Annunziato City Planner ~UIU(,CT Accompanying this memo you will find a copy of a letter from John Ewseychik to the City Planner requesting consideration of a modification to the approved master plan. PUD modifications are addressed procedurally by Chapter 3l-l(L) of the Boynton Beach Code. Specifically, the process is two-fold. First, a determination must be made by the City Council as to the degree of the change; that is, whether or not the change is "substantial". If the change is deter- mined by Council to be "substantial", a new application for PUD approval shall be required. If the change is determined to be not of a substantial nature, the application for modifica- tion may be approved by the Planning and Zoning Board based on a finding that the modifications requested are consistent with current regulations and the intent and purpose of the comprehen- sive plan. Annunziato City Planner 9UBJECT Dos Lagos PUD Specifically, the 204, two-story townhouses approved as located in the southwest quarter of the project are proposed to be changed to 202, 2 story garden apartments, and the 128, duplex/Townhouses approved as located in the northwest quarter of the project are proposed to be changed to 128 attached, single story patio homes. The single family detached area remains un- changed. Concerning recreation, the recreational package for the modified proposal is similar in form and content to the one offered in the approved PUD. The approved uses included 4 tennis courts, two swimming pools, two clubhouses, two fishing piers, a par-course and perimeter bike trails in the landscaped buffer area. The modification proposes all of the above except that the par-course has been removed. Additionally, the sizes of the clubhouses have been delineated (2800 sq. ft. each) and the recreational areas have been relocated to the lake. Access to the site remains unchanged with an east/west 4 lane divided roadway proposed. Rights-of-way dedications pro- posed for Congress Avenue, Miner Rd. and the drainage canals have not changed. At the time of PUD approval, improvements related to traffic were imposed by Council. These requirements are not requested to be changed, but for the edification of the Council, I will list them. 1. dedicate right-of-way for Congress Ave. to pro- vide for a 60', one -half section; 2. dedicate 108' of right-of-way for Miner Road; 3. bear the cost of a traffic signal at project's entrance if and when warranted by the County Engineer; 4. Construct turn lanes at entrance to project as follows: a. left turn lane, north approach b. right turn lane, south approach c. left and right turn lanes, east approach; 5. Pay the fair share of $ 95,000 to Palm Beach County to off-set the project's road impact at the time of building permits. Annunziato City Planner at the time of PUD approval, the developer agreed to commit to the .4% transfer fee, but these contracts have been sus- pended by an action of the Palm Beach County Board of PUblre- Inst,r-uction. On Tuesday, March 31st, 1981, the Technical Review Board reviewed this proposal for consistency with the approved master plan. The Board found the plans and proposals submitted to be consistent with the approved PUD. Therefore, the Board recommends to the City Council that a finding of no substantial change be made. In addition, the recommendations that follow are suggested to the Planning and Zoning Board by the appropriate staff members as provisos to the approval of the modification of the master plan. Utility Department: Subject to revised utility plans per meeting with developer's engineer on 3/30/81; Public Works Dept.: Subject to the approval of the dumpster locations. Planning Department: Subject to the developer dedicating the rights-of-way for Congress Avenue and Miner Road within sixty days of final action by the Planning and Zoning Board.
