Please forward, to my attention, a list of all conditions imposed by
City Boards relative to the above referenced site.
As you are aware, I was not in attendence at these meetings and I
would benefit greatly by knowing what asphalt areas need to be
removed, etc. so that I may incorporate that work into the red tag
Notice of Violations that are currently being prepared by this office.
Your prompt attention in this matter would facilitate an expeditious
reply from this office to the City Manager.

RE: Landscape Appeal for Captain Frank's Seafood
Richard Parsons, the owner of Captain Frank's Seafood, is
requesting the waiver of a landscaping island at his site located
at 435 W. Boynton Beach Boulevard.
The request is an appeal of an administrative decision to require
a landscape island to be installed.
In early 1991, Mr. Parsons submitted a minor site plan
modification for the existing structure on site. A building
permit was granted after the plans were corrected to meet code.
Since that time the parking lot has been installed and Mr.
Parsons has not installed the island and the parking lot has not
been finaled.
Attached is a letter from Ronald Uphoff citing the need for a 10
foot visibility triangle for the driveway. However, this need can
be met and the landscaping can still be installed and kept
trimmed so the sight triangle is not interfered with.
We see no reason to allow for the elimination of the landscaping
amenity and would ask that the Board deny this appeal.

Capt. Frank's Seafood Parking Lot Improvements
Dear Mr. Parsons:
There is not adequ.3te space for plant(~rs at the west
driveway (curb cut) onto Boynton Beach Blvd. There
should be a minimum 10' line of site triangle each side
of drive access dU8 to pedestrian an~ auto traffic.
Also, it would impeed the proper use )f exisiting
handicapped parking space. This unit is in compliance
with State Handicapped new and existing Code for Space
and Access.
In my opinion there is adequate lands~ape existing to
the east of the sign and around the building. Also,
new and existing vegitation is provided to the west and
north property lines.

Capt. Frank's Seafood Landscaping Appeal

Richard Parsons, the owner of Capt. Frank's Seafood, is appealing
the requirement for two terminal islands for his parking lot
located to the west of his business located at 435 W. Boynton
Beach Boulevard.
Backaround
This property has a long history that dates back to mid 1990. It
seems that in August or September of that year, Mr. Parsons
appeared before the City Commission to plead his case regarding
the expansion of his business which at the time was
nonconforming. After this, a number of meetings were held with
different staff members and finally, in December of 1990, a site
plan was submitted that could be reviewed by staff (see Exhibit
1 ) .
Staff responded with a list of comments so that the plans could
be rectified (see attached letter 12/28/90 from Christopher
Cutro.) It was at this point that the applicant began
disagreeing with staff about what had to be done, started the
construction of the parking lot without an approved plan, claimed
that the sign-off on the parking lot was also an approval of the
building expansion (see attached letters).
Finally, Mr. Parsons carne in and rectified his plan (see
exhibit 2) and proceeded to build the parking lot and then the
expansion to the building. However, when inspections were called
for, it was discovered that the parking lot had not been built
according to the plan.
Analvsis and recommendation:
The attached letter from Mr. Uphoff indicated that reasons for
deleting the islands are:
1) the site triangle for the street will be affected by the
landscaping and;
2) the handicap space becomes nonfunctional.
The site triangle is only effective on the right side of the
driveway and while a hedge and trees are required in the island,
the tree can be trimmed up and the shrubs trimmed down so that
pedestrians can be seen.
The handicap space only becomes nonfunctional because the
applicant insists on maintaining a one-way drive in front of the
building. There is 26.38 feet between the front property line
and the front of the structure (see Exhibit 3). Even allowing
for the 5.5 foot sidewalk in front of the structure a handicap
space at 17 feet and an island of 3.88 feet could be installed.

It is evident by now that we are opposed to this request. Staff
feels that the islands should be installed as provided on the
plan and landscaped.
This request was reviewed by the Planning and Development Board
at its meeting of September 8, 1992 and forwarded to the City
Commission with a recommendation for denial.
One last point, in an attempt to be responsive to Mr. Parsons'
request, we allowed this item to proceed prior to the payment of
the $35.00 landscape appeal fee. If Mr. Parsons has not paid
this fee by the time of the City Commission meeting, staff will
ask that the item be tabled until the fee is paid.
