The undersigned hereby petitions the Planning and Zoning Board to
grant to the petitioner a variance to Article X "Parking Lots",
of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Section 5-142 (h) (3) - No parking lot driveway may be constructed closer
than thirty (30) feet fran the intersection of the right-of-way lines
along local streets and one hundred eighty (180) feet along streets of a
higher classification as shown on the city or county thoroughfare plans.

PUrchaser shall obtain, a~ its sole cost and expense, a preliminary
title report (the ttTitle Report"), which Title Report sh"ll set
forth the state of title to the property and shall be ~QoompanieQ
by copies of all recorded documents relating to any exceptions or
conditions to such title.
In the event any matters contained within the Title Report are
unacceptable to Purchaser t.hen Purohaser shall notify Seller of the
sge and Seller shall forthwit.h eliminate or mOclify all such
unacceptable matters to the reasonable satisfaction of Purchaser.
In the evant Seller is unable or unwilling to do so ~ithin fifteen

Survey
3.03 Within sixty (GO) days af~.r the E~f8ctive Date hereor,
Purohaser shall obtain a current boundary line and topographical
survey of the Property, prepaFed by a duly licensed land surveyor
acceptable to PuX'chaser. The survey shall show the location of all
improve~ent5, highways, streets, roads, railroads, riversj creeks,
ar other water courses, fences', powerline., easements, sorvi tUde,
and rights-of-way on or adjacent to the Property it any, And shall
contain the surveyor' s certitication that there are no
encroachment a onto the Property or onto adjacent properties except
as shown Qn the survey, and shall set forth the number ot total
Square teet. and the nUlDber ot net square teet co.prising t.he
Property, together with a metes and bounds description thereot.
The survey shall a180 contirm that all water, sewer, and other
utility e.sements servicinq the Property are located within valid
public or private eaaements over adjoining properties. The term
"net sQUare feet.. shall mean the nulDber of square teet contained in
~e Property, exclusive ot any land lying within the bed of any
alley, street or road, or right ot ways and shall be calculated to
the nearest one-hundredth (lOOth) square ~oot.
PurQhaser shall notity Sellar in the event the survey
discloses any cQndi~ions in Purchaser's 80181 jUdgment which would
render the Property or any part thereof unusable by Purchaser for
the pUrposes herein stated. In such, ~vent, Seller shall forthwith
eliminate or mOdity a~l aU9h unacceptable conditions to the
