The Marriott Corporation as petitioner acknowledges the staff comments
to be addressed in order for the project to conform With Boynton Beach City
Codes With the following exceptions:
UTILITIES DEPARTMENT - John Guidry. Director of Utilities 8/2/89 Memorandum:
Request deletion of Condition 2 since to maintain the required 30" cover
over the water mains the crossing must be under the proposed 18" Rep storm
sewer. Crossing over the storm sewer. with 6" clearances leaves only 19"
of cover.
PLANNING DEPARTMENT - Carmen S. Annunziatos Planning Director 8/3/89
Memorandum: Modify Condition 5s second sentence. to substitute "project
title or one (1) main use" for the term "project name" in order that the
terminology of the condition will be consistent with the definition of freestanding

The following is a response to comments made by the vaious
departments of the city of Boynton Beach during the Technical
Review Board meeting of August 1, 1990, and Footprint modifications
due to State Health Code requirements, for the above referenced
project.
BUILDING DEPARTMENT - Med Kopczynski, Deputy Building Official
1. All Arch. plans submitted for public record will be
signed and sealed by Robbie Fusch state of Florida
Registration Number 9969 and Thomas Duncan Registration
Number 35173.
2. Comments # 2,3, & 4 of the 8/1/89 Med Kopczynski's memo
have been addressed in writing on the A-1 drawing.
3. Footprint Changes to meet state Health Code:
a. Community Center Dining expanded to +892 SF.
b. Mech. Room relocated due to expansion at kitchen,
added +278 SF.
c. Nursing Wing expanded to +123 SF.
d. Nursing Wing added storage +296 SF.
e. Nursing Wing widened the corridor, +110 SF.
f. ACLF Wing two stairs adjusted, +12 SF.
Drawing number A-1 covers all the above modifications.
4. Elevation drawing number A-2 has been revised based on
Footprint Changes.

The attached document is a copy of the cross access agreement
submitted by the agent representing the Brighton Gardens ACLF
project. As indicated in the attached Planning Department staff
comments, submittal of this document was required as a condition
of site plan approval. Also attached is a reduced copy of the
site plan to better illustrate where cross access between the
Brighton Gardens parcel and the existing Congress Center project
to the north will occur. Please review the cross access
agreement document, which incidentally has already been recorded,
to determine if cross access between the parcels and joint access
from Congress Avenue has been adequately provided for. Your
comments would be appreciated by June 29, 1990 so that they may
be addressed prior to issuance of a building permit.

Dear Mr. Haag:
The following is a response to comments made by the various departments of the
City of Boynton Beach during the Technical Review Board meeting of August 1,
1989, for the proposed Marriott Brighton Gardens ACLF. I have described what
revisions or corrections have been made to the Site Improvement Plans prepared
by BRW, Inc. for the Marriott Corporation. Marriott will address concerns and
comments on the architectural documents.
I have addressed each of the seven memorandums, wri tten between August 1
through August 4, 1989, as follows:
BUILDING DEPARTMENT - Med Kopczynski, Deputy Building Official
-All plans submitted for public record will be signed and sealed
by Donald W. Ringrose, State of Florida Registration Number
0038499.
ENGINEERING DEPARTMENT - Roger Kuver, Engineering Inspector
-The Paving Plan, C-4, details and locates the F.D.O.T. R-l-l stop
signs, the F.D.O.T. Type V directional arrows, and the 2411 stop
bars.
-Handicap ramps, Detail 30tC-12, and the Depressed Curb, Detail
18/C-12 are included on the Detail sheet, C-12.
-The dumpster pad will be enclosed in a service court behind a
six-foot block screen wall with stucco to match the building, as
shown on Sheet C-6. The alignment of the dumpster has been

revised for a more direct approach. Roger Eichorst of the Public
Works Department indicated that five bollards would be acceptable
to relocate the dumpster after each pick-up. These bollards will
be located such that the inside, face-to-face dimension is 10.00
feet. See the Service Court Plan on sheet C-6.
-The parking lot and facilities were designed and prepared under
the direct supervision of a duly Registered Professional Engineer
under the State of Florida Statutes - Donald W. Ringrose, State
of Florida Registration Number 0038499.
PUBLIC WORKS DEPARTMENT - Robert Eichorst, acting Public Works Dir.
-Refer to dumpster revisions as described above.
UTILITIES DEPARTMENT - John Guidry, Director Of Utilities
-"Lead" on Sheets C-7 and C-8 refers to the length of 6" DIP
between the tee and the gate valve and hydrant. It is not a
material callout.
-The water main has been revised on Sheets C-7, C-8, and C-10 to
cross over the 18" storm sewer, ma i nta i ni ng a cl earance of 6" and
a cover of approximately 30".
PLANNING DEPARTMENT - Canmen Annunziato, Planning Director
-The width of both driveways is 27.00 feet face-to-face, and they
have been dimensioned on C-3. The front building setback is 63.73
feet, and has been dimensioned on C-3.
-The side setback is 26.41 feet, which exceeds the required 10 -
foot side setback requirement. See sheet C-3.
FORESTER - Kevin Hallahan, Forester/Horticulturist
-The median in front of the site in Congress Avenue is concrete.
As per Kevin Hallahan's memorandum dated August 9, 1989, this
will not require landscaping.
-At least 50% of the plantings are native to South Florida. 9 of
17 species are native. See the Plant Schedule on sheet L-2.
-The proposed hedge along Congress Avenue is Wax Myrt 1 e and is 36"
in height. See Landscape Plans, L-1 and L-2.

-The Congress Avenue right-of-way will be sodded and irrigated.
See Landscape and Irrigation Plans, L-1 and L-3.
POLICE DEPARTMENT - Lt. Dale S. Hammack
-The requirement of a fence along the canal has been removed as
per Carmen Annunziato's Agenda Memorandum to George Hunt, dated
August 9, 1989.
-Traffic control devices, including stop signs, stop bars, and
directional arrows have been added to the Paving Plan, C-4.
The "Site Data" information, pages 3 and 4 of the Application, has been
revised and added to the Dimension Plan, Sheet C-3, as you had requested.

1. Provide copy of cross access agreement with property to the
north.
2. Dimension the width of the western driveway (a minimum 20
feet) and the front building setback. Article X, Parking
Lots, Section 5-142(h)1 and Appendix A, Section 11-A~3).
3. The C-1 zoning district building height limitation is 25
feet, not to exceed two stories. Sheet A-2, elevations,
dimensions the building height at 25 feet; however, the
scale is 1 inch equals 16 feet and measures 45 feet in
height. Article II, Section 19-17(i) and Appendix A,
Section 6-A(3).
4. Any roof -mounted mechanical equipment shall be screened.
Appendix A, Section 4N.
5. The following information is needed on the freestanding
sign: sign colors, materials, letter size and style.
Additionally, only the project name is allowed to be
advertised on the freestanding sign. Chapter 21, Section
21-3, Freestanding Sign.
6. Lighting plan falls below the average one footcandle per
square foot, no point less the 1/2 footcandle requirement.,
Article X, Parking Lots, Section 5-142(a).

Response to letter of 8/8/89
In the subject letter, Mr. Shenkman requested deletion of comment no. 2
on our 8/2/89 memo, on the basis that there would be insufficient cover
if the water main crossed over the storm drainage.
Based upon sheet C-10, titled Phase II Storm Sewer Plan and Profile, the
profile view indicates a finished grade of approximately 14.1, and a top
of storm drain of approximately 10.5, leaving a difference of 3.6 feet.
Allowing a separation of 0.5 feet (6 inches) between the storm drain and
the water main, and a nominal outside diameter of 0.58 feet for the
water main, a distance of 2.52 feet from top of water main to finished
grade will remain. This will provide the nominal 30 inches we require.
Therefore, based upon the submitted drawings, we maintain our request as
stated in comment no. 2. If the drawings are in error, or need revision,
please advise.

This memorandum is in reference to the two statements of Mr.
Curtis L. Shenkman (attached), pertaining to the landscaping for
the above project.
1. Mr. Shenkman is correct that the concrete median in front of
the parcel on Congress Avenue would not have to be
landscaped. In reviewing the site plan sheets for
"existing conditions and demolition plans" (C2), I
mistakenly viewed the median labeled grass medians shown as
part of the site. However, this grass median is part of the
adjacent land parcel immediately north of the Brighten
Gardens site.
2. I agree with the recommendation that sprinkler heads be
placed on the project side of the sidewalk along Congress
Avenue.
