Based on the formula for dedication of land in Section 8, Article IX, Appendix C - subdivisions, platting, .252 acres of land are required to be dedicated. Due to the small size of this dedication, it is recommended that a fee, equivalent to the fair market value of the amount of land which is required to be dedicated, be paid in lieu of land dedication. This fee is to be determined by the planning and zoning Board at the time of filing of the preliminary plat. A copy of the purchase contract or an M.A.I. certified appraisal should be submitted to this office prior to review by the Planning and zoning Board so that the appropriate land value can be determined by staff and included in the report to the planning and Zoning Board. Otherwise, the fair market value must be determined by the Planning and zoning Board without a recommendation from staff. If the latter occurs, the subdivider may then contest this value by submitting an appraisal if he feels the value has been set too high. 2. Finizio Administrative Coordinator of Engineering RE: TECHNICAL REVIEW BOARD COMMENTS BUCHANAN ESTATES PRELIMINARY PLAT SUBMISSION In accordance with the City of Boynton Beach Code of Ordinances,' Appendix "C", Subdivision and Platting Regulations inclusive, the applicant for the above referenced project shall submit the following information, technical data and plan revisions. l. Place the following notes on the associated construction plans; a) Contractor to obtain"Construct within Public Rights-of-Wayllpermits from the Engineering Department prior to commencement of construction. b) Contractor to employ traffic control devices in accordance with the Manual on Uniform Traffic Control Devices and current D.O.T. standards in order to provide a safe work zone. c) All roadway excavations shall be backfilled at the end of each working day and brought to grade with shellrock or limerock and temporarily patched with asphaltic concrete. d) All swales shall be redeveloped in accordance with minimum City standards and be fully sodded. 2. Provide a current survey. The Engineering Department for the City of Boynton Beach reserves the right to provide the applicant with additional comments after review of the submitted survey. The survey shall be a current survey updated within the past six months. 3. Provide an approved Florida Power & Light street lighting plan. Appendix "C", Article VIII, Section 5Bld, Street Lighting. 4. Provide a certified Engineer's Opinion of Cost for all required subdivision improvements. Appendix "C", Article VIII, Section 5B4, Certified Cost Estimate. 5. The applicant shall overlay all ajoining public rights-of-ways in order to bring subject roadways up to minimum City standards for asphalt thickness, in order to provide a uniform wearing course after completion of the numerous roadway open cuts associated with sewerage collection and water distribution construction. 6. Provide a streetscape plan for the ajoining public rights-of-ways in accordance with Appendix "C", Subdivision and Platting, Article VIII, Section 5Bld, Landscaping within Public Rights-of-Ways. Scott Miller, city Manager ~ Richard Staudinger, city Enginfl(lcY One Year Extension Preliminary Plat - Buchanan Estates TO: RE: The owner of the property in the referenced plat has requested a one year extension for the approval of the Buchanan Estates Preliminary Plat. The original plat was approved on February 19, 1991 by the city commission. Appendix C, Article VIII, section 6 requires an application for final plat approval be filed within one year of the date of preliminary plat approval unless a time extension is granted. I have reviewed the file and find nothing unusual with extneding this plat approval. Due to economic times, many landowners are delaying projects and requesting time extensions for preliminary plat approvals in Boynton Beach. I recommend the city commission grant a one year extension for the Buchanan Estates preliminary Plat Approval. The applicant's letter requesting an extension is attached.
