NATURE OF REQUEST:
Joseph Defeo, Jr., property owner is requesting City approval to
subdivide a single family lot from the Chants Enterprises, Inc.
property. Chan's Enterprises, Inc. property, commonly known as
Sun Wah Restaurant property, is located at 3010 South Federal
Highway.
BACKGROUND:
The Sun Wah property that borders Federal Highway is zoned C-3
with the eastern portion of the property having an R-l-AA zoning
classification. The Sun Wah property, formerly known as Carriage
Housel became part of the City on June 4, 1962. At that time the
street frontage along Federal Highway was zoned C-l and the rear
portion was zoned R-l-AA. On February 181 1963, the rear portion
of the property was rezoned to C-l and identified as the parking
lot for the property then known as Tropical Acres. On June 3,
1963, the zoning of the rear property was rezoned back to R-1-AA.
At present, the land use designation for the eastern portion of
the property is low density residential. The DeFeo property is
located in the residential zoned portion of the property and
contains an existing residential structure that is presently
being remodeled. The south and east sides of the proposed DeFeo
property represent the perimeter border of the City limits. Mr.
DeFeo is requesting approval to separate his property from the
Chan's property to become an independent lot.
ANALYSIS:
This request is being forwarded to the Planning and Development
Board in conjunction with the requirements set forth in Article
VI of Appendix C Subdivision and Platting Regulations. The DeFeo
property, as described on the attached survey, is in compliance
with the R-l-AA Single Family Residential District regulations
specified in Appendix A-Zoning Code. The only exceptions are
that the survey indicates that the structure is a duplex,
however, the remodeling presently being done at the site with
permit number 93-3220 indicates the building will be a single
family residence and the east setback of nine point six (9.6)
feet is point four (.4) feet less than the present code
requirement of ten (10) feet. The water meter for the site is
located on the Sun Wah property. (See Utilities Department
memorandum #93-535.) The sewer system for the property is a
septic tank.
RECOMMENDATION(S):
The Technical Review Committee (TRC) met on December 281 1993 to
discuss the request. The consensus of the TRC was to recommend
approval of the request subject to Utilities Department staff
comments memorandum #93-535.

SUBJECT: Request for Waiver of Plat by Joseph DeFeo, Jr.
Staff has reviewed the above referenced item and offers the
following comments:
Joseph DeFeo, Jr. should be advised that his water line
is running across private property from the north side
of Sun Wah Restaurant to his property on Bamboo Lane.
This water line is his responsibility to own and
maintain from point of connection at his water meter.
We strongly recommend he obtain a private easement over
this line as part of the purchase agreement.
It is our recommendation that this item proceed through the
review process.

Please place the above-referenced item on the City Commission
agenda for January 18, 1994 under Development Plans, Consent
Agenda.
DESCRIPTION: This is a request to subdivide the existing structure
at 815 Bamboo Lane, originally a duplex, but now being remodeled
into a single-family home, from the Sun Wah Restaurant property at
3010 South Federal Highway. The portion of the Sun Wah Restaurant
property that fronts on South Federal Highway is zoned C-3,
Community Commercial. The rear portion of the Sun Wah Restaurant
property, which includes their parking lot and the proposed lot, is
zoned RIAA, Single Family Residential. Water and sewer service to
the proposed lot crosses the Sun Wah Restaurant property.
RECOMMENDATION: The Planning and Development Board unanimously
recommended approval of the requested waiver of plat, subject to
utili ties Department Memorandum #93-535, regarding dedication of an
easement.
