Unfortunately, the City cannot endorse a 50/50 split of costs
between the City and Palm Beach County for this work. The vast
majority of the costs directly benefit Palm Beach County in
reducing their future costs of widening and any potential costs
which might have occurred in right-of-way acquisition at this
intersection. I would sincerely hope that your office can see
fit to fund the entire amount for this intersection improvement
project.

In response to your recent letter on the referenced matter, I have reviewed my files on
this intersection. Both roads are County maintained major thoroughfares. The City of
Boynton Beach has assisted the County by requiring adequate Rights-of-Ways be
dedicated by property owners developing at this intersection. The Right-of-Way available
will accommodate six laning of Woolbright at the present time without the need for
additional Right-of-Way. This effort by the City has saved Palm Beach County the cost
of acquiring Right-of-Way to widen Woolbright Road. This widening is planned by Palm
Beach County in the future, as design costs have already been budgeted by Palm Beach
County. .
The request for a right turn lane on the east side of Woolbright to northbound Congress
Avenue was made by a citizen, which was passed on to Palm Beach County by myself.
The addition of a right turn lane would be incorporated as a portion of the six lane future
roadway section of Woolbright. The costs of the right turn lane would result in less total
cost to Palm Beach County when Woolbright is widened to six lanes in the future.
Therefore, I cannot endor~e a SO/50 split of costs between the City and Palm Beach
County for this work. The vast majority of the costs directly benefit Palm Beach County
in reducing their future cost of widening and any potential costs which might have
occurred in Right-of-Way acquisition at the intersection.

In response to your recent memo concerning the reference time extension my only
concern is that we review the appropriate right-of-way on Congress Avenue to determine
that there is enough room for a right turn lane to be added in the near future. The
County appears to be ready to move on this project within the next six (6) months. We
should request that possibly in within ninety (90) to one hundred twenty (120) days as a
condition of this extension the property owner dedicate any necessary right-of-way along
Congress Avenue that was previously reserved for right-of-way.

the payment of the reservation fee and they are contacting Exxon.
We will report verbally to the City Commission on their response.
This item has been scheduled for City Commission review and final
determination on May 18, 1993.

Dear Mr. Miller:
As you are aware, the County is considering constructing east
approach and south approach right turn lanes at the above
intersection. Design plans are currently being prepared for the
two (2) turn lanes with $10,000 the County has approved for that
purpose. The estimated remaining construction costs are $90,000.'
The County is requesting the City of Boynton Beach to participate
in the remaining construction cost for this project in the amount
of fifty (50) percent, or approximately $45,000.
Please present this matter to your city council at your earliest
convenience and advise us of the outcome. Once we have a
commi tment from the city we can approach the Board of County
Commissioners and request the additional funding for construction.

PALM BEACH COUNTY ROAD IMPACT FEES
The Boynton Beach Building Department has been collecting impact fees' for
county roads since July 1979. To date, in road area H we have collected
$5,932,240 and in road area J we have collected $942,645, for a total of
$6,874.885. The dividing line between these two road areas is Woolbright
Road.
Currently, the boundary of road area H is the Atlantic Ocean on the east,
Military Trail on the west, Woolbright Road on the south and Lake Worth
Road on the north. The boundary of road area J is the Atlantic Ocean on
the east, Military Trail on the west, Clint Moore Road on the south and
Woolbright Road on the north.
Funds collected by the City must be used exclusively for the construction
or improvement of county roads, streets, highways and bridges within each
target area. The county has six years from the time the fees are
collected to expend the resources for the road improvements.
This week I asked our Engineering Department for the latest Palm Beach
County road program information. I was supplied one dated July 21, 1992
(copy attached). The only road project list~d within the corporate
limits of Boynton Beach is the widening of Congress Avenue from the L-30
to the L-28 Canal at Hunters Run, from four to six lanes. This widening
is not anticipated to occur until the 1996/97 fiscal year.
