Dear Mr. Cutro:
As outlined in recent meetings with the City Manager and with you, we are
requesting a six month extension of the Preliminary Plat Approval, Site Plan
Approval and concurrency vesting which was previously granted on December 18,
1990. It is our understanding that the initial deadline for the expiration of
those approvals will be December 18, 1991. This extension request is in order
to allow us time to complete the necessary loan commitments which are
currently pending for this project. I am sure that the City can appreciate
the fact that todays difficult economic climate has extended the time required
to secure construction financing.
For your information, we have progressed extensively with a pending sale of
the property to Mr. Allan Goins, who has secured 90% pre-leasing commitments
as well as preliminary commitments for construction and permanent take-out
loans from two lenders. We need this additional time to finalize the loan
agreements and transact the sale satisfactorily to allow Mr. Goins to proceed
with the proper application for final Plat and Building Permits. We would
appreciate it if this matter could be scheduled for an official decision by
the City Commission at their regular December 3rd meeting and will be happy to
provide you with any other additional information which you may need in order
to facilitate this.
We will further appreciate your providing us with the proper information
specifying the event or series of events which must occur prior to the
deadline of any extensions which are granted in order to properly vest our
approval status.
We sincerely appreciate your assistance in this matter. We will look forward
to hearing from you soon as to the date we may expect a decision from the City
Commission.

Boynton Lakes Commercial Plat (Tract A)
Dear Mr. Proctor:
In response to your November 18, 1991 letter and submission of
documents related to the Tract "A", Boynton Lakes Commercial
Plat, this office has determined the submission for final plat is
incomplete and cannot be reviewed as noted below:
1. Section Seven (7) of Appendix C - Six sets of construction
plans are required. These plans must have health department
approvals.
2. Section Seven (7) of Appendix C - Surety or performance bond
must be furnished with submittal.
3. Section six (6) of Appendix C - A filing fee is required.
In addition, a single engineer of record is required. Also,
during discussions with planning department staff, it was noted
that the Parcel "A" final plat submission is based on concurrency
"borrowed" from the 137,000 ft. allocated to the shopping center
(Parcel B). This is contrary to statements made in your November
18th letter.
As the preliminary approval for Parcel B & A (combined plat)
expires on December 18th, I strongly recommend you provide the
above items and discuss this submittal with City staff as soon as
possible. I will set up a meeting should you wish to pursue this
further prior to December 18th.

The Engineering Department, for the City of Boynton Beach, Florida, respectfully
requests your office perform a review of the above referenced preliminary plat
submission and associated construction plans.
At you earliest convenience, please transmit your comments to my office regarding
this projects compliance and/or non-compliance with County ordinances and regula-
tions, via facsimile to the following number: (407) 738-7459.
Special attention should be paid to the fact that the applicant previously
submitted a preliminary plat document for Boynton Lakes Plaza which incorporated
Parcel A and Parcel B, which is indicated on this transmittal as being ~nplattied.
There may be some potential problems relative to dedicating only a small portion
of the east right-of-way line of Congress Avenue when the property to the south
remains unplatted, including dedications along the south rights-of-way line of
Hypo1uxo Road when the remaining portion of the unplatted land may not be
developed for some time. Should dedications be required for the aggregate parcel
as a condition of approval, please incorporate same into your staff comments.

Final Plat Approval
Dear Mr. Tompkins:
The Engineering Department for the City of Boynton Beach, Florida,
herein provides you with the executed original plat document for the
above referenced project.
It shall be the responsibility of the real property owner and/or the
real property owner's agent to immediately record the plat document
into the public records of Palm Beach County. After the plat has been
recorded, please provide this office with a time stable reproducible
plat document exhibiting recordation information, including six sets
of blue line plat documents.
Upon receipt of the aforementioned plat documents, the City Engineer
shall provide the property owners with a Land Development Order
authorizing the construction of required infrastructure improvements
pursuant to City Code of Ordinances, Appendix "C", Subdivision and
Platting Regulations.

project wi 11 generate 955 net daily tri ps. The buil d-out of the project is
proposed for 1994. The Traffic Division has determined that the project meets
the standards of the 1990 Countywide Traffic Performance Standards Code.

Dear Ms. Heyden:
The, Palm Beach County Traffic Division has reviewed the traffic impact study for
the project ent i tl ed Boynton Lakes Commerci al pursuant to the 1990 Traffi c
Performance Standards Code (Ord. No. 90-40). The proposed project consists of
11,000 square feet of general commercial space. It is located on the southeast
corner of Congress Avenue and Hypoluxo Road. The build-out of the project is
proposed for 1993. The Traffic Division has determined that the project meets
the standards of the 1990 Countywide Traffic Performance Standards Code. The
total trip generation is 981 trips per day.
It appears that this project is one tract of a larger parcel. Should the other
tract be considered for approval before the traffic from this project is
reflected in the County's traffic counts, the traffic from the entire site will
have to be considered.
If you have any questions regarding the determination of the County Traffic

Pursuant to your directive in regards to providing you with the sections of our
City's Code of Ordinances, reference the incomplete "Final Plat Submission" for
Tract "A", Boynton Lakes Commercial Plat, please be advised that the submission
does not conform to the following code provisions:
1. The final plat submission did not contain six (6) sets of construction plans
as required by Article VIII, Section 7A1 of Appendix "C", Subdivision and Platting. Pg 21
2. The final plat submission did not contain adequate surety as required by
Article VIII, Section 7A2, "Surety Bond". Additionally, should the developer
desire to submit alternat surety, said surety shall comply with a newly adopted
ordinance which sets forth the criteria by which "Letters of Credit" are accepted
and reviewed by the City. Page 2113
3. The final plat submission did not contain the appropriate filing fee adopted
by City Commission resolution. The final plat submission fee is three-hundred
(300) dollars (US dollars) and shall include a two (2) percent administration fee
which shall be based upon one-hundred (100) percent of the cost to construct the
required improvements, based on an "Engineer's Opinion of Cost" which shall meet
with the approval of the City Engineer. Article VIII, Section 6. App. "c" pg.2105
4. The final plat submission did not include a fee to be made payable to the City
in an amount equal to one-hundred and twenty five (125) percent of the costs that
are associated with street light installation, should street lights be required.
Ordinance 90-38 (effective October 1, 1990)
5. The final plat submission, reference the actual mylar plat document, does not
contain easements for the required utilities necessary to serve the subject land.
Article X, Section 6, "Easements", Appendix "C", Subdivision and Platting, Page 2135
(see also page 2109, Article VIII, Section 6D9, "rights-of-Way and Easements)
6. The final plat submission contains many errors such as incorrect labeling of
signature lines etc requireing corrections to the face of the plat. Article VIII,
Section 6D inclusive, pages 2106 thru 2113 of Appendix "c"
I strongly recommend that the applicant be urged to immediately contact the affected
City Departments in order to schedule a meeting to discuss methods by which the
omissions and various states of non-compliance can be resolved. Please contact
Planning Director Christopher Cutro regarding coordination of City efforts in this
regard.
