You have now missed the December 9th deadline for this
month's Community Appearance Board meeting on December 19.
It is now imperative that you comply with this request in
order for your project to proceed on a timely basis. The
next deadline will be on January 4, 1989, by 4:30 p.m.
If I can be of further assistance, please advise.

Dear Jim:
As per our conversation this morning I am enclosing a revised
copy of Sheet A-2.01 for the Casablanca Apartments at 815 W.
Boynton Beach Boulevard. This sheet shows the change to the
Electric Meter Boxes whereby Florida Power and light required
the combining of the two meter boxes per building into one
slightly larger meter box. As per our conversation this
morning regarding the City Commission's policy, I have not
included any of the minor exterior elevation changes which
you felt were not a part of your area of concern.
This change will result in a net increase of 13.9 sq. ft. on
the largest building and this increase represents a total
slab increase of two tenths of one percent (.2%).
As you know, upon reviewing the city code, we feel that the
filing is not necessary because of the amount of the change.
We feel that chapter 19's quidelines preclude the necessity
of going before the TRB & P&Z. This application is being
filed at the insistence of the Building Department and thus
we are filing under protest. We will expect a full refund of
all fees and any damages sustained, if it is subsequently
determined that this peti ion was not necessary.

Dear Mr. Miller:
I would like to take this opportunity to thank you for your time
yesterday afternoon and also to reiterate my thinking on the
street lighting situation along Boynton Beach Boulevard.
We do not feel obligated at this time to provide street lighting
along Boynton Beach Bou1evard for the following reasons:
1} Boynton Beach Boulevard is a state right of way. I
talked with Mr. Bernard Freeman of DOT. He explained
that street lighting along a DOT right of way is required
only when a "Justification Report" for the proposed
lighting has been requested by the municipality or county
involved and issued by DOT. In this case, it has been
neither requested nor issued. If the report is issued,
then DOT installs the lighting at their expense. I
checked with the county and they said that they would not
request this within a municipality.
2) I checked the city of Boynton Beach code and could only
find reference to street lighting under Article 9,
Section 14 and Appendix "c" Article 10 Section 11. In
neither instance are references made to the installation
of lighting on State of Florida rights of way. Appendix
"c" covers subdivisions and Platting. As you know, it
has been determined several times over, the past 2 1/2
years that we are not subject to that ordinance. Section
14 merely states that "Street lighting may be installed".
It in no way assumes or intends to dictate that it will
be installed along public rights of way at developer's
expense.

very outset. We argued against it in the case of Park
Fees, Platting, Bonding on Site utilities and at other
times. Although Raymond Ray agreed that we were not
under this ordinance, Carmen Annunziato elected to ignore
his advice and forced us to adhere to the ordinance. At
one point he stopped our TRB approvals for five months,
at great expense to us, because we did not want to pay
the $152,000 park fee. We were proven right in that and
all other cases. In effect the city staff held a gun to
our heads in these matters. We feel that the street
lighting obligation was pressed upon us under the exact
same duress as the other items and thus feel under no
obligation to adhere to conditions laid down by the city
staff under such duress. Further evidence of the city
staff's high handedness in this matter can be seen on the
plan laid out by FPL. In Mr. A.G. Russill's letter of
December 14, 1988 to Mr. Jeffrey Boone, our then
engineer, Post Buckley Scheek and Jernigan, he outlined
the system and an estimated cost of construction of
$22,183.00. The layout was never sent to us to review.
When Mr. Finizio first contacted me about the street
lighting, he showed me the layout and it included
installing lights along the opposite side of SR 804 along
the front of Leisureville. Apparently someone (a former
mayor who live there?) decided we should also provide
lighting for Leisureville~ side of the street! No wonder
they never sent us the lighting plan.
When I invited Mr. Finizio's attention to this extra
lighting requirement, he was genuinely taken aback and
after consultation with you, I believe, agreed to delete
those lights from our bill.
Scott, the fact remains, that I cannot find any justification to
require us to install street lighting along a State right-of-way
which we do not own and which is not dictated by any code. I
feel that the old administration, as was its policy, was trying
to stick it to us again. We must therefore respectfully decline
,to install the requested street lighting. If you feel it is a
safety issue, I suggest you discuss it with DOT. It is their
responsibility.

The Community Appearance Board met on Thursday, February 15,
1'990, and took the following action:
NEW BUSINESS
1. SITE PLAN
a. Target Shopping Center - The Board unanimously
recommended approval, 7-0, to allow construction of a
140,000 square foot shopping center, including a junior
department store and three outparcels, subject to' staff
comments with the following stipulations:

i. In addition, a minimum of sixteen (16) landscaped
islands, with trees, are to go into the main
parking lot directly in front of Target.
ii. The entrance into the Target Shopping Center will
have decorative stampcrete floor surface material,
similar to the entrance to Service Merchandise.
iii. The visual barrier to screen outside storage in the
garden area will be decorative metal other than
chain link fencing.
iv. Enlarge the landscape strip directly behind the
Target store to eight feet (8') wide.
b. Quantum Office Park - The Board unanimously recommended
approval, 7-0, to allow construction of a 50,978 square
foot office complex consisting of two buildings, subject
to staff comments.
2. SITE PLAN MODIFICATION
a. Casa Blanca Apartments of Boynton Beach - The Board
unanimously recommended approval to allow for changes in
building layout and design, subject to staff comments
with the following stipulations associated with the
attached letter:
i. All of the proposed changes were recommended for
approval, except that #1 was rejected.

ii. Request #4 was deleted from the list by the
applicant. The curved arches will remain as
shown on the original plan.
c. Airco Industrial Gasses Tank Farm - The Board
unanimously recommended approval, 7-0, to allow for the
addition of a tank farm to the Motorola project, subject
to staff comments.
3. SIGN APPROVAL
a. Two (2) City of Boynton Beach Welcome Signs - The Board
unanimously recommended approval, 7-0, to allow for the
placement of "Welcome to Boynton Beach" signs at South
Federal Highway at the City limits and West Boynton
Beach Boulevard at the City limits (in the medians).

RE: CASA BLANCA - CHANGE IN FOOTPRINT AND EXTERIOR ELEVATIONS
Upon review of the above mentioned project, the following
comments must be addressed in order to conform with Boynton Beach
City Codes:
1. Proposed modification creates an exterior design change
which requires Community Appearance Board (CAB) review and
recommendation to the City Commission for their approval.
Apply for CAB review.
2. All plans submitted for public record and prepared by a
design professional shall show original raised seal
(legible) and signature of the Florida registered design
professional responsible for the drawings.
3. Provide revised landscape plans for the foundation
landscaping around multifamily buildings where meter room
change occurred.
