Dear Ms. Hayden:
I spoke with Shortly Aluminum today, and was told that you
require the section of the Condominium Documents which pertains
to allowing for the improvement or alternation of a unit
dwelling or or limited common elements restricted to individual
unit owners, which would include the porches some owners wish to
enclose.
I have enclosed a page from the Tradewinds at Dos Lagos
Condominium Association Documents; specifically, Article VIII,
paragraph #3 of the Declaration of Condominium, which allows for
the enclosure with the consent of the unit owner and the Board
of Directors, which Covenant was made part of the minutes of the
Board of Directors at Tradewinds.
I trust this will clarify the situation, so that we may continue
with our permits for the enclosures.

2. By the dwelling unit owner. The responsibility of the
dwelling unit owner shall be as follows:
a. To maintain, repair and replace at his expense all
portions of his dwelling unit except the portions
to be maintained, repaired and replaced by the
Association. Such shall be done without disturbing
the rights of other dwelling unit owners.
b. Not to paint or otherwise decorate or change the
appearance of any portion of the exterior of the
apartment building without the approval of the Asso-
ciation.
c. To promptly report to the Association any defect
or need for repairs for which the Association is
responsible.
Alteration and Im~rovement. Except as elsewhere reserved
to Developer, ne~ther a dwelling unit owner nor the Asso
ciation shall make any alteration in the portion of a
dwelling unit or of any apartment building that are to b
maintained by the Association, or remove any portion of
such, or make any additions to them, or do anything that
would jeopardize the safety or soundness of an apartment
building, or impair any easment, without first Obtaining
approval in writing of owners of all dwelling units in
which such work is to be done and the approval of the
Board of Directors of the Association. A copy of plans
for all such work prepared by an arc~itect licensed to
practice in this state shall be filed with the
Association prior to the start of the work.
B. Common Elements
1. By the Association. The maintenance and operation of the
common elements shall be the responsibility of the Associ-
ation and a common expense. However, each unit owner shall
be responsible for the maintenance and operation of the
limited common elements appurtenant to his unit. In the
event that the unit owner does not maintain the limited
common elements which are his responsibility after written
notic(! by the Association, the Association shall have the
right to maintain them at the expense of the unit owner
and shall have the right to file a lien on the unit owner's
apar~lent in accordance with the other provisicns of this
Declaration.

Change in Condominium Documents
Dear Mr. Newbold:
It is the understanding of the Board of Directors of Tradewinds
at Dos Lagos Condominium Association, Inc. that in order to have
permits for screened enclosures issued properly and within City
of Boynton Beach requirements, the wording of our present
Condominium Documents must be changed. Therefore, the Board of
Directors is having the Documents changed to read as follows:
I. Common Grounds Elements. There shall be certain
limited common grounds, consisting of patios, planters
and garden courts. The boundaries of such limited common
grounds shall be considered to extend from the ground to
the upper boundary of the unit, and they shall be bounded
by the distances as shown on the blueprints.
We trust that the change above, from the wording "common
elements", as previously stated in the Documents, to "common
grounds" will be sufficient and within the requirements of the
City of Boynton Beach for future issuance of such permits.

Administrative Site Plan Modification (roofed screen rooms)
Dear Mr. Shortley:
Please be advised that the plans submitted for site plan review
of the above-referenced request cannot be processed further as
they are lacking information and the changes proposed violate the
minimum, perimeter setbacks of the Dos Lagos PUD master plan (see
comment #1 and #2 below, respectivelYr for details).
To request approval to reduce the minimum setback, a master plan
modification must be filed with the Planning Department. This
procedure takes approximately 1 1/2 months to process and
requires both city Commission and Planning Zoning Board approval,
respectively. The requirements for submittal are six sets of the
entire master plan, reviied to show the reduced setback for all
units, a'letter stating the nature and purpose of the
modification to the master plan (what the reduced setback would
be) and a $200 filing fee. If a master plan modification is
approved, then processing of the application for a site plan
modificatioll, currently on file, can resume, subject to a
resubmittal which addresses those comments below as well as the
attached comments from other departments. If a complete master
plan modification and revised site plan modification are
submitted no later than 5:00 P.M., September 19, 1990 to the
Planning Department, potentially the roofed screen enclosures
could be approved as follows:

approved on october 9, 1990. If denied on October 9, 1990,
the (T.R.B.) approval of the site plan modification would
only be valid for enclosures on the interior units.
1. The drawings provided for the site plan modification must
show street names, north arrow, all units and the location
of all enclosures in order to determine the minimum building
(enclosure) separation and spot potential fire hazards and
security problems. Appendix A - Zoning, Section ll.A.1, 2
and 3.
2. Roofed structures must meet the building setbacks which,
according to the approved master plan, are as follows: for
the PUD frontage on dedicated public roads (Congress Avenue
and Miner Road) - 25 feet from the required perimeter
buffer, for the PUD periphery which abutts another zoning
district (L.W.D.D. L-21 Canal) - 25 feet from the property
line. Lesser setbacks would require approval of a master
plan modification as previously discussed. Appendix A -
Zoning, Section 1, definition of "buildingll and "setbackll
and Appendix B - Planned unit Developments, section 12.
3. Provide documentation verifying the type of condominium
ownership that exists as related to the patio slabs and
future enclosures. If enclosures and slabs are common area,
and not limited common elements, such is at Hunter's Run,
the association documents may have to be amended to allow
the owner of a unit with an enclosure within the common
area, exclusive or limited rights to the use of such an
enclosure. Appendix B - Planned Unit Developments, Section
1l, last paragraph.

SITE PLAN MODIFICATION - 4-PLEX DOS LAGOS (SCREENED ENCLOSURES)
Upon review of the above mentioned project, the following list of
comments have been provided as a courtesy with the applicant's
full knowledge that there will be a full review made when the
project is placed on a future Technical Review Board agenda.
1. Submit a master plan showing all 4-plex units. Specify on
the plan the proposed setback distance from property line
to the leading edge of the new hard roof for the screen
enclosures. Indicate on the plan the distance between each
building. Provide a note on the plan that identifies the
proposed minimum setback from the property line to the
building and minimum distance proposed between buildings.
2. Provide typical exterior rear and side elevations of
existing buildings and new screen rooms.
3. On the plans identify the color of the screen enclosure
frame work. I recommend selecting a color that will blend
with the existing color(s) of the building.
4. Provide a statement that there will be no encroachments of
existing Public Utility or Drainage Easements.
In order to facilitate the permitting process the following
information should be included with your documents submitted to
the Building Department for review and permitting:

This letter is to inform you that your project has received final sign-off
on November 28, 1990 of the plans submitted for review by the Technical
Review Board. Completing the Site Plan Review process enables you to submit
working drawings and construction plans for the site work and building
construction to the Building Department for plan review and permitting. To
initiate this process present to the plans analyst in the Building
Department the following:
a) appropriate and completed permit application form
b) copy of this letter
c) appropriate plans and associated documents
d) a plan filing *permit fee
The plan filing fee is made payable to the City of Boynton Beach in the
amount of *** .3% *** of the valuation of the work specified on the permit
application. The total permit fee is determined by the Building Department,
and is due when the permit is issued.
