I PLANNING & ZONING DEPARTMENT MEMORANDUM NO. 93-236 FROM: Members of the Planning & Development Board ~er~o Planning & Zoning Director TO: DATE: September 9, 1993 RE: Waiver of Plat - Modification - Boynton Lakes Plaza You will recall that in June of this year, the Board approved a waiver of plat to allow the creation of two outparcels at Boynton Lakes Plaza. The outparcels that were approved are shown on the site plan dated June 8, 1993. Somehow when we submitted the backup to the Board for review, I identified the wrong parcels to be subdivided. The outparcels that the applicant wishes to subdivide are located on congress Avenue on the north and south side of the entrance. I have discussed this modification with Richard Staudinger, the City Engineer, and he has indicated he has no objection to changing the waiver of the plat for the indicated parcels. Since the needed infrastructure is in place and the site has been reviewed for zoning compliance, platting is unnecessary. We recommend that this request be approved subject to the applicant providing cross access and cross parking agreements showing that access and parking will be available as originally requested in the site plan. Since easements are not a zoning issue, the Planning and Zoning Department has not been involved in the review of agreements for cross access and cross parking easements since the current site plan ordinance was effectuated. With the institution of the conceptual site plan process, this responsibility, among others, was agreed to rest in the Engineering Department. After your department completes its review of this easement agreement, including legal descriptions, it is suggested that you transmit your comments to the City Attorney, so that he may combine his legal sufficiency comments with your department's comments and coordinate revisions to the agreement. Speaking from experience with coordinating parking leases and shared parking agreements, this procedure seems to work best and is time efficient when multi- departmental review of these agreements is necessary. Lennar and Boynton Lakes shall maintain their respective properties (Lenna~ Property and Boynton Lakes Property) in good condition and repair at all times and shall be solely responsible for the costs of neoessary repairs, replacements and maintenance thereto. 5. In the event of the violation of any of the terms and obligations herein contained, the party or parties entitled to enforce this Agreement shall have the right to do so either by action at law or in equity against any party(s), entities, person( s), firms or corporations violating, or attempting to violate, any of the covenants contained herein, either to restrain such viclation, to abate same, to recover damages, or for any combination of the foregoinq. 10. Invalidation of anyone or any combination of the covenants contained herein by judgment or court order shall in no way affect any of the other provisions hereof, or any of the other provisions recited herein, all of which shall remain in full force and effect. Reference the last sentence, paragraph #1 of your memo wherein you indicate Departmenbrffiponsibili ty to review cross-access agreements, the Engineering Department has researched your files as well as it's own and has determined that no agreement was made between our Depart- ments indicating that Engineering would assume this task. Historically, the Planning Department has been the sole Department which has requested, reviewed and approved past cross-access agree- ments. Attached for your review and in support of our position that this task should remain under the purview of the Planning and City Attorney's Offices, please find copies of the then Planning Director, Christopher Cutro's Memo #93-140 dated June 3, 1993 ind- icating that Planning staff imposed the condition for the submission of such an agreement. Additionally, Mr. Cutro's October 1, 1993 letter to Stuart Wilson of FRU-CON Development (see attached letter) validates and approves the Cross-Access Agreement further representing your Department's historical control over such matters when submitted in conjunction with applications for platting waiver, a process which pursuant to City Ordinances is administered by the Planning Director. Planning and Zoning was also responsible for the administrative action of approving other such agreements, specifically Catalina Centre at Congress Lakes etc, therefore, this Office feels that the Engineering Department should not be involved in reviewing agreements that are geared to insure access to required parking areas (a zoning matter) . Development, the owners of Boynton Lakes Plaza, has requested a waiver of plat to allow for the creation of two outparcels for restaurants. This development was reviewed and approved by the city Commission in December of 1990. The property was taken over by the present owner from the R.T.C. at the end of 1992 and platted earlier this year. The site plan for the site will not change and all the needed improvements are being installed as part of the plat requirements or the site plan requirements. Therefore, making the new owners replat is unnecessary. The City Engineer has reviewed this request and has no objections to this request. The Planning and Zoning Department has no objections to the request but would ask that a condition be added that cross access and parking agreements be required to ensure that the access and parking will be available as originally represented in the site plan. This item has been scheduled for review by the planning and Development Board at its meeting of June 8, 1993. With the institution of the conceptual site plan process, this responsibility, among others, was agreed to rest in the Engineering Department. After your department completes its review of this easement agreement, including legal descriptions, it is suggested that you transmit your comments to the City Attorney, so that he may combine his legal sufficiency comments with your department's comments and coordinate revisions to the agreement. Speaking from experience with coordinating parking leases and shared parking agreements, this procedure seems to work best and is time efficient when multi- departmental review of these agreements is necessary.
