needs to be altered because of these comments, please call
me to discuss these changes.

SUBJECT: Boynton Lakes Plaza
status of Capacity Reservation
As you may recall, we gave a favorabl e recommendation to this
project with the notation that water and sewer reservation fees
were past due and must be paid before the plat was signed off by
the City and recorded.
Members of my staff met today with Gregory "Rocky" Goins and Terry
Harms, who were representing the developers of Boynton Lakes Plaza.
These two gentlemen indicated that their firms wish to fast-track
this project and begin construction as soon as possible after
approval of the Final Plat by the City. Due to their imminent
construction, they are considering paying the capital facilities
charges for retail use at the Plaza in lieu of the necessary
reservation fee. This option is allowed by the City Code, and we
would have no objection to it.
It will take several days, however, to arrange payment of whichever
fee the developers decide to pay. The project can therefore either
go forward for Commission action, with the plat not being signed
until payment is received, or the project can be withheld from the
agenda until payment is received. Either option is workable from
an administrative standpoint, and we would have no objection to
either alternative as long as a time limit is placed upon the grace
period for making payment.
Please advise me if you require any additional information on this
matter.

Procedure - removal of square footage notation
Recently, I received correspondence from Rocky Goins, agent for
Boynton Lakes Plaza, regarding the procedure for removal of the
vested square footage from the Boynton Lakes Plaza plat. I
believe Mr. Goins may have misconstrued the statement in your
letter, dated April 28, 1994, that he was to direct all future
correspondence to me, because Mr. Goins is asking for this
department to administer this procedure. As you know, this
department does not accept and process replats or separate
instruments associated with plats. I have relayed this to Mr.
Goins, however it might be wise for your office to communicate
this to Mr. Goins as well, since it appears he has not initiated
the steps you advised in your April 28, 1994 letter to him.
When a replat or separate instrument is submitted to your office
and is circulated to staff for comment, I will stand behind my
original statement that all square footage notations be removed
from the plat (by whatever means deemed appropriate by your
department), regardless of their relation to vesting. Since
vesting and traffic concurrency are tied to a site plan and
monitored by the City and Palm Beach county through the site plan
process, any increase in square footage will be processed as a
site plan modification, separate from the issue of removing the
vested square footage notation.

Mr. Rocky Goins of AG Development desires to remove from the above
referenced plat specific language regarding maximum square footage
of buildable areas, a condition imposed upon them by the then
Planning & Zoning Director Mr. Christopher Cutro.
In order to protect the interests of all those individuals who
signed the original plat, this office seeks from you an opinion as
to whether or not they must replat the document to remove the
subject text (a matter which requires City Commission action) or
may the singular property owner record a separate instrument
deleting the text without benefit of formally obtaining approvals
from those individuals who signed the original plat.

Dear Alan and Rocky,
We have reviewed your request for a drive- up window at the
proposed Walgreens in the Boynton Lakes Shopping Center.
At this time we cannot support this proposed change to the site
plan. The proposed amendment would be located on a main accessway
and reduce the accessway width below city standards. In addition,
the drive-up access as proposed would flow in the opposite
direction of the nearest traffic lane. This situation would be
unsafe. Even if the flow was reversed we feel that the number of
turnarounds in the accessway close to the driveway from Plaza Lane
would create another dangerous situation.
If you should have any questions regarding this matter, please feel

Dear Alan,
I would like you to consider this as a suggestion to put some
flexibility into the Boynton Lakes Plaza site plan.
As you know, the number of parking spaces for this site is very
tight. Based on past experience in monitoring developments of this
size, and because of your need to be flexible in sizing outparcels,
I expect that providing the full number of required parking spaces
may become impossible.
I would suggest that you consider applying for a variance for the
number of parking spaces for the entire site. This would allow
some flexibility for the site and allow us to delete spaces if
construction problems occur.
As I stated, this is a suggestion, not a requirement. If you think
that this suggestion has some merit, please feel free to call me to
discuss it.

It is with great pleasure that I inform you that the City Commission,
during their regular February 16, 1993 meeting, ruled favorably on
your final plat submission which was approved conditioned upon your
submission of the following documents:
1) In accordance with the City's Subdivision & Platting Regulations
and staff comments generated by Palm Beach County Traffic Division
specifically, Charles Walker, Jr.'s requirement that the dedicated
rights-of-way along Congress Ave. and Hypoluxo Rd. be formally
submitted to the County in the form of an executed deed, provide
the subject deed to Mr. Walker and submit to this office an
approved copy.
2) A fully executed mylar plat dedication sheet and plat boundary
survey shall be submitted to this office so that we may compare it
to the approved preliminary plat submission documents which were
reviewed by the City's Technical Review Committee.
3) All checks issued by Fru-Con Development Corporation shall be
cleared by the issuing bank and it should be especially noted that
the $59,000i check issued for capital facility charges shall
constitute a credit against individual uses within the shopping
center facility and when these credits are exhausted, further capital
facility charges must be paid by the owners in order to represent
the charges against uses over and above those uses which have

shall be transmitted to the undersigned by the owner prior to
the issuance of a Land Development Permit after proper recordation
of the plat documents. At that time the City's R.O.W. permit
(if issued) will then expire and your obligations under the platting
regulations will commence.
When the aforementioned conditions of approval have been resolved to
the satisfaction of the City Engineer, this of ice stands ready to
accept your permit application for authorization to construct those
required improvements specified within your Design Engineer's Opinion
of Cost for infrastructure improvements to be owned, operated and
maintained by the City of Boynton Beach, Florida, therefore, in order
to move your project ahead of schedule, I recommend that you address
your immediate attention to providing the requested information and
documents.

addressed, Lennar requires your acknowledgment of the following in order to execute the
Satisfaction of Mortgage recently received.

Lennar at closing the sum of $164,589.00, plus per diem interest of $46.16/day beginning

Upon receipt of a signed acknowledgment of this letter, I will have the Satisfaction of
Mortgage executed and sent to Ricky L. Farrell, (attorney handling your closing). Per
Diane J. Robbins, Paralegal, dated September 21,1992, the Satisfaction of Mortgage will
be placed in escrow pending the disbursement of the funds necessary to satisfy the
obligation.

of the requested items have already been satisfied.
1) The dedicating of the right-of-way along Congress Ave. has been completed. In the conversation we
had, the same for Hypoluxo Ave. was never requested. It was my understanding that this was acceptable
as presented since the work is to start immediately. Please confirm this with Mr. Walker.
2) Fully executed mylars should already be with the city. They were overnighted out of our office, Friday,
February 19, 1993.
3) It is fully understood that check #6, in the amount of $59,825 is being submitted as an estimated capital
facility charge and is subject to change as individual tenants are identified and permits requested for
their buildouts. At this time any additional charges will be paid for that individual use. The City of
Boynton Beach will credit a portion of the estimated amount paid, by square footage, for the individual
space being applied for.
It is our understanding in accordance with the city ordinance, those permits that are available will be issued,
based on the plat approval, during the recording period in order to permit us to begin our site and utility work.

According to Palm Beach County Traffic Engineering Division, the
conveyance of ownership has not yet occurred. As you are aware, a
major portion of this rights-of-way is to be used for required parking
for your project(s) pursuant to City of Boynton Beach, Florida Code of
Ordinances, therefore I request that you coordinate the resolution of
this matter so that compliance with City codes may be attained by the
developer(s) in this regard.

I spoke with Doug Swartz (W~lgreens) today. I explained to him that
the city planning officer is retiring from the city. Since Mr.
Cutro is fully cognizant with the drive-thru issue, Doug wants us
to resolve the drive-thru issue wit~ Mr. Cutro.
I further explained to Doug that Winn Dixie requires two way
traffic behind the store. The enclosed sketch, which I gave to both
Mr. Cutro and Doug during the earlier meeting, is our proposal to
resolve this issue.
We agreed that the partnership should meet with Mr. Cutro,during
the week of August 23-27. Additionally, Doug wants to be there with
me when Mr. Cutro presents it to the association president for the
first time. Doug will try to fly down for a day to attend this
meeting during the week of September 7-10 if the meeting can be
arranged.

On a second matter, Doug indicated that we should have the
Walgreens "approved as noted" drawings by Wednesday, August 18,
1993. stuart can contact him for specific direction on changes that
effect the floor slab before the concrete is poured.

A meeting was held the morning of August 24, 1993 in the office of Mr. Chris Cutro, Planning
Director, City of Boynton Beach, Florida. In attendance were Chris Cutro, Allen GoIns, Stuart
Wilson and Terry Harms. The p1.1Ipose of the meeting was to discuss and receive direotions on
the following issues:
1) Walgreen's drive thru. Three alternatives are to be reviewed.
a. Eliminate the second drive, riaht turn only, on to Plaza Lane. This would
require reducing the sidewalk behind Walgreens to between 1'-091 and
about 1'-6" and reduce the buffer area between the drive and the wall to
not less than 2'.6" from 5'-0", This will allow for a concrete buffer ourb
to separate the drive thru lane from the main drive and allow for a 20'
wide two-way drive.
b. Chris will try to talk with Mr. Morrill and Lynne Matson about the current
drawings we presented. If they do not have a major problem, we will then
have to present them to the board for approval. This provides for the
second drive cut on to Plaza Lane.
c. Place the drive thru on the south side of the rear drive and utilize a
vacuum tube system similar to a bank drive thru. The drive can then
~ejoin the traffic flow and exit around back of the center.
2) Outparcel Waiver: Prepare letter to Chris Cutro explaining that we already have
an approved waiver to the Plat to subdivide two Outparcels which are currently
identified as Outparcels 2 and 3. At thls time we desire to amend the waiver to
identify Outparcels 1 and 2. Along with the letter. we will need to re-supply nine
(9) drawings identifying the outparcels desired.

information regarding the PrevioUS Approval status for the Boynton Lakes Plaza.
This project was determined to be a PreV10US Approval by the City and concurred
by the County, with an intensity of 137,833 square feet. This is the intensity
officially on our records.
The Pa'lm Beach County Traffic DivlSl0n has revlewed two traffic studies for a
parcel of land on the immediate southeast corner of Hypoluxo Road and Congress
Avenue, identified as Boynton lakes Commercial. The f1rst traffic study was for
11.000 sQuare feet of commercial. The secon.j traff1c study was for a gas
station. car wash and 1,570 square foot convenience store. When two uses have
different traffic generating characteristics, any change from one use to another
would have to address the traffic generation of the two uses. A reduct10n in
traffic due to an amendment to a site plan would be deducted from the project
traffic of the original approval.
It is possible for approved intensity to be transferred within a project. The
projp-ct must be subject to a single development order for a single applIcant.
In the case in Question, these are two separate projects and intensity can not
be transferred from one project to another.

Dear Mr. Goins:
The Engineering Department for the City of Boynton Beach, Florida
is in receipt of the above referenced letter of inquiry and herein
provide a response to questions contained in paragraph #2 of your
letter.
1. I've spoken to Mr. Cutro and according to him, the requirement
to place maximum square footage for the shopping center on the
plat documents for both Tract A & Tract B was originally
generated by the Planning & Zoning Director, as a direct
result of our initial meeting with Mr. Jacobe (the previous
owner) and representatives of Lennar wherein Lennar and Mr.
Jacobe agreed to "cover under the umbrella of vesting",
Lennar ' s tract as part of the shopping center tract. The
maximum square footage for the shopping center as set forth on
the original plat was determined to be a "vesting point"
established and based on the maximum square footage of the
original approved 1988 site plan (in accordance with the
County's Traffic Circulation Plan). It is my understanding
that in order to increase this number, a current traffic study
should be submitted by your group to Palm Beach County and the
City for our evaluation.
2. Since the Honorable Mayor, City Engineer and City Clerk, as
well as others have executed the plat document, an amendment
to the plat document shall be performed by replatting the
affected sheet. Such action must be approved by the City
Commission. Should A.G. Development Group propose other
alternatives, they may contact the City Attorney, that being
Mr. James Cherof, at #(407) 375-6050 for assistance.

Procedure - removal of square footage notation
Dear Mr. Goins:
I have read your letter to Michael Haag, requesting removal of
the square footage notation from the Boynton Lakes Plaza plat.
It is this department's position that since vesting and traffic
concurrency are tied to a site plan and monitored by the city and
Palm Beach County through the site plan process, it was, and is,
not necessary for the vested square footage to be indicated on
the plat. As previously discussed, an increase in square footage
will require a site plan modificaion, separate from the issue of
removing the vested square footage notation from the plat.
The site plan process is administered by the Planning and Zoning
Department, however the Engineering Department accepts and
processes replats and separate instruments (as suggested in your
letter) associated with plats. In reading Mr. Finizio's, April
28, 1994 letter to you, it is not clear whether he has determined
that a replat is necessary. Realizing that this issue seems to
be circling, I took it upon myself to contact the city Engineer,
Ron Last (a consultant with the firm of Lawson, Noble and
Associates, Inc.) regarding your question. Mr. Last believed a
replat was necessary, but wanted to confer with his land
surveyor. when I hear back from Mr. Last, I will contact you.
You may also call him at (407)-684-6686. In the interim, I would
also suggest recontacting Mr. Finizio for clarification of
statements in his April 28, 1994 letter to you, since ultimately
he will be processing your request. By separate memorandum, I
have relayed to Mr. Finizio, the problem with your request to
Michael Haag. I believe these actions will result in a
resolution of this issue in the immediate future.

In reference to the plat of Boynton Lakes Plaza, there is a note on
the plat that places an artificial ceiling on the shopping center's
square footage. Upon inspection, we discovered this note is not
only incorrect in scope, but it is also improper to be placed on
the plat.
We sent requests to the city's Engineering and Planning & zoning
department, and it is the consensus that no one wants this note on
the plat. It was stated that we can replat which will cost us
several thousand dollars to accomplish. We are told by our
consultants that a request to the city council to provide a
resolution to rescind this plat note would suffice.
Your prompt direction regarding this matter would be kindly

Procedure - removal of square footage notation
Dear Hr. Goins:
I have read your letter to Michael Haag, requesting removal of
the square footage notation from the Boynton Lakes Plaza plat.
It is this department's position that since vesting and traffic
concurrency are tied to a site plan and monitored by the City and
Palm Beach County through the site plan process, it was, and is,
not necessary for the vested square footage to be indicated on
the plat. As previously discussed, an increase in square footage
will require a site plan modificaion, separate from the issue of
removing the vested square footage notation from the plat.
The site plan process is administered by the planning and zoning
Department, however the Engineering Department accepts and
processes replats and separate instruments (as suggested in your
letter) associated with plats. In reading Mr. Finizio's, April
28, 1994 letter to you, it is not clear whether he has determined
that a replat is necessary. Realizing that this issue seems to
be circling, I took it upon myself to contact the City Engineer,
Ron Last (a consultant with the firm of Lawson, Noble and
Associates, Inc.) regarding your question. Hr. Last believed a
replat was necessary, but wanted to confer with his land
surveyor. When I hear back from Mr. Last, I will contact you.
You may also call him at (407)-684-6686. In the interim, I would
also suggest recontacting Mr. Finizio for clarification of
statements in his April 28, 1994 letter to you, since ultimately
he will be processing your request. By separate memorandum, I
have relayed to Mr. Finizio, the problem with your request to
Michael Haag. I believe these actions will result in a
resolution of this issue in the immediate future.

Dear Mr. Goins:
The Engineering Department for the City of Boynton Beach, Florida
is in receipt of the above referenced letter of inquiry and herein
provide a response to questions contained in paragraph #2 of your
letter.
1. I'Ve spoken to Mr. Cutro and according to him, the requirement
to place maximum square footage for the shopping center on the
plat documents for both Tract A & Tract B was originally
generated by the Planning & Zoning Director, as a direct
result of our initial meeting with Mr. Jacobe (the previous
owner) and representatives of Lennar wherein Lennar and Mr.
Jacobe agreed to "cover under the umbrella of vesting",
Lennar's tract as part of the shopping center tract. The
maximum square footage for the shopping center as set forth on
the original plat was determined to be a "vesting point"
established and based on the maximum square footage of the
original approved 1988 site plan (in accordance with the
County's Traffic Circulation Plan). It is my understanding
that in order to increase this number, a current traffic study
should be submitted by your group to Palm Beach County and the
City for our evaluation.
2. Since the Honorable Mayor, City Engineer and City Clerk, as
well as others have executed the plat document, an amendment
to the plat document shall be performed by replatting the
affected sheet. Such action must be approved by the City
Commission. Should A. G. Development Group propose other
alternatives, they may contact the City Attorney, that being
Mr. James Cherof, at #(407) 375-6050 for assistance.

Dear Chris:
I want to thank you for meeting with Doug Swartz and me at such
short notice. when we found out on Friday, that Doug would be in
town on Monday afternoon, we thought it would be an excellent
opportunity to meet with the city regarding their request for a
drive-thru pharmacy. We regret that Commissioner Matson and the
local civic association president could not meet with us.
To recap our discussion, Doug explained the use of the drive-thru
to us. You stated that if we made the rear road one way behind the
center, between Walgreens and World Gym, with clear directional
signs and road markings, you felt this drive-thru could be
considered a minor site plan modification and did not have to go
through the Planning & Zoning Board and Board of Commissioners. You
al so indicated that a second road cut on pI aza Lane may not
necessarily have to go through the two boards, but you explained
the history and sensitivity of trucks on Plaza Lane.
Our procedure to address this issue is for Boynton Lakes Plaza to
reconcile a design proposal amongst Walgreens, Winn Dixie, World
Gym and our engineers. I f we can get a one way approved you
recommend cross hatching a passenger car exit out of the drive-thru
onto Plaza Lane as "Option One". You would take the drawing and
discuss it with the civic association president. If Y:=i-;, .'p-.'.- ,
positive feedback, we would submit for a minor site charge to the
City and a $100.00 application.
I subsequently informed you that Winn Dixie does in fact unload on
both sides, you indicated that when you receive our revised site
plan, you will have an informal discussion with the civic
association president.
I believe this represents the discussions. If I missed a point,
please let me know.

This morning I received a call from Chris (:Mtro. Some citizens had
called Chris and wanted to know who had approved the back wall of
Winn-Dixie to be painted instead of stuccoed~ This person(s) said
that the 1990 drawings show a sooth surface not a concrete block.
I asked Chris how a citizen could have access to the 1990 drawings
that are only conceptual drawings not approved construction
drawings~ Chris said that somebody in the building dept. is
looking over the approved drawings and feeding somebody with
information that they can be freely interpret to create apparent
problems.
I asked Chris why someone would want to cause all of us problems
because it doesn~t Inake any sense, what could be gained by creating
problems? Could it be political?
Chris informed me t.hat. he can think of t.hree people who could gain
polit.ically by causing us and him problems. Chris will check into
t.his aspect. and let me know what he finds.
