We have received the attached request from representatives for
Exxon regarding a time extension for the convenience store with
gasoline sales approved last year at the southeast corner of
Woolbright Road and Congress Avenue,
I would like to know if any concurrency problems exist that would
prevent this time extension from being granted,
I would appreciate a response from your department as soon as
possible.
This item will be listed as a discussion item on the next
Technical Review Committee agenda.

Time Extension for Conditional Use -
Exxon Convenience store with Gasoline sales
Exxon, through its agent Trammell Crow, has requested an
extension of a conditional use for a convenience store with
gasoline sales at the southeast corner of Woolbright Road and
Congress Avenue.
In reviewing such a request, the same criteria for conditional
uses are used, Since there are no changes of circumstances that
we know of, the findings made when this use was originally
approved still stand.
The members of the Technical Review Committee, who review
concurrency, have reviewed this request and no objections have
been raised to this extension. The applicant has been contacted
regarding the payment of a reservation fee.
The comment regarding dedication of the right-of-way is
improperly worded. The original condition for the dedication was
tied to a sign-off for building permit, Since this condition was
approved by the city Commission, we feel that the City Commission
should decide if they wish to change the condition, Therefore,
we are taking this request forward to the Board and the City
Commission.
If the proper dedications have not been made, we would suggest a
condition that the dedications be made 90 days after extension
approval.
staff recommends that the Planning and Development Board forward
this request to the City Commission with a recommendation for
approval of a one year extension.

I have reviewed the above referenced request and conditioned upon
the following, render no objections to the time extension.
1. The required rights-of-way dedication, necessary to effectuate
roadway expansion improvements to Congress Avenue and Woolbright
Road, shall be considered a condition of approval, therefore, the
real property owners should provide this office with an appropriate
deed for said rights-Of-way prior to consideration of this matter
before the City Commission and/or review boards.
