Dear Mr. Annunziato:
On behalf of the W.O. Brisben Companies, Inc., please accept the enclosed
package as the Master Plan Submittal for the Casa Blanca Apartments of Boynton
Beach, formerly referred to as the Boynton Beach Apartments Project. The
Master Plan drawing and associated information and documentation have been
prepared in accordance with the City's Subdivision and Platting Regulations
and with previous staff comments received at pre-application.
A summary of the submittal as outlined in Section 4, Master Plan;
Subdivision and Platting Regulations follows:
A. Seven (7) copies of the Master Plan are enclosed for placement on the
June 7, 1988 Technical Review Board Agenda.
B. In addition to the Engineer and Surveyor as noted on the cover sheet
of the plans, the owner has selected Womack-Humphreys with local offices
in Boca Raton, as architect for the project.
C. Items 1-19 are as noted on the enclosed Master Plan Drawings.
D. The project does not trip either threshold requiring the preparation
of a traffic impact analysis. Please refer to the attached calculations,
Exhibit 1.
E. The master stormwater management plan comprised of the engineering
drawings (Master Plan), written report and preliminary calculations
are submitted for your review and approval, please see Exhibit 2.
F. Enclosed, please find a check in the amount of $400.00 for administering
and processing of the Master Plan.
Following is a brief response to staff comments received at the
pre-application level, as provided in your May 4, 1988 letter.
1. The boardwalk and dock facilities shown on property owned by others
has been deleted.

time of site plan approval, with consideration given to both the
residents of the subject project, as well as the single family residences
lying north of the adjacent canal.
7. Ultimate rights of way for both Boynton Beach Boulevard (SR 804) and
Old Boynton Road are reflected on the accompanying plans.
8. The project has been given the name of CASA BLANCA APARTMENTS OF BOYNTON
BEACH.
9. Copies of two (2) surveys by O'Brien, Suiter & O'Brien are enclosed
for your consideration. The primary survey is dated May 13, 1988.
The other survey which was recertified on March 3, 1987, currently
being recertified once again and will be submitted at the time of site
plan approval.
Also in response to the pre-application comments by Kevin J. Hallahan,
please note that the area of Willows and Pond Apples adjacent to the E-4
canal are designated to remain. The need to avoid placement of structures
and fill in this area is acknowledged. We will seek direction from Mr.
Hallahan as to proper methods of protecting trees prior to clearing and
grubbing.

The approval of the City entitles you to construct only the

agrees that it shall not require DEVELOPER to post a bond for completion of

Enclosed herewith please find a copy of a memorandum dated October 10, 1990
from James A. Cherof, City Attorney, reference the Case Blanca Development
and the installation of street lighting along Boynton Beach Boulevard.
This letter is in response to your letter dated September 19, 1990, in
which you state that you do not feel Brisben Companies should be required
to install the street lighting along Boynton Beach Boulevard.
It is Mr. Cherof's determination and conclusion that since the Casa Blanca
project is not covered under the City'S subdivision requirements, a~ that
there are no pertinent City code provisions concerning street light'~g
placing the responsibility on the developer, it is not your obligation to
install street lighting along Boynton Beach Boulevard. All appropriate
departments will be notified of this legal determination of the City

division of the property and therefore, platting is not required

would be the appropriate party to make a determination and to

its development plans on the basis that it will not be required
to plat. Therefore, in order to provide an appropriate comfort

in this regard.

THIS AGREEMENT entered into this
day. of
1989, by and between CITY OF BOYNTON BEACH, a Municipal Subdivision of
the State of Florida. ("CITY"), and CASABLANCA BOYNTON PARTNERSHIP.
LTD.. a Florida Limited Partnership ("DEVELOPER").
WI T N ESSE T H:
WHEREAS. DEVELOPER is the contract purchaser of that certain property
described in Exhibit "A" attached hereto and made a part hereof, located within
the City of Boynton Beach (the "Property"); and
WHEREAS. DEVELOPER has submitted plans to CITY for development of a

WHEREAS. CITY has reviewed all of the plans and specifications for the

Project submitted by DEVELOPER. and has determined that same are in
accordance with all applicable City ordinances. codes. and building code
requirements; and
WHEREAS. CITY has indicated that it shall approve DEVELOPER's plans
and specifications upon the execution of this Agreement memorializing certain
agreements between the parties; and
WHEREAS, ~EVELOPER recognizes that it is its obligation, in order to
develop the Project, to pay certain recreational impact fees as set forth more
completely below; and
WHEREAS. C~TY acknowledges that DEVELOPER is not required to plat the
Property in order to develop same or construct the Project; and
WHEREAS. DEVELOPER acknowledges that it is its obligation in order to
develop the Project to post a bond with CITY in order to ensure th~ completion
of certai@ite improvements set forth more completely below; and
WHEREAS, CITY has expressed concern with regard to the commencement,
installation and completion of the on site infrastructure improvements necessary
for development of the Project; and

wherein you request that this City confirm in writing that
your client is not required to plat in order to develop the

To conduct a TEFRA hearing concerning the issuance of bonds
by the Agency to finance the acquisition, rehabilitation, and/or
construction of the fOllowing residential rental projects:
Casablanca Apartments, Ltd., approximately 18 acres on the
north side of Boynton Beach Boulevard, east of Lake Worth
Drainage District Canal E-4, west of SW 8th Street and southwest
of Old Boynton Road, Boynton Beach, Florida. The sponsor of this
project is Casablanca Apartments, Ltd., 1451 West Cypress Creek
Road, Suite 300, Fort Lauderdale, Florida 33309, or such
successor in interest in which Casablanca Apartments, Ltd. is a
managing, general partner and/or controlling stockholder. The
aggregate face amount of bonds issued for this project will not
exceed $16,100,000.
Cypress Run, east side of Park Avenue, approximately 1,200
feet north of 45th Street, West Palm Beach, Florida. The sponsor
of this project is Cypress Run Associates, Ltd., CDC Equity
Corporation, c/o CDC Financial corporation, 17 Talcott Notch
Road, Farmington, Connecticut 06032, or such successor in
interest in which Cypress Run Associates, Ltd., is a managing,
general partner and/or controlling stockholder. The aggregate
face amount of bonds issued for this project will not exceed
$11,155,000.
All interested parties are invited to submit written
comments and/or present oral comments at the public hearing
regarding the bond issuance of the projects being financed.

December 16, 1988. Any persons desiring to present oral comments

should appear at the hearing.
A fact-finding hearing will be held in the cOllnty where the
proposed projects are located only if requested in writing. Local
hearings will be held before the formal TEFRA hearing, where
possible, and comments received at the local hearing will be
placed on the record at the TEFRA Hearing.
If any person decides to appeal any decision made by the
Agency with respect to any matter considered at this hearing, he
will need a record of the proceedings, and for such purpose he
may need to ensure that a verbatim record of the proceedings be
made, which record includes the testimony and evidence upon which
the appeal is to be based.

As requested, I have reviewed the Development Agreement proposed in
connection with the construction of the Casa Blanca rental project.
In this regard, I offer for your consideration the following
comments and recommendations.
1. The unit count is wrong. The correct count is 203.
2. Rights-of-way dedications are required for Old Boynton
Road, Boynton Beach Boulevard, and the L.W.D.D. E-4
Canal.
3. The applicants have previously agreed to not accept the
money placed in the registry of the Courts for the taking
of Old Boynton Road. This should be documented in the
agreement.
4. The Recreation and Parks Dedication fee shown is correct.
5. All utility constructing, whether on-site or off-site
should be bonded and an administration fee paid to the
City.
6. As the applicants have received! credit against required
recreation and parks dedication criteria, the on-site
recreational improvements must be bonded as required
improvements.

In our recent meeting with you and Carmen Annunziato, Andy
Carlino, Jeff Boone, Randy stevenson and myself we discussed
the Parks and Recreation fee situation for ou~ proposed
project on Boynton Beach Blvd. and the Old Boynton Rd.
intersection. I would like at this time to readdress this
situation, insofar as we are pretty well along the road on
this project and need to come to a decision and agreement
regarding the project.
Firstly, our survey & title inspection indicated that we have
~ore land than we thought. We have re-filed our master plan
to indicate 18.91 acres of land with an allowable density of
204.228 dwelling units. We are thus seeking a master plan
approval of 204 units. This will consist of 72 one bedroom
units and 132 two bedroom units.
Subsequent to our last meeting, I was thinking over our
conversation ~nd reviewing our project costs when it dawned
on me that.I had made a serious mistake in determining our
cost basis in the land. We are purchasing our property
j ncl uding impact fees and' thus I gross 1 y overstated our
2ctual land cost, We were computing our park fee on top of
the fees including your fee. In effect, we were computing
park fees based on our sewer, water, road and park fees, in
effect double dipping ourselves, Sewer water and county road
impact fees will amount to $330,648. For purposes of this
discussion, let us use a park fee of $500 per unit, inasmuch
as that seems to be a common amount that has been recently
paid. This would come to $102,000. We must then deduct
these fees from our purchase price of $2,189,000 to determine
our land cost. Our real land cost is thus $1,756,352. This
is a rough figure, but a decent approximation.

On behalf of the W.O. Brisben Companies, Inc., please accept the enclosed
package as the Master Plan Submittal for the Casa Blanca Apartments of Boynton
Beach, formerly referred to as the Boynton Beach Apartments Project. As
you know, based on our discussions with you and your staff, the Master Plan
is being resubmitted as a result of modifications to the plan and the addition
of five (5) dwelling units resulting from the discovery of additional acreage
in the most recent title search. The Master Plan drawing and associated
information and documentation have been prepared in accordance with the
City's Subdivision and Platting Regulations and with previous staff comments
received at pre-application.
A summary of the submittal as outlined in Section 4, Master Plan;
Subdivision and Platting Regulations follows:
A. Seven (7) copies of the Master Plan are enclosed for placement on the
July 25, 1988 Technical Review Board Agenda.
B. In addition to the Engineer and Surveyor as noted on the cover sheet
of the plans, the owner has selected Womack-Humphreys with local offices
in Boca Raton, as architect for the project.
C. Items 1-19 are as noted on the enclosed Master Plan Drawings.
D. The project does not trip either threshold requiring the preparation
of a traffic impact analysis. Please refer to the attached calculations,
Exhi bi t 1.
E. The master stormwater management plan comprised of the engineering
drawings (Master Plan), written report and preliminary calculations
are submitted for your review and approval, please see Exhibit 2.
F. Enclosed, please find a check in the amount of $400.00 for administering
and processing of the Master Plan.
