Mr. White, on February 7, 1994, had advised he was unable to determine if the outparcels were located within the legal description of the center. On March 4, 1994, Mr. Nick Miller, an independent licensed surveyor in the State of Florida, sent a letter to Mr. White that provided the determination that both outparcels did in fact lie within the shopping center. Now that the City has proof that the outparcels, as described in the previously provided information, do lie within the center, does the recorded cross access and parking agreements, for the outparcels, satisfy the requirements set forth in the approved Waiver of Plat? If so, I would appreciate it if you could provide me with a letter stating that the requirement is met. As the Owner's continue to move forward with their ongoing negotiations for these outparcels, it is important that they get this matter resolved satisfactorily with the City.
