Dear Brenda,
As per our telephone conversation on Monday, April 10, 1989 the
following is National Property's plan to maintain the pollution
abatement boxes to be installed on our site.
The pollution abatement boxes will be inspected on a monthly
basis by our maintenance people. Upon the inspection, if found
that there is grease, floatables or solids in the box, they
will be pumped out at that time.

(f) Drainage
Storm water shall be contained on
site. Containment capacity shall be
designated for a minimum of two and
one-half (2.5) inches of rainfall in
one (1) hour. Drainage structures and
Fren~h drains shall comply with mini-
mum city standards established by the
city engineer. For impervious areas
exceeding twenty-five thousand
(25,000) square feet, the design of
the parking lot and facilities shall
be done by an engineer registered in
the State of Florida, and the plans
submitted shall be sealed. Maximum
storage capacity of soil shall be con-
sidered at the rate of one (1) inch of
water for each six (6) inches of soil
above the water table. Drainage
calculations are required in all
instanc~s. The hydraulic conductivity
of soil shall be determined with tests
made at the site using test procedures
recommended by the South Florida Water
Management District or other proce-
dures which have been approved by the
city engineer.
All interested parties are notified to appear at said
hearing in person or by attorney and be heard. Any person
who decides to appeal any decision of the Planning & Zoning
Board with respect to any matter considered at this meeting
will need a record of the proceedings and for such purpose
may need to ensure that a verbatim record of the proceedings
is made, which record includes the testimony and evidence
upon which the appeal is to be based.

LIMITING CONDITIONS
1. THE PERMITTEE SHALL' PROSECUTE THE WORK AUTHORIZED IN A MANNER SO AS TO
MINIMIZE ANY ADVER$E IMPACT OF THE WORKS ON FISH, WILDLIFE, NATURAL
ENVIRONMENTAL VALUES, AND WATER QUALITY. THE PERMITTEE SHALL INSTITUTE
NECESSARY MEASURES DURING THE CONSTRUCTION PERIOD, INCLUDING FULL
COMPACTION OF ANY FILL MATERIAL PLACED AROUND NEWLY INSTALLED STRUCTURES,
TO REDUCE EROSION, TURBIDITY, NUTRIENT LOADING AND SEDIMENTATION IN THE
RECE IVING WATERS. '
2. WATER QUALITY DATA FOR THE WATER DISCHARGED FROM THE PERMITTEE'S PROPERTY
SHALL BE SUBMITTED TO THE DISTRICT AS REQUIRED. PARAMETERS TO BE MONITORED
INCLUDE: TOTAL SUSPENDED SOLIDS, NITRATES AS N, NITRITES AS N, TOTAL
KJELDAHl NITROGEN'AS N, AMMONIA AS N, TOTAL PHOSPHORUS AS P, ORTHO-
PHOSPHORUS AS P, 5 DAY 200C BOD, TURBIDITY, SPECIFIC CONDUCTIVITY, DISSOLVED
OXYGEN AND pH. IF WATER QUALITY DATA ARE REQUIRED, THE PERMITTEE SHALL
PROVIDE DATA ON VOLUMES OF WATER DISCHARGED, INCLUDING TOTAL VOLUME
DISCHARGED DURING THE DAYS OF SAMPLING AND TOTAL MONTHLY DISCHARGES FROM
THE PROPERTY.
3. THE PERMITTEE SHALL COMPLY WITH ALL APPLICABLE LOCAL SUBDIVISION REGULATIONS
AND OTHER LOCAL REQUIREMENTS. IN ADDITION THE PERMITTEE SHALL OBTAIN ALL
NECESSARY FEDERAL, STATE, LOCAL AND SPECIAL DISTRICT AUTHORIZATIONS PRIOR TO
THE START OF ANY CONSTRUCTION OR ALTERATION OF WORKS AUTHORIZED BY THIS PERMIT.
4. THE OPERATION PHASE OF THIS' PERMIT SHALL NOT BECOME EFFECTIVE UNTIL A
FLORIDA REGISTERED PROFESSIONAL ENGINEER CERTIFIES THAT ALL FACILITIES
HAVE BEEN CONSTRUCTED IN ACCORDANCE WITH THE DESIGN APPROVED BY THE DISTRICT.
UPON COMPLETION OF CONSTRUCTION OF THE DRAINAGE SYSTEM, THE DISTRICT SHALL
BE NOTIFIED FOR AN INSPECTION AND APPROVAL OF THE FACILITIES.
5. ALL ROADS SHALL ~E SET AT OR ABOVE ELEVATIONS REQUIRED BY THE APPLICABLE
LOCAL GOVERNMENT FLOOD CRITERIA.
6. ALL BUILDING FLOORS SHALL BE SET AT OR ABOVE ELEVATIONS ACCEPTABLE TO THE
APPLICABLE LOCAL GOVERNMENT.
7. WATER DISCHARGED FROM THE PROJECT SHALL BE THROUGH STRUCTURES HAVING A
MECHANISM SUITABLE' FOR REGULATING UPSTREAM WATER STAGES. STAGES MAY BE
SUBJECT TO OPERATING SCHEDULES SATISFACTORY TO THE DISTRICT.
a. NO CONSTRUCTION AUTHORIZED HEREIN SHALL CO~~ENCE UNTIL A RESPONSIBLE ENTITY
ACCEPTABLE TO THE DISTRICT HAS BEEN ESTABLISHED AND HAS AGREED TO OPERATE
AND MAINTAIN THE SYSTEM. THE ENTITY MUST BE PROVIDED WITH SUFFICIENT
OWNERSHIP SO THAT IT HAS CONTROL OVER ALL WATER MANAGEMENT FACILITIES
AUTHORIZED HEREIN. UPON RECEIPT OF WRITTEN EVIDENCE OF THE SATISFACTION
OF THIS CONDITION, THE DISTRICT WILL ISSUE AN AUTHORIZATION TO COMMENCE
CONSTRUCTION.
9. THE PERMIT DOES NOT CONVEY TO THE PERMITTEE ANY PROPERTY RIGHT NOR ANY RIGHTS
OR PRIVILEGES OTHER THAN THOSE SPECIFIED IN THE PERMIT AND CHAPTER 40E-4.
10. THE PERMITTEE SHALL HOLD AND SAVE THE DISTRICT HARMLESS FROM ANY AND ALL
DA~1AGES, CLAIMS, OR LIABILITIES WHICH ~1AY ARISE BY REASON OF THE CONSTRUCTION,
OPERATION, MAINTENANCE OR USE OF ANY FACILITY AUTHORIZED BY THE PERMIT.

Parking Lot Variance (Drainage)
Section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward the Planning and Zoning
Board a recommendation, and that the recommendation forwarded is
to ~e made a part of the public hearing proceedings. To that
end, this memo is forwarded, consistent with 5-145(c)(4).
Michael Timmons, agent for E & H Properties, Inc., has requested
a variance to Section 5-142(f) IIDrainage" of the Parking Lot
Regulations, which requires that stormwater be retained on-site
at a capacity of not less than two and one-half inches of
rainfall in one hour. In this instance, the applicant is
requesting that the existing stormwater discharge into the
Intracoastal Waterway be allowed to continue. The shopping
center in question is located at the southeast corner of South
Federal Highway and Woolbright Road. For an explanation of the
code requirement, the nature of the variance requested and the
variance justification, please refer to the attached Notice of
Public Hearing and application.
On Tuesday, December 6, 1988 the Technical Review Board (TRB) met
to review the plans and documents submitted and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended approval of the
variance request subject to the following:
1) Construction of the pollution control devices proposed by the
project engineer at the two storm water outfalls into the
Intracoastal Waterway.
2) Submittal of a management plan for maintenance of the
pollution control devices to the City Engineering Department.
The above recommendation was made based on the TRB finding that
to repave the entire site and install new drainage facilities
would create an unreasonable hardship for the applicant.

An objection was raised by Mr. Ron Tumoszwicz representing Westwoods PUD Homeowners
Association, indicating that a report prepared by Rossi and Malavasi Engineers, Inc.
(Feb. 1977) recommended a polishing pond with baffles be placed on the conmercial
site to improve the quality of the runoff prior to discharging into 18.3 acre residential
lake. The developer agreed to incorporate the recommendation, satisfying the objector.
In the southeast corner of the commercial parcel there will be 0.6 acre lake (polishing
pond) with 1-10' crest at elevation 15.5\ NGVD and 55 LF of 7211 diameter RCP culvert to
discharge into the 18.3 acre residential lake in Westwoods PUD.
The original permit specified that the minimum floor and road elevations would be
19.5' NGVD and 17.5' NGVD. respectively. Floor elevations are as pre.ivusly a~~ru~eJ.

LIMITING CONDITIONS
1. THE PERMITTEE SHALL PROSECUTE THE WORK AUTHORIZED IN A MANNER SO AS TO
MINIMIZE ANY ADVERSE IMPACT OF THE WORKS ON FISH, WILDLIFE, NATURAL
ENVIRONMENTAL VALUES, AND WATER QUALITY. THE PERMITTEE SHALL INSTITUTE
NECESSARY MEASURES DURING THE CONSTRUCTION PERIOD, INCLUDING FULL
COMPACTION OF ANY FILL MATERIAL PLACED AROUND NEWLY INSTALLED STRUCTURES,
TO REDUCE EROSION, TURBIDITY, NUTRIENT LOADING AND SEDIMENTATION IN THE
RECEIVING WATERS. .
2. WATER QUALITY DATA FOR THE WATER DISCHARGED FROM THE PERMITTEE'S PROPERTY
SHALL BE SUBMITTED TO THE DISTRICT AS REQUIRED. PARAMETERS TO BE MONITORED
INCLUDE: TOTAL SUSPENDED SOLIDS, NITRATES AS N, NITRITES AS N, TOTAL
KJELDAHL NITROGEN" AS N, AMMONIA AS N, TOTAL PHOSPHORUS AS P, ORTHO-
PHOSPHORUS AS P, 5 DAY 200C BOD, TURBIDITY, SPECIFIC CONDUCTIVITY, DISSOLVED
OXYGEN AND pH. IF WATER QUALITY DATA ARE REQUIRED, THE PERMITTEE SHALL
PROVIDE DATA ON VOLUMES OF WATER DISCHARGED, INCLUDING TOTAL VOLUME
DISCHARGED DURING THE DAYS OF SAMPLING AND TOTAL MONTHLY DISCHARGES FROM
THE PROPERTY.
3. THE PERMITTEE SHALL COMPLY WITH ALL APPLICABLE LOCAL SUBDIVISION REGULATIONS
AND OTHER LOCAL REQUIREMENTS. IN ADDITION THE PERMITTEE SHALL OBTAIN ALL
NECESSARY FEDERAL, STATE, LOCAL AND SPECIAL DISTRICT AUTHORIZATIONS PRIOR TO
THE START OF ANY CONSTRUCTION OR ALTERATION OF WORKS AUTHORIZED BY THIS PERMIT.
4. THE OPERATION PHASE OF THIS. PERMIT SHALL NOT BECOME EFFECTIVE UNTIL A
FLORIDA REGISTERED PROFESSIONAL ENGINEER CERTIFIES THAT ALL FACILITIES
HAVE BEEN CONSTRUCTED IN ACCORDANCE WITH THE DESIGN APPROVED BY THE DISTRICT.
UPON COMPLETION OF CONSTRUCTION OF THE DRAINAGE SYSTEM, THE DISTRICT SHALL
BE NOTIFIED FOR AN INSPECTION AND APPROVAL OF THE FACILITIES.
5. ALL ROADS SHALL 6E SET AT OR ABOVE ELEVATIONS REQUIRED BY THE APPLICABLE
LOCAL GOVERNMENT FLOOD CRITERIA. :
6. ALL BUILDING FLOORS SHALL BE SET AT OR ABOVE ELEVATIONS ACCEPTABLE TO THE
APPLICABLE LOCAL GOVERNMENT.
7. WATER DISCHARGED FROM THE PROJECT SHALL BE THROUGH STRUCTURES HAVING A
MECHANISM SUITABLE' FOR REGULATING UPSTREAM WATER STAGES. STAGES MAY BE
SUBJECT TO OPERATING SCHEDULES SATISFACTORY TO THE DISTRICT.
8. NO CONSTRUCTION AUTHORIZED HEREIN SHALL CO~1MENCE UNTIL A RESPONSIBLE ENTITY
ACCEPTABLE TO THE DISTRICT HAS BEEN ESTABLISHED AND HAS AGREED TO OPERATE
AND MAINTAIN THE SYSTEM. THE ENTITY MUST BE PROVIDED WITH SUFFICIENT
OWNERSHIP SO THAT IT HAS CONTROL OVER ALL WATER MANAGEMENT FACILITIES
AUTHORIZED HEREIN. UPON RECEIPT OF WRITTEN EVIDENCE OF THE SATISFACTION
OF THIS CONDITION, THE DISTRICT WILL ISSUE AN AUTHORIZATION TO COMMENCE

9. THE PERMIT DOES NOT CONVEY TO THE PERMITTEE ANY PROPERTY RIGHT NOR ANY RIGHTS

Accompanying this memorandum, you will find documents related to
a request for a variance to the Parking Lot Regulations (Section
5-142.f). Also enclosed is a check for $50.00 to cover the
review and processing of this application.
Please advertise both requests for a public hearing before the
Planning and Zoning Board at the December 13, 1988 meeting.
Please note that the "statement of special conditions" referenced
on page 3 of the application has not yet been submitted to the
Planning Department and will be forwarded to your office upon
receipt.
