Dear Tom,
The Planning Department has decided we need to maintain
a 1 space per 100 sq ft ratio for si~e parking for the
Recreation Building. This would also apply to the Madsen
Center. This would require at least 90 spaces.
It appears there is a problem with any future expansion
for either building even if both tennis courts are
eliminated. Therefore, please base your site parking
designs on only the present Madsen Center and proposed 6500
sq ft Recreation Building using both tennis courts.

submitted with this application for review by the City of

Upon review of the above mentioned project, the following list of
comments must be addressed in order to conform with Boynton Beach
city Codes:
1. Identify on the plans the location of the building by
specifying the distance from the east property line to the
building.
2. Specify on the plan the total square foot area of the
eXisting Madsen Center and adjacent impervious recreation
areas.
3. Identify on the plans the total number of parking spaces
located in the parking area identified as existing parking
lot.
4. Show and specify on the plans the width, length and
elevation of the level platform that is required at the
handicapped accessible entrance to the Activity building.
Include spot elevations along the walkway leading to the
handicapped parking spaces.
5. To comply with the sidewalk variance approved by the
Technical Review Board on July 30, 1991 the following
conditions must be incorporated into the final sign-off
drawings for the project:
i. show on the site plan a sidewalk located on the
north side of S.E. 2nd Avenue right-of-way. The
sidewalk shall run within the right-of-way between
the City project property line and the asphalt
surface of S.E. 2nd Avenue. The sidewalk shall
start at the west side of the south driveway
leading into the Activity Center parking area and
extend west to and connect with the sidewalk
running along the east side of Seacrest Boulevard.
ii. a second sidewalk shall be shown on the site plan.
This sidewalk shall be located directly north and
run parallel with the property line shown north of
the Activity building on sheet 1 of 1, Gee & Jenson
Plan #91-050. The sidewalk shall start at the west
side of the new Activity Center sidewalk that
crosses said property line and extend west to the
east side of the east library parking aisle.
Sidewalk specifications:
a. sidewalks located within public rights-of-
way shall be located and constructed
according to the Engineering Department
standard, incorporate same as part of the
drawings,

b. specify the width, type of material and
slope for the entire length of the north
sidewalk. Specify and show a curb-cut
where the sidewalk meets the edge of the
existing east library parking aisle.
iii. incorporate the following as a note on the site
plan:
Specify that the remainder of the required
right-of-way sidewalk will be installed
when future improvements are made to the
Madsen Center.
6. Show on the plans the location of the building and site
signage.
7. Identify on the plans the color of the circle detail shown
on the East and West elevation view drawing. Specify on the
plans the color of the louver.
8. This project will be reviewed by the Community Appearance
Board for general compatibility and aesthetic consideration
with respect to existing architectural design, signage and
landscaping at the site.
9. The outline, configuration and material shown and identified
on the project drawing(s) submitted with the plan(s) for
final sign-off shall match in every respect the colored
drawing(s) approved by the City Commission during the
approval process of the project. The color of each exterior
finish material shown on the final sign-off plans shall be
identified by name, color number and manufacturers name
which shall match in every respect with the color(s) shown
on the drawing(s) approved by the city Commission. A
manufacturer's color chart showing and identifying all
approved color(s) shall be submitted with the plans for
final sign-off.
10. The size specifications for the Sabal Palms, Green
Buttonwood and Sugarberry trees described in the plant
legend must be revised to indicate no less than the minimum
required by the Landscape Code [height eight (8) feet and
caliber two (2) inches].
11. Delineate within the landscape material directory the native
species. The total material count for native and exotic
species must show fifty percent of the required landscape
material of a native specie.
12. The existing parking area is required to be upgraded to the
present code, the code required landscaping shall be
installed. Revise the plans accordingly or seek approval of
an administrative appeal to the Landscape Code from the
Community Appearance Board. Landscape appeal forms are
obtained from and submitted to the Site Development Division
(deadline for submittal for the August 15, 1991 Community
Appearance Board meeting is August 5, 1991).

In order to facilitate the permitting process, the following
information should be included within your documents submitted to
the Building Department for required permits:
1. Provide a detailed plan view and full section view drawing
of the dumpster enclosure and pad. Identify the following
dumpster information:
i. type, size and color of material proposed for the
sides of the enclosure,
ii. specify the size and type of all required vertical
and horizontal structural material and components
for the enclosure walls and associated pad,
iii. identify the overall height, width and length of
the enclosure,
iv. where gates are proposed, specify the methods of
holding the enclosure gates in the open and closed
position.
2. Provide detail drawings specifying that the site lighting
poles are designed to meet the windload requirements of
Chapter 12, standard Building Code, 1988 Edition.

In accordance with the City of Boynton Beach, Florida, Code of Ordinances
specifically, Chapter 19, Section 19-17, "Plan Required", including Chapter 5,
Article X, "Boynton Beach Parking Lot Regulations", Section 5-142, "Required
Improvements" inclusive, the Engineering Department herein provides the follow-
ing staff comments (drainage review coordinated with Mike Kazunas, P.E. of the
City's Utility Department as insufficient information and design criteria not
in accordance with City codes was realized by the Engineering Department).
1. Provide a photometric plan depicting levels of illumination which conform
to the standards specified within Chapter 5, Section 5-142 (a), "Lighting" and
Section 5-142 (g), "Parking Lot Construction Standards and Specifications".
All site lighting systems shall be photo-cell activated in accordance with
Section 5-142 (g), "Required Photo-cell Activation".
2. Provide percolation test data including a percolation test location plan
and associated drainage calculations which comply with the provisions specified
within Section 5-142 (f), "Drainage" and Section 5-142 (g), "Drainage Standards".
The "preliminary drainage caclulations" specified on sheet 1 of 1 of the Gee &
Jenson plans depicts a containment capacity of one (1) inch. The City's Code of
Ordinances, Chapter 5, Section 5-142 (f), "Drainage", requires containment of
two and one-half (2-1/2) inches of rainfall in one hour. Revise plans accord-
ingly and provide the required submission data.
3. The submitted plan does not conform to the provlslons set forth within
Section 5-142 (i), (3) which states the following: "Within parking lots, a
minimum design radius of ten (10) feet shall be provided". Revise plans accord-
ingly.
4. In accordance with City of Boynton Beach, Florida, "Standard Drawings for
Construction Within lheRights-of-Way, revise plans to indicate the following
information:
a) Subgrade for driveways shall be stabilized to a 50 FBV.
b) Base course for driveways shall be eight (8) of approved limerock
or shell-rock.
c) Asphaltic Concrete wearing surface shall be a minimum of one and one-half
(1-1/2) inches of Type II asphaltic concrete.
5. Handicap ramps shall conform to DCA requirements. Section 5-142 (k) inclusive.
Handicap ramps should be curb-side ramps as the ramps depicted will be comprised of
side slopes (flairs) which will make handicap access quite difficult. Recommend
on grade ramps in lieu of ramps with side slopes.

6. Standard and Handicap striping details shall be provided in accordance
with Section 5-142 (1), "Parking Lot Striping". Revise plans accordingly.
7. Provide details for all signage in accordance with Section 5-142 (g),
"Construction Standards". Additionally, a General Notes and Specification
sheet, should be provided in accordance with Section 5-142 (g), "Parking Lot
Standards" which states the following: "Each parking lot shall be constructed
consistent with city standards. Materials and design shall meet or exceed
City Standards".
8. In order to limit construction costs associated with the construction of
raised continuous concrete curbing, the reference to FDOT "D" type curbing
could be deleted and curbing specifications which comply with minimum City
standards could be utilized.
9. Provide a trench restoration detail for the roadway excavation associated
with the sanitary sewer construction. Chapter 22, "Streets", Section 22-17,
"Application required, contents".
10. Sidewalk construction required along property lines adjoining public
rights-of-way. Sidewalks shall continue through ingress/egress approaches
and be so transitioned to facilitate the circulation of handicap persons.
Section 5-142 (g), "Sidewalk standards" and Chapter 22, Section 22-25, "Side-
walks required.
(*)Note: Sidewalks shall be constructed regardless of ownership of adjoining
roadway systems or condition of adjoining property.
11. In accordance with the City of Boynton Beach, Florida Code of Ordinances,
the existing parking facility shall be modified (upgraded) to comply with City
Codes relative to parking lot construction and all other associated elements
thereof. As this municipality typically compels iand owners to comply with
the subject provision of our codes, the City should not set a precedent by
granting itself a variance, as a prerequisite precedent to the granting of a (*)
variance requires the applicant to prove that literal enforcement of the govern-
ing provisions would result in an unnecessary hardship, not created by the
applicant or his predecessor in title, use, or possession. Additionally, the
granting of a variance cannot be contrary to the public interest. Section
5-145, "Variances to this Article". Provide plans for the existing parking lot.

on October 17, 1991, of the plans submitted for review by the Technical.
Review Board. Completing the Site Plan Review process enables you to submit
working drawings and construction plans for the site work/and building
construction to the Building Department for plan review and permitting. To
initiate this process present to the plans analyst in the Building
Department the following:
a) appropriate and completed permit application form
b) copy of this letter

d) a plan filing *permit fee
The plan filing fee is 30% of the estimated permit fee and is made payable

Two (2) colored elevations and color chips. (Please note

memorandum.) City Commission approved, subject to staff
comments, all C.A.B. recommendations and the additional
stipulation of no cross parking with the library and the
Madsen Center.
CONDITIONAL USE
2. Williams Auto Sales: (Re-establishment of a used car lot at
1009 N. Federal Highway)
Although this request was denied with a 2-2 vote at the City
Commission meeting, the two (2) colored elevations and
photographs of surrounding buildings are being held until
the outcome of the September 3, 1991, City Commission when
reconsideration of this item is tentatively scheduled.
The name of the project and date of City Commission approval
have been placed on the elevations.

DESCRIPTION: Request submitted by the City for site plan
approval to demolish the existing Tennis Center and construct a
6,640 square foot recreation activity center and 89 space parking
lot. The project is located at 125 S.E. 2nd Avenue.
RECOMMENDATION: The Planning and Zoning Board unanimously
recommended approval of this request subject to staff comments,

Please be advised that the Planning and Zoning Board met on
Tuesday, August 13, 1991, and took the following action:
1. Unanimously elected an Acting Chairman, Nathan Collins, in
the absence of Mr.Rosenstock and Mr. Lehnertz.
2. After conducting a public hearing, unanimously recommended
approval of the request submitted by Horace Williams for the
abandonment of a 20 foot wide alley at 1009 North Federal
Highway, subject to proviso. The motion was made by Mrs.
Greenhouse and seconded by Mr. Howard. (PM91-197)
3. After conducting a public hearing, unanimously recommended
denial of the conditional use request submitted by Horace
Williams to establish a used car lot to be known as Williams
Auto Sales at 1009 North Federal Highway. The motion was
made by Mrs. Huckle and seconded by Mrs. Greenhouse.

4. After conducting a public hearing, recommended denial of the
request submitted by the City, in connection with the
Boynton Beach Activity Center site plan, of a variance to
Section 5-138 "Scope"(a) of Article X-Parking Lots. The
motion was made by Mrs. Greenhouse and seconded by Mrs.
Huckle. The vote was 4-2 with Mr. Collins and Mr. Hinson
dissenting. The Board unanimously approved the request of
the variance to Section 5-142(h)(7) "Driveway" of Article X,
Parking Lots. The motion was made by Mrs. Huckle and
seconded by Mrs. Greenhouse. (PM91-200)
5. Unanimously recommended approval of the site plan request
submitted by the City for the Boynton Beach Activity Center;
a 6,640 square foot recreation activity center and 89 space
parking lot to replace the existing Tennis Center, subject
to proviso. The motion was made by Mrs. Greenhouse and
seconded by Mr. Howard. (PM91-201)
6. The Board approved in part and denied in part the master
plan modification submitted by Kilday and Associates for the
Shoppes of Woolbright P.C.D. as follows:
a) Denied the request for an additional driveway onto
Woolbright Road (item #1 of Planning Department
Memorandum No. 91-165). The motion was made by Mrs.
Huckle and seconded by Mrs. Stevens. The vote was 5-1
with Mr. Collins dissenting.
b) Unanimously approved the request to change the size,
number of stories and use designation of the outparcel
at the northeast corner of Woolbright Road and S.W. 8th
street from a 4,300 square foot retail building to a
two story, 6,000 square foot bank (item #3 of Planning
Department Memorandum Mo. 91-165). The motion was made
by Mrs. Huckle and seconded by Mrs. Greenhouse.

c) Unanimously approved the request to add another
driveway onto S.W. 8th Street from the shopping center
and outparcels and to relocate the approved driveway
southward, subject to eliminating one of the two access
aisle connections between the outparcels and Home Depot
and relocating the remaining access aisle connection to
behind (east) outparcel 2, (items #4 and #5 of Planning
Department No. 91-165). The motion was made by Mr.
Howard and seconded by Mrs. Huckle.
The Board accepted the Planning Department's recommendation
to require the amended plans within 3 weeks of the date of
approval rather than within the time period stated in
condition #1 of Planning Department Memorandum No. 91-183.
The request to change the size and use designation of the
outparcel at the northeast corner of Woolbright Road and
S.W. 8th Street (item #2 of Planning Department Memorandum
No. 91-165) was withdrawn at the applicant's request. In
addition, the applicant is requesting an appeal to the
Planning and Zoning Board's denial of the request for an
additional driveway onto Woolbright Road-(a) above.

7. Unanimously made a finding of consistency with the
Comprehensive Plan for the amendment to Chapter 19 to
implement a new site plan review ordinance, subject to
proviso. Motion was made by Mrs. Greenhouse and seconded by
Mr. Howard. In addition, the Board requested that they
receive a copy of the revised ordinance prior to the
September 3, 1991 City Commission meeting. (PM91-202)
8. Deleted the consistency review determination of the proposed
Adminstrative Procedures Ordinance from the agenda since
this ordinance has not been completed by staff. This item
will be placed on a future Planning and Zoning Board agenda.
9. The Board tabled action with respect to the consistency
review determination of the proposed amendment to Appendix
A-Zoning, Section 11.1 of the Code of Ordinances to allow
for expansion of nonconforming structures, until the
September 10, 1991, Planning and Zoning Board meeting to
allow staff sufficient time to incorporate the changes
recommended by the Board.
10. The Board accepted the Planning Department's recommendation
to postpone the consistency review of the proposed
amendments to Appendix B-Planned Unit Developments of the
Code of Ordinances, Section 6.F - Planned Commercial
Development District and Section 7 - Planned Industrial
Development District of Appendix A-Zoning of the Code of
Ordinances to create time extensions for master plan
approvals, until the September 10, 1991 Planning and Zoning
Board meeting.
11. Deleted the consistency review determination of the proposed
amendment to Appendix A-Zoning to allow towing companies in
the M-1, Light Industrial zoning district from the agenda.
12. Unanimously made a finding of consistency with the
Comprehensive Plan for the amendment to the Zoning Code to
allow wholesale/distribution of prepackaged and prepared
meat and poultry in the C-4, General Commercial, zoning
district, subject to proviso. Motion was made by Mrs.
Greenhouse and seconded by Mr. Howard. (PM91-199)

13. Unanimously approved the Lawrence Lake PUD 12 month time
extension for exemption from concurrency, subject "to posting
surety for the incomplete, required improvements. The
motion was made by Mrs. Stevens and seconded by Mr. Howard.
14. Unanimously recommended that the City Commission initiate a
change to the minimum frontage required by the Code of
Ordinances for service stations with or without major
repairs from 175 feet to 240 feet. The motion was made by
Mrs. Greenhouse and seconded by Mrs. Huckle. (PM91-203)
15. The Board requested a copy of the Planning Department's list
of expired site plan approvals as soon as it is completed by
the Planning Department.

This letter will serve as a formal request for approval from
the Building Department to waive the requirements at this time to
install sidewalks on the north and south sides of the project on
First and Second Avenue.
There exists no other sidewalks on this block and future
plans for the east end are incomplete to date. Sidewalks were
already excluded on the Library site due to indecision on type
and placement, ie; swale and walk vs.curb and gutter. This item
was referred to the Engineering Department as part of their
street program.
Completion of all sidewalks on First and second Avenue and
First street will be included with the completion of phase III
Madsen Center project.
Variances for other work are already processing through the
Planning Department for the east end parking and landscaping
conflicts.
Please provide written approval for consideration at the
July 30th TRB meeting.

SITE PLAN MODIFICATION - NEW RECREA~ION BUILDING (REMOVE TENNIS
COURTS AT THE MADSEN CENTER RECREA~ION AREA AND CONS~UCT
NEW BUILDING AND PARKING AREA)
Upon review of the above mentioned project, the following list of
comments have been provided as a courtesy with the applicant's
knowledge that there will be a full review made when the project
is placed on a future Technical Review Board agenda.
1. Specify on the plans the slope for the entire length of the
handicapped accessible ~alkway leading to the entrance of
the building from both ~ets of handicapped parking spaces
including the five (5~'foot wide aisle located between both
sets of handicapped parking spaces. (Specify type of
material)
2. Show and specify on the plans the width, length and
elevation of the level platform that is required at the
handicapped accessible entrance to the building.
3. show on the plans a handicapped accessible walkway leading
to the bUilding from a public right-of-way. Specify the
width, type of material and slope for the entire length of
the walkway.
4. All drawing andlor documents submitted for public record and
prepared by a design professional, shall show original
legible raised seal and signature of a Florida registered
design professional responsible for the drawings/documents.
5. Specify on the plans the gross square footage of the
building.
6. Include with the submittal a current survey of the property
showing all easements.
7. If a property line is created along the west limit of the
contract line, the required building setback distance shall
be twenty-five (25) feet.
8. Identify on the plans the overall height of the building.
9. Identify on the plans the location of the building by
specifying the distance from the south and east property
lines to the building.
10. Identify on the plans the total number of parking spaces
located in the parking area identified as existing parking
lot.

11. Include within the drawings a detailed elevation view
drawing of the proposed site lighting pole and fixture. Show
and specify the following pole and fixture data.
i. specify that the fixture is photocell activated
ii. state that the pole, pole base and fixture is designed
to withstand a windload consistent with Chapter 12,
Standard Building Code, 1988 Edition
iii. specify the type of luminary (metal halide or high or
low pressure sodium)
iv. show the light contours and specify their foot candle
light level
v. specify, where applicable, shields to deter off-site
glare
vi. show the height of the pole and fixture matching the
height specified on the photometric drawing
vii. specify the depth of the pole andlor pole base is
placed below grade
viii. provide a detail drawing of the pole base showing and
specifying the vertical and horizontal structural
materials and components. Including the size and type
of fasteners required to attach the pole to the base
ix. show the distance from the grade to the top of the pole
base
x. correct conflicts between the location of site lighting
pole(s} and drainage structures, landscaping and
parking spaces
12. This project is required to be presented to the Community
Appearance Board for review to ensure that the proposed
structure is in harmony with adjacent surroundings. Colored
elevation view drawings of the proposed structure are
required for the presentation. Check the project review
schedule for the Community Appearance Board submittal
deadline dates.
13. Show on the plans the line of sight triangles that are
required on both sides of all ingresslegresses to the
project. Specify that there shall be maintained a clear
unobstructed space between thirty (30) inches and six (6)
feet within the line of sight triangle areas.
14. Indicate on the plans that all landscape material will be
irrigated with an automatic water supply system. Specify on
the plans the source of the irrigation water.
15. State on the plans the plant quality specifications
complying with the requirements of the Landscape Code.
16. If it is determined that the existing parking area is
required to be upgraded to the present code, the code
required landscaping shall be installed. Revise the plans
accordingly.
17. show on the plans the location, type, size, letter style and
color of the building and site signage.
18. Specify on the plans the manufacturer name and color number
for the colors identified for the exterior finish materials
of the building.
