Agenda of Feb. 3, 1982.
Accompanying this memorandum, you will find a copy of
a letter from Fred Roth, P.E., Vice President-Engineering for
the Satter Architectural & Engineering Group, Inc. requesting
that the rear-yard setback for the proposed single-family homes
be set at fifteen (15) feet. Because rear-yard setbacks for the
single-family home section were not discussed at the time of
master plan approval, it was assumed that all building setbacks
would be the same as for RIA zoned properties. In this instance,
it was assumed that the rear-yard setback would be twenty-five
(25) feet. Procedurally, this request is being processed as
a master plan modification consistent with Appendix B, Section
12 of the Code of Ordinances (copy attached) in order to clarify
what should have been determined conclusively at the time of
master plan approval.
This request was reviewed by the Technical Review
Board on Tuesday, January 26th, 1982 and based on the evidence
submitted,the staff, except for the Building Official, recommended
that the City Council find that this request does not constitute
a substantial change and further that this master plan modifica-
tion be found to be in accord with current regulations and the
Comprehensive Plan by the Planning and Zoning Board and be approved.
The Building Official's objection is based on the requested reduc-
tion of the rear-yard setback by ten (10) feet.
