Please be advised that the Planning & Zoning Board met on
Tuesday, January 14, 1992 and took the folliwng action:
1. Removed from the agenda the public hearing for the Cross
Creek Centre parking lot variance as a result of the
applicant withdrawing the request.
2. Continued the public hearin~ for the Cedar Grove, P.U.D. to
the February 11, 1992 meeting at 7:00 P.M., as a result of
the applicant not resubmitting a revised master plan for
review and recommendation by the Technical Review Board to
the Planning & Zoning Board. PM# 92-008.
3. Unanimously made a finding of consistency with the
Comprehensive Plan for the proposed amendment to Appendix
A-Zoning to modify the regulations governing service
stations and convenience stores, subject to proviso (that
the words "major repair" be changed to "minor repairll, a
clause be added stating that the definitions are for the
purpose of these regulations only, IInon" be changed to "not"

4. Recommended denial and found the proposed amendment to

Greenhouse and seconded by Mr. Howard. The vote was 6-1

Comprehensive Plan for the proposed amendment to Appendix
c-subdivisions, Platting, Article XII, regarding the
acceptance and maintenance of required improvements, subject
to proviso. The motion was 1ade by Mrs. Greenhouse and

6. Unanimously made a finding of consistency with the
Comprehensive Plan for th~ proposed amendment to Appendix
A-Zoning, Section 4.F, regarding height limitations and

Parking Lot variance (fire lane)
section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to be made a part of the public hearing proceedings.
To that end, this memorandum is forwarded, consistent with
5-145(c) (4).
Robert A. Bentz of Land Design south, agent for Denholtz
Associates, has requested a variance to Section 5-142 (m) Fire
Lanes of the Parking Lot Regulations, which requires a minimum 22
foot wide designated fire lane, unencumbered by parked vehicles,
along the front of all shopping centers, retail-office complexes
and retail establishments that are 15,000 square feet in size or
greater. The subject property is located at 1313 West Boynton
Beach Boulevard, the site of the existing 35,000 square foot
retailloffice complex, known as Cross Creek Center.
The applicant is requesting that the existing fire lane along the
front of the commercial building be removed to construct fifteen
(15) additional parking spaces along the front of the commercial
building. The existing parking lot meets code with no surplus
parking spaces available. For an explanation of the code
requirement, the nature of the variance requested, and the
variance justification, please refer to the attached Notice of
Public Hearing and application.
The Technical Review Board (TRB) met on Tuesday, september 24,
1991 to review the plans and documents submitted for the variance
requested and again on Monday, December 30, 1991, at the request
of the applicant, based on the submittal of additional
documentation. After review and discussion, the TRB unanimously
recommended that the variance request be denied. The issues
raised by the TRB in formulating their recommendation are as
follows (see also the attached staff comments):
1. The building is equipped with a sprinkler system which makes
the need for a fire lane less critical for fire fighters.
However, a fire lane does provide unencumbered access for
other emergency services that do not benefit from sprinkler
systems.
2. Allowing additional parking along the front of the existing
commercial building will congest this area and exacerbate
existing circulation problems due to the greater demand to
park in these spaces located closest to the building.
3. The applicant has not demonstrated that special conditions
and circumstances exist which would justify granting the
requested variance.
It should be noted that if the variance is approved, the
applicant will be required to file a minor site plan modification

directed staff to formulate language to include specific
landscape buffer criteria, a 6 foot rather than a 5 foot

uses.
3. After conducting a public hearing recommended approval of
Ray F. Flow's request for conditional use approval of an
existing day care center, subject to proviso. Motion was
made by Mrs. Huckle and seconded by Mr. Howard. The vote

4. After conducting a public hearing, unanimously recommended
approval of Kilday and Associates' Mall South request to
show annexed land as Local Retail commercial, to rezone from
AR in Palm Beach County to C-3 and AG and to amend the
Traffic Circulation Element Support Document of the
Comprehensive Plan to include Winchester Boulevard as a city
collector on the Future Functional Classification Map and as
a 4-lane divided road on the 2010 Roadway Design Map,
subject to proviso. The motion was made by Mrs. Huckle and

5. After conducting a public hearing, recommended approval of
the City's water treatment plant expansion request to amend
the Future Land Use Element of the Comprehensive Plan from

and rezone from R-2 to PU, Public Usage. The motion was
made by Mr. Howard and seconded by Mrs. Huckle. The vote

6. After conducting a public hearing, unanimously recommended
denial of the City's North Federal Highway request to amend
Area 1.i of the Future Land Use Element Support Document, to

Land Use Element AmendmentlRezoninglText Amendment
Please place the above-referenced item on the City commission
agenda for Tuesday, November 19, 1991, under Public Hearings.
DESCRIPTION: Request to amend the Future Land Use Element of the
Comprehensive Plan from "Moderate Density Residential" to "Office
Commercial" and to rezone from R1AA/PUD (Single-family
Residential) to C-l (Office and Professional Commercial).
Project is located on the south side of West Boynton Beach
Boulevard, approximately 300 feet east of Leisureville Boulevard.
RECOMMENDATION: The Planning and Zoning Board recommended
approval of the request to amend the Future Land Use Element of
the Comprehensive Plan from "Moderate Density Residential" to
"Office Commercial". The Board recommended approval of the
request to rezone from R1AA/PUD to C-1, subject to the following
conditions which are necessary for consistency of the proposed
rezoning of the property with the Comprehensive Plan:
1. That the use of the property be limited to those uses in the
C-1 zoning district which generate no more than 1,191 trips
per day.
2. Dedication of right-of-way for Boynton Beach Boulevard sixty
(60) feet from centerline, consistent with the Palm Beach
County Thoroughfare Right-of-Way Protection Map and
Policy 2.6.3 of the City's Comprehensive Plan.
3. That Land Use Conflict Area 7.a. of the Future Land Use
Element Support Document be amended as follows. This
amendment prepared by the Planning Department supersedes the
applicant's proposed amendment:
7.a. Residential Parcels in Vicinity of Old Boynton Road and
Boynton Beach Boulevard, Between Congress Avenue and
Interstate 95
Due to the increased traffic which will be drawn
to the Boynton Beach Mall, there will be pressure
to rezone the parcels in this area from
residential to commercial use. Other than minor
adjustments to the existing zoning district
boundar ies , commercial zoning should not be
allowed to extend westward along Old Boynton Road
and Boynton Beach Boulevard. Extending commercial
Zoning along these thoroughfares would cause
serious traffic congestion and degrade the
residential environment in the adjacent
neighborhoods. In particular, commercial zoning
should not be permitted on the residential lots
and small parcels which lie along Old Boynton Road
to the northwest of the Florida Power and Light
substation. Two additions to the commercial
zoning district are desirable, however: 1) It is
recommended that the land use on the southern 300
feet of the R-2 zoned property owned by
Planning Dept. Memorandum #91-287
Page 2
Florida Power and Light Company, at the northeast
corner of Boynton Beach Boulevard and Old Boynton
Road, be changed to Local Retail Commercial, and
the zoning changed to C-2 Neighborhood Commercial.
The development of this parcel should be
contingent upon its being combined with the
vacated right-of-way for Old Boynton Road, and the
small triangular-shaped parcel at this
intersection, and the rezoning of the combined
parcels to a planned commercial development. The
northern 330 feet of the Florida Power & Light
Company property should be changed from Medium
Density Residential land use and R-2 zoning to Low
Density Residential land use and R1A zoning. This
land usel zoning change would prevent duplex
dwellings from being placed immediately next to a
single-family neighborhood; and 2) It is
recommended that the land use on the vacant 2 acre
parcel which lies along the east side of Palm
Beach Leisureville and fronts on Boynton Beach
Boulevard be changed to "Office Commercial" and
the zoning changed to C-l Office and Professional
Commercial, due to the small size of the parcel
which was created after the dedication to the City
for public park purposes of 3.617 acres, south of
the 2 acre parcel, to create a transition between
the single-family zoning to the west and the C-2
zoning to the east. However, due to the close
proximity of the 2 acre commercial parcel to
existing single-family residences in Palm Beach
Leisureville and Lake Boynton Estates, the
following restrictions should be placed on the
development of the site:
a. Pole-mounted lighting should be provided instead
of building-mounted lighting and lighting fixtures
should be properly shielded and directed so as to
minimize glare on nearby residences:
b. Screening and noise mitigation should be provided
for all mechanical equipment;
c. A six foot high concrete block buffer wall should
be provided along the eastern and western property
boundaries adjacent to single-family parcels in
Palm Beach Leisureville and Lake Boynton Estates
and trees should be planted along the buffer wall
20 feet on center with canopies above the 6 foot
high buffer wall.

Please be advised that the Planning and Zoning Board met on
Tuesday, November 12, 1991 and took the following action:
1. Continued the public hearing for the Cross Creek Centre
parking lot variance to the December 10, 1991 meeting at
7:00 p.m., as per the applicant's request for another 30 day
postponement.
2. After conducting a public hearing, recommended approval of
Kilday & Associates request for Tradewinds Development
Corporation (Boynton Beach Boulevard rezoning) to amend the
Future Land Use Element of the Comprehensive Plan from
"Moderate Density Residential" to "Office Commercial".
Motion was made by Mr. Collins and seconded by Mrs. Huckle.
The vote was 4-2 with Mr. Lehnertz and Mrs. Stevens
dissenting.
Also, recommended approval to rezone from R1AA/pUD
(Single-family Residential) to C-1 (Office and Professional
Commercial), subject to provisos, which are necessary for
consistency of the proposed rezoning of the property with
the Comprehensive Plan. Motion was made by Mr. Collins and
seconded by Mrs. Huckle. The vote was 4-2 with Mr. Lehnertz
and Mrs. Stevens dissenting. (PM91-287)
3. Approved the request submitted by William Turner for the
LakeshorelHeatherlake Homeowners' Association to amend the
Meadows, Tract "L", Heatherlake master plan to reduce the
rear setback for hard-roofed screen enclosures, from 25 to
15 feet, subject to proviso. Vote was 5-1 with Mr. Lehnertz
dissenting.
4. Unanimously recommended approval of the request for an
amended site plan for Bethesda Memorial Hospital to
construct a parking lot expansion, subject to proviso. The
motion was made by Mr. Collins and seconded by Mrs. Huckle.
Mrs. Stevens and Mr. Rosenstock left the room prior to the
motion being made. (PM91-288).
5. Unanimously recommended approval of the request for an
amended site plan for Motorola P.I.D. to construct phase III
of the P.I.D. to include 83,564 square feet of additional
office place, changes to the existing parking lot layout and
design and the addition of 112 parking spaces, subject to
proviso. The motion was made by Mrs. Huckle and seconded by

6. Tabled the determination of consistency with the
Comprehensive Plan for the proposed amendment to Appendix
A-Zoning, to amend the regulations governing service
stations and convenience stores until further analysis,
including mapping of all existing service station locations,
potential locations under the existing code and potential
locations under the proposed amendment and evaluation of the
existing distance separation against current safety
standards, is prepared by the Planning Department and
presented to the Planning and Zoning Board at the December
meeting.
7. Unanimously made a finding of consistency with the
Comprehensive Plan for the proposed amendment to Appendix
A-Zoning, to include limitations on restaurants located in
the C-1 zoning district, as conditional uses, subject to
proviso. Motion was made by Mr. Lehnertz and seconded by
Mrs. Huckle. First reading of the ordinance for this
amendment is proposed for the December 3, 1991 City
Commission meeting.
8. At the request of the City Commission, revisited the issue
of towing companies as a permitted use in the M-l zoning
district and unanimously decided not to amend the Planning
and Zoning Board's September 10, 1991 finding of consistency
with the Comprehensive Plan for the proposed amendment to
Appendix A-Zoning, to allow towing companies in the M-1

had left the room during the making of the motion.

A-Zoning to allow vegetation recycling facilities in the
M-1, Light Industrial, zoning district, subject to proviso.

6. Discussed placing limitations on restaurants located in the
C-1, zoning district. The Planning and Zoning Board
accepted the recommendations made by the Planning
Department, as itemized in the Planning Department
memorandum dated October 3, 1991, and additionally suggested
that restaurants in C-1 be located only within multi-tenant
buildings (not permitted as freestanding buildings) and
allowed only as an accessory use to a lawful principal use.
The Planning and Zoning Board directed the Planning
Department to bring this proposed code change back to the
Planning and Zoning Board at the November 12, 1991 meeting
for a determination of consistency with the Comprehensive
Plan.

which compares various cities' regulations governing service
stations. The Planning and Zoning Board made
recommendations for a future change to the City's service
