NOTICE IS HEREBY GIVEN that the Planning & Development Board of the
CITY OF BOYNTON BEACH, FLORIDA, will conduct a PUBLIC HEARING on
Tuesday, July 9, 1991 at 7:00 P.M. at City Hall in the Commission
Chambers, 100 East Boynton Beach Boulevard, Boynton Beach to
consider an application to ABANDON a utility easement submitted by
Carriage Homes Development Inc. on a parcel of land described as
follows:
A portion of the Plat of Carriage Homes of Congress
Lakes, P.U.D. as recorded in Plat Book 66, Pages 133 to
135 and also lYing in Section 18, Township 45 south,
Range 43 east, Palm Beach County, Florida, and being more
particularly described:
CommenCing at the northwest corner of said plat, said

distance of 678.03 feet; thence, leaving said westerly

THIS DISCLAIMER AND ABANDONMENT OF UTILITY EASEMENT, made
and entered into this day of May, 1992, by and between
CARRIAGE HOMES DEVELOPMENT, INC., a Florida corporation
("Carriage") and the CITY OF BOYNTON BEACH, FLORIDA, a municipal
corporation (the "City").
R E C I TAL S
WHEREAS, Carriage is the fee simple owner of that certain
parcel of real property situate, lying and being in Palm Beach
County, Florida more particularly described as follows:
All of the PLAT OF CARRIAGE HOMES OF CONGRESS LAKES,
P.U.D., according to the Plat thereof (the "Plat"),
recorded in Plat Book 66 at Pages 133 through 135, of
the Public Records of Palm Beach County, Florida.
WHEREAS, the Plat dedicated certain utility easements as
shown on the Plat, in perpetuity for the maintenance and
construction of public utilities and cable television facilities~
and
WHEREAS, Carriage and the City desire to abandon, release,
disclaim and render a portion of a 25' wide utility easement as
shown on the Plat of no further force and effect, which portion

Please find the enclosed documentation relating to the
abandonment of a platted utility easement on the Carriage
Homes parcel. Apartment BUilding Number Nine was found to
encroach upon this easement and it was agreed that
Carriage Homes Development would abandon the easement and
then take responsibility for the maintenance of the sewer
line located within the easement (see attached letter from
Richard Staudinger, P.E.). Your files should show that we
have obtained written releases from all utilities. Please
review the release and forward to the City Attorney and/or
other necessary parties. After approval or if there are
any problems, please give me a call, as we are anxious to
get this document recorded.

would require a considerable amount of feea, effort and the
submission of . replat and review by the city .a well as Palm
Beach county. As an alternative, both pete and Z have no
problem with a separate instrument being recorded for the aban-
donment of this easement in lieu of replatiD9 as long as the
instrument recorded includes a map1ndicat1nq the location of the
easement to be abandoned with respect to the rest of the develop-
ment 80 that any title searoh would produce a dooument that
olearly in4icates whioh of one of the many easements on-aite is

Dear Ms. Heyden:
This firm represents The Prudential Insurance Company of
America ("Prudential") in connection with their purchase of a
planned unit development located in Boynton Beach, Florida commonly
known as Carriage Homes of Congress Lakes and described in Exhibit
"A" attached hereto (the "Property"). The purpose of this letter
is to confirm the existence of certain development rights which
inure to the benefit of the current and future owners of the
Property by virtue of approvals granted by the City of Boynton
Beach (the "City").
On July 16, 1990 the City Commission of the City of Boynton
Beach approved that certain site plan entitled "Carriage Homes of
Congress Lakes", prepared by STB Architects and Planners, Inc.
dated April 19, 1990, last revised June 25, 1990 (the "Site Plan").
The Site Plan provided for the construction of 466 dwelling units
on the Property. I have been informed by the City that, in the
event all or a portion of the dwelling units are destroyed by a
casualty in the future, the owner of the Property would be
permitted to reconstruct the existing development on the Property
in accordance with the Site Plan, specifically including the
construction of 466 dwelling units. The City further confirmed
that the right to reconstruct and maintain 466 dwelling units on
the Property is vested, notwithstanding any present or future
density limitations on the Property.

This letter also confirms that there is an existing lake on
the Property delineated as Tract A of the Plat of carriage Homes of
Congress Lakes (the "Lake"). The acreage of the Lake was utilized
by the City to calculate the density of the development approved
under the Site Plan. At the time the Site Plan was approved, title
to the Lake was held in the name of the ~rrent owner, Carriage
Homes Development, Inc. ("CHD"), but was dedicated to Catalina Club
South Property OWners Master A'ssociation, Inc. (the "Association") .
As part of Prudential's purchase of the Prop~r~, CHD will convey
the Lake to the Association, subject -to'pruoential's retention of
all development rights associated with the Lake. The City has
confirmed that, although title to the Lake will not be held in the
name of the party rebuilding the development in the event of a
casual ty, the permissible density on the Property will not be
decreased and the current owner will be permitted to maintain 466
dwelling units on the Property.
If the facts and conclusions contained in this letter are true
and correct, please indicate so by signing in the space provided
below and returning it to me at your earliest convenience.

In response to Gail Bryant's verbal request for a bond release or
reduction, the Engineering Department for the City of Boynton Beach,
Florida has transmitted her request to various affected departments
and expect walk-thru inspection punch list items within the next ten
days. I will transmit a copy of staff comments (if any) to your
attention as well as the attention of your Design Engineer.
In the meantime, I feel it my responsibility to advise you that there
still remains outstanding issues relative to the recordation of,a
temporary, off site and combination utility easement, the recordation
of an access easement, superimposed over the existing utility easement
in Savannah Lakes Drive, including the required termination of the
recorded tennis court agreement for the deleted tennis court amenities.
In order to ensure that your bond release/reduction request occurs in
a timely fashion, please submit the requested documents to my attention
within ten days from receipt of this certified letter.

Abandonment of Easement at Carriage Homes
at Savannah Lakes
Thomas McMurrian, the owner of Carriage Homes, is requesting the
abandonment of a 25-foot easement within the development.
It has been discovered that Building 9 encroaches into this
easement which contains a sewer line. The portion of sewer line
in the area to be abandoned will be maintained by the property
owner and will not be turned over to the City with the other
utilities.
This request has been reviewed by other departments and no
negative comments have been made regarding this request.
The Planning and Development Board, at its meeting of
September 8, 1992, reviewed this request and forwarded it
to the City Commission with a recommendation for approval.
This item has been scheduled for City Commission consideration on
September 15, 1992.
