VILLA VALENCIA
RESIDENCE AGREEMENT
Marriott Lifecare Retirement Communities, Inc. (referred
to in this Agreement as "Marriott") is a Delaware
corporation, organized to establish and operate retirement
communities. Marriott owns and operates the retirement
community known as villa Valencia (referred to in this
Agreement as the "Community"), located in Laguna Hills,
California.
(referred to in this Agreement. 3G Ifyoult) has/have entered
into this Residence Agreement ("Agreementtl) with Marriott, on
the day of I 19_.
YOU AND MARRIOTT AGREE AS FOLLOWS:
ARTICLE I
RESIDENCE ACCOMMODATIONS AND FACILITIES
A. Your Residence You have selected Apartment
to be your residence (this apartment will
be referred to in the Agreement as your "residence"). You
shall have a personal and non-assignable right to reside in
the residence, subj ect to the terms of this Agreement and
Community rules and regulations, as long as you are capable
of independent living. Your residence will be furnished with
carpeting and draperies and the minimum furniture package
described on Addendum A. You may decline the furnitur~
package and receive a credit of $150.00 per person against
y-our monthly fee. You may then furnish and decorate your~
residence in accordance with your own individual tastes and
preferences. Placement and use of your furniture and small
appliances is at your discretion as long as this does not
interfere with the Community's safety standards. Resident
agrees to obtain and maintain an active telephone line
necessary for the installation and functioning of the
Community'S emergency alert system.
B. Parking - If requested, a parking space will be
assigned to you, at no additional charge, for a single motor
vehicle used by you.
c. Modifications to your Residence - You will not make
any structural or physical change to your residence.

without the General Manager's written consent.. At your
request, for an additional fee, and in compliance with your
residence in accordance with the terms of a separate
agreement between you and Marriott. Subject to Marriott r s
approval, you may perform the modification work.
D. Community Facilities - You will be entitled to
share with all residents in the use of the common grounds and
facilities, and to reserve certain areas for special
occasions in accordance with Community rules and regulations.
The Community will feature facilities for a wide range of
social and recreational activities. The Community will
include a community center, reception area, library, mail
boxes, a beauty shop, and a high quality dining room with
additional provisions for private dining. The Community will
offer a wide range and balance of social and recreational
activities.
E. Property Protection You agree to keep your
residence clean and orderly and agree not to permit misuse of
or damage to your residence.
ARTICLE II
SERVICES
A. Meals - Marriott will make available morning, noon,
and evening meals at designated hours with nutritionally well
bdldnced and varied menus. The Monthly ree entitles you to
meals per day in the Community dining room. other meals may
be obtained at an additional charge.
1. Tray Service - Tray service will be provided in
your residence at an extra charge if such service is required
by t.he Community's Nursing Supervisor.
2. Guest Meals - You may invite guests to any
meal, although Marriott requests that you give prior notice
so that proper accommodation can be made. Guest meals will
be billed to you as an additional charge.
B. Housekeeping At least weekly, Marriott will
provide light cleaning service for your residence. Marriott
will provide window washing, oven cleaning, and carpet
shampooing once a year, or more frequently, if necessary, as
determined by the General Manager. Additional housekeeping
service may be contracted for an additional charge.

c. Maintenance and Repair - Marriott will provide
necessary repairs, maintenance, and replacement of. Community
property and equipment. Except in an emergency, such services
will be provdided during normal working hours, Monday through
Friday. Marriott shall have the right to charge you for any
repairs, maintenance or replacement required as a result of
the negligence or intentional acts of you or your guests.
YoU are responsible for maintaining, repairing and replacing
your property.
D. security - Your residence will be equipped with an
emergency call system by which you can contact personnel who
will be available to provide assistance 24 hours a day, seven
days a week. Marriott will employ security personnel to
supervise the Community buildings and grounds during certai~
hours, as it deems necessary.
E. Buildings and Grounds - Marriott will maintain all
Community buildings, common areas and grounds, including
lawns, walkways, and driveways. Landscaping and decorative
plantings will be provided and maintained by Marriott as it
deems appropriate.
F. Insurance and Responsibility for Resident's Property
- You will be responsible for providing all personal property
and liability insurance for you, your property and your
guests. Marriott shall not be responsible for and Marriott
insurance will not protect you against any loss or damage to
your personal property (including your automobile) from
theft, fire or other cause which is not the fault of
Marriott, nor does Marriott agree to indemnify you against
personal liability for injury to guests or other persons in
your residence.
G. Utilities - Your residence will be provided with
water, heat, air conditioning and electricity. Electricity,
water, sewer and garbage collection fees are included in your
Monthly Fee. Telephone service to each residence will be
available; however, installation of telephones and service
costs will be your responsibility.
H. Transportation - Marriott will provide scheduled
local transportation to shopping center and other points of
common interest.
I. Personal Hygiene Items - The personal hygiene items
listed on Addendum A are included in the monthly fee. If you
furnish our own personal hygiene items 0 w II receiv
credit of 50.00 per person aga1ns your monthly fee.

J. Laundry - Basic laundry service (washing, drying and
ironing) is included in your monthly fee. If you do your own
laundry you will receive a credit of $100.00 per person
against your monthly tee.
ARTICLE III
MONTHLY CHARGES
A. Monthly Fee
1. Payment of Monthly Fee - You will pay Marriott
a monthly fee (referred to in this Agreement as the "Monthly
Fee") in advance on or before the fifth (5th) day of each
month throughout the term of this Agreement. The Monthly Fee
will be deemed paid when received by Marriott. Marriott may
assess a five percent (5%) penalty charge for late payment.
The Monthly Fee for the first month shall be prorated based
upon the number of days in the first month of the Agreement
and will be billed after moving into the community. The
Monthly Fee for the last month of the Agreement must be paid
upon signing this Agreement. The Monthly Fee is not rent but
is consideration for services provided to you as herein
described.

B. Good Order Deposit - You must give Marriott a $350
good order deposit upon signinq this Agreement. The good
order deposit is fully refundable, without interest, within
30 days after the termination or cancellation of this
Agreement. If your residence has been damaged beyond normal
wear and tear and/or if all Monthly Fees and other amounts
due Marriott have not been paid in full, Marriott may apply
the good order deposit against any amounts due.
c. Adjustments of Monthly Fee
1. Adjustments - Marriott will have the right to
adjust your monthly fee at any time commencing twelve (12)
months after the beginning of this Agreement. Adj ustments
shall not be made more than once in each twelve (12) month
period nor without at least sixty (60) days written notice to
you.
2. Residence Absence - If you are absent from the
Community for more than ten (10) consecutive days, you will
receive a partial refund of your Monthly Fee as determined by
Marriott, provided you first give written notice to the
General Manager of the Community at least five (5) days
prior to such absence.
ARTICLE IV
TERM OF AGREEMENT
A. Commencement - Your residency will begin on

by you at any time by thirty (30) days written notice to
Marriott. This Agreement shall not terminate until the end
of such thirty (30) day period, and until such termination
date Marriott shall continue to be entitled to all fees
required under this Agreement. If you cancel, the Agreement
prior to moving in, all monies paid hereunder, less $50 for
Marriott's processing costs, will be refunded.
c. Cancellation by Marriott - Marriott may cancel this
Agreement at any time for good and sufficient cause (as set
forth herein) upon thirty (30) days written notice. In the
event that Marriott gives you a notice of termination under
this paragraph, Marriott will permit you during the thirty

(30) day period following the notice to correct the problem
that led to the notice of termination. If M~rriott is
satisfied that the problems have been corrected, it will not
terminate this Agreement.
Good and sufficient cause for termination shall include
the following:
1. conduct by you which constitutes a danger to
yourself or others;
2. Failure to perform your obligations under this
Agreement including failure to pay your Monthly Fee when due;
3. Repeated conduct that interferes with the quiet
enjoyment of the Community by other residents:
4. persistent refusal to comply with written
Community rules and regulations; or
5. You are no longer ambulatory and are in need of
artificial support, or you are no longer capable of
independent living.
D. Termination by Death - Unless sooner terminated as
provided in this Agreement, upon your death this Agreement
shall terminate as soon as your personal property has been
removed from your residence. The death of one resident of a
jointly occupied unit shall not cause this Agreement to be
terminated.

mail properly addressed and postage prepaid.
F. Release upon Termination - Upon termination of this
Agreement, (1) Marriott will take possession of your
residence and be released from all obligations to you except
to payor refund any amounts required to be paid or refunded
to you under this Agreement, and (2) upon payment of all
amounts owed to Marriott by you under this Agreement, you
shall be released from further obligation to Marriott.

G. Removal of personal property - If your personal
property 1s not removed from your residence ~fter the
termination of this Agreement, Marriott shall have the right
to remove it and place it in storage for one (1) year at your
or your estate's expense, after which it shall be sold,
pursuant to the requirements of California law, and the
proceeds, after deductions for expenses, credited to your
account.
ARTICLE V
OTHER CONSIDERATONS
A. Resident's Covenant of Performance - You agree to
pay promptly all fees and charges required by this Agreement,
and otherwise comply fully with all of your other obligations
set forth in this Agreement.
B. Attorney's Fees - In the event that litigation
arises between the parties in connection with their rights
and obligations under this Agreement, the prevailing party
will be entitled to reasonable attorney fees and costs
incurred in connection with such litigation, to be paid by
the other party.
c. Additional occupants
1. Increase or Change in Number of occupants - No
person other than you may occupy your residence except as a
temporary quest. Any guest staying overnight must first
register with the Community. Permission must first be
obtained from the General Manager if Resident desires that a
guest stay for more than seven (7) nights in any thirty (30)
day period. Persons granted such permission shall acquire
no rights or privileges under this Agreement. Marriott shall
revoke such permission at any time upon twenty-four hours
notice.
2. other Parties - Should you desire to have
another person live in your residence with you on a permanent
basis, prior written permission of the General Manager shall
be necessary. If approved, the Monthly Fee shall be adjusted
to reflect double occupancy.

D. Property Rights
1. Right of Entry - Marriott employees may enter
your residence at any reasonable time to perform housekeeping
duties, inspection and maintenance functions and at any time
to respond to a medical, fire or other emergency. Marriott
recognizes your right to privacy and Marriott's
responsibility to limit entry only to situations such as
those described above or where Marriott deems it advisable
for the best interest of you or the Community. Marriott
reserves the right to call your physician or other designated
doctor in the event of an emergency.
2. Ownership Rights You have no ownership
interest or proprietary right in the residence assigned to
you and the personal property, land, buildings, improvements
or other Community facilities provided under this Agreement.
This Agreement shall not be construed to be a lease or to
confer any rights of tenancy or ownership to you. Your
rights under this Agreement are subject to all terms and
conditions of this Agreement and subordinate to any mortgage
financing deed, deed of trust, or financing lease on
Community premises. Upon request, you agree to e~ecute and
deliver any instrument requested by Marriott or the owner or
holder of any such document to effect the sale, assignment,
or conveyance thereof, provided that by so doing you shall
not be required to prejudice your rights under this
Agreement.
3. Responsibility for Damage You will be
responsible for any loss or damage to Marriott's property
caused by the negligence. If negligence or another
resident, invitee or other person, other than an employee or
agent of Marriott, results in injury, illness or damage to
you or your property, Marriott assumes no responsibility
therefor and you release and discharge Marriott from all
liability and responsibility for same.
E. Rules and Regulations - Marriott shall have the
right to adopt or amend, either by itself or with or through
a residents' association, such reasonable rules and
regulations as it deems necessary or desirable for the proper
management and operation of the Community and the safety,
health and comfort of the residents. You agree to abide by
such rules and regulations.
F. Admissions and Dismissals of other Residents - You
agree that you have no right to determine or appeal the
admission, terms of admission, placement or dismissal of any

other resident. All residents must be at least 55 years old,
ambulatory (without artificial support) and in good mental
and physical health and free from infectious or contagious
diseases. The Community is open to any person without regard
to race, religion, sex, or national origin.
G. visitor Policy - Except as provided in Article v,
Section e.l, Residents may invite Guests for visits at
reasonable times. Guests must comply with Community rules
and reg'ulations.
H. Waiver - The failure of Marriott in anyone or more
instances to insist upon strict compliance by you with any of
the terms of this Agreement, shall not be construed to be a
waiver of Marriott of the right to insist upon strict
compliance by you with any of the other terms of this
Agreement.
I. Assignment - Your rights under this Agreement are
pcrconal to you and cannot be transferred or assigned by any
ac'C ot you, or by any proceed.ing at law, or ol..ht;lL'wl:;;i':l.
Marriott may assign the Agreement to any subsidiary or other
entity. The Agreement shall bind and inure to the benefit of
Marriott's successors and assigns and shall bind and inure to
the benefit of your heirs, executors and administrators in
accordance with its terms.
J. Entire Agreement - This Agreement constitutes the
entire agreement between Marriott and you. Marriott is not
liable for nor bound in any manner by any statements,
representations, or promises made by any person representing
or proposing' to represent Marriott unless such statements,
representations, or promises are set forth in the Agreement.
Any modifications of the Agreement must be in writing signed
by Marriott and you.
K. Partial Illegality This Agreement shall be
construed in accordance with the laws of the State of
California. If any portion of this Agreement shall be
determined to be illegal or not in conformity with applicable
laws and regulations, such portion shall be deemed to be
modified so as to be in accordance with such laws and
regulation, and the validity of the balance of this Agreement
shall not be affected.
L. Construction - Words used in this Agreement of any
gender eh~ll be deemed to include any other gender and words
in the singular shall be deemed to include the plural, when
the sense requires.

M. Joint and Several Liability If two parties
execute this Agreement as residents, the term "resident" or
"you" as used in the Agreement shall apply to both and they
shall be jointlY and severally liable under this Agreement
unless otherwise provided.

Brighton yellow
The colors originally proposed were similar to those installed at our project in
Port St. Lucie. After reviewing the completed Port St. Lucie project we
determined that a richer color palette would be better at the Boynton Beach
site. The installed colors are very similar to those I anticipated using
originally, but are custom colors specifically developed for this project and are
richer in color than the original selections.

Dear Chris:
Enclosed, please find the revised color elevation for Marriott's proposed Boynton Beach
Brighton Gardens. As we discussed, it is my understanding that the revised elevation plan
will be reviewed by the P.& D. Board at their October meeting.
In regards to the height issue, the ridge line is 25 feet, 7-1/2 inches at the peak. The roof
tile manufacturer recommends the optional 4 to 12 pitch (as proposed), however, the pitch
can be lowered to achieve a maximum 25 foot roof height. While Marriott's preference is
to meet the manufacturer's recommendation, we can be flexible.
Marriott's architect is in the process of providing you with a letter documenting the bed
count/parking ratio.

All of the Structural, Plumbing, Mechanical, Drainage and Paving, and Electrical Comments
have been addressed. HRS has completed their review of the final plans and we anticipate
receipt of their final plan comments this week. Their comments will be incorporated into
the final plans. Subsequently, Marriott will provide the Boynton Beach Building Department
with the revised plans incorporating the City and HRS comments.

As you requested, this letter is being provided to document the bed count for the
above referenced project for parking space count determination. This project
consists of a sheltered care facility with 128 beds and a nursing care facility with 19
beds for a total bed count of 147.
The nursing care facility may be expanded by 11 beds in the future, upon receipt of
C.O.N. approval. This expansion would be accomplished by converting private
rooms to semi-private rooms and would not increase the building square footage. If
this expansion occurs, the sheltered care facility bed count would be reduced by
eleven beds to offset the increased nursing care bed count. The total maximum bed
count for this project, therefor, would remain at 147 beds.

Dear Chris:
In accordance with our discussions and meetings on September 10,
Marriott Retirement Communities, Inc. (Marriott) hereby requests an
additional extension of Application No. 90-2281. This Application
was previously extended in accordance with the enclosed letter
dated June 18, 1991 which was addressed to curtis Shenkman, our
local legal counsel.
The project was approved to contain 104 Assisted Living Units, plus
30 Skilled Nursing Beds (in 19 rooms). In the fall of 1989,
Marriott filed a certificate of Need Application with the Florida
Health and Rehabilitation Services (HRS). The application was to
obtain approval of the nursing beds. The application was initially
denied in the Spring of 1990. The decision was subsequeI)tly
appealed. In the Spring of 1991, a settlement was reached whereby
19 beds would be transferred to Marriott. The transfer was
completed at the end of August 1991.
Prior to obtaining HRS authorization to commence construction, the
following must occur:
1. HRS review and approval of Schematic Plans.
2. HRS review and approval of Preliminary Plans.
3. HRS review and approval of Working Drawings.
Marriott's architect has informed us that the building plans which
were approved by Boynton Beach in 1990 will have to be revised to
meet the new Federal Fair Housing regulations. While addressing
the new requirements, Marriott desires also to increase the size of
some of the assisted living units. This is a result of our actual
operating experience. The number of units will remain unchanged.

TURBIDITY. NUTRIENT LOADING AND SEDIMENTATION IN THE RECEIVING WATERS.
2. WATER OUALITY DAT-A FOR THE WATER DISCHARGED FROM THE PERMITTEE'S PROPERTY OR INTO SURFACE
WA TERS OF THE STATE SHALL BE SUBMITTED TO THE DISTRICT AS REOUIRED. PARAMETERS TO BE MONITORED
MAY INCLUDE THOSE LISTED IN CHAPTER 17.3. IF WATER OUALITY DATA IS REOUIRED. THE PERMITTEE SHALL
PAOVIDE DATA AS REOUIRED. ON VOLUMES OF WATER DISCHARGED, INCl.UDING TOTAL VOLUME DISCHARGED
DURING THE DAYS OF SAMPLING AND TOTAL MONTHLY DISCHARGES FROM THE PROPERTY OR INTO SURFACE
WATERS OF THE STATE.
3. THE PERMITTEE SHALL COMPLY WITH ALL APPl.ICABl.E LOCAL SUBDIVISION REGUI..A TIONS AND OTHER LOCAL

4. THE OPERATION PHASE OF THIS PERMIT SHALL NOT BECOME EFFECTIVE UNTIL A FLORIDA REGISTERED
PROFESSIONAL ENGINEER CERTIFIES THAT ALL FACILITIES HAVE BEEN CONSTRUCTED IN ACCORDANCE WITH
THE DESIGN APPROVED BY THE DISTRICT. WITHIN 30 DAYS AFTER COMPlETION OF CONSTRUCTION OF THE
SURFACE WATER MANAGEMENT SYSTEM, THE PERMITTEE SHALL SUBMIT THE CEATIFICATION AND NOTtFY THE

COMPLETED SURFACE WATER MANAGEMENT SYSTEM, THE PERMITTEE SHALL AEQUEST TRANSFER OF THE
PERMIT TO THE RESPONSIBLE ENTITY APPROVED BY THE DISTRICT.

The building increase of 4,283 square feet is attributable to the
following:

The balance of the square footage resulted from enlarging
some of the assisted living units and revising the number
of nursing rooms from 18 to 19 (no increase in beds).

The assisted living room and nursing room mix is noted on the
program. The assisted living room total is 104 for both programs.

In summary, one semi-private nursing room has been converted to two
private rooms - - in response to a greater resident interest in
private rooms. The total number of resident rooms increased by
one, but the total number of beds remains unchanged. other
modifications such as additional mechanical were required by HRS.
In regards to the increased impervious surface, our consultants
have provided the following calculations:
Approximate increase of 2,600 sq. ft. of building
Approximate increase of 2,250 sq. ft. sidewalk which is
currently code required for emergency fire egress (not
required previously).
Approximate increase of 200 sq. ft. of sidewalk and
paving in the service courtyard.
Balance of the impervious surface difference is existing
paved area within the northern property line (see site
plan). This paved area serves as part of the Congress
Center (adjacent two-story professional building)
driveway. Marriott's consultants had not included this
existing pavement in their original calculations. The
original impervious calculation included only the new
building/paving coverage.
The color elevations are being prepared to reflect the revised
building and will be forwarded to you shortly. Please contact me

C-l to C-12, L-l to L-4, and A-I to A-3.
2. 6 sets of surveys sealed by a Florida registered surveyor.
3. 6 sets of Drainage Calculations and Fire Flow Calculations
sealed by a Florida engineer.
4. Original and 1 copy of Application pages 1, 2, 3, 4, and 9 with
certification signatures and authorization of agent signatures
on page 9.
5. Marriott Corporation check no. 16926130 payable to the City
of Boynton Beach in the amount of $300.00 as filing fee.

Building Permit #92-2327 - A revision to approved site plan
#89-3401
Dear Don:
The submitted building plans were reviewed by staff for
consistency with the approved site plan and the following
inconsistencies were found:
1. The approved site plan showed a total floor area square
footage of 65,370 and a building footprint of 38,063 square
feet. The revised building plans show a floor area square
footage of 69,653 and a building footprint of 40,656 square
feet. Respectively, these increases are floor area square
feet 4,283 square feet or .07% and building footprint square
footage is 2,593 square feet or .07%.
2. The horizontal controls as shown on the building plans when
compared to the approved site do not match.
3. The site data information as provided on the building plans
do not match the approved site plan data and show an
increase in the impervious areas from 71,960 square feet,
43.3%, to 80,784, 48.7% of the site.
4. Colored elevations of the revised project should be
submitted that accurately depict the proposed changes.

Dear Chris:
On October 15, 1991, the above referenced site plan was approved
for reinstatement and extended to October 15, 1992. In accordance
with my correspondence last fall, we have completed the following:
Obtained a Certificate of Need from HRS for 19 Nursing Beds
(19 rooms).
Obtained preliminary and schematic plans approval for HRS.
Items which we are now proceeding with:
Procurement of a certificate of Need from HRS for 10 Nursing
Beds (to be utilized in the previously referenced 19 nursing
rooms). Expected to be complete this fall.
Procurement of final HRS approval of the working drawings,
(proj ected to occur soon after the 10 nursing beds are
procured) .
Enclosed are two copies of the slightly revised site plan dated
November 21, 1992, similar to the one I gave you last September,\
The original building is outlined in light blue and the revised
building is outlined in bold blue. The minor revisions amount to
a 5.37% increase in the total building size. The number of units,
beds, and parking spaces remain unchanged. The increased building
is primarily the result of some of the assisted living units
increasing in size (in accordance with our actual operating
experience).

Recently, members of Marriott's Design Management and Construction
staff met with Boynton Beach Building Department Officials to
discuss the project. The procedure discussed was as follows:
· Marriott would submit the Brighton Gardens drawings to Boynton
Beach by May 29 for the building permit.
Boynton Beach would review the plans.
Upon final approval of the working drawings by HRS, Marriott
would submit the HRS required revisions (if any) to Boynton
Beach.
Upon final approval by Boynton Beach, Marriott would pull a
building permit.
Marriott is proceeding in accordance with this schedule.
In accordance with our previous discussions, I am assuming that the
proposed site plan revisions (as noted on the enclosed plans) would
constitute a minor site plan revision.
Upon review of this letter and the attached plans, please notify me
with any comments or questions which you may have. Thank you for
your assistance in this matter.

Brighton Gardens
Marriott Corporation is requesting that the approved site plan
for a development known as Brighton Gardens located on the west
side of Congress Avenue, 200 feet north of Woolbright Road be
extended.

This plan was approved by the City Commission in August of 1989.
The applicant applied for a building permit, but did not pull the
permits because they were involved in a HRS review of their
development. The permit application was extended by the Building
Official because the applicant was involved in the state process.
We have now learned that the applicant~ having received approval
for 19 nursing home beds, must now go through a 9 month review
process and it is anticipated that some changes will be required
to the proposed development. While these changes are minor,
staff feels that the continued extension of the site plan by
extending the building permit application process is improper.
Based on the attached letter from Marriott Corporation, the
Planning Department would recommend that the city Commission
allow the approved site plan for this development to remain
operative while Marriott is involved in the HRS review process or
for a period of 12 months, whichever comes first. This should
enable Marriott to complete the State review process and modify
the site plan accordingly.
This item has been scheduled for City commission review on
october 15, 1991.

In accordance with our disoussions and meetings on September 10,
Marriott Retirement Communitiesr Ino. (Ma~riott) he~Qby requests an
a~~itional extension of Application No. 90-2281. This Application
was previously extended in accordanoe with the enclosGd letter
dated June 18, 1991 which was addre3$ed to curtic Shenkman, our
local legal counsel.
The prOject was approved to cont~in 104 Assisted Living Units, plUG
30 Skilled Nursing Beds (in 19 rooms). In the fall of 1989,
Marriott filed a certificate ot Need Application with the Florida
Health and Rehabilitation services (HRS). The application was to
obtain approval of the nursing bedS. The application was initially
denied in the Spring of 1990. The decision was subsequently
appealed. In the Spring of 1991, a settlement was reache~ wnereby
19 beds would be transferred to Marriott. The transter was
completed at the end of August 1991.
Prior to obtaininq fiRS authorization to commence construction, tne
following must occur: '
1. RRS review and approval of Schematic Plans.
2. HRS.revi~w and approval of Preliminary Plans.
J. HRS revi~w and approval of Workinq Drawings.
Marriott's architect has informGd u. that the building plans which
were approved by Boynton Beaoh in 1990 will have to be revised to
meet the new Federal Fair Housing rQgulations. While addressinq
the new requirements, Marriott dGsirQ~ also to inorease t.he size of
some ot the assisted 1ivin9 unita. This is a rQ~ult of our actual
operating experience. The number of unite will rQmain unchanged.
The net increase of the building footprint would bQ approximately
6%.

This letter serves as written approval of your reques~, on behalf a!
Marriott Retirement communitiesl Inc., for a 90-day ex~ension on the
Brighton Gardens project. This extension is from June 28, 1991 to
September 27, 1991, subject to.all codes, ordinances, laws or tees
applicable at the time of permit issuance. .
Please be advised that new permit fees and sewer and water fees have
gone into effect since your application was originally submitted. In
addition, a water conservation ordinance has gone into effect. Your
project will be req~ired to comply with all applicable codes and fees
when permitted. =
This extension and condition also 'applies to your application ~90-2282
for paving and drainage, i90-2283 for site liqhting and .90-2284 for
elearing and grubbing, which you may wish to obtain before
September 27th.

Based on actual experience, completing steps 1. & 2. can take six
to nine months;: dUQ to review time, scheduling, resubmittals of
plans, e~o., rQquir~d by HRS. This is the justifiable cause for
the Applioation extension in acoordance with Section 103.1.5 of the
Countywide ModelAdministrativ~ Coda. upon completion of step 1.,
Marriott would b~ preparad to ~ubmit the modified site plan for
Site plan Modifioation approval.
It is my understanding that the Boynton Beach City council will
receive an update in regards to this ma~tar on Octobar 1.
Wnile Marriott initially has obtained a CON for 19 nursing beds,
Marriott continues to seek approval for additional nursing had5.
Initially, tne l~ nursing center rooms can be operated as private
rooms (the 19 rooms are designed to accommodate a maxi~um of 30
residents) . -

The above referenced project is nearing completion. Prior to the
Building Department issuing the Certificate of Occupancy, I would like to
ensure that you do not have any outstanding or pending conditions
concerning this site that must be rectified (excluding issues that are
covered entirely with a city approved surety).
If any outstanding conditions are related to permits issued by the
Building Department, please provide this department a memorandum
containing a description of the unresolved conditions. If the unresolved
conditions are not permit related, please notify the owner or the owner's
agent to ensure that the matters are rectified.
Please respond to Don Johnson, Building Compliance Administrator, within
ten (10) days in order that we may proceed in a timely manner to issue
the Certificate of Occupancy. No response is necessary if your
department is satisfied with the current state of the above referenced
