Resubmitted Master Plan Without Benefit of Submission Fee
Dear Mr. Bryan:
On February 9, 1993, at 3 P.M., you personally hand delivered to my
office a quantity of master plans for the above referenced project,
at which time you desired to leave them in the custody of this office
without benefit of you paying the appropriate submission fee as set
forth in the City of Boynton Beach, Florida Code of Ordinances,
specifically Appendix C, "Subdivision and Platting Regulations",
Article VIII, Section 4F, which states that: "If more than one re-
submittal of the corrected or revised master plan is required by the
Technical Review Board, an additional fee, as adopted by resolution
of the City Council, shall be charged for each resubmittal.
This letter shall serve to document the City's position that this
delivery of plans for the Boynton Seacrest project constitutes a
resubmission over and above your previous second review resubmission
which was scheduled to be considered by the City's Planning and
Development Board on Tuesday, February 9, 1993.
Attached is a courtesy copy of the City's Code of Ordinances relative
to master plan submissions. You are advised that the plans you left
with the City Engineer during the regular meeting of the City's Planning
and Development Board are being held for your benefit and will be held
in abeyance, with no further action being taken towards the subject
plans, until such time as you comply with the submission fee require-
ments set forth in City codes provided you herein.
At the Planning and Development Board meeting the City Attorney
indicated to your attorney, Martin Perry, that the City Attorney J....'

that Mr. Perry wished to provide. The City Attorney has advised me
that he left two messages for Mr. Perry following the Planning and
Development Board meeting but that he has had no response.
Should the office of the City Engineer not receive the $1,500.00
submittal fee from you within ten days from receipt of this certified
letter, the City will return the master plans to you without further
consideration.

I am pleased to submit on behalf of Cedar Grove Investments, the attached
Subdivision Master Plan for the above referenced tract. This submittal is in
accordance with Appendix C, Article VIII, Sec. 4, of the Boynton Beach
Code.
A check In the amount of $1250 for filing fees is also attached with the
twelve sets of drawings. The submittal package includes a Master Plan,
Boundary Survey, Master Storm Water Management Plan, Traffic Report and
Preliminary Engineering Data.
Upon the completion of your initial review of this package I would
appreciate your written response as verification of the sufficiency of the
submittal.

Pre-Application Procedure
Dear Ms. Jarkesy:
This letter is sent in response to your letter of 8/26/92 concerning the pre-application
procedure discussed at the 8/14/92 meeting the proposed Cedar Grove subdivision.
First of all I note that your letter referred to this matter as a rezoning of this project. No
rezoning was discussed at the 8/14/92 meting. What was discussed was the Master Plan
submittal for the Cedar Grove subdivision under the existing zoning. This is an important
point to understand in discussing the pre-application process.
The pre-application process outlined in Appendix C, Article VIII, Section 3 has no binding
effect in the outcome of the Platting process or the Master Plan process. The pre-
application process is available to developers who wish to have a preliminary review of
a development prior to submitting a Master Plan. Because the proposed subdivision
zoning is similar to existing development both north and south of Cedar Grove, the pre-
application process would be unnecessary, time consuming and of no apparent benefit
to the developer.
