parking Lot Variance (fire lane)
section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Committee must forward to the Planning and
Development Board a recommendation, and that the recommendation
forwarded is to be made a part of the public hearing proceedings.
To that end, this memorandum is forwarded, consistent with
5-145(c) (4).
Robert A. Bentz of Land Design South, agent for Denholtz
Associates, has requested a variance to Section 5-142 (m) Fire
Lanes of the Parking Lot Regulations, which requires a minimum 22
foot wide designated fire lane, unencumbered by parked vehicles,
along the front of all shopping centers, retail-office complexes
and retail establishments that are 15,000 square feet in size or
greater. The subject property is located at 1313 West Boynton
Beach Boulevard, the site of the existing 35,000 square foot
retail/office complex, known as Cross Creek Center.
The applicant is requesting that the existing fire lane along the
front of the commercial building be removed to construct fourteen
(14) additional parking spaces along the front of the commercial
building (see Exhibit "A" for the proposed site plan). The
existing parking lot meets code with no surplus parking spaces
available. For an explanation of the code requirement, the
nature of the variance requested, and the variance justification,
please refer to the attached Notice of Public Hearing and
application.
A parking lot variance for removal of the subject fire lane was
submitted by the applicant for the January 1992 Planning and
Zoning Board meeting, but was subsequently withdrawn by the
applicant at this meeting. Upon review of this original request,
the Technical Review Board recommended that the variance be
denied for the following reasons:
1. Although the building is equipped with a sprinkler system
which makes the need for a fire lane less critical for fire
fighters, a fire lane provides unencumbered access for other
emergency services that do not benefit from a sprinkler
system.
2. Allowing additional parking along the front of the existing
commercial building will congest this area and exacerbate
existing circulation problems due to the greater demand to
park in these spaces located closest to the building.
3. The applicant had not demonstrated that special conditions
and circumstances exist which would justify granting the
requested variance.
On Tuesday, July 28, 1992, the Technical Review Committee (TRC)
met to review the plans and documents submitted for the current
variance request. After review and discussion, the TRC
recommended that the variance request be approved. The basis for
this recommendation was that since the site plan submitted with
the current variance request differs from the site plan submitted
with the original variance request (see Exhibit liB" for the
original site plan proposed) by providing more openings between
consecutive parking spaces, together with the building's existing

sprinkler system, both fire fighters and other emergency
personnel could satisfactorily respond to various types of
emergencies, in and around the building. Although a marked fire
lane provides the best assurance that emergency access will not
be encumbered by parked, stopped or standing vehicles, it was
felt that removal of the fire lane, as shown on the proposed site
plan, would not jeopardize safety because parking space breaks
would provide adequate room to carry emergency equipment.
This recommendation is subject to the attached, Exhibit "C"
Engineering Department Memorandum No. 92-206 (Revised), which
states that the proposed landscaped islands (i.e. - parking space
breaks, since existing palm tree clusters will be removed) shall
be shifted to locate one of the islands in front of the existing,
outdoor seating area at Sunny Gourmet restaurant to protect the
seating area from moving vehicles. Since the applicant will be
required to file a minor site plan modification, prior to
constructing the additional parking spaces, the recommendation
will be addressed on the site plan at that time.
Exhibit "C" also contains Police Department Memorandum #92-149
stating the Police Department's position on the requested
variance. As was an issue with the original variance request,
the Police Department projects that the additional parking
spaces, added to the front of the bUilding where congestion
already occurs, will increase the number of parking lot accidents
at this location.
